The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on June 11, 1973, at the Town Hall, Mill Street
Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:15 P.M.
Present:

The minutes of the May 14, 1973 Regular Monthly Meeting and the
May 22, 1973 Special Meeting having been previously sent to the
Town Board members, were now placed before them for their approval.
MR. JENSEN moved the minutes of the May 14, 1973 Regular Monthly
Meeting, and the May 22, 1973 Special Meeting, as submitted by
the Town Clerk be and they are hereby approved.
Seconded by Mr. Holt.

The monthly reports were received from the Supervisor, Building
Inspector bk.t.kuan and Town Justices.
MR. HOLT moved that the Supervisor, Building Inspector and Town
Justices reports be accepted and placed on file.

The Board was inf ormed that the yearly Audit Report of the
Town of Wappinger finances, had been submitted by Frank Manning,
Licensed Public Accountant on June 11, 1973.
MR. HOLT moved to receive the yearly Audit and place it on file.

While awaiting the return of Mr. Clausen (who was temporarily
delayed due to paying his last respects to a local resident)
Supervisor Diehl opened the meeting to the Floor.
Mr. William Biasotti asked to speak on behalf of Bob Baisley, and
himself, with regard to Cluster and PUD Zoning. He stated that
he and Mr. Baisley had made a trip to Heritage Village (Conn.)
and that they had never been so impressed before with what they
had seen. They wished the Board to know how much they both would
love to see something like it come to Wappinger, they were 100%
in favor of Cluster Zoning.
Mr. Diehl, noting a larger than normal attendance, asked if there
was anyone present, not on the Agenda, that wished to address the
Board, before they got into the regular meeting.
Mr. Strohm, representing the Zoning Regulations Advisory Committee,
stated that members of this Committee had undertaken a project to
get the feelings of residents of the community regarding the
Cluster and PUD proposals. Mr. Strohm submitted petitions
signed by about 500 persons which indicated they were in favor
of the Board's adoption of Cluster Zoning and requested the Board
reject the PUD zoning. Mr. jStrohm explained that his Committee
felt there wasn't enough public involvement and by contacting
residents individually and discussing briefly the purposes of
both proposals, this would indicate a more accurate cross section
of public sentiment. There was a brief discussion regarding the
pros and cons and what the Board is trying to achieve of both

proposals amongst Mr. Holt, Mr. Steinhaus, Mr. Rifkin and Mr.
Incoronato indicated that cluster was what they, and the people
they contacted, would prefer seeing established.

Dear Sir:
My neighbors and I are concerned over a development which
has been approved adjacent to Ervin Drive. We would like to
be granted time on the agenda of the next board meeting to
obtain information onthe following issues:
There is presently a slight problem with surface
water run-off, and we would like to know what steps
have been taken to prevent flooding from an increase
in surface water which the development would create.
Ervin Drive, a dead end street, terminates on
Myers Corners Road, approximately eighty feet from the
entrance and exit of Roy C. Ketcham High School, and we
are anxious to know what steps have been considered to
alleviate the possible traffic problems which would be
created by the extension of Ervin Drive. Another factor
to be mentioned here is that the street is heavily popu-
lated with young children; fourteen under fourteen years
of age in the last six hundred feet of road.
We understand that it is possible to have this area
changed from R-20 (half acre lots) to cluster zoning. It
is our impression that the following are advantages of
cluster zoning, but would be interested in knowing addi-
tional points of view on this matter:
1. lessen the amount of surface water run-off.
2.. provide large wooded areas that will act as
wind breaks in the winter while keeping the
area cool in the summer.
3. create a more aesthetic community.
4. provide a refuge for existing wildlife.
We would also like verification that the construction
of this development (I believe the name of this development
is to be Brookvale) is contingent upon town water and sewers.
Please advise me at the above address of the date and time
of the earliest board meeting at which we may be present to dis-
cuss the aforementioned issues.

