2002-203.It RESOLUTION NO. 2002-203 RESOLUTION AUTHORIZING THE CONTINUED REVIEW OF THE MGD/ CAPOLINO SITE PLAN APPLICATION The following Resolution was introduced by Mr. Paoloni and seconded by Mr. Colsey WHEREAS, Frederick P. Clark Associates, Inc. is the Planner to the Town of Wappinger and to the Town of Wappinger Planning Board; and WHEREAS, the Town of Wappinger Planning Board is presently reviewing a Site Plan Application known as the MGD/ Capolino Site Plan, for premises owned by the Estate of Capolino and Cavillo Trust (Capolino Property) located on Old Hopewell Road in the Town of Wappinger; and WHEREAS, MGD is the Contract Vendee for the Capolino Property on Old Hopewell Road in the Town of Wappinger; and WHEREAS, MGD is a subsidiary company of Ginsburg Development Corporation (GDC); and WHEREAS, Frederick P. Clark Associates, Inc. has been retained by Ginsburg Corporation CT, LLC to undertake traffic consulting for Connecticut developments; and WHEREAS, Ginsburg Corporation CT, LLC is also a division of Ginsburg Development Corporation (GDC); and WHEREAS, Frederick P. Clark Associates, Inc.'s involvement with Ginsburg Development CT, LLC is limited to projects in the state of Connecticut; and WHEREAS, the above information has been disclosed to the Town Board of the Town of Wappinger pursuant to a letter dated June 10, 2002, a copy of which is attached to this Resolution; and C:\DOCUME-I\Gina\LOCALS-1\Temp\Review-MGD-Capolino.doc WHEREAS, Frederick P. Clark Associates, Inc. having disclosed the above information hereby requests permission of the Town Board to continue to review the MGD/ Capolino Site Plan Application on behalf of the Town of Wappinger. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. Frederick P. Clark Associates, Inc., Planners to the Town of Wappinger, with an office at 350 Theodore Fremd Road, Rye, New York is hereby authorized to continue to review the MGD/ Capolino Site Plan Application on behalf of the Town of Wappinger. 3. Supervisor Joseph Ruggiero is authorized to execute a copy of the letter of June 10, 2002 formally acknowledging that Frederick P. Clark Associates, Inc. is authorized to continue to the MGD/ Capolino Site Plan Application. The foregoing was put to a vote which resulted as follows: JOSEPH RUGGIERO, Supervisor Voting ROBERT L. SUN 1 i Pv ` rASMCE N �qEp As per our recent conversation, the purpose of this letter is to inform the Town that we are currently providing traffic consulting services (not planning or environmental services) for Ginsburg Development CT, LLC (Connecticut) a division of the Ginsburg Development Corporation (GDC). Our professional services are limited to traffic consulting for Connecticut developments. It came to our attention at the May 20, 2002 meeting of the Planning Board that MGD Development Group, LLC (MGD) is the contract vendee for the Capolino property on Old Hopewell Road and Route 9D, and that MGD is a subsidiary company of GDC. We have not and are not involved in any business with MGD, and until May 20`", were not aware of MGD or that it was associated with the Ginsburg Development Corporation.
