Public Hearings Resolution Setting Public Hearing on Cable Franchise Renewal Agreement between the Town of Wappinger and Cablevision of Wappingers Falls, Inc Supervisor Ruggiero opened the Public Hearing at 7:34 PM. Town Clerk Chris Masterson offered for the record the Affidavits of Posting and Publication, duly signed and notarized (These Affidavits are attached hereto and made a part thereof the Minutes of the Public Hearing). Supervisor Ruggiero asked if there was anyone in attendance that wanted to comment on the topic. Rena Dandrea, of 2 Country Club Lane, asked what impact the residents could expect when Verizon gets its fiber optics up. She didn't want to deal with Cablevision anymore. She wanted to switch everything over to Verizon. Supervisor Ruggiero explained that Verizon would have to seek a franchise agreement. There were other conditions to be met first. Once the agreement is in place, the resident would be able to change providers. Roger Conner, a representative from Cablevision was on hand to answer any questions that the residents had. There were no other questions. Councilman Bettina made a motion to close the Public Hearing. The motion was seconded by Councilwoman McCarthy and passed unanimously. Discussion A. Soccer Fields - Jay Paggi Supervisor Ruggiero opened the discussion at 7:36 PM. Jay Paggi, Town Engineer, began by recapping the discussions and presentations that have taken place so far. In previous meetings, Mr. Paggi and the representatives from Field Turf have presented options to the Board regarding the fields at the Airport Drive Soccer Field Complex. Matthew Olds, a representative from Field Turf, was on hand for this meeting to discuss the topic and answer questions from the Board. Mr. Olds described the basics of the Field Turf system and how it could benefit the Town. He also listed current clients of Field Turf. Councilman Bettina mentioned that he played on artificial turf when he was in College. He noticed that it was common to get burns from sliding on Astroturf and asked if the same would happen with Fields Turf. Mr. Olds replied that it would not and explained the reasons why. He went on to discuss the average life expectancy of the fields. At the request of Mr. Paggi, Mr. Olds explained to the Board what would need to be replaced at the end of the 10 year life expectancy. Supervisor Ruggiero discussed the fields in question and clarified which ones would be sod and which one would be Field Turf. Mr. Paggi also explained the SWPPP, the Soil Erosion Control, which is in place to prevent impact to the wetland. The Board then looked over the maps and plans so that everyone was sure of the fields that were being discussed. Discussion followed. Councilwoman McCarthy asked Mr. Olds to go over the maintenance costs again. Councilman Paoloni asked that Mr. Paggi bring a breakdown of the costs the next time this topic is on the agenda. Mr. Paggi replied that Councilman Paoloni was interested in the 10 year cost analysis. Mr. Olds then discussed the analysis in detail. Supervisor Ruggiero asked Ralph Holt, Chairman of the Recreation Commission, how often the Town is maintaining the Airport Drive fields. Mr. Holt replied that the workers are out there twice a week during the summer. Supervisor Ruggiero calculated that the workers spend sixteen hours per week to maintain the fields. Councilman Paoloni commented that this is the type of information he is looking for. He would like to know what the town is doing now and how the costs of this project would be amortized over the life of the fields. He asked when the last time the Town made an investment like this at the Airport Drive complex was. Supervisor Ruggiero answered that the last time was a $100,000 project to develop parking lots. In 2003, there was also a $9,000 well project. Discussion followed. Supervisor Ruggiero introduced Jim Purdy, a representative of the Wappinger United Soccer Club, and asked Mr. Purdy to comment. Mr. Purdy discussed the maintenance work that the Town did and the maintenance work that the club did themselves. Supervisor Ruggiero referenced a letter that was submitted by the soccer club in which the club offered to contribute $140,000 of the club's money for the rehabilitation of the fields. Mr. Purdy then discussed the problems that have been occurring on the fields. He commented that 150 Town kids use the field every night. 