The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on July 8, 1974, at 8:00 P.M. at the Town Hall,
Mill Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:08 P.M.

The Minutes of the June 10, 1974 Regular Monthly Meeting and the
June 19, 1974 Special Meeting, having been previously sent to the
Town Board members, were now placed before them for their approval.
MR. SALAND moved the minutes of the June 10, 1974 Regular Monthly
Meeting and the June 19, 1974 Special Meeting, as submitted by
the Town Clerk be and they are hereby approved.
Seconded by Mr. Clausen.

Mr. Clausen commented that, with reference to the discussion on
the Wappinger Park Homes issue, it should be clarified that Mr.
Rappleyea was to write up a Bonding Resolution and if it did call
for a referendum, the Board would go by whatever the Bonding Resolu-
tion stated.
The reports for the month of June were received from the Supervisor,
Town Justices and Building Inspector and also the semi-annual report
from Virginia Ferris, Town Historian.
MR. CLAUSEN moved that the monthly reports from the Super4isor,
Town Justices, Building Inspector, and semi-annual Report of the Town
Historian be accepted and placed on file.

The Town Clerk informed the Board that she had been served, on
June 27, 1974, with a Summons and Complaint by Serenity Homes Inc.,
VS the Town Board of the Town of Wappinger, Planning Board of the
Town of Wappinger, Town Clerk of the Town of Wappinger and Highway
Superintendent of the Town of Wappinger, the subject of the action
being the constitutionality of the Town Highway Law. The relief
sought to compel the Town to accept a Bond in lieu of cash.
MR. SALAND moved to refer this matter of summons with complaint
from Serenity Homes Inc. to Allan Rappleyea, Attorney, to answer
and defend on behalf of—the Town of Wappinger.
Seconded by Mr. Clausen.

Notice of a Public Hearing from the Town of LaGrange regarding an
amdndment to their Zoning Ordinance was received.
Mr. Diehl directed the Notice of Public Hearing be received and
placed on file.

MR. CLAUSEN moved to refer this matter to Mr. William Horton,
Highway Superintendent and the Attorney to the Town, Mr. Rappleyea.

A Petition was received from W.C. Dean, Sr. Trucking Inc. request-
ing the rezoning of their present parcel on.Old Route 9 (169 East
Main Street) and a parcel adjacentto their property, which they
are presently purchasing, both parcels presently are zoned HB1
and the request is for a rezoning of both parcels to GB so that
their present property and that which is being purchased will have
the same classification.
Mr. William Dean Jr. was present, and spoke before the Board en-
larging on the petition and the reasons for the requested rezoning.
MR. JENSEN moved that the rezoning request of W.C. Dean Sr.,
Trucking Inc. be referred to the Dutchess County Department of
Planning and the Town of Wappinger Planning Board for their review
and recommendation, subject to the receipt of a surveyors plot plan
of both properties referred to in the petition.

A letter was received from (Mrs.) Barbara Briggs, Cyclethon
Chairman, 1975 Heart Fund Campaign, indicating there would be
a Cyclethon for the benefit of the 1975 Dutchess County Heart Fund
Drive conducted through the Town of Wappinger on October 13, 1974,
and permission is requested to use the Town of Wappinger streets.
MR. CLAUSEN moved that permission be granted for the use of the
Town roads for the Cyclethon for the benefit of the Heart Fund, and
that Mrs. Briggs be informed that the Dutchess County Sheriff's
Office be so notified and made aware of the date of this event.

The resignation of W. Thomas Rogers, Jr., as Director of Recreation
for the Town of Wappinger was received, effective August 26, 1974.
(Mr. Rogers has accepted a position in the State of Massachusetts
as of September 1, 1974).
MR. CLAUSEN moved that Mr. Rogers' resignation be accepted with
thanks. He believes Mr. Rogers has done an outstanding job for
the community, he will be missed. The Town will now have to
proceed to find another Director of Recreation as adequate as he
was.

