ADJOURNMENT iF The Regular Monthly Meeting of the Town Board of the Town'of WaggAnger was held on April 8, 1974, at - 8:00 P.M. at the Town Hall; Mill Street, Wappingers Falls, New York. MR: SALAND moved the minutes of the March ' 11, 1974 regular monthly meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Jensen. - Motion Unanimously Carried Reports for the month of February were received from the Supervisor, Building Inspector and Town Justices; also, the Annual Report for the year 1973, was received from Town Justice Vincent S. Francese. MR. CLAUSEN moved the monthly reports for February from the Supervi- sor, Town Justices and Building Inspector, and the Annual Report for e year 1973 from Town Justice Francese, be accepted and placed on file. MR. JENSEN moved the bills be paid, subject to audit. Seconded by Mr. Clausen. Motion Unanimously, Carried Supervisor Diehl recognized John Armstro,,Wappinger County Representative indicating Mr. Armstrong had another meeting to attend, but wished to answer some of the questions the Board had asked him last month, so, the agenda would be temporarily sus- pended to acco muo to Mr. Armstrong . On the first question, on what the County,was,doing on the landfill, and what actions were• being„taken, he stated that, the matter was -in the County 'Attorney's hands to look over the overalls estimated costs - to operate and to close it when that brae comes - so, no action 'has been taken up to this point. On construction of Route 376 - thestraighten it;out -- on checking..with the ..New York •Sta;te ,Department of Transportation,. the only bid out was for straightening a portion of Route 376 ,from Hillside Lake Road out to Route 52. On Mr., !orton',s question of a larggr, culvert yonder/,New,pHackeftl&dk Road (between Wildwood Drive and :rWappinger :a 'Trailer Park) , it's on the schedule to be done. In the last month Mr. Armstrong said he had sent a letter to the New York State Department of Transportation about Route 9D, asking them to consider one, or all three of the following things, consider reducing the speed for thhwhole road from the Fishkill Town line, post recommended speeds on the curves, or straighten the whole road out. A study is supposed to have been completed in the area of the Montclair Apartments, and that area is supposed to be posted with reduced speed signs. He also mentioned attending a meeting in the Village of Wappingers Falls on recreation at which Mr. Diehl was also present and had sent a letter to the County Executive recommending that he take a look at purchasing Hillside Lake as a recreation area for the County. Sylvan Lake has also come up again, and there are a few other sites being looked at for County recreation. Mr. Saland had asked and reiterated, if Mr. Armstrong might get back to the Board any information on the proposed expansion or renovation of the airport. Mr. Armstrong said he would check and get back to the Board. Mr. Diehl, observing residents from the Wappinger Park Homes present, and noting there had been an informational meeting with them last week, placed the matter before the Board for a possible resolution of their problems. MR. JENSEN moved that Rudolph E. Lapar, P.E. be directed to make a complete storm drainage study of all of the drainage problems in Wappinger Park, and have it presented to the Board by their next regular meeting. Seconded by Mr. Clausen. Motion Unanimously Carried MR. CLAUSEN moved that the Attorney to the Town and Hugh J. Maurer, Chairman of the Recreation Commision, contact the Hankins, owners and operators of the water plant in Wappingers Park Homes to see if the Town can obtain a lease for a period of ten years, or better, on their land adjacent to the water plant for recreational purposes, and further, that the Attorney advise the legality, and the pro- cesses that are required when and if the Town were to acquire those lands. Seconded by Mr. Versace. Motion Unanimously Carried Supervisor Diehl recognized Keith Christoffersen, President of the Royal Ridge Civic Association, who, in turn, presented the Board with a petition signed by 185 residents of the Royal Ridge Development protesting any rate increase proposed by the Mayim Water Company. Their reasons for protesting were that, the system is not and never has been adequate to provide sufficient water pressure to those residents on Top O'H{11 Road; the -water system has been shut down at least 4 or 5 times a year on an average of a day and after service has been restored the residents experience air and dirt in the lines, severe enough to require plumbing services; and, the company's water system has not been adequate to provide domestic water for specific peak periods. In view of this, the residents feel any rate increase should be denied. It was requested that the Town Board forward these peti- tions