Resolution Authorizing Refund of Application Fee Paid in Connection with Change of
Occupancy and Operational Permits
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February
27,2012.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being
called, the following were present:

ABSENT:
The following Resolution was introduced by Councilman Beale and seconded by
Councilman Bettina.
WHEREAS, Gjerj Shala, owner of Shear Success (hereinafter the "Applicant"), paid an
application fee of$500.00 for a Change of Occupancy Permit; and
WHEREAS, the application fee for the Change of Occupancy Permit was only $250.00
resulting in an overpayment of $250.00; and
WHEREAS, the overpayment of $250.00 for the Change of Occupancy Permit fee was
to be applied to cover the Applicant's Operational Permit fee which would have been due in
August of this year; and
WHEREAS, by letter dated December 16,2011 to Hon. Barbara Gutzler, the Applicant
has advised the Town Board of his intention to close the business and not apply for the
Operational Permit, and requests the return of the overpayment in the amount of$250.00.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the overpayment in the amount of $250.00 to
be refunded to the Applicant.
The foregoing was put to a vote which resulted as follows:
