Resolution Introducing "Local Law No. _ of the Year 2011, Designating a Three -Way Full
Stop Intersection at Diddell Road and Smith Crossing Road, and Full Stop Intersections at
Viola Court at Its Intersection with Robinson Lane and Gerhard Court at Its Intersection
with Viola Court"
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 13,
2011.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman Czarniecki and seconded by
Councilman Bettina.
WHEREAS, the Town Board has been informed by the Dutchess County Director of
Engineering that the component of the Dutchess Rail Trail as it passes through the Town of Wappinger
has been completed; and
WHEREAS, the Dutchess County Director of Engineering has indicated that, based on
observations of this intersection, safety would be improved by the installation of a three-way stop at the
intersection of Diddell Road and Smith Crossing Road; and
WHEREAS, Highway Superintendent, Graham Foster, shares the concerns raised by the
Dutchess County Director of Engineering and also recommends a three-way stop at the intersection of
Diddell Road and Smith Crossing Road; and
WHEREAS, Highway Superintendent, Graham Foster, has noted that the Town has recently
accepted two roads from the Blackwatch Farm Subdivision known as Viola Court and Gerhard Court; and
WHEREAS, the Highway Superintendent recommends a stop intersection at Viola Court
heading in an easterly direction at Robinson Lane and on Gerhard Court heading in a southerly direction
at Viola Court; and
WHEREAS, the proposed Local Law establishing the stop intersections is a Type I1 action
pursuant to 6 NYCRR 617.5 (c) (20) and is otherwise exempt from environmental review pursuant to the
New York State Environmental Quality Review Act (SEQRA) or pursuant to Local Law No. 6 of 1992.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby introduces for adoption Local Law No. of 2011 in the form
annexed hereto.
3. The Town Board hereby determines that the enactment of the aforementioned Local Law
is a Type II action as defined in 6 NYCRR 617.5 (c) (20) and, accordingly, the Town
Board hereby expressly determines that this action is not an action that requires review
pursuant to the provisions of New York State Environmental Quality Review Act
(SEQRA) or pursuant to Local Law No. 6 of 1992 or pursuant to 6 NYCRR Part 617.
4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of Local
Law No. of the Year 2011 to be held at Town Hall, 20 Middlebush Road,
Wappingers Falls, New York on the 11th day of July 2011, at 7:30 P.M., and that the
Town Clerk be directed to post and publish Notice of the Public Hearing in the form
annexed hereto.
The foregoing was put to a vote which resulted as follows:

At a recent Town Board meeting we discussed a request for stop signs in both
directions on Diddell Road, where it intersects with Smith'Crossing Road and the
Dutchess County Rail Trail. This request came from Greg Bentley, Director of
Engineering for Dutchess County.
While I have some concerns concerning the sign on Diddell Road heading
northwest as it approaches Smith Crossing, the safety of users of the Rail Trail far
out weigh those concerns.
I recommend we update our local stop sign law as follows:
1.) On Diddell Road heading in an easterly direction at Smith Crossing Road
intersection
2.) On Diddell Road heading in a northwesterly directon at Smith Crossing Road
intersection
We should also include, in this update, our newly accepted Blackwatch
Subdivision signs.
1.) On Viola Court heading in an easterly direction at the Robinson Lane
intersection
2.) On Gerhard Court heading in a southerly direction at Viola Court intersection

Dear Supervisor Colsey:
Dutchess County has now completed its grading operations and installation of most
of the asphalt at the intersection of Diddell Road and the Dutchess Rail Trail.
Based upon our observations of this intersection throughout the trail construction

stop at the intersection of Diddell Road and Smith Crossing Road. We feel this

William R. Steinhauwould benefit not just the safety of the trail users, but of the motoring public as
well. We have reviewed the concept of installing a three-way stop at this location
Highway Systems with Highway Superintendent Foster and he has indicated his support for the
Management change.

With our past experience with trail projects, we have also found that trail users
sometimes use any space available near trail heads and intersections to park. We
feel that this location has several places that lend itself for people to create their
own parking which could create a safety concern for the motoring public and trail
users by blocking sight lines.
Dutchess County DPW requests that the Town of Wappinger consider passing any
necessary resolutions for both a three way stop at this location, and the creation of
an enforceable no parking area within 200' in every direction from the trail
intersection.

Dear Supervisor Colsey:
This section of the Dutchess Rail Trail is planned to be opened this month. In the
Town of Wappinger, the trail will have two designated access locations:
o Maloney Road, between Daley Road and Maloney Drive;
o Diddell Road, just west of Smith Crossing Road.
To enhance safety for pedestrians accessing the trail, the Dutchess County Department
of Public Works (DCDPW) believes "no parking zones" need to be established.
Attached is a diagram which depicts the proposed "no parking" zones on Maloney
Road. We request that the Town of Wappinger adopt a "no parking" ordinance as
shown.
A request for "no parking" zones on Diddell Road was made in our letter dated May
10, 2011.
Once the resolutions are established, the DCDPW will install the signs which will be
maintained by the Town. We would greatly appreciate it if the Town would act upon
this request at its earliest convenience.