A letter was received from Warren Strohm, Chairman of the Zoning
Regulations Advisory Committee requesting an executive meeting
at the Board's earliest convenience, preferably during the week
of July 15 to 19th, to discuss the zoning map changes which ZRAC
had submitted for the Board's cOnsideration. Mr. Zak added that
he felt the Planning Board should also be invited to sit in on
this executive session, and it was finally recommended that Dave
Portman (from Frederick Clark Associates) be included in the dis-
cussion, also. There was some discussion in relation to the more
recently submitted recommendations of amendments to the Town of'
Wappinger Zoning Ordinance in support of the new Master Plan.
MR. CLAUSEN moved that July 25, 1974, 8:00 P.M. be set for an -ex-
ecutive meeting with the Town Planning Board, ZRAC and Dave Portman
from Frederick Clark Associates to discuss the ZRAC recommendations
regarding zoning,map changes and cursory discussion of the rec-
ommended amendments. It was further recommended that the ZRAC
recommended amendments to the Zoning Ordinance in support of the
new Master Plan be forwarded to Mr. Portman.

Re: Improvements to the Fleetwood
Manor Wastewater Treatment System
Gentlemen:
On December 3, 1973 a letter was sent from this office to the
Town Board indicating to them that the modifications and im-
provements to the Fleetwood Sewage Treatment Plant could be
undertaken if necessary. There is on file in the office of
the Town Clerk a report written by my office in or around the
month of July, 1973, indicating the costs for said improve-
ments.
On Friday June 21, 1974 Mr. Richard H. Struble, P.E. of the
Dept. of Environmental Conservation called me and informed me
that if this work is not done in the Fleetwood Manor Sewer
District the Town would no longer be eligible for State Aid
for operation and maintenance, which as far as I know they
have been receiving or will be receiving for the fiscal years
1971, 1972 and 1973.
Please inform us of your decision on this matter so that we
can inform the N.Y.S. Dept. of Environmental Conservation.

MR. DIEHL moved to defer any action on Mr. Lapar's recommendation
for six months, and wait for the Tri -Municipal. If Tri -Municipal
should fail then the Town should move forward and make the recom-
mended corrections to Fleetwood Wastewater Treatment Plant.
Seconded by Mr. Clausen.

Mr. Jensen commented that the Board should move forward on the
rates - it's obvious some of the rates are going to have to go up ---
what the Board should do is set up a new rate schedule. He also
commented on the vandalism in the Fleetwood Sewer Plant area.
Reports from Central Hudson, Camo Pollution and John Mailepors
have indicated serious vandalism, and it's getting to the point
where it's going to cost the people in the area for the repairs.

He also recommended to the Supervisor that a letter be sent out
with the next billing to Fleetwood that there be better surveillance
on their part regarding the vandalism.
MR. JENSEN moved that, since the informal bids received seemed
to be quite low, the fencing, as recommended by the Superintendent
of the Water and Sewer Plants, be installed (in the immediate area
of the Fleetwood Sewer and Water Plants).

Area Meters
Gentlemen:
We are presently installing electronic water meters for
use within the Central Wappinger Water Improvement Area and
would like the Town Board to negotiate the possible use of the
Town of Poughkeepsie's Computer Center wherein the meters can be
readily read.
If this can be accomplished either by a Town Board member or
the Supervisor, or Attorney to the Town, or myself as the Engineer
to the District, I think it should be done in the very near future.
We also will require the services of a meter reader. On June
12, 1974 Mr. Bruno Hermans asked me to approach the Board on this
matter and I am now doing same and hope that you will provide such
a person to the Town force as soon as possible.

A copy of Sykes, Galloway & D*keman's answer to Mr. Rappleyea's
inquiry regarding a proposed storm drainage project for Wappinger
Park Homes was received by the Board, and Mr. Rappleyea briefly
summarized the content, that if this was subject to a permissive
referendum, the Bonding resolution would have to be approved by
a 4 to 1 affirmative vote, if it were subject to a mandatory

referendum, a 3 to 2 affirmative vote would carry the resolution.
The third alternative would be to form a district.
Mr. Diehl reviewed the developments of the Wappinger Park problems.
He mentioned that he had contacted the Dutchess County Department
of Health, and been informed that they have made 8 or 9 tests so far
of homes in the development to establish if there is any violations
or problems of individual homes. They have found one home that
has a violation, and a citation is to be made. Tests will continue
to establish just how many homes have a problem of leaking -septics
or fields in a bad way. The Board has decided to await the results
and decision of the Health Department and will consider the alterna-
tive of moving to a system of a master sewer area where the homes
that are presently having problems can hook into this sewer system
until Tri -Municipal comes in. If this is found to be the way to go,
the Town would immediately set up a special district for putting
in the laterals and completing the job - waiting for Tri -Municipal,
with the expense to be borne by the residents in the district.
These lines would have to be put in sooner or ]a ter anyway, and
would solve the immediate problems of those homes that are having
problems right now. Mr. Clausen commented that, although there is
a resolution to come before the Board to consider, the feeling has
been that this storm drainage problem might alleviate the sewer
problem in that the storm drainage problem might bring the water
table down so that the residents having septic problems would
possibly get some relief. However, it is the concensus of the
Board that the primary problem is sewer. Since this discussion
of the drainage program, tests are being conducted on septic tank
infiltration around the site of the well and drainage pipes that
exist there now. There is some feeling that there is:sae septic
from individual properties going in to the existing drainage system.
If more drainage pipes were put in, again it could be picking up
some septic, and emptied, untreated, on someone's property. Through