450 kids use the fields every Saturday for games. Discussion followed. Councilman Bettina asked how many of the program's players were actually Town of Wappinger residents. Mr. Purdy answered that there were 1150 players in the program. Approximately 800 are from the Town of Wappinger. Supervisor Ruggiero added that the players that were not Wappinger residents were mostly Fishkill and East Fishkill residents. There has been dialogue with those towns pertaining to a shared services agreement. Supervisor Pagones, Supervisor of the Town of Fishkill, has agreed to such an agreement. The Town of Poughkeepsie and the Town of East Fishkill were not interested. Mr. Purdy pointed out the he believes the $140,000 contribution that his program is offering is unprecedented. His program receives the least amount of recreation money, per capita, of all Town programs. In the past, the Club has signed the check and returned it to the town. Recently, they have retained the money and added it to the money that the program raises on its own. In the future, he plans on saving the stipend and holding that to put towards the replacement of the fields. Councilman Bettina asked how much the program charged for registration. Mr. Purdy replied that it was $65.00. He claimed that it was the least costly program in the Town and was cheaper than what neighboring towns charge. Supervisor Ruggiero reminded the Board that the Town has a Parkland Trust Fund that is to be used strictly for park improvement. He went over the amount in the fund and the subdivisions that are planned that would contribute to that fund. Councilman Bettina asked for a joint meeting with the Town of Fishkill. Supervisor Ruggiero agreed. Councilman Beale asked what the current condition of the Rockingham field was. Mr. Purdy replied that it was four feet under water. This has happened twice in the past 18 months. Mr. Holt added that, even if there was no water there, there is still no good grass. Discussion followed regarding the usage of the fields at the Rockingham complex and the Airport Drive complex. Supervisor Ruggiero mentioned the Robinson Lane complex. Town of Wappinger Page 2 Printed 4/27/2007 Z� T T Regular Meeting Minutes April 9, 2007 Councilman Bettina added that he has been in contact with the Pop Warner Football program. They have asked Councilman Bettina to make sure that they are not overlooked. Councilman Beale asked if the field would need to be continually lined. Mr. Olds explained that there were many options relating to lining the fields. Mr. Purdy commented that the Soccer Club expects to continue lining the fields if the Town so wished. Councilman Bettina asked Mr. Olds if the Town would be able to line the fields on its own. Mr. Olds replied that it would. Supervisor Ruggiero asked Mr. Paggi how long it would take to prepare "spec's" for this project. Mr. Paggi replied that it would take about four months. Supervisor Ruggiero followed up by asking Mr. Olds how long it would take to construct the Field Turf fields. Mr. Olds replied that it would take 60 days from the time that the shovel was put in the ground. Supervisor Ruggiero then closed the discussion at 8:19 PM. B. Webcasting - Robert Feldman Supervisor Ruggiero opened the discussion at 8:20 PM and introduced Mr. Robert Feldman. Supervisor Ruggiero mentioned that the Governor has issued an Executive Order relating to webcasting Board Meetings and the Town of Wappinger is interested in how this relates to municipalities. Mr. Feldman replied that it does not apply to municipalities at this time. Supervisor Ruggiero commented that the County government has begun webcasting its meetings. The Town of Wappinger is looking to integrate some type of webcasting abilities with the MinuteTraq program that it is currently using. Mr. Feldman explained what webcasting is and how his firm can provide that service for the Town. He also described the hardware that would be required and gave examples of how it could be set up in the Meeting Room. Supervisor Ruggiero explained that Cablevision will be installing robotic cameras as a condition of the franchise agreement. He asked if the Town would be able to use those cameras for what Mr. Feldman is proposing. Mr. Feldman replied that it could. He stated that the Town would also need an encoder, which is nothing more than a laptop. Councilman Paoloni asked why the Town couldn't use a less expensive desktop. Mr. Feldman recommended using laptops for portability, so that the Town could webcast from remote locations. Councilman Beale wanted to verify that the proposal from Mr. Feldman included a portable camera. Discussion on the equipment to be used and the best way to set up that equipment followed. Mr. Feldman went on to explain what a content distribution network is. This network allows the Town to distribute the webcast to an unlimited audience. Councilwoman McCarthy asked what the fees would be. Mr. Feldman estimated