Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The Minutes of the January 3, 1972 Reorganizational Meeting, and the Regular Monthly Meeting of March 13, 1972, having been previously sent, to the Town Board members, were now placed before them for their approval. Mr. Saland requested several corrections in the minutes of the meet- ing of March 13th.. First, with reference to discussion of Royal Ridge, mention is made of storage tanks, the capacity of which should' read "50 to 60 thousand gallon tank." The second correction was in connection with Mr. Clausen's motion concerning the Town speed limit, he believed what Mr. Clausen had said was "where otherwise deemed necessary." MR. SALAND moved the Minutes of the January 3, 1972 Reorganizational Meeting as submitted by the Town Clerk be and they are hereby approved, and the Minutes of the .March 13; 1972 Regular Monthly Meeting, with the corrections as stated above, be and they are hereby approved. Seconded by Mr. Holt. Motion Unanimously Carried Reports for the month of March were received from the Building Inspector, Town Justices and Supervisor. MR. CLAUSEN moved the Building Inspector, Town Justices and Super- visor's reports for the month of March be accepted and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried Mrs. Alsdorf, Town Historian, under Reports of Officers, had several topics she wished to see cleared up. The first subject was cemeteries. She reported that Highway Superintendent Horton and his crew had helped clean up the Middlebush Cemetery to the point where it can be mowed. Mr. Horton has agreed to put up a fence around this cemetery, and the school shop has consented to make a sign. She spoke next about the Robinson -Lane Community Cemetery, stating that man hours were needed in order to put to rights this landmark (and asked for volunteers to sign up to help). Brush needs cutting and fallen head stones, have to be erected on new bases. Her next concern was regarding both the cemeteries on Montross-Montfort Pye Lane (Sleight) and the/Cemetery on the'Vorndran Property. It is her, understanding that there is a possibility of the Trailer Park (Roberts-Pye Lane) expanding, and development of Vorndran property; these could potentially endanger the burial grounds. She admonished the Board for procrastinating do her suggestions of doing something in these areas to preserve their dignity (adopt - regulations for the proper care of these burial grounds.) The second matter was regarding Town colors and a Town Emblem. She had discussed this with the Board in the past also, and had, at that time, recommended the colors be: oran§e, representing the Dutch, who were the first settlers (to be next to the -Mast); Blue, second, representing the U.S.A.; and Red last, representing the British who largely developed the county. She had suggested two emblems, the first, a circle divided in z diagonally, with one side depicting a waterfall, the other a farmer. The second emblem would be that which was designed by a prior Engineer, and hangs in the New County Office Building. The second is a man and woman standing on a rocky ledge over the falls. Mr. Diehl stated that he would like to see the Board act on Mrs. Alsdorf's recommendations for Town colors and emblem. He further recommended that the Engineer work with Mrs. Alsdorf in preparing an emblem to be adopted by the Town of Wappinger, to be done as soon as possible, in honor of the fine work Mrs. Alsdorf-has done as 3 97 Town Historian. - MR. HOLT moved that Mr. Lapar be instructed to work with Mrs. Alsdorf in preparing the emblem, composed of 'the farmer and water- fall, andmake preparations to adopt the Town colors, at the next regular meeting. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Holt, with respect to the cemetery on the Vorndran property - and the Roberts Trailer Park, recommended that the Planning Board be advised to ,be alerted to their existence, and related responsi- bilities, and to act accordingly. Bills presented for payment were as follows: General Fund $14,817.88 OKSD $969.08 F1tSD$468.61 Highway Fund 8,599.00 OKWD 802.81 F1tWD 153.44 RFSD 549.21 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Holt. Motion Unanimously Carried Residents from the Appleblossom Lane, Pine Ridge Drive area peti- tioned the Board to speak to them regarding the swampy condition of their properties. Mr. Gaetano DeSantis, Appleblossom Lane, addressed the Board first, stating that there was no drainage, no way for the water to go from their properties. It was a breeding ground for mosquitos. He understood that some time ago taxes