1974-05-30 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on May 30, 1974 at the Town Hall, Mill Street, Wappingers Falls, New York. Notice of said meeting was mailed to each Board member on May 24, 1974, calling this meeting for 8:30 P.M. May 30, 1974, for the purpose of considering bids for the Central Wappinger Water Improv-- ment, Wappinger Sewer Improvement, and Oakwood Sewage Treatment Plant, and any other business that might properly come before the Board. Supervisor Diehl called the meeting to order at 10:42 P.M. Present: Louis Diehl, Supervisor Louis Clausen, :;Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Rudolph E. Lapar., Engineer to the Town Allan E. Rappleyea, Attorney to the Town The following resolution was offered by COUNCILMAN JENSEN who moved its adoption: The bids for construction within the Wappinger Sewer Improve- ment #1 and Central Wappinger Water Improvement #1 are hereby awarded to the low bidders for the following: 1. Hall & Co. Inc. for Wappinger Sewer Improvement #1 - Contract lA - Expansion to the Oakwood Knolls Sewage 'irreatment Plant @ $623,175.00. .2., Rebena Construction Co. Inc. for Central Wappinger Water Improvement - Contract #3 @ $255,168.00. 3. Rebena Construction Co., Inc. for Wappinger Sewer Improvement #1 - Contract #2 @ $404,466.55. 4. K&A Excavating Contractors, Inc. for Wappinger Sewer Improvement #1 -.Contract #3 @ $392,548.36. 5. K&A Excavating Contractors, Inc. for Central Wappinger Water Improvement #1 - Contract #4 @ $379,414.45 The Supervisor is hereby authorized and directed to execute the contracts for the aforementioned work. Ave Resolution Duly Adopted The following Local Law was introduced by COUNCILMAN JENSEN who moved its adoption: A LOCAL LAW RELATING TO THE IMPOSITION, CHARGE AND COLLECTION OF WATER RATES FOR THE CONSUMPTION AND USE OF WATER FOR THE CENTRAL WAPPINGER WATER , IMPROVEMENT AREA AS WELL AS THE PENALTIES AND ENFORCEMENT THEREOF. Be it enacted by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: SECTION 1 IMPOSITION AND COMPUTATION OF WATER RATES A. All water rates are payable quarterly and the minimum rate shall be payable even though no water is consumed, so long as the service shall be considered as connected with the district main unless shut off by authority of the district at the curb box or otherwise at the request of the owner. The minimum rate shall be payable even though the water has been shut off when such discontinuance has been Made,by.someone not authorized by the district. B. Each owner or tenant of real property using or connected to the said water system shall pay a water charge at the said rates as set forth below: WATER RATE SCHEDULE RATE QUANTITY .70c Each 100 cubic feet or part thereof. The owner or tenant shall be obligated to pay a minimum charge of $23.00 per quarter regardless of the consumption or use of water for said quarter provided only that said owner is connected to the system for more than thirty (30) days during said quarter. No minimum charge shall be fixed for connection to the system for less than thirty (30) days during any one quarter. The quarter shall be deemed to be each three month period commencing January lst, April 1st, July lst and October lst of each year. Such water rates shall be payable within fifteen (15) days after receipt and for non-payment shall be subject to the penalties hereinafter provided. L� SECTION 2 PAYMENT AND ENFORCEMENT OF WATER RATES A. All water bills shall be due and payable within fifteen (15) days of the billing date. After fifteen (15) days and prior to the expiration of thirty (30) days from the billing date, a penalty equal to five (5) percent of the amount remaining due shall be added to said bill. After the expiration of thirty (30) days, a penalty equal to ten (10) percent of the amount unpaid shall be added to that bill. B. Said water charges shall constitute a lien upon the real properties served by the water system of the district and such lien shall be prior and superior to every other lien or claim except the lien of an existing tax, assessment, water rate sewer rent or other lawful charge imposed by the town. SECTION 3 This Local Law shall take effect immediately upon adoption as provided by the Municipal Home Rule Law. The following resolution was proposed by COUNCILMAN JENSEN; WHEREAS, there has been duly presented and introduced at a Special Meeting of this Town Board held on May 30, 1974, a proposed Local Law entitled, "A Local Law Relating to the Imposition, Charge and Collection of Water Rates for the Consumption and use of Water for the Central Wappinger Water Improvment Area as well as the Penalties and Enforcement Thereof", and WHEREAS, the provisions of the Municipal Home Rule Law require that no local law shall be passed by the legislative body of the town until a public hearing thereon has been held before such body, NOW, THEREFORE, be it resolved as follows: 1. That a public hearing shall be held on the said proposed local law by the Town Board of the Town of Wappinger on the 19th day of June, 1974, at 7:30, o'clock P.M. EDST on such day, at the Town Hall, Mill Street in the Village of Wappingers Falls, Town of Wappinger Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman Versace Roll Call Vote: 5 Ayes Mr. Jensen commented on the probable vacancy on the Board of Assessment Review due to Mr. Eck's moving to Georgia. He Suggested that some thought be given to forwarding names of persons to be considered for the vacancy at the next Regular Town Board meeting. j82•. MR.