that the Town would be charged $100 - $125 per meeting. Councilman Bettina asked if it would be correct that it would cost $2000 - $3000 annually. Mr. Feldman confirmed. Councilman Beale commended Mr. Feldman on the quality of the Dutchess County webcasts. Councilman Bettina recommended that the Town sell advertising on the Town's webcast webpage. Supervisor Ruggiero asked the Town Clerk, Chris Masterson, if this program would be compatible with the MinuteTraq system. Mr. Masterson answered that it would be, as long as the Town retained the rights to the files. Mr. Feldman assured the Town Clerk that the Town would retain ownership of all content. Discussion followed. Mr. Feldman pointed out that his program also offers full transcripts, with 99% accuracy, and captioning for the hearing impaired. It also provides the residents with the ability to search the video files. Councilman Beale asked for an explanation of the Executive Order. Mr. Feldman explained the requirements of the Order and commented that it is currently only for State agencies. Since there were no further comments or questions for Mr. Feldman, Supervisor Ruggiero closed the discussion at 8:43 PM. C. Carnwath Farms Update - Don Swartz Supervisor Ruggiero opened the discussion at 8:43 PM. Michael Bufi was present to discuss the Carnwath repairs as Don Swartz was not able to attend. Mr. Bufi used PowerPoint slides to demonstrate the work that has been done since the last meeting and to show what work is planned to be completed. At the conclusion of the presentation, Councilwoman McCarthy asked if the Town was still under budget for this emergency work project. Jay Paggi, Engineer to the Town, replied that the Town is under budget. An anonymous resident asked why the buildings fell into such disrepair. Supervisor Ruggiero explained that the building is 150 years old and the Town bought it four years ago "as is". It is now being fixed. The Mansion has not been occupied since 1980. The Supervisor went on to explain the time period between the acquisition of the property to the present. Councilman Bettina added that it was bought for open space and the Town is trying to maintain the integrity of the property. Councilwoman McCarthy again asked if the Town was under budget. Mr. Paggi replied that the totals, as of March 30th, are between $380,000 and $390,000 on the Mansion and $135,000 on the Carriage House. Councilwoman McCarthy thanked the contractors for their work to this point. Councilman Beale asked when the earliest opportunity to get the Dutchess County Sports Museum back open was. Supervisor Ruggiero answered that it would probably be within the month. Supervisor Ruggiero replied that the Town has the fences until June. The Town will go out to bid for the roof, so the fences will stay up through that time. Since there were no further comments or questions, the discussion was then closed at 9:01 PM. VI. Resolutions RESOLUTION: 2007-80 Resolution Authorizing Refund of Unused Escrow for 146 New Hackensack Road for Retention Pond WHEREAS, on or about January 14th, 2005, Paul Wallace deposited Two Thousand Dollars and 00/100 ($2,000.00) with the Town of Wappinger for the property located at 146 New Hackensack Road for retention pond, and WHEREAS, Paul Wallace has requested a refund in the amount of Two Thousand Dollars and 00/100 ($2,000.00), and has been approved by George Kolb, Director of Code Enforcement in letter dated February 5th, 2007 to the Town of Wappinger Town Board. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. VII. New Business 1. Councilman Beale New Business Councilman Beale asked George Kolb, Director of Code Enforcement, about a building that was demolished on Route 9D, just north of Montclair Townhouses. There has been a dumpster at that location for approximately four months. Mr. Kolb replied that there is a valid demolition permit for that property. The permit is good for a year. There is also an application to build a home there. A meeting with Central Hudson will need to be set up to address issues. Councilman Beale then asked about Building 14 at Montclair. At the last meeting, the Board discussed this building and decided that the Attorney General's Office would be contacted. Councilman Beale gave a brief update on the condition of the building and commented that it is a disgrace. He asked if any citations have been issued. Mr. Kolb replied that he has met with a representative from DOS to discuss this issue. That representative has given some direction that Mr. Kolb will now need to go over with the Town Attorney, Al Roberts. The Town is doing as much as it possible can. Councilman Beale pointed out that this building was designated a collapse hazard and then encountered a collapse. Now it has had no roof for months. He asked how stable it is now. In the Councilman's opinion, the building is now less stable without the roof. Mr. Kolb explained that they have retained an engineer and he has been updating the Town. Supervisor Ruggiero asked Mr. Roberts if there was something that the Town could do concerning this building. Mr. Roberts answered that the Town could declare it hazardous and keep the public away from it. The Town could not mandate that it be reconstructed. Mr. Kolb stated that he would follow up to cordon off the building. 