were raised to drain this. There was some pipe laid to drain the water, which took the water from one spot, the rest is still all swamp. Since they live in a swamp they were asking the Board to do something about it, either lower the tax or drain the swamp. Mrs. Calomino, Appleblossom Lane, stated that her property was always full of water, can't even cut the grass. Mr. Charles Zichko, Appleblossom Lane, said it appeared these properties had a lot of springs, and it seems that the culverts at the intersection of Pine Ridge Drive and Locust View are blocked up, and the water won't drain out of this area. Mrs. E. V. K. Cunningham, All Angels Hill Road (opposite Apple- blossom Lane) stated that a while back some drainage had been put in on -Pine Ridge Drive and Appleblossom Lane, and a culvert was placed under All Angels, draining on to her property. She asked if more drainage was 'contemplated -to correct the problem, would they consider piping her property also. She has a problem now, and it would only be compounded if further drainage was installed. Mr. Peter Giangaspro, Pine Ridge Drive, said his property became flooded when drainage was installed. - Mr. Horton informed the Board that all these problems were on private property, that the Highway Department had no jurisdiction with respect to them. Mr. Rappleyea, when questioned by the Supervisor, indicated that, if it was claimed that a private lake, or parcel containing a lake or swamp, is causing hazards to its neighbors in perhaps the form either a breeding place for mosquitos, or other types of insects, or rodents would probably belong in the realm of the county Depart- ment of Health. This would be the first area to investigate as far as being a health hazard. There is no right in the Town to go in and simply tell someone they must drain an area. It must first be a public nuisance, or cause a public nuisance. MR. DIEHL moved that Dr. Link, Commissioner of the Dutchess County Department of Health, be directed to investigate the swamp area in Appleblossom Lane, Pine Ridge Drive in regard to a health hazard, with a copy of the petition and signatures presented at this meeting, and to report back to the Town Board at their next monthly meeting. Also, Mr. Petrovits, Commissioner of Dutchess County Highways, be requested to investigate the problem, regarding the drainage pipes going under All Angels Hill Road, and drainage on the Cunningham property. Seconded by Mr. Clausen. Motion Unanimously Carried Three applications were received for Hawkers and Peddlers Licenses - Harry Vail, Geraldine Messerich and George Not°. These licenses had been referred to the Dutchess County Sheriff's Office, and returned 5 - indicating no criminal record in file. MR. DIEHL Moved to approve the applications and grant Harry Vail, Geraldine Messerich and George Noto Licenses for Hawking and Pedd- ling in the Town of Wappinger. Seconded by Mr. Holt. Motion Unanimously Carried An Application was also received from Donna and John Kozlarek for a Hawking and Peddling License. MR. DIEHL moved that the application from Donna and JohnKozlarek be referred to -the Attorney to the Town to see that the proper application is filled out. Seconded by Mr. Jensen. Motion Unanimously Carried A Letter was•received from Mr. Petrovits with regard to an applica- tion submitted by the Town for restricted speed limits on roads in the Town. He indicated he would be glad to sign the application to forward to the New York State Department Transportation if it excluded the County Roads. MR. CLAUSEN moved to resubmit an application to the New York State Department of Transportation for a 35 MPH speed limit on all Town roads, excluding all County and State Roads within the Town. Seconded by Mr. Holt. .Motion Unanimously Carried A letter was received from H. J. Maurer, Chairman of the Recreation Commission requesting permission for Recreation Members to attend the 1972 New York State Recreation and Park Conference and Exhibits at Kerhonkson, April 30 to May 3, 1972. MR. JENSEN moved that permission be granted to the Recreation Members to attend the conference in Kerhonkson April 30 to May 3, 1972, and that their legitimate expenses be Town charges. