1973-01-23 PH2 8R A Public Hearing was held by the Town Board of the Town of Wappinger on Tuesday, January 23, 1973, at the Town Hall, Village of Wappingers Falls, Mill Street, Wappingers Falls, New York, on an Ordinance Amending the Zoning Ordinance of the Town of Wappinger. Supervisor Diehl opened the Hearing at 8:00 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Elaine H. Snowden, Town Clerk Others Present: Allan Rappleyea, Attorney to the Town The Town Clerk offered for the record the Affidavit of Posting and Publication duly signed and notarized by Albert Osten of the W&SD News. (These Affidavits are attached hereto and made a part thereof of the minutes of this Hearing.) The Town Clerk read the recommendations of Dutchess County Planning and Town of Wappinger Planning Boards. Supervisor Diehl asked for those in favor of this Ordinance to speak and limit their time to five minutes. Joseph Incoronato, Ronsue Drive, a member of the Zoning Regulations Advisory Committee, said that this Committee recommended in July, 1971 that the "density bonus" be struck from the Zoning Ordinance, and again in November 1971, they recommended this in conjunction with the Planning Board's recommendation. He thought that eliminating this Section would be in the best interests of the Town. Warren Strohm, Pine Ridge Drive, chairman of the Zoning Regulations Advisory Committee was in favor of eliminating Section 412.02 from the Zoning Ordinance; developers should not have a "density bonus", this is a wrong approach. Jeff Berg, PresidV)t Cedar Hill -Pine Ridge Civic Association stated that 170 residents had signed a petition in favor of repealing this Section. David J. Flitt, President Round Tree Builders and Development Corp. owner of 52 acres of property on Baxter Town Road was against this Ordinance. He said he had already made application for building permits and paid a fee of $950. They were willing to put in sewer and water at their own cost. He did not know about this Ordinance at the time of application and did not think it would apply to his Corporation. They should be allowed to proceed under Section 412.02. Louis Eck spoke at length against the Ordinance. His main complaint was that sewer and water costs would be higher if this went through. The figures that went to Audit and Control would no longer apply if this Section was repealed. Stan Lizinski represented owner of property on Route 376 according to his understanding, when the Town was seeking Federal Aid for sewer and water, they had to show density, and in order to do this they asked certain property owners what they intended to to with their property. Will this action have any effect on Federal Aid? Vincent Brancato resented the advice of the Zoning Regulations Ad- visory Committee, which he called a citizens group. He commented that he bore no malice against this group but he did not think it was a true representation of the people in the Town of Wappinger, and he did not feel they were qualified to recommend favorably to the Board on this Ordinance. Joseph Ludewig, Spook Hill Road, was opposed to the repeal of this Section, mainly because "it's just a repeal", thought there should be an alternative. If the Board goes along with this, it would put a 2f3 - damper damper on Town -wide Sewer and Wates`. The developers could put in their own septic and well on 1 acre zoning. In order to keep costs realistic, they should keep z acre zoning. Stan Ford, owns property on Robinson Lane, not for or against, but in sympathy with both. There's something to be said for both sides, but cluster zoning might be the answer. The ultimate goal of this repeal is to stop density and relieve burden on schools; you have to look to PUD, or cluste- and new concept zoning in order to cut building costs and road costs. He thought perhaps it should be left as is until water and sewer lines are in, so developers could tie in. They have to think about the young couples and also senior citizens who cannot pay the price on larger lots; nor do they want or need them. He felt it should be studied further. Arthur Walker, Pleasant Lane, would this effect the approval they already have received from Audit and Control? Allan Hall -- if -a developer builds in an area where sewer and water is already in at Town expense, can he still reap the benefits of "density bonus"? John Vorndran, owner of 100 acres in the Town of Wappinger owns it for 60 years. They have about 1800 feet of sewer pipe on their land which they paid 1/3 of. It has been in for 5 or 6 years. If this Ordinance goes through, they would stand considerable loss. It's been used by local people and by the Town and as far as he was concerned, "they had nothing". Charles Alpert, Alpine Drive --people new in the district should be made cognizant of the difference in rates for water and sewer if this goes through; what their rate could have been and what it will be if this amendment goes through. 28D George Rudy, Kent Road, besides comparing the sewer costs at the two densities, we should also compare the school costs at the two densi- ties. David Albert, represents owner of 300•acres of property on All Angels and Hopewell Road. He is opposed to this Ordinance based on increase in construction costs. If the growth is slow, this will not slow the increase in education, cost of protection security, garbage removal. If the growth is slow, who's to pick up the increased costs? Supervisor Diehl asked for anyone else who had not yet spoken to present themselves. No one wished else wished to speak. Motion made by Mr. Holt, seconded by Mr. Clausen, to close the Public Hearing.
