The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was: held on January 13, 1975, at 8:00 P.M. at the Town
Hall, Mill Street, Wappingers Falls, New York.

Deputy Supervisor Clausen called the meeting to order at 8:36 P.M
(Supervisor Diehl was absent, due to the severe illness of his
daughter).
The minutes of the Special Meeting of December 23, 1974, and the
Annual Auditing of Accounts Meeting of December 30, 1974, having
been previously sent to the Town Board members, were now placed
before them for their approval.
MR. JENSEN moved the minutes of the December 23, 1974 and December
30, 1974 Special Meetings, as submitted by the Town Clerk be and
they are hereby approved.

Reports for the month of December 1974 were received from the
Supervisor, Building Inspector and Town Justices, and the Annual
Report was also received from the Building Inspector.

A letter was received from Harold L. Mangold, Attorney, regarding
DWS Holdings - Cranberry Hills (Scheme "A"). Mr. Mangold reiterated
briefly the correspondence to the Town in the matter of the use
of Section 281 of the Town Law to develop these properties. It
is his hope the Town Board would consider a resolution authorizing
the Planning Board to review this application of the subdivisions
as set forth in Section 281 of the Town Law.
Mr. Saland voiced a hope that the Board would take action one way
or another soon on this request, as he believes it is generally
looked upon as something that can be implemented with the new
Zoning Ordinance.
Mr. Clausen also generally agreed, and it has been discussed,
although not clear in the Board's mind. They want to make sure,
but there reiinains a few questions. It was suggested and agreed
upon that one more executive meeting be held before the next
regular monthly Board meeting (and include the Chairman of the
Planning Board). The Supervisor's office will so notify Mr.
Mangold of a date.
'Mr. Clausen directed the Town Clerk notify Mr. Marvin Specter
that the Board would like to meet with him on the H.L. Associates
(S. J. Reynolds Property) PUD one more time in executive session
before it is reviewed by the appropriate Boards.

Mr. Clausen noted the reason the Town was in arrears on these
bills was due to a lack of money due to possible low rates as
comparisons as to what it costs the Town tooperate the systems
in relation to what the revenues are. The Town has been contem-
plating to rearrange rates in these districts so that the Town
could meet the bills. Mr. Jensen added that delinquent bills are
continually being a problem, Districts just don't pay for them-
selves. It was agreed that Mr. Conte's letter be answered explain-
ing that the Board is looking over its rate shcedules, and in the
near future possibly some more funds will be available.
MR. SALAND moved to refer Mr. Conte's letter to Allan Rappleyea
to answer.

Mr. Saland suggested that the Board schedule a meeting in the
very near future, as he believes it imperative that the Board
adjust the rate schedule.

In the interest of safety, the Civic Association recommends
attention to the following matters:
1. On Tor Road adjacent to the brook, there are no protective
walls or fences. A child can easily fall from the roadway
into the brook.
2. In the area of the Dennis Truett residence, 23 Alpert Dr.
there is a large drainage pipe with no protective grating.
While the town may for may not choose to cope with the
general drainage problems around the pipe at this time,
we strongly advocate a protective grating immediately.

Mr. Jensen indicated that the grating had been put into place
several weeks ago, as far as the protective fencing, he doesn't
believe that comes under the purview of the Town.
Mr. Clausen directed a letter to Mr. Hall indicating the Board
believes the corrective action has been taken as far as the
drainage pipe is concerned. If he has any other questions on
that, please advise the Town Board, also copy Mr. Horton again
on Mr. Hall's letter and advise him of the foregoing instructions.
A letter was received from Henry Mekaelian, General Manager for
"NUWS-New and Used Water Specialists, Inc." indicating this firms
desire to offer a quotation on providing similar services now being
rendered by another outside firm to operate and maintain the Sewer
and Water systems of the Town.
MR. JENSEN moved to receive and place on file, the letter from
NUWS.
Seconded by Mr. Clausen.

Mr. Clausen directed the Town Clerk write Mr. Mikaelian advising
him that the Town Board had received his letter and would keep
his firm in mind in the future.
A letter was received from Mr. Walter Meier, Assistant Principal
of the Wappinger Central School District requesting the Town to
donate two voting machines, that can no longer be considered
functional for Town Election purposes, to the Wappinger Central
School District for their use by the pupils for such activities
as senior class elections.
MR. SALAND moved that the Town Clerk and the Attorney to the Town
be so directed to make the necessary preparations for the transfer
of the retired voting machines to the Wappinger Central School.

