The Regular Monthly Meeting of the Town -Board ofsthe.Town of

The minutes of the Special Meeting of June 29, 1973, adjourned to
July 2, 1973; and the regular monthly meeting 'of =July 9,.1973.:, :.
having been previously sent to the Town Board members, .were now
placed before them for their approval..
Mr. Saland questioned, in the July 9,, 1973 minutes, pertaining *to
certain comments with regard to Mr. Manning's report concerning the
role of Comptroller and whether he had moved.to receive or accept
Frank Manning's audit of Town Finances. It was his recollection
he had moved to "receive" rather than to "accept" as was so indicated
by the minutes.
MR. CLAUSEN moved that the minutes of the July 9, 1973 regular month-
ly meeting, as submitted by the Town Clerk, be approved, subject to
review of the tape of said meeting to ascertain whether Mr. Saland
moved to receive or accept Frank Manning's audit report, and correct
if necessary.

A request was received from John Vorndran for a renewal of his
soil mining permit for one year. (property located on All Angels.
Hill .Road and Brown Road). A recommendation was received from
Susan Pike Zoning Administrator, indicating she and Mr. Lapar,
having inspected the property, had no objections to the renewal
of Mr. Vorndran's, permit.' ,
MR. JENSEN moved that, approval be granted for renewal of John
Vorndran's soil mining permit for one year.

The following petition was received from Harold Mangold, Attorney
representing U.S. Cablevision Corp:
WHEREAS, the Town of Wappinger and the U.S. Cablevision
Corp., a Rhode Island Corporation, have entered into anagreement
of franchise with relation to the installation and service of
CATV systems within the Town of Wappinger; and
WHEREAS, ,said franchise sets forth the terms and conditions
of the installation and servicing of said CATV systems, including
rates; and,
WHEREAS, the t i.S..-Cablevision .Corp. now desires to petition
the Town Board of the Town of Wappinger for a change, amendment,
and increase to the said rates;

NOW, THEREFORE, the undersigned hereby respectfully petition
the Town Board of the Town of Wappinger to entertain an application
for a change in rates pursuant to a franchise dated the 21st day
of June 1967, and it is further petitioned that the Town Board at
a regular meeting of the Town Board of the Town of Wappinger set
a date for a_,pubiic hearing on said application with due and proper
notice to the town's people of the Town of Wappinger pursuant to
Section.684 (7). of the Town Law and subject to the approval of the
New York State Commission on Cable Television and other govern-
mental authorities.
WHEREFORE, it is respectfully prayed that the within applica-
tion be approved, granting the change as per Schedule A attached
hereto.

MR. CLAUSEN moved to refer the. U.S., Cablevision petition to Mr.
Rappleyea, Attorney to the Town.

about reception of Cablevision in the past year, and poor service
with regard to these complaints to the company offices.
Mr. Cortellino, being recognized by the Chair, complained that
there was no information.avaiiable for perusal prior to the Public
Hearing, he would like material made available.

L.S., called to ask for infiltration inspection on the sewer line.
My office has absolutely no intention of making said inspection
until we find out who is paying for the time involved.

The Town Clerk informed the Board that she had been served with -
several Tax Reviews. The first was City of New York (Chelsea Pump-
ing Station) served, on August 20, 1973, the second and third were
Land. Properties. Co,. and Invesco Holding Corp. served on August 24,
1973.
MR. CLAUSEN moved that Joseph D. Quinn Jr. Attorney, be appointed
to answer and defend the Tax Review of the City of New York, on
behalf, of the Town of Wappinger.

The Town Clerk noted for the record that she had been served.withji
the Summons and Complaint on September 6, 1973 for the Tort Claim
of Elia Darsa as administrator of the estate of Irma Darsa, deceased,
and Elia Darsa individually against Dutchess County, Department of
Public Works of Dutchess County, Town of Wappinger, Department of
Highways of the•Town of Wappinger and Village of Wappingers Falls,
and had, on September 6, 1973 referred it to the Insurance carrier
for the Town of Wappinger.
The Town Clerk further noted that she had been served with Notices
of Claim, on September 8, 1973, for the Tort Claims of Lindsay
Linda d/b/a L.T. Linda Septic Tank Cleaning Service, and James
Herring,against the Town of Wappinger, and had, on September 10,

1973, referred it to the Insurance Carrier for the Town of Wappinger.
An Order was received from the State of New York Department of
Audit and Control on September 7, 1973, granting the application of
the Town Board of the Town of Wappinger for permission to provide
a Water Improvement Area in the Town of Wappinger to be known as.
Tall Trees Water Improvement Area.
MR. CLAUSEN moved to receive the Order from the State of New York
Department of Audit and Control and place it on file.