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from Dorothy Alsdorf, Town Historian to attend the Hudson Valley Historian's Association Meeting in Kingston 99 1 on April 22, 1972. MR. CLAUSEN moved that Mrs. Alsdorf be granted permission to attend the meeting in Kingston, April 22, 1972, and that her legitimate expenses be a Town charge. Seconded by Mr. Holt. Motion Unanimously Carried A request for a parade permit was received from Brenda'Knight, Secretary of the Southern Dutchess Walk for Development. A walk for Development is scheduled for May 7, 1972, through the Town of Wappinger. ,(It was noted that the Town has no Ordinance requiring Parade Permits.) MR. DIEHL moved that Mrs. Snowden notify Brenda Knight, and the Dutchess County Sheriff's Office, with a copy of Miss Knights' request, that the Town of Wappinger has no objections; also request that the Sheriff take whatever action he deems necessary. Seconded by Mr. Holt. Motion Unanimously Carried A rezoning petition was received from Eugen Schuele requesting an LB zoning on a parcel presently zoned R-40 on Myers Corners Road, which is contiguous to his existing LB zoned property. MR. CLAUSEN moved Mr. Schuele's Petition be forwarded to the Town Planning Board and the Dutchess County Department of Planning, for their review and recommendation. Seconded by Mr. Holt. Motion Unanimously Carried The following recommendations was received from the Town of Wappinger Planning Board: March 29, 1972 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Gentlemen: Regarding the request of the S.F.R. for rezoning of their property from R-20 Wappinger Planning Board at its February mended that this request be denied. Development Corporation to RD -40, the Town of 28, 1972 meeting, recom- 7 1 o The Planning Board recommends that this request be denied on the basis that the rezoning would represent an increase in density not in keeping with the orderly growth of this area of the community. The Planning Board is presently considering amendments to the Zoning Ordinance to allow Planned Unit Developments and Cluster Zoning which might better suit the needs of the Town. This request for rezoning is recommended for disapproval without prejudice. The Planning Board mould like to suggest that the applicants resubmit their rezoning request at such time as the Town has adopted a plan of the type mentioned above. Seconded by Mr. Holt Motion Unanimously Carried March 28, 1972 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Gentlemen: Regarding the rezoning the request of Atlantic Richfield Company and/or Gladia Corporation, the_Town of WappingerPlanning Board at its March 20, 1972 meeting recommended that this request be denied. The Planning 'Board recommended that this request be denied on the basis that even with the rezoning there is still inadequate acreage to meet the. HB -1 requirements and, therefore, a variance would be necessary in order to make use of the land. Under these circumstances the Planning Board finds the rezoning to HB -1 to be an unsatisfactory solution to the problem. Sincerely :yours, s/ Betty -Ann Geoghegan Secretary Planning Bd. Mr. William -Boyd; .New ,Windsor,. New York, -an employde of Atlantic Richfield, asked to speak before the Board on this matter, and was recognized. He stated that Gladia Corp. was an independent financing Corporation for whom Atlantic Richfield acts as agent; Gladia-supplies capitol, ARCO handles properties. In the agreement with:Gladia, Atlantic Richfield agrees to buy from Gladia, any property_that-iis notneeded for service stations.. When the property in question was purchased, it was agreed that whatever property was not needed for the station, AR would buy, and would then try to resell.. The parcel was originally 1.2 acres lying partly in the Village. The Village portion being used for the service station, leaving the six tenths of an acre portion in the Town unused. They further believed this was a separate lot. When Route 9 was rezoned this area was designated HB2 which left this parcel below require- ments. AR now has a buyer for this piece of property who wants to develop it for used car sales. The Zoning Administrator and the Planning Board had told him he does not have a proper subdivision, so they have no rights. If it were recognized that it was a sub- division, then even under the HB2 according to the ordinance they would have a right to develop since the lot was purchased prior to the rezoning, and any lot that didn't meet the requirements could still be used. The Zoning Administrator suggested, since it was an illegal subdivision, however, to request a rezoning from HB2 to HB1 then resolve the variance that would be needed, subdivision and all the rest. Mr. Boyd asked, in conclusion, if they were being denied the use of the land, or was there some way they can get the use of it. Mr. Rappleyea indicated that the problem is, if it were built in todays standards the Service Station itself, whether they saw fit to only use a.small-portion