Mr. Haase was present, and addressed the Board, first asking,
if this would not be in Town water and sewer district, what
sewer plans would be put into effect. Mr. Lapar indicated this
was in both the water and sewer Improvement Areas. His second
question was regarding surface water runoff, what consideration
with respect to this have been thought of. Mr. Lapar assured him
this had been taken into consideration. Mr. Haase mentioned that
some of the area residents had hired Dr. Warthin to look over the
drainage in this area, and it was the Doctor's opinion that it
was definitely a drainage problem, and that just storm drains
or dry wells would not be adequate to take the drain off and
the water would have to be channelled off into some existing
area to get it'off the land. If this wasn't done, there would
be a drainage problem to the existing residents in the Lake Oniad
development. Mr. Haase next discussed Ervin Drive, part of which
is at present a dead-end road. The problem will be the extension
of this road and-thru-traffic, He said his concern was for the
children living -there now that are playing in the street that,
at present, has no thru traffic, and they have been pretty much
conditioned to certain habits. If the traffic were to increase,
there uouldbe some endangerment of life. He also showed some
concern about the fact that Ervin Drive also terminates on Myers
Corners Road almost opposite the entrance to the Roy C. Ketcham
High School. He cited there is a traffic problem now in the
mornings and with additional traffic what is the Town going to
do, it might even demand a traffic light. If road problems aren't
considered early in the planning stage, it becomes a tremendous
problem. He thinks it would be wise to give some consideration
to leaving Ervin Drive a dead-end, -- dead -ends are very advan-
tageous to communities. It was suggested that Mr. Haase discuss
these problems with Mr. Steinhaus and/or the Planning Board.

The following letter was received:

Dear Miss Snowden:
This letter is in reference to approximately 2.03 acres
of land situated in the middle of Wappingers Park Homes, Inc.,
surrounded by Iroquois Drive, Onondaga Drive, and Mohawk Drive.
It is presently owned by Mr. S. Hankin, who is being repre-
sented by his son, Mr. J. Hankin, (see enclosed letter). Mr.
Hankin has offered this land for lease to our Association far
the sum of one dollar ($1.00) per year. Mr. Hankin has also
made known his willingness to sell this -parcel to the Town
of Wappinger. It is our desire as homeowners for the Town of
Wappinger to purchase this parcel and to improve it as a
playground for our children.
It is the feeling of the homeowners that we do not have
adequate play area for our children and they are, therefore,
forced to use the streets as playgrounds. Since there are
only two streets, Cayuga Drive and Iroquois Drive, that lead
to the rear of the development, we are very concerned about
the safety of our children. Also, in its present condition,
this uncleared piece of land proposes a hazard to the health
and safety of our children.
The Department of Rodent Control has been notified, and,
because there was evidence of rat infestation, they have baited
the property surrounding the pump house (which is only the
fenced -in area). There is stagnant water on this land, and in
the summer this property and surrounding areas are infested
with mosquitoes and has an odor of sewage.
The Homeowners Association would like to know if the town
would consider the fore -mentioned problems and possibly allocate
funds to have the land cleared to make a playground. We feel
that we should not be reassessed if the town were to take over
this property since our taxes are already quite high. We have
enormous drainage problems, no sewers, sidewalks, street lights,
or traffic signs (speed limits, dead end signs, stop signs, etc.).
As you will note from the enclosed copy of Mr. Hankin's letter,
the Wappingers Park Homeowners Association was offered to lease
the land from Wappingers Park Homes, Inca We have discussed this
at our homeowners meeting of May 20, 1973 and the majority voted
on the -possibility of the town leasing or purchasing this land
instead.
We would appreciate your giving this matter your utmost
attention and await your early reply.

Mrs. Wells was present to address the Board on this question of
recreation in her development. Mr. Diehl stated that he had met
with this Homeowners Association, and at the time informed them
that he didn't believe the Town would be interested in a one year
lease on a piece of property such as this, since a large amount
of_ money would have to be spent to recondition this piece of
property. It might be appropriate to have Mr. Rappleyea contact
Mr. Hankin to discuss the possibilities of perhaps -a10 year lease.
MR. DIEHL moved that Mr. Rappleyea be instructed to contact Mr.
Jerard Hankin and explore the best possibilities in regard to
leasing this property in terms of money and time, and also a price
of the water plant, if Mr. Hankin so desires to sell, to form a
district.