to Public Service Commission. Mr. Christoffersen indicated the proposed increase was from $72.00 to $125.00 per year. Mr. Saland, noting that item 5g on the agenda also related to the Royal Ridge Development, that of the sewer, indicated that the Board, having met with Mr. Christoffersen in their last workshop session, was aware that the Mid -Point Park people are putting a tremendous amount of pressure on the residents. On the one hand, they are asking -for a 75% increase in their water rate, and on the other hand, they say they are going to abandon the sewer plant becuase they're not making enough money. With regard to the sewer plant, the Attorney to the Town has contacted the Dutchess County Depart- ment of Health, and raised the question as to whether or not there may be any possible criminal sanctions with regard to this aban- donment. Insofar as the water system is concerned, Mr. Saland has been advised by Supervisor Diehl that he has sent a letter immediate- ly upon receipt of the request to the Public Service Commission for a hearing on an increase of water rates, informing them that the Town Board is opposed to such an increase. Mr. Saland also noted , being a resident of this development, that at the time he was informed of the requested rate increase, he, in fact, had no water at all. Mr. Johnson, also a resident, remarked that the residents in this development pay their bills quarterly and most of the residents have paid their bill for the second quarter of the year. •,a This would indicate that services were paid through June, and now it's indicated they intend to abandon the plant (in April). It seems there would be some problems as relating to asking for prepayment then abandoning the plant. Mr. Clausen asked that the Attorney to the Town look into the possibility of prepayment due to a specific service, and having the operators abandon the plant, and if Mr. Johnson can supply the Town Clerk with additional information on this, that a letter be sent to Jack Hill with this information. Mr. Diehl noted that he had had a call from Jack Hill's office informing him that a meeting would be set up with all Board members, the Attorney to the Town, the Engineer to the Town, and representatives for Mid -Point, but no firm date was established. Mr. Johnson indicated that if the necessity arose, the residents of Royal Ridge would ask the Town Board to take over the sewer plant. This concluded the discussion on Royal Ridge problems. Returning to the order of business, Supervisor Diehl declared the following Proclamation: PROCLAMATION The world of tomorrow will be governed by the youth of today. In• recognitionof this, the_17th_annuai nationwide -obser- vance of LAW DAY USA on Wednesday, May 1, will be centered on youth and the law. The slogan for Law Day '74 will be: YOUNG AMERICA! Lead the Way. Help Preserve good laws, Change bad laws, Make better laws. It is especially fitting that Law Day '74 be devoted to this worthy purpose, for without laws and independent courts, the freedoms we enjoy would be meaningless. We can be justly proud of America's youth for they are playing an ever active role in the continuing growth of our: Nation. These young citizens are learning the ideals of America by takinga:.concerned-interest in community action programs embracing student government, civic, social, business, religious and educational. activities. I am confident that our youth will carry out the responsi- bilities that will soon be thrust upon them with great credit to our country. THEREFORE, I, Louis D. County of Dutchess Dear Sir: This Office has received numerous complaints in regard to the sanitary fill area adjacent to the Dutchess County Airport concerning the condition of Route NY 376. We have found that the area has improved considerably during the last year and even under trying conditions - (heavy winds, etc.), that shortly thereafter the area is properly policed and made presentable. I would attribute this welcome change primarily, to the splendid work Mr. Heiser has done since he has been in charge of the sanitary fill operation. Very truly yours, s/ C. J. Motion Unanimously Carried Notices of Public Hearings had been received from the Towns of LaGrange (March 21, 1974) and East Fishkill (March 25, 1974); LaGrange Public Hearing, on amendments to the Zoning Map and Ordinance, held April 2, 1974; and, East Fishkill Public Hearings, on a proposed Local Law #2, 1974, and proposed amendment to the 4:45 Zoning Ordinance, held April 4, 1974). MR.