of it, would be obliged to take and consider the entire parcel as a gas station site. The density requirements are such, that under todays standards you couldn't use such a small site and then try to sell the surplus for other purposes. He believed the Planning Board's thought was that what should be done first is a proper application be made for a subdivi- sion. If the Planning Board approved of that subdivision there.. might not be any problem. DIEHL moved that the Town Board concur in the recommendation from the Planning Board regarding the Lisofsky rezoning request, and order it placed on file. Seconded by Mr. Holt. Motion Unanimously Carried The following recommendation was received from the Town Planning Board: April 4, 1972 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Gentlemen: Regarding the rezoning request of Roy O. Guarino and Lawrence Pereira, the Town of Wappinger Planning Board recom- mended that this request be granted. The Planning Board recommended that this request be granted on the basis that the proposed use would be a definite improvement to the property. The Planning Boardalsofeels that this rezoning would be contiguous with the adjoining properties since many LB uses exist. Respectfully yours, s/ Betty -Ann Geoghegan, Secr. Planning Board MR. CLAUSEN moved that the Town Board concur with the Planning Board's recommendation, and direct the Attorney to the Town to prepare an Ordinance for Public Hearing. Seconded by Mr. Holt 4 Ayes 0 Nays Mr. Saland Abstain Mr. Eck had=requested to speak before the -Board with regard to sewer and water. He addressed the Board first about the -purchase of the water companies. Starting with Fleetwood, he commented there has been a history of water problems there, beginning in '64 and'65 with the Gailo's. In July and August their water becomes impossible,to use. Mr. Incoronato encouraged the Town to buy this system, knowing the wells were no good. The Town should have with- held $10,000 in case the wells went bad, so there would be some money to work with. He felt the Town is obligated, because of mistakes, to try to drill a well, it would only cost a few thou- sand dollars. He then mentioned that Schoonmaker had sole the RF Development, but retained the water. The Town could have bought these limes for about $300 a curb cock. He thought the Town should dive into purchasing the water plants fast. Going on, he thought he remembered Mid -Point Park signing over the water system for a dollar when the Town was ready to do something about municipal water, but couldn't find anything filed with regard to it. But regardless, he felt Mid -Point was in default on the Local Law #2, '67 since they had extended their lines since the law was put into effect, and again, this development could draw water off the Schuele system by extending the line in DeGarmo Hills Road by only a few thousand feet. He would like to see the Town decide what they want to do and move, the time for putting off is past. On the subject of sewers, Mr. Eck said people have asked when are the lines coming C in, and he is concerned about the delays because of litigation, L&A has no right, because the principals don't even live in the area, to hold the Town up=from going "ahead. 105 Herb Arndt, Oakwood Knolls, supported most of Mr. Eck's statements in regard to the -needs. for Town wide central sewerage especially in the area along Myers Corners Road. He feels the Town should move ahead in trying to incorporate the widespread sewer districts and plants to a single entity, so there can be a more efficient operation. Mr. Lafko refuted Mr. Eck's statements- regarding his ownership of property in the Wappinger Sewer. Improvement Area and the articles in the papers of Mr. Eck's. He then asked who gave Mr. Schuele the right to violate Local Law #2, '67 for the second time. Has Hill Top Water Works applied, and been granted, the right to.expand its water system for the second time" He intimated Hill Top has just drilled another well. Under Late Correspondence, Mrs. Snowden informed the Board that she had received the resignation of Dorothy Alsdorf_as Town Historian, as they are moving out of the area. April 6, 1972 Elaine •H.. Dear Mrs. Snowden: It is with mixed emotions that I herewith submit my resigna- tion as Historian for the Town of Wappinger. We_have :sold our_ property in Wappingers Falls and have purchased a home in Ballston Spa, Saratoga County.:,-We:shal•1 be leaving Wappingers Falls June first. I would hope to terminate my services as of May 30th. My years of service to the Town of Wappinger have been happy ones. This