CLAUSEN, who moved its adoption, seconded by Mr. Holt, to -wit: BOND AND CAPITAL NOTE RESOLUTION DATED SEPTEMBER 26th, 1972. A RESOLUTION AUTHORIZING THE ACQUISITION OF REAL PROPERTY IN AND FOR THE TOWN OF WAPPINGER, DUTCHESS COUNT(, NEW YORK, FOR TOWN HALL PURPOSES AT A TOTAL ESTIMATED COST OF $300,000, CONSISTING OF A PARCEL OF LAND AND A BUILDING LOCATED THEREON, AND AUTHORIZING THE ISSUANCE OF $285,000 SERIAL BONDS AND $15,000 CAPITAL NOTES OF SAID TOWN TO PAY THE TOTAL COST THEREOF. BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess :County, New York, as follows: Section 1. The acquisition of the following real property is hereby authorized in and for the Town of Wappinger, Dutchess County, :New York, for Town Hall purposes: a) 23 acres of land located on Myers Corners Road, at a maximum estimated cost of $79,000; and b) A building located on such land, at a maximum estimated cost of $221,000. Section 2. The total estimated cost of the aforesaid specific objects or purposes is $300,000 and the plan for the financing thereof is as follows: a) By the issuance of $285,000 serial bonds hereby authorized to be issued pursuant to the Local Finance Law. Of such authorized bonds, $75,050 bonds shall be for the acquisi- tion of land described herein and $209,950 bonds shall be for the acquisition of the building described herein; and b) By the issuance of $15,000 capital notes of said Town hereby authorized to be issued therefor pursuant to the Local Finance Law. Such capital notes shall be sold at private sale and all further powers in connection with the details and the sale thereof are hereby delegated to the Supervisor in accordance with the Local Finance Law. Pursuant to Section 107.00 of the Local Finance Law, the proceeds from the sale of such capital notes will be provided prior to the issuance of the bonds herein authorized or bond anticipation notes. Said $15,000 capital notes shall constitute the down payment required by Section 107.00 of the Local Finance Law. Of such authorized capital notes, $3,950 shall be for the acquisition of the land described herein, and $11,050 capital notes shall be for the acquisition of the building described herein. Section 3. It is hereby determined that the period of prob- able usefulness of the land to be acquired pursuant to this resolu- tion is thirty years pursuant to subdivision 21 of paragraph a of SeCtiodilt40;of the Lodal Finance Law. It ,is laereby determined that the building authorized to be acquired pursuant to this reso- lution is of Class "An construction and that the period of probable usefulness' thereof is ;thirty years pursuant to subdivision II (a) of paragraph a of Section 11.00 of the Local-Final:1'de Law. it is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. 3 224 Section 4. The faith and credit of said Town of Wappinger, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such obligations as the same respect- ively become due and payable. An annual appropriation shall be made in each year sufficient to pay 'the principal of and interest on such obligations becoming due and payable in such years. There shall annually be levied on all the taxable real property of said Town a tax sufficient to pay the principal of and interest on such obligations as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of 'the serial bonds herein_author.ized, including renewals of such notes, is hereby delegated to the Supervisor the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds and capital notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2 The provisions of law which should be complied with at the date of publication of this resolution are not sub- stantially complied with, and an action, suit or pro- ceeding contesting -such validity -is commenced • within twenty days after the date of such publication, or Such obligations are authorized in violation of the provisions of'the Constitution. Section '7. :Upon this resolution taking effect, the same shall be published in full in the W&SD News, the official news- paper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Section 8. This resolution is adopted subject to the approval of the qualified voters of said Town voting .on•a proposition therefor to be submitted at the next special Town election to be on November 7th, 1972. The following resolution was offered by MR. HOLT who moved its adoption, seconded by Mr. Clausen, to wit: RESOLUTION DATED SEPTEMBER 26th, 1972 A RESOLUTION" CALLING A SPECIAL TOWN ELECTION OF THE TOWN OF WAPPINGER, DUTCHESSrCOUNTY; NEW YORK, AND PROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH. WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, duly adopted a bond and capital note resolution on September 26th, 1972, ,authorizing the issuance of $285,000.00 serial bonds and $15,000.00 capital notes, to pay the cost for the acquisition of 23 acres of land and a building for a Town Hall,", which resolution was made subject to a referendum; and WHEREAS, the Town Clerk has prepared and transmitted to said Town Board the form of the propostion for the approval of such resolution in accordance with Section 92 of the Town Law; and WHEREAS, it is now desired to call a special election of said Town for the submission of said proposition; NOW THEREFORE, BE IT ARESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. A special election of the qualified voters of the Town of Wappinger, Dutchess County,'New York, shall be held on the 7th day of November, 1972, for the purpose of voting upon the proposition referred to in the Section 2hereof. Voting shall be by machine and the polls at such election shall be kept open be- tween the hours of 6:00 o'clock A.M. and 9:00 o'clock P.M. Eastern Standard Time. The following described proposition shall be submitted for the approval of the qualified voters of said Town at the Special Town election to be held in said Town on the 7th day of November, 1972: 5 PROPOSITION Shall the bond and capital note resolution duly adopted by the Town Board of the Town of Wappinger, Dutchess County, New York, on September 26, 1972, authorizing the acquisition of real property in and for said Town for Town Hall purposes at a total estimated cost of $300,000, consisting of a parcel of land and a building located thereon; providing that the plan for the financing of such cost consists of the issuance of $285,000 serial'bonds (of which $75,050 shall be for the acquisition of land and $209,950 shall be for the acquisition of the building) and $15,000 capital notes (of which $3,950 shall: be_ for theuacquisi- tion of the land and $11,050 shall be for -the acquisition of the building) of said Town; authorizing the issuance of said bonds and notes; determining that the period of probable usefulness of each of the aforesaid objects or purposes is thirty years, and that the maximum maturity of said bonds will exceed five years; pledging •the faith and credit of said Town for the payment of said bonds and notes; providing for the issuance of bond anticipation notes; containing an estoppel clause, and providing for the publication of an estoppel notice:, be approved? The Town Clerk of said Town is hereby authorized and directed to give notice of said election by publication in W&SD News, the first publication of such notice to be made at least ten days prior to the time of such special election. In addition, the Town Clerk shall post or cause to be posted a copy of such notice on the Sign Board maintained pursuant to sub- division 6 of Section 30 of the Town Law at least ten days prior to such election.