-CLAUSEN moved the notices of Public Hearings from the -Towns of East Fishkill and LaGrange be received and placed on file. Seconded by Mr. Jensen. r. Vrooman regarding storm drainage on Norman Scofield, Section 2 subdivision - All Angels Hill Road. (Copies of said letter attached.) Gentlemen: The Planning Board of the Town of Wappinger is herewith referring this letter to your Board for a reply. The Planning Board feels that they can take no action with regard to this_letter_as this subdivision was granted final approval on February 28, 1972 on the basis of reports received. and said: subdivision map. was fiied:-in. thec County: Clerk's office on April 13, 1972. Dear Sir: On January 20, 1972 I wrote a letter to the Town of Wappinger Planning Board stating my concern over the subdivision of the property of Mr. Scofield on All Angels Hill Rd., town of Wappinger. In that letter I noted that the abutting properties of Mr. T.W. Merrill (date of this letter this property has new owner) and Mr. R.W. Vrooman were experiencing water problems and that the: --removal o.f -;the -trees 'and: -.the addition ! of Ja -road =with a drain system directing the water collected to a point it had to pass .aoross-our.:properties :.would -compond .the:_probiem.w I-&sked this problem be coAeidered and had hoped I would be called on before the subdivision was voted on. This was not the case. Mr. Rudolph E. Lapar called my wife and told her that Mr., Scofield's plan had a 20' right-of-way across the back of the properties between our property and the subdivision for a drain system, and that the water would not pass across my property. This letter is to inform you that the storm drain was started last fall and it terminates at a point that will collect and deposit the water as to run across our properties. Mr. Louis D. Diehl stated as a candidate for a fourth term as supervisor that water, sewerage and surface water drain- age as priority issues, this is one of those priority issues. Please contact me so that we can resolve this problem. Yours truly s/ R.W . Vrooman It was Mr. Lapar's and Mr. Horton's understanding that Mr. Scofield was to pipe the entire easement from the lots above Vrooman, down to the pond (on Perkins Property). Mr. Lapar believed the only control the Town really has is that if Mr. Scofield doesn't he doesn't get any building permits. It was discussed that the problem was more properly the flooding of the pond back on to the Vrooman property rather than the fact of piping, which the developer was aware of but did not consider his problem. Mr. Clausen's conjecture was that Perkins dam would either have to be lowered or removed, it was Perkins dam that was basicallycausing the problem. Mr. Lapar indicated that Scofield was obliged to pipe to the pond, the only other alternative is to look up Highway Law to see if the Highway Superintendent has any control over the situation and/or could clean out to the stream. Mr. Diehl directed Mr. Horton and Mr. Lapar to look into the flooding problem and report back to the Board at the next -regular meeting. A letter was received from the Planning Board regarding communi- cations they had had with the New York State Department of Trans- portation involving traffic flow on Route 9 between Myers Corners Road and New,Hackensack Road. It was the Planning Boards conten- tion, considering the type of problems addressed in D.O.T's letter 147 of Feb. 5, 1974, that it would be more practical for the Town Board to follow_it up. Mr. Diehl stated he had spoken with Mr. Steinhaus about the prob- lem, and it was Mr. Steinhaus' desire to have the Town Boards' Highway Committee meet with him (Clausen & Jensen) to give him and the Planning Board some direction in this avenue. It was agreed that the Highway Committee would get together with Mr. Steinhaus. A letter was received from N.T. Slocum, President of the Rocking- ham Farms Homeowners Association, dealing with some areas of low water pressure, and continual overflow from the water tower in the Rockingham development. Mr. Diehl commented there was an executive meeting scheduled for April 19, 1974 with Schoon- maker, Mr. Rappleyea, Mr. Lapar and the Town Board and this problem would be brought up at this meeting. With regard to a letter received from John M. Reed, Attorney for Mid -Point Park, referring to the Mid -Point sewage disposal system and the possibility of abandonment by the principals, Mr. Rappleyea was asked if there was need of any enabling legisla- tion to have the Town or anyone step in and take it over, and he replied= that that would be the function of the -'County Board of Health. : MR. SALAND moved that the Town Clerk notify Mr. John M. Reed, as Attorney 'for Mid -Point Park Filtration -Corp. and the Dutchess County Department of Health that the Town Board of the Town of Wappinger objects to the abandonment of the Mid -Point Sewage Disposal Plant, and urges the County of Dutchess to do everything in its power to see that the plant is not abandoned. Seconded by Mr. Clausen. • Motion Unanimously Carried The Board was informed that the term of office of Richard Garren as a member of the Recreation