has been due in a,,large •measure to thewilling assist- ance and courteous treatment I have always received from all of the members of the Town Board and their Staffs. ,I'11 never forget any of you! He further stated that he felt she had done a wonderful job, far surpassing -any job done before, and voiced a personal regret to see the Alsdorf's Leave the area. Each of the Council'rnen• added their thanks for a job exceedingly well done, and their regrets at her leaving. Under Committee Reports, Mr. Diehl briefly outlined the progress of -the Sanitary Landfill. Milton Chazen Associates presented -a study to $120,000. It has 3 the Board of Governors. It encompasses spending' -about to correct the present problem, and any future problems. phases, first to correct the drainage: problem atthe top of the hill, second would be to block a bad leachate area, the third would be to completely seal off the entire creek from the Landfill. The Engineer's have been -authorized -to put out for bid these 3 phases. The Board of Health has indicated the Governor's have been moving quite quickly and satisfactorily on their recom- mendations, and they have seen improvements at the Landfill. A Public Hearing, having been duly held on April 7, 1972, -on the Application for Exemption from Local Law ##2, 1967, by MTS Corp, the matter was placed before the Board for their consideration. MR. DIEHL moved action be tabled on MTS Application. Seconded by Mr. Holt. Motion Unanimously Carried A Public Hearing having been duly held on April 7, 1972 on the Rezoning Application by Livio and Louisa Burgazzoli; Affidavits of Posting and Publication having been offered for the record at the time of the hearing; and recommendations received from the Town Planning Board and Dutchess County Department of Planning; the matter was placed before the Board for their consideration. The following Ordinance was introduce d by COUNCILMAN CLAUSEN who moved its adoption: BE IT RESOLVED by the Town Board of the Town of Wappinger, Dutchess County, New York, pursuant to the authority conferred by the laws of the State of New York as follows: l3 L L 107 Section 1: The Town of Wappinger Zoning Map adopted January 29, 1963, as amended from time to time is hereby further amended by rezoning the following parcel of land from HB -1 to RD -20: Premises of Livio and Louisa Burgazzoli, Lot 5.1, Block 3, Town of Wappinger Tax Map #68 Section 2: This ordinance shall take effect immediately upon adoption posting and publication as prescribed by Town Law. Seconded by: Mr. Jensen Roll Call Vote: 5 Ayes A Public Hearing having been duly held on April 7, 1972 on the Rezoning of a portion of property owned by Edwin Palmatier, and Affidavits of Posting and Publication having been offered for the record at the time of the hearing, the matter was placed before the Board for their consideration. The following Ordinance was introduced by COUNCILMAN CLAUS -EN who moved its adoption: BE IT RESOLVED by the Town Board of the Town of Wappinger, Dutchess County,New York, pursuant to the authority conferred by the laws of the State of New York as follows: Section 1: The Town of Wappinger Zoning Map adopted January 29, 1963, as amended from time to time is hereby further amended by rezoning the following parcel of land from HB -1 to R-40: Lot 46, Block- 1, Town of Wappinger Tax Map #63 Section 2: The Town of Wappinger Zoning Map adopted January 29, 1963, as amended from time to time is hereby further amended by rezoning the following parcel of land so that said parcel of land is hereafter zoned in its entirety HB -1. _r Lot 46, Block 1, Town of Wappinger Tax Map #60 Section:3: This Ordinance shall take effect immediately upon adoption, posting and publication as prescribed by Town Law. Seconded by: Councilman Holt Roll Call Vote: 5 Ayes A Public Hearing having been duly held on April 7, 1972, on the Amendment to Section 412.02 of the Town of Wappinger Zoning Ordinance, the matter was -placed before the Board for their consideration. MR. HOLT moved to table action until the next Town Board meeting, on the Amendment of Section 412.02 for more time to assess the scope of this particular amendment. 