these discussions with the Board of Health it does seem there is
a possibility of putting in sewer pipes at this stage of the game,
and the violators might be allowed to hook into these dry sewer
lines and treated on a temporary basis sufficiently so as to
reduce the pollution problem, and when Tri -Municipal becomes a
I
reality, all of Wappinger Park will hook into it. This might be
a better way to go, and to hold off for a few weeks, the Board
tire will possibly see a formal report from the Health Department.
A resolution from the Dutchess County Board of Representatives
was received regarding the implementation of a County Solid Waste
Program which, in essence, asked that the municipalities desiring
to participate in this program submit a resolution stating their
intent to participate and support the short-term and long range
solid waste program developed by Dutchess County.
The following resolution was offered by SUPERVISOR DIEHL who
moved its adoption:
WHEREAS, resolution number 265 of 1974 of the County of
Dutchess, Board of Representatives, requested each of the towns
of Dutchess County to submit to the County of Dutchess a resolu-
tion concerning the town's attitude toward a County solid waste
program.
WHEREAS, the Town Board of the Town of Wappinger has considered
the various alternatives with regard to the treatment and handling
of solid waste, now therefore, be it
RESOLVED that the Town Board of the Town of Wappinger hereby
requests =the County of Dutchess to continue its efforts toward a
long-range solution to handling solid waste on a full or part
County program, and the Town Board of the Town of Wappinger here-
with and hereby indicates its intention to participate in and
support the long-range solid waste program, and be it further
RESOLVED that while the Town of Wappinger supports a long-
range solution to the solid waste problems of the county, it
opposes the location of any full or part county land fill opera-
tions within the Town of Wappinger, and urges the County Board of
Representatives to look for sites other than in the Town of Wappinger
for the solution to the land fill disposal problems.

Mr. Jensen commented that he had read, with distress that the
Board of Governors of the Landfill had voted to expand the exist-
ing landfill, with Mr. Diehl being the only dissenting vote. He
doesn't believe that Mr. Laird has done a thorough job, they are
again proposing a site near a known tributary - with a potential
problem of leachate arriving again, and if not, the possibility
of expending unknown thousands of dollars, to put in pipes to pre-
vent leachate. It would seem more logical for the County Board
to go out to east Dutchess or some other location. He hoped that
some novel approach could be taken, such as way stations along
railroad sidings where garbage could be collected and possibly
once a week pick up all the loaded cars and take it out to the
center of Dutchess some place where there is plenty of land avail-
able - good land for landfill sites - Mr. Clausen concurred with
Mr. Jensen, and added he felt Mr. Laird was buying time for his
pyrolysis plant, and having spoken personally to him, he felt Mr.
Laird would recommend privately, and in some quarters publicly,
that he would recommend a site other than the Dutchess County Air-
port site for expansion, would favor the Trap Rock site. If more
pressure were put on by the County Representatives or nothing is
going to be done.
Mr. Diehl recognized County Representative John Armstrong, and at
the same time asked him for confirmation of the information that
the Trap Rock site had been ruled out as a landfill site. Mr.
Armstrong indicated this was correct, due to the water table and
the type of ground. He further stated that by no means would he
agree to expand the existing site. He would only condone the
Board of Governors using the present site to its present limita-
tion, cover it and fulfill their contract. He commented that there
weren't too many sites that had the right soil that didn't have a
problem with the water table. The situation is becoming more and
more an emergency, and the County is looking at the problem as
just that. There doesn't seem to be too many areas that are being

received very favorably. He mentioned that Airport Park will be
opened up again for the remainder of the summer, since tests have
indicated the water is usable, and testing will continue to be
taken to assure safety. Mr. Saland asked about action taken on
the expansion of their facilities by Banner at the Airport. Mr.
Armstrong indicated the County Board had approved the expansion
of Banner today, they were given permission to put up two smaller
buildings on six more acres, prior to putting up the hangar, that
they need for the school they have over there. Mr. Saland asked
if this wasn't encouraging the expansion of the facility and more
traffic. Mr. Armstrong didn't feel this was the case, he believed
the airport was an asset to a point. He and Mr. Saland differed
in_their opinions on this. Mr. Incoronato had a few questions
regarding.the financial situation of the airport.