Commission, expires May 1, 1974. MR. JENSEN moved action be tabled on the appointment to the Recreation Commission to the May meeting. Seconded by Mr. Saland. Motion Unanimously Carried The Town Clerk informed the Board that she had received the resignation of Ruth Sutton as an Election Inspector (R -Dist 13). MR. SALAND moved that Mrs. Sutton's resignation be received and placed on file. Seconded by Mr. Jensen. _ r. Motion Unanimously Carried A letter was received from Mrs. William Brickner concerning the dog situation in Chelsea. - Mr. Diehl stated that he had checked with Mr. Wells, Dog Warden, who checked his records for the past six months and did not have any record of having received a call regarding dog problems from her. Judge Francese had also asked him to check the =C :?.:1 area every two or three days for dogs running loose, Chelsea c7. which he has been doing and will continue to do so. The Town Clerk was asked to contact Mrs. Brickner and relay this information. A request. -was received from Virginia, Ferris, .Town Historian to attend a meting of the Hudson Valley Historians Association. in Kingston on April 20, 1974. MR. CLAUSEN moved that Mrs. Ferris be granted permission to attend the Historians Meeting in Kingston on April 20th, and that her legitimate expenses be a Town charge. Seconded by Mr. Jensen. Motion Unanimously Carried A request had been received by Supervisor Diehl from Frank Manning in November 1973, to increase the budgetary allowance for the fees for the Town auditing from $2,000 to $3,000 due to 1.' t its the drastic increase in the general size of the Town and special districts. A second letter was received in March from Mr. Manning asking if the Board had honored his request. MR. SALAND moved that, as he didn't believe that at this time the Town had a budget line item in excess of $2,000; the Board would take Mr. Manning's request under advisement for the next year's budget, but further, that Supervisor Diehl contact Mr. Manning to find out if the audit will take place for the budgeted amount of $2,000, and if it wouldn't, the Board would consider a special meeting to decide what direction to take. Seconded by Mr. Clausen. Motion Unanimously Carried Under Committee Reports, the request by Mr. N.TSlocum for street lighting at the intersections of Balfour and Scott Roads with Old Hopewell Road was again placed before the Committee. Mr. Clausen indicated he would contact Mr. Slocum tomorrow. Mr. Incoronato asked to give a report as a member of the Conser- vation -Advisory Council. It was in reference to the Greenfly Swamp. Mr. Diehl interrupted with the statement that he, Mr. Horton had discussed the problem and has it in front of him to instruct the Attorney and Engineer to the Town to take immediate action there. Mr. Incoronatb, proceeded however, to remind the Board there was a local law, #1, 1969, dealing with dumping in the Town, which exclusively prohibits the dumping of debris and build- ing materials on private grounds, (quotes from Section 2 and Sec- tion 3 of said local law). It is Mr. Incoronato's.understanding that Montfort Brothers Co. is responsible for dumping all that cinder block etc. in the swamp. It would also be in conflict with the 1990 plan (to fill in swamp) which recommends retention of this particular area to be preserved for its very valuable ecological and environmental water area. It was his belief that the Town y� needs this kind of ecol_gical asset, and hoped the Board would 3.09 take the necessary steps to preserve it. Mr. Steinhaus, Planning Board Chairman, requested of the Town Board to take some formal action so as to insure that the funds are available for the 1990 plan on the next phase, (he did not believe the funds had been allocated yet) so they could get into updatiii'ng the Ordinance. Mr. Jensen indicated he had already sent out two letters along these lines, one to the Office of the New York State Planning Services, indicating our need to continue the continuity of the development plan and going into the next phase of the`".Zoning Ordinance. And the second letter was sent to the Office of Frederick P. Clark Associates, the consultants asking them to formulate an estimate and the time frame that is required if the Town elected to fund this phase themselves. Once bothtanswers.are received, the Town can make a decision which way to go. Mr. Versace reported that the second pump was hooked up for the Oakwood Knolls water supply, the plumbing is done and bids are in for the electrical work, and as soon as the bids are let they will have _A second pump for the Oakwood Water. The.next order }of business was to take into consideration an, Amendment to the_Zoning Ordinance of the Townof_Wappinger which was the repeal of Section 412.02. A Public Hearing having been duly held, on March 20, 1974, at which time