Mr. Eck, having requested to speak before the Board_ regarding
the purchasing or condemnation of private water systems, said
he had done some checking and Ile found that when Rockingham
became a Sewer ,District there were to be some 650 homes, since
that time there have been addedto it about 145 lots, this was
so to speak found money to the developers, he doesn't believe
it's fair to pay for these additional lots (as far as purchasing
the water system);. The total existing homes in the developments
total 900, and, as he's been advocating, that each customer
should be bought for $500, this would amount to $450,000. Then
there's about 10,000 ft. @ $5.00 a ft. where there are no cus-
tomers, that's $50,000 - then there's $100,000 for tanks, $600,000
is a ball park figure to negotiate with these guys. And by
talking to other developers, enough evidence would be gathered
to support a reasonable price to go to condemnation; $40.00 a
foot is ridiculous to pay these developers.

Pursuant to Section 43 of Election Law recommendations for the
Town of Wappinger Election Inspectors were received from Richard
J. Brady, Dutchess County Republican Committee Chairman, and
Forrest L. Cousens, Dutchess County Democratic Committee Chairman.
MR. HOLT moved that the following persons be appointed as Election
_Inspectors for the Town of Wappinger for a term of one year
commencing July 1, 1973 and terminating June 30, 1974.

The following letter was received from Arthur Waddle:
February 1, 1973
Memo to: Mr. H. Holt
Mr. L. Jensen
Subject: Water Meters - Fleetwood Water District
There is presently one spare water meter left in the district.
We have replaced 4 meters in the past two (2) months. The
last new meters were purchased by Mr. Lapar in 1969. At the
time these meters were placed in service Mr. Lapar requested
that a meter testing setup be installed in the Sewage Treat-
ment Plant Control House so that calibration can be checked
and minor repairs to meters made, this apparently was not done.
I would like to have -the Town Board give careful consideration
to the above request of Mr. Lapar's due to the forming of new
districts and the possibility of the Water Dept. having the
responsibility of repairs to approximately 1000 meters - some
that are now in use and new ones to be installed and not
having any equipment, space or personnel qualified to do re-
pairs/calibrations.
I would also like written authorization to send six (6)
broken meters to the Neptune Meter Co., or to purchase
six (6) new ones for replacement purposes.

MR. JENSEN moved that Mr. Waddle's request for the purchase of
6 new meters be approved, and, also authorize him to send 6
broken meters_to Neptune Meter Co. for repair, to -be then held
for standby's.

Mr. Jensen further commented on Mr. Waddle's suggestion regarding
water repair/calibration by stating that in the future it will be
done within the Township once we get our own facilities.
An application for a Hawking & Peddling License was received
from James Scott. The application had been referred to the
Dutchess County_Sheriff's Office, and returned indicating no
criminal record in file.
MR. CLAUSEN moved to approve the application and grant James
Scott a license for Hawking and Peddling in the Town of Wappinger.
Seconded by Mr. Holt. -

Mr. Clausen asked that Mr. Rappleyea investigate Magazine sales-
men licensing.
A request was received from Virginia Ferris, Town Historian,
for permission to attend the .Hudson Valley Historians' Associa-
tion Meeting in Kingston June 16, 1973, and, Supervisor Diehl
requested permission to attend the 24th Annual Supervisor's
Conference in Kerhonkson, N.Y. June 24th thru June 27th, 1973.

MR. HOLT moved that both Virginia Ferris and Louis Diehl be
granted permission to attend their respective meetings and that
their legitimate expenses be Town charges.

Dear Supervisor Diehl:
The following resolution was recently adopted by the Wappinger
Conservation Association's board of directors:
"Because of resultant increases in the levels of thermal and/or
air pollution in the Mid -Hudson Valley, the Wappinger Conservation
Association rejects the proposed establishment of a power gener-
ating plant in Poughkeepsie's Trap Rock property. In addition
to biologically undesirable emissions, the generators in question
also lack merit because their output would not be used for the
benefit of area residents but to satisfy MTA needs in another
locale." _

Mr. Diehl, objecting to the power plant, said he would enter-
tain a motion to the various officials, and particularly letting
the public know through public hearings just what type of an
installation it is to be.
The following Resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that letters be sent to our State Assemblymen
and Senators, Governor Rockefeller, and the Chairman of the
State Power Authority, that Public Hearings be held, and held
in the local area concerning the Power Plant proposed in the
Town of Poughkeepsie.
Seconded by Mr. Holt.

