2011-2612011-261 Resolution Refunding Unused Zoning Board of Appeals Application Fees At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on July 25, 2011. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers ABSENT: Christopher J. Colsey William H. Beale (Arrived 6:32PM) Vincent F. Bettina Joseph P. Paoloni Ismay Czarniecki The following Resolution was introduced by Councilman Bettina and seconded by Councilman Beale. WHEREAS, Josh and Marlena Indorf submitted an application for a variance for a swimming pool project; and WHEREAS, the Applicants withdrew the application prior to any actions by the Office of Code Enforcement or the Zoning Board of Appeals; and WHEREAS, the Zoning Board of Appeals Clerk has submitted a memo supporting the refund action, dated July 7, 2011; and WHEREAS, the Town Board hereby authorizes the refund of Zoning Board of Appeals application fees in the amount of Two Hundred Fifty Dollars ($250.00), payable to Josh and Marlena Indorf. NO W, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby authorizes the issuance of a voucher to Josh and Marlena Indorf for Zoning Board of Appeals application fees in the amount of Two Hundred Fifty Dollars ($250.00). 3. The Town Board hereby authorizes the Town Accountant to issue the refund to Josh and Marlena Indorf for Zoning Board of Appeals application fees in the amount of Two Hundred Fifty Dollars ($250.00) upon receipt of the executed voucher and attached documentation supporting the original payment of application fees to the Town of Wappinger. The request was submitted after we had a stop work order on our property. I was told after it was submitted that we could not submit any type of permits until that was cleared.