Under Committee Reports, Mr. Clausen noted that various departments
within the Town building were moving from one section to another;
one room has already been painted, and the others will also be done
to give the building a new look inside and out.
Mr. Holt noted that no new chairman for the Town Centennial had
been determined as yet. There will be a meeting of the Centennial
Committee, however, at the Town Hall on Wednesday, Sept. 12, 1973.
He intends to pursue the matter of a Chairman for this committee
further. Mr. Holt further noted that he hopes to have a resolution
for an ordinance presented at the next Town Board meeting on the
subject of Licensing the places of Public Assembly. This, he believes
would put the Town Board and Town Officials in a position of knowing
in the event that any gathering of a public nature was scheduled for
anywhere in our Town. This way early detailed information could
be obtained and perhaps, in that degree, to control the size of such
a public gathering. Mr. Saland had a question on not having received
any Landfill reports since the last regular Town Board meeting. He
was wondering if Mr. Diehl might inform him as to whether or not
there is still a leachate problem, and have theydone any work
on the wells. Mr. Diehl answered that there has been no further
work on the wells. The personnel at the Landfill did put in a
second pipe to catch more water that was flowing off of Route 376
and they have a trench about 2 or 3 feet deep with this pipe and
was filled with stone to direct it into the extra pipe they put in.
There has been no further problems in the leaching intothe stream.
There is no great problems, and there have been no reports from either
the State or Federal Government. -
Mr. Rappleyea, going back to Mr. Lapar's letter on inspection in Ye
Olde Apple Orchard, said he thought the Board perhaps should, in line
with past discussions, appoint Mr. Lapar, if that's the Boards'
pleasure, to make inspections of the additional installations in
the Rockingham Farms District and that the inspections could be
paid out of funds being established by any of the persons seeking
attachments to the system. (The matter was set aside again tempor-
arily).
Mr. Saland, again with regard to the Landfill, wishing to clarify
a statement of Mr. Diehl's, the additional ditch has been dug by the
landfill employees, the purpose of that is to divert the water com-
ing across Route 376 before it gets into the Landfill site, and
diverting it directly into the creek, and avoid then carrying
leachate? Mr. Diehl indicated that was correct and added tint
it was directed into one of the major pipes that had been put in
several months ago, under the direction of the Health Department,
to pick up the surface water coming in. Mr. Saland then asked
where they stand with the wall. Mr. Diehl said they have not been
instructed to go any further, from either the State or Federal
Government, and he assumes there is no serious problem there now.
The County, State and Federal Government would have to ascertain
whether further work was warranted. The purpose of the wall was
if the first phase didn't work, the wall was considered the second
type of protection to go into. If the first phase is satisfactory
they will never be ordered to go further.
A Public Hearing having been duly held on September 10, 1973, on
an Ordinance Prohibiting Parking During Certain Hours on Public
Highways of the Town of Wappinger, affidavits of Posting and Publica-
tion offered for the record at the time aEthe hearing, and all

persons desiring to be heard, having been heard, the matter was
now placed before the Board for their consideration.
The following resolution was offered by COUNCILMAN JENSEN who moved
its adoption:
BE IT ORDAINED AND ENACTED by the Town Board of the Town of
Wappinger,
Section 1. Legislative Intent
WHEREAS, it is deemed that the parking of motor vehicles on
public highways during winter months causes serious problems for
highway_ crews in the clearing of snow and ice, and
WHEREAS, it is necessary to have the public highway clear of
motor vehicles at certain hours to allow the streets and public
highways to be properly cleared.
Section 2. Between November 1 of each year and April 1 of
the following year and between the hours of 12:00 o'clock mid-
night and 8:00 A.M. during such months, no vehicle shall be left
standing or allowed to remain parked upon any public highway of
the Town of Wappinger outside of the corporate limits of the Village
of Wappingers Falls.
Section 3. A violation of this ordinance shall be a traffic
infraction pursuant to Section 155 of the Vehicle and Traffic
Law of the State of New York.
Section 4. .This ordinance shall take effect on November 1,
1973.