It has failed on several occasions and Town personnel have dug the
line up to fabricate a 'Imake-shift" cleanout.

Re: Blockage of Line from
3 Kent Road (Mr. Precious)
Dear Mr. Cacchio:
We are in receipt of your letter of December 31, 1974 referenc-
ing the blockage of the line from 3 Kent Road, the property of
Mr. Precious.
It has always been the position of this office (most recently
indicated in the case of the dentist on Tor Road) wherein the
Town assumes no responsibility from the house to the 8" sewer
lateral. This position was taken many years ago in Oakwood
Knolls and has remained steadfast throughout the Town.
The only reason the Town ever got involved with Mrs. Precious
was that there was an extraordinary position; the position being
that the two houses to the East and uphill of Mrs. Precious dis-
charges their sewage through her sewer lateral. However, sometime
in 1974 this office inspected the installation and cut off these
two house laterals across Kent Road and tied them into the main
line of the 8" sewer line in that subdivision. At that point,
responsibility was never quite established. It is now established
and, as far as this office is concerned, we now revert to'the posi-
tion that has always been taken with regard to a private house
lateral, that it is the homeowner's responsibility in all subdivi-
sions not inspected by a Town authorized inspector.
The house lateral is the responsibility of the homeowner and, as
such, must be repaired, maintained, and kept open by said home-,
owner at no expense to the residents of the Town of Wappinger.

Mr. Lapar stated that many years ago (maybe 66-67) three model
houses were built on Kent Road and the sewer lines for the two
upper houses ran through the third house then with what was then
a septic tank and which was eventually hooked into the sewer line.
Last year the two upper houses were taken off this line and hooked
up directly to the main line on Kent Road. It was his opinion,
at this point, that that house on 3 Kent Road has to take care
of its own problem to its own house lateral. He feels now it is
the homeowners responsibility, as the Town has taken this position
initially in Oakwood Knolls and all the other subsequent subdivi-
sions, the line between the house and the main line, is completely
the responsibility of the homeowner.
MR. JENSEN moved to acdept the recommendation of the Engineer to
the Town, that according to previous Town policy, it is the
obligation of the resident to correct the lateral line, if in
deed, it needs correction, and not the responsibility of the Town.

Precious be so advised of the policy of the Town Board, along
with a copy of Mr. Lapar's letter.

Gentlemen:
We have taken the liberty of requesting service on the Penn
Flow recorder at the above facility.">Presently, the meter
does not totalize. We had requested that the meter be serviced
previously, but we connot find any indications that an order
has been placed.
The rate of flow in gallons per minute are recorded on the
circular weekly chart, but an average daily flow is not being
recorded. As we had previously recommended the high flows
observed should be thoroughly investigated. In that we
understand some work has been done on the collection lines,
an accurate record of daily flows might give the needed in-
formation as to the origin of these flows.

Dear Mr. Cacchio:
We are in receipt of your letter of December 31, 1974 and
would agree that the meter certainly should be fixed as
soon as possible; of course, with the proper authorization
of the Town Board.
The collection"lines have been TV'd and a serious break has
been corrected. We would certainly hope that a substantial
decrease in the flows would ge recorded during the spring-
time due to the repairs effectuated by the TV survey.

Re: Oakwood Knolls Wastewater Treatment
Plant Corrective Maintenance
Gentlemen:
Recently we have been experiencing difficulties in maintain-
ing adequate return of sludge in the above facility. The
settling tank has been completely dewatered, flushed, cleaned,
and the air lift pump inspected. At that time, it was noted
that without complete removal, it could not be determined
whether our efforts had completely opened the air -•lift. In
that renovation of this air-lift is scheduled, we cut the
system back in service. The air-lift continued to operate
for approximately two (2) weeks.
Now that the return has again failed to operate properly, we
have requested that the contractor install a new air-lift
when we pump the settling tank. He has agreed to do so.

This should enable us to maintain adequate return until the
flow is switched to the other side.
On thursday, December 26, 1974, the existing pump could not
maintain the incoming flow and the wet well overflowed. We
therefore installed a spare portable pump. In that this pump
is not for raw sewage, we would recommend that the proper
portable pump be purchased and installed. You might remember
that authorization was previously gran -ted to purchase this
pump. At that time, Mr. Maiepors purchased a Goulds sewage
pump which is being utilized but does not seem to be able to
handle the flows or solids. In that the new pump station
may be installed soon but no earlier than one (1) month, you
may want to "gamble" on using the existing pumps. Please
advise as to your pleasure in this matter.
We have also experienced problems with the the existing blowers,
and Mr. Lapar has authorized us to make whatever repairs
are necessary to this equipment.