A petition was received from residents of the Fleetwood Devel-
opment, and a letter from Frank Voyez requesting the installation
of Storm Drainage Sewers on Franton and Midge Drives. Mr. Diehl

stated that Mr. Horton has verified that these areas are included
in the Storm Drainage program, and that Mr. Voyez has already
been so notified of this fact.
Mr. Diehl called for a five minute recess at 9:31 P.M.
Supervisor.Diehl:-called the meeting back to order at 9:50 P.M.
All Board members again. being present, with .the exception of Mr.
Saland.

Re: Inspection of Improvements
Geneltmen:
In accordance with Section 23.2 of the Land Subdivision
Regulation of the Town of Wappinger, the Town Board shall
hire an inspector and the, applicant for subdivider) shall
pay the Town the costs of inspection.
It is my estimate that the cost of such inspection be
equal to 4.5% of the estimated cost of the -project as
determined by the Engineer to the Town.
It is further recommended that my firm be authorized
to conduct suchdaily- inspections and testing, and to certify
the completion of the facilities, for a fee of 4% of the esti-
mated construction costs until such time as the Town Board -
hires a full-time inspector. The 0.5% of the construction
costs will be for administration.
I am enclosing The recent updated..estimates for storm
drainage and also estimates for the calculation of sewer and
water projects.
It is my recommendation that these three tables for
computing the cost of construction be updated by thefirst
of May every year.

P.S. - Please note that the inspection of all roadway
construction will continue -to:.be handled by the
Highway Department.

MR. CLAUSEN moved that the firm of Rudolph E. Lapar, P.E.,
is hereby hired and authorized to do said inspection at the
cost of the developer, in accordance with his letter regarding
Inspection of Improvements and Section 23.2 of the Land Subdivi-
sion Regulations of the Town of Wappinger; and, further, that the
Town of Wappinger Planning Board be so instructed that all future
site plan :applicants and/or developers be apprise.dof this
obligation on their part, and that this requirement be imposed
on all future developments prior to final approval.
Seconded by Mr. Holt.

Mr. Clausen suggested that a letter be sent to the Planning
Board advising them that all future developments follow the same
proceedure before final approval is given that inspectors should
be hired with certificates attached that Inspectors have been
retained.
A letter was received from Camo Pollution Control Inc: indicating
that they were in the process of inspecting the Rockingham Sewer
ti
Plant system and asked to be advised as to any information the
Town might have on the design of this system.
MR. JENSEN moved that Camo Pollution request be honored, and that
Mr. Lapar contact Mr. Kelley for a meeting to put the recommenda-
tion in motion.

Further correspondence was received from John M. Reed regarding
the claim of Richard Barger, asking that he be advised as to
what the Board's intentions are in connection therewith.
MR. DIEHL moved that the letter from Mr. Reed, in regard to
Mr. Barger, be referred to Mr. Rappleyea.

The Board was informed that the Towh of Wappinger Planning Board
had been served with a Show Cause by Mobil Oil Corp. in regard
to a Planning Board decision against the establishment of a
Gas Station.
MR. CLAUSEN moved that Allan E. Rappleyea, Attorney, be appointed
to answer and defend this action on behalf of the Town of Wappinger.

