A Public Hearing was held by the Town Board of the Town of Wappinger
on October 3, 1973, at the Town Hall, Mill Street, Wappingers Falls,
New York on a Petition for Expansion of the Orchard Homes, Inc.
Water System, pursuant to Local Law No. 2 of the Year 1967.
Supervisor Diehl opened the hearing at 7:45 P.M.

Louis Clausen, Councilman
The Town Clerk offered for the record, the Affidavit of Posting
duly signed and notariezed, and the Affidavit of Publication duly
signed and notarized by Albert Osten of the W&SD News.
(These Affidavits are attached hereto and made a part hereof of
the Minutes of this Hearing).
Supervisor Diehl asked if there was anyone present wishing to
speak for or against the petition.
Mr. Gerard Hankin, Attorney for Orchard Homes Inc. and Spook Hill
Properties Inc. stated that on the 24th day of September, Department
of Environmental Conservation held a public hearing on the expan-
sion of Orchard Homes Water System, at which time he stipulated with
Mr. Rappleyea, Attorney for the Town, they would abide with require-
ments of the Town and Local Law #2 before they did anything on the
extension of the water system. They have an existing water system
in Orchard Homes with two wells and an additional well on Spook
Hill Properties, which will be more than adequate to supply the
existing development and the proposed development. The third well
would be an emergency well, which pumps approximately 50 gallons
per minute.

In ,the event ,the Townl gets approval from the State to purchase
the' 'Orchard 'Homes Water System, there -will be no need for an
extension.
Supervisor Diehl asked again if there was anyone to speak for or
against this application.
No one spoke for or against.
MR. HOLT moved to close the Public Hearing, seconded by Mr. Saland
and unanimously carried.
The Public Hearing closed at 7:49 P.M.