Mr. Jensen explained that it had been suggested several months
ago by Camo to buy a portable pump to relieve problems The then
Superintendent of the Water and Sewer Departments elected to buy
a pump that someone recommended, and it seems this pump doesn't
have the capacity that is required to do the job properly, it's
an underrated pump. What Camo is asking for is to purchase the
proper size pump.
MR. JENSEN moved that the Sewer and Water Committee contact
Camo Pollution gontrol, Inc., and if the price is within $500.00
to purchase the requested pump, the Committee is authorized to
authorize Camo to purchase said pump.

Gentlemen:
We are in receipt of a letter from Mr. Cesare J. Manfredi,
dated October 31, 1974, wherein he orders us to install the
sand filters at the above captioned project. That is, of
course, contrary to the agreements we had with Mr. Jack Hill
and Mr. Ronald Friedman in various letters; one from Mr.
Friedman dated July 30, 1973 and one from our office to Mr.
Hill dated June 20, 1974. Copies of these letters are enclosed.
Since the contractor has been told not to put these sand filters
in, we would appreciate your advice on what to do. As we see
it right now we really have no choice. We would like some
direction and/or help from the Town Board since this is a
$40,000 to $50,000 item which we were told, because of Tri -
Municipal, we would not have to put in, and now it appears
that, according to Mr. Manfredi, we will have to place it on
line.
Your imndiate answer to our request would be appreciated since,
as I said before, the contractor has been told not to place
the filter on line and if we are going to now put them in,
based on Mr. Manfredi's letter, we must inform him in early
January.

A deed for the Recreation Area for the Thorn Acres Develop-
ment was received for acceptance by the Town Board, pursuant
to the conditions of the Planning Board approval.
MR. SALAND moved to refer the Thorn Acres Recreation land deed

Bids had been received by the Recreation Commission for base-
ball equipment.
MR. CLAUSEN moved action on these bids be tabled in order to
give the Board a better chance to look them over, since the
recommendation was received this evening from the Recreation
Commission.

A request was received from William Horton, Highway Superinten-
dent for permission to bid for a 4 •yard dump truck (money for
the purchase has been appropriated in this years budget).
MR. JENSEN moved that William Horton, Highway Superintendent
be granted permission to advertise for bids for a 4 yard dump
truck.

A letter was received from the Planning Board regarding a
letter from Henry Heissenbuttel, Commissioner of Planning,
which concerned a resolution Memoralizing State Legislation to
Authorize Final Action on Site Plan Approval by Local Planning
Boards in Dutchess County. The Planning Board recommended that
the Town Board take action to urge the State Legislature to
pass this enabling action.
MR. CLAUSEN moved that the communication from the Planning
Board regarding acts to improve Local Planning and Zoning
Legislation be received, placed on file, and reviewed further
by the Town Board for future action.

Under Committee Reports the Town Clerk asked the Bca rd for
some direction regarding monthly, weekly, and intermittent
reports received from Camo Pollution Control Inc., since the
abolishment of a Town Sewer and Water Department. In what
office should these reports be filed, and to what extent
should copies be made for the Town Board members?
MR. CLAUSEN moved that any correspondence received by the
Town Clerk be forwarded to the Supervisor's Office, with the
exception of communications calling for Town Board action;
operation and maintenance reports to be copied for the Sewer
and Water Committee before filing with the Supervisor.

Due to the forthcoming Association of Towns meeting February
10 through 12th, which would fall on the normal regular monthly
meeting date, the Board considered a change of date for the
regular monthly meeting for February.

of February be changed from February 10, 1975 to February 18,
1975 at 8:00 P.M. Town Hall, Mill Street, Wappingers Falls, New
York.

The matter of the appointment of a Chairman of the Planning
Board for the year 1975 was placed before the Board for their
consideration.

of the Town of Wappinger Planning Board for the year 1975.

WHEREAS, the Department of Housing and Urban Develop;
ment has, by letter dated November 29, 1974, sent formal
notice of tentative identification of flood prone areas to
the Town of Wappinger,

Re: Various questions by Mr. Rohonczy
Myers Corners Road
Gentlemen:
In response to Mr. Rohonczy's questions, we submit the
following information:
1. The sewer is designed deep enough to drain the present
facilities in his house. This was determined previous
to the original design and checked subsequent to the
installation of the pipe on October 23rd 1974 by three
members of my firm.
2. In answer to his question on the cost of the concrete
that was placed underneath the pipe, we have examined
the costs)of lowering the line from the culvert east
to Kent Road. This cost would be many times greater
than the cost of the concrete.
3. As far as the condition of the highway, the Dutchess
County Department of Public Works has notified the
Contractor by letter of his duties to restore the road
and shoulders to their original condition.
If this information does not fully answer all his questions,
please call the office. Thank you.