The following resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
WHEREAS, the Town of Wappinger, herein called the "applicant"
has hereby determined that the construction of certain works,
required for the treatment of sewage, generally described as
additions to an existing secondary sewage treatment plant to con-
vert it to tertiary treatment (0.2 MGD), herein called the -"project"
is desirable and in the public interest.
WHEREAS, under the Federal Water Pollution Control Act, as
amended, the United States,of America has authorized the making
of grants to aid, in financing the cost of construction of necessary
treatment works to prevent the discharge of untreated or inadequate-
ly treated sewage or other waste into any waters and for the pur-
pose of reports, plans, and specifications in connection therewith;
and
WHEREAS, the applicant has examined and duly considered said

Act, as amended and the applicant deems it to be in the public
interest and to the public benefit to file an application under this
act as amended, and to authorize other action in connection there-
with;
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town
of Wappinger, the governing body of said applicant, as follows:
1. That the construction of said project is essential to and is in
the best interests of the applicant,
2. That Louis D. Diehl, Supervisor be hereby authorized to file
on behalf of the applicant an application. (in the form required
by the United States and in conformity with the act as amended)
for a grant to be made by the United States to the applicant to
aid in defraying the cost of construction of the sewerage treatment
works described above;
3. That if such grant be made, the applicant agrees to pay all the
remaining cost of the approved project, over and above the amount
of the grant;
4. That if such grant bemade, the applicant agrees to make pro-
visfion satisfactory to the United States Environmental Protection
Agency for assuring proper and efficient operation and maintenance
of the treatment works after completion of the construction thereof;
5. That the said Louis D. Diehl, Supervisor is hereby authorized
to accept any Federal Grant that may be offered; to furnish such
information and to take such other action as may be necessary to
enable the applicant to qualify for the grant and
6. That the said Louis D. Diehl, Supervisor is hereby designated
as the authorized representative of the applicant for the purpose
of furnishing to the United States such information, data, and
documents pertaining to the application for a grant as may be
required; and otherwise to act as the authorized representative
of the applicant in connection with this application and in con-
nection with any requirements of any Federal Grant which may be
made;
7. That certified copies of this resolution be included as part
of the application to be submitted to the United States, for a
grant.

The matter of Mr. Lapar's letter regarding Inspection of Utilities
in Ye Olde Apple Orchard was again brought up. Mr. Holt attempted
to offer a motion to the effect of appointing *Mr. Lapar to inspect,
but the discussion indicated a need for Mr. Rappleyea to draw up
a resolution. Therefore, the matter again was temporarily set
aside.
Mr. William Crane, attorney representing Dave Alexander, asked
to speak before the Board, and was recognized by the Chair. Mr.
Crane stated that over a year ago an application had been submitted
by Messrs. Klein and Alexander for a permit to extract natural
resources from their property located on Route 9 north of Old
Hopewell Road. (This application had been held in abeyance until
the completion of all previous work had been accomplished on a site
on St. Nicholas Road with a similar permit). He was seeking Board
approval for this application.
Mr. Diehl reflected that Mr. Horton and Mr. Lapar had okayed the
situation on St. Nicholas Road. Mr. Saland and Mr. Holt also
indicated that their previous objections had been taken care of.
MR. HOLT moved that the permit bond (#81-83-889-C) posted by David
Alexander, for completion of work in connection with.his permit
to mine natural resources on St. Nicholas Road, be released.

The application for a permit for the extraction of natural resources
on property located on Route 9 and Old Hopewell Road subject to the
following conditions, recommended by Susan Pike, Zoning Administra-
tor to the Town Board as of January 28, 1972:
1. A performance bond be posted with the Town Board in the amount
of $10,000 form of said bond to be determined by the Town Board,
insuring conformance to approved plans and all applicable regulations.
2. Prior to the Town Board's releasing the performance bond after
the excavations are completed, plans certified by a licensed pro-

fessional'engineer and showing final contours of the site shall
be submitted to and approved by the Engineer to the Town.
3. Since there is a discrepancy in the amount of land contained
in this parcel and the shape of the parcel,. the discrepancy being

between the Site ,Improvement Plan submitted and the Town Tax Maps,
it is recommended that the applicants be required to furnish the
Town with proper records that would clear-up this discrepancy.
4. Permits must be obtained from the proper agencies having
jurisdiction for all proposed ingress and egress to the site. Along
Hopewell Road such permits would have to be obtained from the
Dutchess County Department of Public Works, and along Route 9 they
would have to be obtained from the New York State Department of
Transportation.
5. The applicants should be furnished with a copy of Section 439.01
of the Town of Wappinger Zoning Ordinance before they commence
extracting resources so that they are made fully aware of the re-
strictions which are set forth, especially with regard to hours,
storage piles, ets.