Affidavits of posting axid_Publication were offered for the record. Mr. Saland, indicating his desire to move the resolution, first wished to clarify what he believed was the sentiment of all Board members. Section 412.02 is perhaps in today's ordinance and today's time, an anachronism, initially put in the Ordinance as an inducement for developers to fit in community water and sewer. The need for that particular service is not really desired by the Board at this time, particularly in light of the Town's municipal water and sewer. It would be assumed, therefore, that that particu- lar section is no longer valid. Also, the new master plan and enactment of a new Zoning Ordinance in the near future has no provi- sion for a density bonus. When the repeal was first before the Board last year, the question was raised on the question of costs. The Board is cognizant of the costs, discussed it at length and are unanimously of the opinion that there will not be a substan- tial increase in our improvement areas and believe at this time, Section 412.02 should be repealed. Mr. Clausen added that if there were any slight increases, it would be due not to the repeal of the density bonus, but due to any noted inflation which might have occurred since the proposal several years ago. The following resolution was offered by COUNCILMAN SALAND. who moved its adoption: BE IT ENACTED AND ORDAINED by the Town Board of the Town of Wappinger that the Zoning Ordinance of the Town of_Wappinger adopted, January. 29, 1963,_and amended from time to time, is further amended as follows: Section 1. Section 412.02 is hereby repealed. Section 2. This amendment shall take effect immediately upon adoption, posting and publication as provided by Town Law. Seconded by: Mr. Clausen. Mr. James Mills, Planning Board member, asked the Board a pro- cedural question, when does the repeal take place, preliminary or final? - you've not given the Planning Board any direction. What do we do with all the preliminaries on the Board. Mr. Rappleyea answered that Town Law, Section 265a provides that the only saving feature would be those subidivisions that have final approval and are filed in the County Clerk's office. If a subdivision does not have final approval at the time of this now no longer have final approval at a down adoption, it can zoning basis. A Public Hearing having been duly held on a proposed Local Law #2, 1974 on Private Sewers in the Town of Wappinger on April 8, 1974, and appropriate Affidavits of Posting and Publication offered for the record at the time of the hearing, the matter was placed before the Board for their consideration. MR. CLAUSEN moved that the following Local Law #2, 1974 entitled A Local Law Requiring all Privately Owned Sewer Plants Located in Subdivisions or using Public Streets or Proposed Public Streets to be Incorporated under the Provisions of the Transportation Corporations Law of the State of New York, be adopted, seconded by Mr. Saland and upon roll call vote unanimously adopted: BE IT ORDAINED AND ENACTED by the Town Board of the Town of Wappinger: WHEREAS, it is essential for the safety and welfare}vf the inhabitants of the Town of Wappinger, exclusive of the Village of Wappingers Falls, that all proposed sanitary sewer plants be organized and operated with some degree of municipal supervision and control, the Town Board of the Town of Wappinger hereby enacts the following provisions to regulate and control such sewer construction and operation: Section 1. All sanitary sewer plants, except those operated by a municipality, and except those operating orproposingto operate solely upon private property and not making use of present or proposed public streets, shall be organized and incorporated under the provisions of the Transportation Corpor- ations Law of the State of New York. Section 2. This local law shall take effect immediately upon adoption, posting and publication as provided by the provi- sions of the Municipal Home Rule Law. There was nothing to be presented to the Board regarding the proposed division of the Town of Wappinger Election Districts at this time. Mr. Mel Zipes, having requested to speak before the Board on behalf of the Conservation Advisory Committee, indicated that currently there are plans among the six Towns for a study of the Wappingers Creek, tentatively for April 21st, to take samples for BOD tests, which will be performed by an analyist company up at Marist. The two tests will be $12.00 each. MR. CLAUSEN moved that the request by the Conservation Advisory Council for $24.00 to pay for samples of water from the Wappingers Creek to be tested, be approved. Seconded by Mr. Saland. Motion Unanimously Carried After some discussion regarding records of samples taken at various times, Mr. Cortellino clarified the request by indicating samples would