Re: Rockingham Farms Recreation Area
Dear Board Members:
On Monday, December 23, 1974 at 8:30 A.M. I met with members of
the Town of Wappinger Recreation Commission and the Town High-
way Department at the Rockingham Farms Recreation Area, between
Regency Drive and Sprout Creek.
After examining the premises the consensus of opinion of everyone
there was that if the developer decided to do nothing, the Town
should accept $5,000. The $5,000 would be needed to bring in
some 1,000 cubic years of fill to shape the fields. There
were many puddles and small ponds in evidence. Also, some top-

soil would be needed (there was none in existence) and we would
like the skating pond increased to at least double its size.
An alternate method proposed was that the Town accept $2,500 and
the developer go in there with his bulldozers, loaders, or what-
ever he has to use, to shape the pond. First of all, we would
like the pond squared with the fence so :that we have no oddball
parking places at some later date, and the size of the pond
expanded to again at least double for skating. The pond would
only -have to be approximately one foot deep -since it is to be
used for skating and any excess fill that is taken out of the
pond by this method would, of course, be used to shape the field.

Mr. Clausen briefly explained the thoughts of the -Board on this
matter to the residents in the audience_
MR. JENSEN moved that a copy of Mr. Lapars report be forwarded to
Mr. Steinberg of Schoonmaker, and at the same time set up a meeting
with him on said subject.

Marvin M. Specter had forwarded a request to the Town Board to
consider a conceptual approval of the H.L. Associates, PUD (H.J.
Reynolds property).
Mr. Clausen recommended that the Town Clerk address a letter to
Mr. Specter requesting he meet with the Board one time in executive
session to finalize the PUD application before the Town Board refers
it to the Planning Board; again, the Town Board will pick a date
that might be agreeable to all.
A letter was received from the Recreation Commission informing the
Town Board of their action on the adoption, by that Commission, of
hours when Town Recreation Parks will be open. The hours will be:
Parks open one hour before sunrise and shall remain open until one
hour after sunset. A copy of the proposed Park Signs was also
forwarded.

Commissions' decision on when Town Parks shall be open.

Under New Business, Mr. Rappleyea informed the Board that Mrs.
Snowden opened some informal bids today for BANotes necessary to
purchase the Wildwood Sewer Plant and the L&A Filtration System.
The rate (from the Dutchess Bank & Trust) was 6.09% for one year,
with the anticipation of refinancing at the end of one year -
(three bids were received, 6.09%, 64/ and 6.30%). The matter
will be referred to the Town's financial consultant. It is hoped
that the closing will be at the end of this month on this system.
He further noted that the Town had received approval from P.S.C.
for Tall Trees Water System purchase. Hopefully the Town will
proceed to take title within the next 30 to 60 days.
Mr. Mills asked if Wildwood was going to be billed on a quarterly'
basis, and asked if the residents could be notified when the Town
takes over and when the billings would begin. Mr. Jensen commented
that that should go out of the Supervisor's Office. Mr. Clausen
added that he believed that this should be the policy and procedure
followed by the Supervisor's office, that of notifying all of the
residents in a district when the Town purchases the system and
when they can expect to receive the first and subsequent billings.
Mr. Mills, as a member of the Centennial Committee, commented
on the lack of meetings for the Centennial. He feels the Board
should discuss with John Bunting the apparent problems, and
ascertain if he, in fact, is still interested in chairing the
Committee. Mr. Clausen asked the press present, especially the
Southern Dutchess News, if they, through the news media would make
it known that the Town is seeking people who would be interested
in taking an active part on the Centennial Committee. Mr. Saland
suggested that the Supervisor's Office contact Mr. Bunitng, and
ascertain if he is or is not actively interested in continuing
to chair the Committee, and so notify the Town of his intentions.
Mary Schmolz offered some comments regarding the Centennial, and
looking into matching grants that are available - from the Asso-
ciate Council for the Arts. Mr. Clausen asked if she was a member
of the Centennial Committee, and the response was this something
that comes under the Recreation Commission, history and the arts.
Mr. Clausen then said if she was interested in becoming a member
of the Centennial Committeem make it known to the Town Board.
MR. SALAND moved the meeting be adjourned, seconded by Mr. Jensen
and unanimously carried.