2. Councilman Bettina New Business Councilman Bettina asked George Kolb, director of Code Enforcement, to bring the Board up-to-date on the Whitegates Condominium complex. Mr. Kolb answered that there were pretty major structural problems in the basement areas. There was work done several years ago. There was also work done without the required building permits. Some of the corrective measures have been taken. The management of the complex has retained an engineer to look at the other buildings. Councilman Bettina then asked about the collapse at the American Lumber facility. Mr. Kolb explained that it is basically an old "shanty" that simply let loose due to the snow load on the roof. It is a minor storage shed that is going to be rebuilt. Councilman Bettina also asked about the Chelsea Ridge complex. All of the roofs in that complex are being worked on. All permits for that work have been obtained. The last point of new business for the Councilman pertained to his requests for reduced speed on Chelsea Road. He asked if any progress has been made. Supervisor Ruggiero replied that DPW has been contacted and it seems that they have done all that they are going to do. The DPW repeatedly states that the road meets the standards of the State. Councilman Bettina replied that he will contact Assemblyman Miller about the issue. 3. Councilwoman McCarthy New Business Councilwoman McCarthy asked for a status report on the Red Barn issue. Attorney to the Town, Al Roberts, recommended that the topic be discussed in Executive Session, due to the amount of litigation that is involved. Councilman Paoloni pointed out that this issue is within his Ward and he has not been receiving correspondence about it. He asked that he be copied in the future. Councilwoman McCarthy asked that Joe Kovalsky, Emergency Services Coordinator, be asked to make a year-to-year comparison in his next report. She would like to see how the service to the Town has been since the change in coverage. Councilman Beale recommended that the Board look at the coverage from a seasonal perspective. Supervisor Ruggiero New Business Supervisor Ruggiero pointed out that there were residents in the audience that were concerned with the AW Scrap license renewal. George Kolb, Director of Code Enforcement, brought the Board up-to-date about the application process. There have been a number of complaints from the residents surrounding the property. The company has been ticketed for illegal operations and is scheduled to appear in court. Discussion followed. Councilman Bettina asked if the owner has expanded recently. Mr. Kolb replied that it doesn't appear that they have expanded the area of use. The owner has been instructed by Central Hudson and the DEC to clean up the area. Councilman Bettina is worried about hazardous material, such as battery acid, making its way into the water supply. Supervisor Ruggiero stated that the Department of Health has agreed to test a well in the area. The Supervisor requested that six wells be tested. Mr. Kolb added that the DEC has been out at the site and has awarded the company a clean bill of health. Rena Dandrea, of 2 Country Club Lane, asked to comment on the topic. She assured the Board that the residents surrounding the scrap yard are a "very strong nucleus" of residents, and they will not allow this to go on for twelve years. Mrs. Dandrea proceeded to recap the history of violations that the owners have incurred. She also listed some of the residents' complaints regarding damage to their homes that was caused by activity at the site. Councilman Bettina asked if the Town could mandate that a fence be constructed around the property. Al Roberts, Attorney to the Town, replied that he will look into it. The resident stated that she will organize demonstrations, contact newspapers and sue everyone if need be. Supervisor Ruggiero explained the process that the Town needs to follow to address this situation. He added that there are limitations to the fines that the Town can give. Discussion followed. VIII.