THE SALE OF A $55,000 STATUTORY INSTALLMENT BOND OF THE
TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, TO PAY THE
COST OF VARIOUSEMTEMS'iQE: EQUIRMENT,FORoUSE-Ely T€1E:r'1TIGSWAY
DEPARTMENT OF SAID TOWN.
WHEREAS, the Town Board of the Town of Wappinger, Dutchess
County, New York, duly adopted a bond resolution on April 9,
1973, authorizing the issuance of $55,000 serial bonds of said
Town to pay the cost of the purchase of various items of mach-
inery and apparatus to be used in connection with the operations
of the Highway Department of said Town; and
WHEREAS, it is now desired to provide for the details and
authorize the sale of such $55,000 serial bonds -and .to .provide
for other matters in connection therewith; NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. The $55,000 serial bonds described in the fore-
going preambles shall be issued in the form of a single type-
written statutory installment bond, to be designated HIGHWAY
MACHINERY (SERIAL) BOND, 1973, Said bond shall be dated June 1,
1973, shall be in the denomination of $55,000, shall provide
for the payment of such principal sum of $55,000 in five equal
annual installments, payable $11,000 on June 1 in each of the
years 1974 to 1978, both inclusive, and shall bear interest at
the rate of four and fifty hundredths per centum (4.50%) per
annum, payable annually on -June 1. Both principal of and interest
on such statutory installment bond shall be payable in lawful
money of the United States of America at Marine Midland Bank of
Southeastern New York, N.A., in Poughkeepsie, New York, which
by contract is the paying agent of the issuer. Such statutory
installment bond shall be signed in the name of said Town of
Wappinger, New York, by its Supervisor, sealed with its corpor-
ate seal and attested by its Town Clerk. Such statutory install-
ment bond shall be in typewritten form and shall be in substan-
tially the following form, to -wit: -
Section 2. All other matters, except as provided herein
relating to such statutory installment bond, shall be determined
by the. Supervisor ofsaidTown.
,.Section 3; It is hereby determined that the period of
probable usefulness of the aforesaid class of objects or pur-
poses is five years, pursuant to subdivision 28 of paragraph
a of Section 11.00 of the Local Finance Law.
Section 4. The faith and credit of said Town of Wappinger,
New York, are hereby irrevocably pledged for the payment of the
principal of and interest on such statutory installment bond as
the Isame respectively become due and payable. An annual appro-
priation shall be made in each year sufficient to pay the prin-
cipal of and interest on such statutory installment bond becoming
due and payable in such year. There shall annually be levied on
all the taxable real property of said Town a tax sufficient to
pay the principal of and interest on such statutory installment
bond as the same become due and payable.
Section 5. Pursuant to the provisions of paragraph b of
Section 63.00 of the Local Finance Law, as last amended, said
statutory installment bond is hereby sold at private sale to
Marine. Midland Bank of Southeastern New York, N.A., in Pough-
keepsie, New York, at par and accrued interest, if any, it
being hereby determined that the total amount of bonds sold by

said Town at private sale in accordance with the provisions o f
said.paragraph b of Section 63.00 of the Local Finance Law for
its current fiscal year is not in excess of $100,000. The
receipt of the Supervisor shall be a full acquittance to the

BE IT RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. The construction of -drainage facilities,
including land or rights in land, original furnishings, equipment,
machinery or apparatus incidental thereto, in and for the Town
of Wappinger, Dutchess County, New York, for the purpose of
drainage aad to protect the property within the town from floods,
freshets, and high waters, is hereby authorized at a maximum
estimated cost of $200,000.
Section 2.. The plan for the financing of the aforesaid
class of objects or purposes,is as follows:
a) By the issuance of $190,000 serial bonds of said Town,
hereby authorized to be issued pursuant to the Local
Finance Law; and
b) By the issuance of $10,000 capital notes of said Town,
hereby authorized to be issued pursuant to the Local
Finance Law. Such capital notes shall be sold at
private sale and all further powers in connection
with the details and the sale thereof are hereby
delegated to the Supervisor in accordance with the
Local Finance Law. Pursuant t6'Section 107.00(of
the Local Finance Law, the proceeds from' the sale of
such capital notes will be provided prior to the
issuance of the bonds herein authorized or bond
anticipation notes. Said $10,000 capital notes shall
constitute the down payment required by..SectiOn 107.00
of the Local Finance Law.

Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid class of objects .or_purposes
is thirty_years, pursuant to subdivision 3 of paragraph a of
Section 11.00 of,,the Local Finance Law. it. is hereby further
determined that:the maximum maturity of the serial bonds herein
authorized will exceed five years.
Section 4. The faith and credit of said Town of Wappinger,
New York, are hereby irrevocably pledged to the payment of the
principal of and interest on such obligations_as the same
respectively become due and payable. An annual appropriation
shall be made in each year sufficient to pay the principal of
and interest on such obligations becoming due and payable in
such year.
Section 5. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of_and.to sell bond
anticipation notes in anticipation of the issuance and sale
of the serial bonds herein authorized, including renewals of
such notes, is hereby delegated to the Supervisor, the chief
fiscal officer. Such notes shall be of such terms, form and
contents, and shall be sold in such manner, as may be prescribed
by said_.Supervisor, consistent with the provisions of the Local
Finance Law.
Section 6. The validity of such bonds, bond anticipation
notes and capital notes may be contested only if:
1) Such obligations are authorized for an object or
purpose for_which said Town. is not authorized to
expand money, or
2) The provisions of law which should be complied with
at the date of publication of this resolution are not
substantially complied with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of publication, or
3) .,Such obligations are authorized in; violations of :the
provisions(of the Constitution. .
Section 7. Upon this resolution taking effect, the same
shall be published in full in the W&SD News, the official
newspaper, together with a notice of the Town Clerk in substan-
tailly the form provided in Section 81.00 of the Local Finance
Law.
:Section_8.- This resolution is adopted subject to per-
missive referendum.

Gentlemen:
The above application has been reviewed by Rudolph E.
Lapar, Engineer to the Town, and mer, our recommendations on
said application being as follows:

. Section 439.013 of the Zoning Ordinance states that
no excavation shall be closer than 50 ft. to any
street line or property line. , The New York State
Department of Transportation has granted Mr. Davis
a work permit to cut the wade of the property along
the frontage on Route 9 down to the grade of the
highway. •This permit allows him to excavate and
remove the excess fill within 50 ft of the street
line. Mr. Lapar and -I agree that on this site,
because most of the adjoining property is lower
than the Davis property, excavating closer than
50 ft. to street or property lines could be done
without adverse affects.,. We feel, however, that
Mr. Davis should obtain a written waiver from the

owners Of the adjoining properties before being
permitted to do so.
2. Engineer's calculations indicating how many cubic
yards of fill will be removed from the premises'must
be submitted 'to the Engineer' to the Town for his `
review. If the total cubic yards should exceed 12,000,
a performance bond must be posted with the Town in
the amount of $10,000.

MR. CLAUSEN moved that Mr. Davis receive a copy of the letter
from Susan Pike, Zoning Administrator indicating his responsi-
bility before he applies for a permit for soil mining.

Mr. Lapar reported on Mr. L. Tomazin's complaint about drainage
on his property. Mr. Lapar stated that he and Mr. Horton, High-
way Superintendent had an on site inspection, and it is their
opinion that the Town has not done anything to Mr. Tomazin's
property that already had not been there. They have not in-
creased or have not improved the property, therefore, Mr. Tomazin
was not damaged beyond what he was already damaged.
MR. rIEHL moved that the Town Clerk notify Mr. Tomazin of the
report given to the Town Board by Mr. Lapar and from this report
the Town Board feels that no damage or injustice has occurred.

Under New Business, Supervisor Diehl asked if there was anyone
from the floor that wished to address the Board.'
Mr. David Graves, 17 Doyle Drive, Rockingham Farms spoke with
regard to a drainage problem in the area of a natural stream in
back of his property (between Balfour and Doyle) . He claims the
developer dug up the natural stream and replaced it with what
is nothing more than a drainage ditch'. Stagnant water settles
in this area and he believes creates a health hazard.
There was some discussion as to whether it had been a natural
stream to begin with. Mr. Diehl believed Mr. Lapar and Mr.
Horton would have to check this out and give an opinion at
the next Board meeting. Mr. Lapar stated that some corrective
measures could be suggested to the developer. Mr. Diehl asked
Mr. Lapar to report back at the next meeting what the situation
is.
Mr. Jensen stated that it had been brought to his attention
by some Town residents that Cablevision has asked for rate in-
creases and what have you, and some of the service that they
have been receiving from the Cablevision people has not been
up to par. At various times they have called these people and
complained about the service and the problem persists. He just
wanted to pass it on in case anyone else hears of similar
complaints.
MR. HOLT moved the meeting be adjourned, seconded by Mr. Clausen
and unanimously carried.