Programs- Contractual Expenses in order to meet bilis presented
for payment in regard to Town of Wappinger Championship Team.

The following resolution was offered by SUPERVISOR DIEHL who
moved its adoption:
WHEREAS, the sum of $3,150 has been appropriated to Account
#B7310.4. This account will be overexpended and overdrawn by the,
sum of $4,000. In order to meet bills presented for payment, the
additional monies were obtained from Account #B1990.4. We, there-
fore, recommend that the Town Board authorize the transfer of the
sum of $4,000,from Account #B1990.4 to Account #B7310.4 in order
to eliminate the overdraft of said amount, and in order to ratify
and confirm the previously unauthorized appropriation.

RESOLVED, that the sum of $4,000 be and the same hereby is
appropriated to Account #B7310.4 and that the said sum is hereby
transferred thereto from Account #B1990.4, subject to auditing
by the recreation department and the Town Auditing Committee in

who moved its adoption:
WHEREAS, the Town Board of the Town of Wappinger, acting on
behalf of the Central Wappinger Water Improvement Area has received
approval from the New York State Department of Environmental
Conservation to establish the aforesaid improvement area and to
acquire the water companies located within the boundaries of
said area, now therefore be it resolved as follows:
The Supervisor and the Attorney for said improvement area
are hereby authorized to make written offers for the facilities
of said water companies in the following amounts and in the
event said offers are not accepted within the time limits set
forth in the Condemnation Law of the State of New York they are
hereby authorized and directed to commence a proceeding in the
Supreme Court or the Dutchess County Court for the condemnation
of the facilities of said companies located in the Town of
Wappinger, Dutchess County, New York.

The Supervisor and the Attorney to the Improvement Area are
also authorized and directed to make application to the Depart-
ment of Transportation (Public Service Commission) and such other
agencies as may be required by law to approve or act upon the
acquisition of such facilities.
The Supervisor and the Attorney to, the Improvement Area are
further'authorized and directed to complete the acquisition of
the Orchard Homes water system in accordance with an option to
purchase said system for the sum of $33,000 as previously approved
by this Board. They are further authorized and directed to acquire
such approvals from other agencies as may be required by Law.

A request was received from Warren Strohm, Chairman of the Zoning
Regulations Advisory Committee, to reschedule a joint executive
meeting with his committee, the Planning Board and Town Board
some time in the third week in September.
It was agreed that Thursday, September 20, 1973, at 7:30 P.M. be
set for a joint executive meeting and the Planning Board and
Zoning Regulations Advisory Committee be so advised.
MR. JENSEN moved to have the Town Clerk draft a letter to the
Planning Board indicating that the Town Board feels that in
reviewing, once again Section 412.02, of the Town of Wappinger
Zoning Ordinance, it is his feeling that the wording in this
section that regards down zoning from R-40 to R-20 is not a man-
datory clause but it is a discretionary clause, therefore it should
be at the discretion of the Planning Board to allow the amount of
down zoning they think would be applicable for each plot plan
approval. This would just be a reminder that it is a discretionary,
power of theirs and further, emphasis that each applicant on its
merits depending on the particular circumstances of each application.

Chairman of the Planning Board on the interpretation of the intent
of Mr. Jensen's motion.
Mr. John Gromyko, Vorndran Drive, being recognized by the Board,
asked about the report Mr. Lapar was requested to submit regarding
the water problem on Vorndran Drive.

The cost appears to be excessive for a problem that can
and will be corrected by the subdivision of the lands -directly
west and uphill of Vorndran Drive.