10$ 'Seconded by Mr. Saland. Motion, Unanimously Carried Mr. Saland commented that he would be very interested, particularly in light of the recent communication received from .the Planning Board, if it's possible, that this amendment be considered in conjunction with a study of a cluster zoning proposal, with this in mind, he would like the Board to request Mr. Rappleyea to make that consideration with the Planning Board. Mr. Clausen said he would favor this if it was in a separate resolution, but would not like to tie it in with the 412.02 amend- ment. Bids were advertized for a Ni Ton Pickup and a 4 wheel drive pick-up truck. Bids were received and opened at 2:00 P.M. April 7, 1972. Two bids were received, J&B Parsons, Inc. and McCallum Chevrolet, Inc. For the 4 wheel drive pickup, the bids were: McCallum ----$4,415.00 . Parsons,; ----$4, 693.70 The Highway Superintendent recommended the bid be awarded to Parsons since McCallum does not meet all of the specifications. For the 'Ton Pickup the bids were: McCallum ----$2,350.00 Parsons $2,345.00 The Highway Superintendent recommended the bid be awarded to Parsons since_ he is the low bidder. MR. CLAUSEN moved that the recommendation of the Highway Superin- tendent be accepted, and the bids for both the liTon Pickup and 4 wheel drive pickup be awarded to J&B Parsons, Inc., as low bidder on the 'ton, and as meeting the specifications on the 4 wheel drive. Seconded by Mr. Holt. Motion Unanimously Carried A letter had been received in February, 1972 from James Thomann, President of Edgehill Manor Inc. requesting final approval and release of the maintenance bond on Hill Top Drive, Namoth Road, Rock Road, and Magura Drive, as their years' maintenance period expires February 2, 1972. This matter was tabled at the February l5" meeting, and was again placed before the Board for their considera- tion. The Highway Superintendent recommended the_ maintenance -bond be released. MR. Motion Unanimously Carried Mr. Saland, directing the question to Mr. Rappleyea, referred to the question raised at last months meeting as to what to do with the "hole" on the corner of St. Nicholas Road and New Hackensack Road for which Mr. Alexander had a soil mining permit for. Has any action been taken, is there any action that can be taken at. this time? Mr. Rappleyea's response was that, as a result of the Board's request, he examined this file, there is a bond posted, the expiration date of which is June 1st.: He has notified Mr. Alex- ander in writing that the Town expects that the work will be completed by that date, if not, the .Town, will , take . action. He has been notified that he is»expected to complete it in accordance with his filed plans. Mr. Holt, under New Business, asked the Supervisora question about the unexpended balances at two points in time. One, as the Board approved the budget for. 1972, the figure at that time was shown to be $180,000-$179,000 in the budget, and in March some figures were submitted from the Supervisor's office wherein this unexpended balance was shown to be about $40,000 higher than that, a variance- of.around 22%. . What was the reason the Board wasn't given a more exact figure to work with in projecting the budget for 1972. It was unreasonable to assume this amount of money came pouring in unexpectedly between November and December 31st, and without having access to the records of the Supervisor's Office, 110 he.didn't see; where this'money had come from. If, on the other hand, the Board was made aware of all of the unexpended balances, then the tax rateifor the Town could have been lower than it was for 1972. He asked if Mr. Diehl could, at a subsequent meeting, give'the Board someguidance on that information. Mr. Diehl first reminded. Mr. Holt that, •:as a Councilman, he is able to inspect or check any of the records of the Town, not only can he, but it is his duty to do it, and secondly he would have a report ready for the next meeting. - Mr. Saland said he would like to place before the Board the consid- eration of the concept of -installment taxes. He has had several people contact him and correspondence also, concerning it. He would like to get the feeling of the Board on it, and perhaps even call a Public Hearing on it to get the feeling of the residents of the Town. He realizes there are some problems connected with iti but if the merits outweigh the problems, maybe the Town ought to go this way: Mr. Diehl agreed with Mr. Saland, and further commented that the Town Board haddiscussed this about four years ago and at that time, it didn't appear -to be a feasible way. He suggested checking with the Town -of Poughkeepsie . to see • :how it works, and look into it again. Mr. Saland said he would definitely like to see -the Board move in that direction, at least a thorough study of the concept, and see if it can be utilized in the Town. He said he would try to present something to the Board at the next Regular meeting. MR. HOLT moved .the meeting be -adjourned, seconded by Mr. Saland, and unanimously carried.