Re: Oakwood Knolls
Wastewater Treatment Plant
Gentlemen:
Recently we experienced an outage of the sewage pump at
the above facility. There exists another pump which was in need
of repair, but not repaired because of the planned renovations.
We were able to get this pump to operate but do not feel it is
reliable. One of our small -submersible pumps is -being utilized
as a back up.
In that these pumps will be "scraped" with the planned
renovation, it is our :recommendation that the Town' s engineer
look into the feasibility of purchasing a submersible pump which
could later be usedas a_standby_in-.other plants.- Whgn this was
installed we could pull the existing pump and ho efullr from the
two (2) pumps make -a -standby._ There is at-prese ,t a submersible
pump at the plant but that too is in need of repairs. The existing
pumps are capable of delivering_125 gpm at 28 feet head.
We feel that this is an urgent situation and would appre-
ciate your prompt attention and cooperation in this matter.

MR. DIEHL moved that serious consideration be given to Mr. Cacchio's
recommendation, and instruct the Engineer to check into a submer-
sible pump of such specifications as recommended by Camo, which
could be used throughout the district, and further direct the
Engineer to go forward and place an order for the purchase of
such a pump as recommended.
Seconded by Mr. Jensen.

Under Committee reports, Mr. Jensen related that about a week ago
he met with Mr. Egan, the Superivsor's Confidential Secretary,
regarding the sewer and water rates at Oakwood. Mr. Egan is recom-
mending an increase in the rates for water. With the high cost of
maintenance, income is not covering the cost of operation. Mr.
Jensen felt a public hearing should be set for the Oakwood residents
for an increase in rates. A rate of $98.00 a year would be needed
to operate this plant.
MR. JENSEN moved that the Town Clerk send a letter to Camo Pollu-
tion Control asking for a fixed price contract for the operation
and maintenance of the Mid -Point Park Sewer System.
Seconded by Mr. Saland.

Mr. Diehl brought up a letter received from the Planning Board
which referred to the Kent -Sussex Company application for final
site plan approval. The Planning Board, in one paragraph, suggested
the Town Board contact the Village Board to formulate a commitment
on police protection for this shopping center, which includes a
portion of property lying in the Town. Mr. Diehl questioned whether
this would be within our jurisdiction or authority to set up any
police work there, being that the Town falls under the protection
services of the Dutchess County Sheriff and State Police. He be-
lieved it would be too complicated to try to coordinate any such
plan, and all the different agencies work together regardless.

The other area of the Planning Board's letter dealt with water
supply for this slhopping center, and Mr. Diehl informed Mr.
Steinhaus the Town Board has already given direction to the
Engineer on this matter and Mr. Lapar has been in contact with
the principals regarding it.
The matter of an ordinance amending the Town of Wappinger Ordinance
for Administering and Enforcing the State Building Construction
Code, having been tabled at the last regular meeting, was placed
again before the Board for their consideration.
Mr. Jensen indicated that he had several questions that have not
as yet been resolved. Mr. Diehl directed the matter of the amend-
ment to the Building Code be tabled until the next regular meeting.
Mr. Rappleyea reported on the status of the purchase of Hill Top
Water Works and after discussions with Public Service Commission,
it is hopeful the approval will be presented to the Commission
the middle of this month. Application has been filed for purchase
of the Mayim Water system, and he is approaching the time for the
closing on Tall Trees Water System hopefully in the next two or
three weeks.
Mr. Clausen commented on discussions held with Mr. Alexander
regarding the purchase of the L&A Sewer Plant for the Wildwood
Sewer District, it is apparent they are ready to negotiate, and
would like to meet with the Town on the matter. Mr. Rappleyea
indicated he and Mr. Lapar were working on this.
Mrs. Riveria asked where the no dumping signs were that the Board
had indicated would be erected in the area of the Wappinger Park
Water Plant. Mr. Horton responded they were on order.
As there was no other business to come before the Board, Supervisor
Diehl called for a motion to adjourn.
MR. CALUSEN moved the meeting be adjourned, seconded by Mr.
Jensen and unanimously carried.