(as alluded to in the last paragraph of Mr. Lapar's letter). Mr.
Horton responded that Rockingham Sewer District was what was hold-
ing that up because they can't get hookups into Rockingham. Mr..
Lapar added that this would be taken care of on a down stream
drainage..
MR. CLAUSEN moved that Mr. Lapar's report on the Vorndran Drive
Storm Sewer problem ,be received and placed: on file and to be placed
on the agenda for the October regular meeting for discussion.

its adoption:
WHEREAS, application has been previously made for connection

to the Rockingham Sewer District by the developer of Ye Olde Apple
Orchard Section 3, and
WHEREAS, there is a necessity for the testing and the inspec-
tion of the sewer lines by a duly licensed engineer appointed by
the Town,
NOW THEREFORE BE IT RESOLVED, that Rudolph E. Lapar, P.E. is
hereby appointed to make such inspections of all new sewer lines
where permission has been granted to connect to the Rockingham
Sewer District, and be it further
RESOLVED, that in the case of Ye Olde Apple Orchard, Section 3,

of a tour of Planned Unit Development in the states Maryland,.

or official who wished to attend, and that their legitimate expenses
be Town charges.

Mr. Saland requdsted that the Attorney to the Town again prepare
another ordinance pertaining to Route 9. This problem has been
laying fallow for quite some time, and he would like to see it
be consistent with the recommendations of 1990, in so far as the
area south of Old Hopewell Road is concerned, in .that they recom-
mended multi-unit residence. He would also like to see if some
of the high traffic uses can be eliminated in the area north of
Old Hopewell Road, and that high traffic again refers to take out
restaurants, gas stations and the like. Perhaps the Board can
have an executive session to discuss it. Maybe we can come up
with something for the attorney to present at the next Board
meeting. It was agreed that the Board set 7:00 P.M. on September
20, 1973 to discuss this matter.
Under New Business, Mr. Costa Adamakis was recognized by the Chair.
Mr. Adamakis, President of the Royal Ridge Civic Association pre-
sented the Board with a petition on sewer facility of proposed
Pine Hollow subdivision. The Royal Ridge Development residents
were indicating their concern over the proposed use of the Mid-
point Park sewer plant for the Pine Hollow subdivision.
MR. HOLT moved that Mr. Adamakis' letter and attached petition
be received and placed on file.
Seconded by Mr. Saland.

Mr. Clausen, as a member of the Highway Committee, mentioned again
that he thinks there is a need in the Town, wherever possible, for
the ever growing need for bicycle paths along Town roads. He has
spoken to Mr. Horton about it before, and there are problems attached
to it; but as we are accepting ROW'S in the future and as we are
preparing roads, if, and where, possible where the roads permit if
sgme type of planning can be kept_in mind for future development of
bicycle paths. I think it's going to be an increasing problem
within the Town and one in which probably will provide the recrea-

tion and transportation for many of the residents of the Town. I
would just like to, again, knowing that we have talked about it
before, and Mr. Horton is aware of it and certainly support it that
wherever possible again maybe a plan on a small scale can be started
out as one was in the County so possibly we can start developing
some bicycle paths, at a low cost, of course. In that he would
mean that if we accept a road with 50" easements and we possibly
need 30" pavement that, or whatever the Highway Superintendent
recommendation is, then instead of leaving 10 on either side,
then possible we could gain some easement for bicycle paths. It
could be when we install lines or pipes instead of covering it up
in the normal manner if it could be placed further over on the
easement and then paved over for possible bicycle paths. There
might be many options but he was just asking Mr. Horton to again
try and keep in mind that maybe the Town is very shortly becoming
in need of bicycle paths. Mr. Horton replied that this should
be taken into consideration then on subdivisions, do you want
50' ROW's or do you want to go 60' ROW"s, you're going to start
utilizing land then you're going to have to go 60' ROW. Mr.
Clausen then asked Mr. Horton if he really felt 50' was minimal
as what the Highway needs are, with that 50' no bicycle paths can
be produced? Mr. Horton siad it only gave 10' on each side for
snow removal and so forth and it's hard because in rural areas you
have mail baxes and so forth to contend with. Mr. Clausen said
then maybe that would have to be considered, and asked Mr. Horton
to think about making a recommendation to the Town Board that if
the Town thinks along the ways of providing bicycle paths, what
direction the Town Board should possibly take.
MR. HOLT moved the meeting be adjourned, seconded by Mr. Saland
and unanimously carried.