be taken at various points along the Creek simultaneously or at least within a two hour period so there will be a profile of the Creek at an instant time which would be different from a day to day sampling. MR. CLAUSEN moved the following report be received and placed on file: March 28, 1974 Town Board Town of Wappinger Mill Street Wappingers Falls, N.Y. 12590 Re:- Sanitary Sewer System Wappinger Park Homes Gentlemen: We are in receipt of a letter to the Town Board from Rose Wells, Chairman of the Wappinger Park Homeowner Association. At various times since early 1969, my office has been asked to investigate the feasibility of a sanitary sewer system for Wappinger Park Homes. We have always come up woth the answer, that since we will need a very sophisticated sewage treatment plant without any state aid it was not economically feasible. When the Tri -Municipal Sewer District is a reality and construction is under way, the problem of a small sewage treat- ment plant will be eliminated and a sewer system can be placed in the Wappinger Park Homes area, which will tie into the Tri -Municipal Sewer District. DIEHL moved that a sum of $1,000.00 be transferred to the Recreation Department Account #B7140.4 from Contingency -Part Town, as there were no funds allocated in the 1974 Budget for any prep- aration of this particular recreational area. Motion Unanimously Carried Dan Murray, having been recognized by the Chair, had a few questions on the legal actions in connection with the abandonment of the Mid -Point Sewage Disposal Plant he wished clarified, and Mr. Rappleyea explained what he has already done. Mr. Diehl commented that he and the other Board members had received information from Mr. Lapar regarding the National Flood Insurance Program by the Federal Government. 1 iz MR. DIEHL moved that Mr. Lapar and/or Mr. Rappleyea prepare the necessary papaers and information so that this Flood Insurance could be available in the Town of Wappinger. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Diehl asked Mr. Lapar if the Tall Trees Water Plant was performing. Mr. Lapar stated in response, that Mr. Cacchio, having been ill, he had been offered the key to inspect the plant, but he didn't feel he wanted to go alone, he wished to talk to Mr. Cacchio before he made any decisions. MR. DIEHL moved that Mr. Rappleyea and Mr. Lapar make an immed- iate investigation and decision in regard to the filling in at the Green Fly Swamp. It appears there are 30 or 40 piles of dirt being filled in there. Mr. Horton has investigated it and feels immediate action should be taken by the Engineer and Attorney. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Clausen asked if the Town Clerk could address a letter to the Dutchess County Department of Public Works and the New York State Department of Transportation with regard to the intersection of New Hackensack Road and Route 9. The outside right land for traffic desiring to turn north is still in need of paving, and the time frequency on the traffic light seems to give an excess- ively long red interval for those exiting from New Hackensack Road. He further noted that the time frequency for the traffic signal at Route 9 and East Main Street gave too long an interval for those exiting from East Main Street. There was some reference to the intersections at Old Hopewell and Myers Corners Road with Route 9, also. Charles Cortellino asked if something could be done about enforcing the one way traffic ("entrance" only) at the first entrance into the Imperial Plaza (and Dutchess Shopping Plaza) 156 off Route 9 on New Hackensack Road and if - there . was some way to straighten out the S of that intersection. MR. CLAUSEN moved to ask either the New York State Department of Transportation and/or Dutchess County Department of Public Works to repave the intersections of New Hackensack and Old Hopewell with Route 9, and further, request the New York State Department of Transportation to check the time frequency at the intersections of Route 9 with New Hackensack Road and East Main Street, and investigate the intersection of New Hackensack with Route 9, keep- ing in mind the entrances and exits at the Imperial Plaza shopping center and the area of Dunkin' Doughnuts (Dutchess Shopping Plaza) to see if straightening,- or widening the r-oad'or regulating the traffic in and/or out would solve the very serious problem of congestion and danger to the residents. Motion Unanimously Carried Mr. Horton mentioned that the County must -have issued a curb cut permit at some time and it might be possible to find out if there was any violation of that permit. And in this vein, Mr. Rappleyea suggested another letter could be addressed to the Dutchess County Department of Public Works to see what that curb cut permit allows and see if they are in any violation of it.
