2012-143 2012-143 Resolution Authorizing Change Order No.2 for Little League Challenger Field Project At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 9, 2012. The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers Barbara Gutzler William H. Beale Vincent F. Bettina Ismay Czarniecki Michael Kuzmicz ABSENT: The following Resolution was introduced by Councilman Beale and seconded by Councilman Kuzmicz. WHEREAS, by Resolution adopted by the Town Board on June 20, 2011, the Town Board awarded a bid to Sun Up Enterprises, Inc. in the amount of$198,300.00 for the construction and installation of a handicapped accessible baseball/softball field designed to meet handicap accessibility requirements which is to be known as the Challenger Field, located at the Robinson Lane Sports Complex; and WHEREAS, by Resolution adopted by the Town Board on August 22,2011, the Town Board approved Change Order No.1 to the aforementioned contract in the amount of $6,465.00, which resulted in a revised contract sum in the amount of $204,765.00; and WHEREAS, Greg W. Bolner, P.E. of Clark Patterson Lee Design Professionals, the Engineer for this project, has identified additional work necessary to make the Challenger Field compliant with handicapped accessibility requirements, and has recommended that the Town Board approve Change Order No.2 to the Contract in accordance with his letter dated April 9, 2012; and WHEREAS, the Town is committed to having the Challenger Field available for play for individuals with handicapping conditions this 2012 recreation season and particularly for Little League opening day, April 21, 2012; and WHEREAS, upon completion of the work authorized by the Change Order, the Challenger Field will meet handicap accessibility requirements. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby approves Change Order No.2 to the above mentioned Contract in the amount of$36,613.50 which Change Order will bring the revised Contract sum to the amount of$241,378.50 all as set forth in a letter dated April 9, 2012 from Greg W. BoIner, P.E. of Clark Lee Patterson Design Professionals to the Town Board, a copy of which is affixed hereto and made a part hereof. 3. The Town Board further directs that the funding for this Change Order shall be paid out of the Parkland Trust Fund. Little League Challenger Field Field Surface Dear Supervisor Outzler and Members of the Town Board: It has been brought to my attention that opening day of little league is April 21st. In an effort to have items addressed before opening day for which the contractor was put on notice in October of last year, Ralph Holt and I met with the contractor on April 2nd. At this meeting, it was discussed that the transition from the rubberized surface to the asphalt subsurface does not meet handicap accessibility requirements. To achieve this, the contractor would need to either caulk the edge or complete the surfacing not included in the original contract. It is our recommendation that the Town consider issuing a change order to complete the surfacing. This will make the field playable for the 2012 season. The surfacing is provided by a specialty contractor and having the same contractor provide the additional surfacing will result in consistency in quality and product warranty and cost savings to the Town. As specified in the bid documents, the contractor is responsible for addressing any soil settlement that has occurred along the edge of the surface prior to opening day. This results in a change order in the amount of $36,613.50, which includes a $600.00 credit, for a total contract amount of $241,378.50. With regard to full handicap accessibility, the 2012 grant is intended to be used to fund the necessary parking and field access which were not completed in 2011 due to lack of sufficient funds.
