Adjournment 1 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on January 10, 1972,.at the Town Hall, Mill Street, Wappingers Falls, New York-.' Supervisor Diehl called the meeting to order at 8:07 P.M, Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen.Saland,.Councilman Others Present: Allan E. Rappleyea, Attorney to the Town William P. Horton, Superintendent of Highways Reports for the month of December were received from the Building Inspector, Town Justices and Supervisor. MR. CLAUSEN moved the reports be accepted and placed on file. 1 Seconded by Mr. Holt. CLAUSEN moved the..bills be paid .subject, to audit. • Seconded by Mr. Jensen. , a Motion Unanimously Carried An application was received.from John A. Mauriello for a Hawkers. and Peddlers License. (Thi: application,.had been referred to'the Dutchess County Sheriff's Department, and returned indicating no criminal record on file.) MR. CLAUSEN moved to approve the application.and grant John A. Mauriello a Lidense for:Hawk.ing:and Peddling in the Town of Wappinger. Seconded by Mr. Holt. Motion Unanimously Carried 2 3 BA A letter was. received from (Mrs.) ~Edna V. Braucher, suggesting, some experts, in the field of recreation.. MR. DIEHL moved that Mrs. Braucher's letter be referred:to.Hugh_J. Maurer, Chairman of the Recreation. Commission for hia investigation, and further, a letter sent to Mrs. Braucher notifying her it has been turned over to the Recreation Commission. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from John Holler, Building Inspector, with regard to the Rockingham Farths Sewer Plant hookups. His concern was in the continuation of issuing building permits. Mr. Diehl commented that Vincent C. Kelley is making a survey and study of this situation, and the Board is awaiting his report. The Clerk was instructed to notify Mr. Holler as such and a letter to Mr. Kelley asking for an early reply. Mrs. Snowden informed the Board that she had received the resigna- tion from Thomas I. Graham as a member of the Zoning Board of Appeals, effective in 30 days (resignation to becoMt effective Jan. 20, 1972) MR. CLAUSEN moved that Mr. Graham's resignation_be received with thanks for the time and dedication he demonstrated as a member and chairman of the Zoning Board. He has distinguished the Town in that capacity over the years, and sincerely sorry to see him resign. Seconded by Mr. Jensen. Motion Unanimously Carried A letter was received from L. Richard Rosenberg, Vice President of Chelsea Ridge Apartments, Inc. ob7ecting onbehalf of himself and Sol Silver to' the proposed Town wide water improvement area. MR. HOLT moved Mr. Rosenberg's letter be received and filed. Seconded by Mr. Saland. Motion Unanimously Carried 3 A rezoning petition was received from Livio and Louisa Burgazzoli, Cooper Road, requesting approximately 21/2 acres of the northeasterly corner of Cooper Road and Old Route 9 be rezoned from HB -2 t� RD -20.' MR. HOLT moved that the rezoning petition of Mr. & Mrs. Burgazzoli be referred to the Dutchess County Planning Department and the Town Planning Board, for their review and recommendation. Seconded by Mr. Jensen. Motion Unanimously Carried A letter was'received from County Representative Robert L'Archevesque (addressed to Mrs. Freda Casner, Executive Director of the Dutchess County Youth Board) indicating that he would -like the Town Board to recommend an individual (from Wappinger) for the Youth Board. Along the same vein, a letter was received from Dr. Hannigan recommending Charles Prokes as a candidate for appointment by the Board to the County Youth Board. MR. DIEHL moved that this information and request be referred to Hugh J. Maurer, Chairman of the Recreation Commission asking the Recreation Commission for any recommendations they may have also for this position. Seconded by Mr. Jensen. - Motion Unanimously Carried Mr. Holt added thatrhe would like'to have Mr. Maurer enlighten the Board on the specifics of the County -Youth Board. The following letter was received: January 2, 1972 Supervisor Louis Diehl Town Board - Wappingers Falls, N.Y. Dear Lou, I believe that it is time for the Town of Wappinger to consider widening and grooming the shoulders of town roads so that they may be used for safe walking and bicycling. Other area town have already given this project some thought. 1 hope to introduce this idea on a county level in the near future. From what I can gather the cost will not be prohibitive. and the upkeep minimal. The benefits, of course, will be great. They include: 1. Recreational 2: Possible. reduced. school busing 3. Greater access to town and shopping areas by youngsters and other non -drivers. - There is a definite need here that can be satisfied at low cost. Would you and the rest of the Town Board please study this proposal, I would be happy to hear your collective opinion and to discuss the idea with you. Sincerely yours, s/ Dan Daniel J. Hannigan MR. Motion Unanimously Carried The following correspondence was received: November 9th, 1971 Planning Board Town of Wappinger Town Hall Wappingers Falls, N.Y. Re: Recreation Area, in Plats Gentlemen: Pursuant to the provisions of the Town Law the amount of property established for a park in eachsubdivision is to be determined by the Planning Board .In the_event there is not suitable land for recreation in the development, The Planning Board may establish a payment to be made to the Town in lieu of the establishment of a recreation area. Gentlemen: Regarding the attached letter from, Mr. Allan Rappleyea,_. Attorney to the Town, dated November 9, 1971, the Planning'Board has made the following recommendation with regard to establishing a payment to the Town for recreation land. - The Planning Board recommends that a payment of $100.00 an approved lot on the final subdivision plat be accepted in lieu of land. January 10, 1972 Town Board Town of Wappinger Wappingers Falls, N.Y. Attention: Mrs. Elaine H. Snowden, Town Clerk Gentlemen: The Town of Wappinger Recreation Commission respectfully requests that the Town Board give consideration to a recent recommendation made by the Commission to the Planning Board regarding dedication of recreation land as follows: 1. In cases where a land dedication is to;be made to the Town of Wappinger it be established that 10% of the final subdivision plat be given. •2. In cases where recreation is not available, the sum of one hundred dollars ($100) per approved lot on the final subdivision plat be paid in lieu of a land contribution. Very truly yours, s/ Hugh J. DIEHL moved to accept the Recreation Commissions and Planning Board's recommendations, but withdrew the motion after discussion that was provoked- from questions from the floor on the subject. MR. HOLT moved that this proposal be referred back to the Planning Board and Recreation Commission for clarification on the $100100 a lot: recommendation:— Seconded ecommendation:- Seconded by Mr. Saland. Motion Unanimously. Carried A memo was received from the Town Clerk regarding the sale of Lottery tickets. Under the new program the Town must take and be responsible for the sale of 200 tickets a week. Mrs. Snowden felt this would be impossible, and therefore recommended the Board 24 take approriate action to withdraw from selling Tickets tickets. MR. DIEHL moved that the Town Clerk be authorized to discontinue selling State Lottery tickets. Seconded by Mr. Holt. Motion Unanimously Carried The following petition was received: January 5, 1972 Town Board Town of Wappinger Town Hall Wappingers Falls, New York Gentlemen: I represent M.T.S. Contracting Corp. which has recently purchased approximately 25 acres of land from Stewart J. Reytolds located generally on the south side of Maloney Road, approximately 1650 feet east 'of, the_intersection of Maloney Road and Route 376. During the year 1971 the Town Board issued a permit to Mr. Reynolds and Mr. Harry Brooks for the purpose of extracting natural re- sources from the ground. On behalf of M.T.S. Contracting Corp. and Mr. Harry Brooks, I would like this letter to act as a request and an application for a permit for the year 1972 to extract natural resources from the ground. I understand that the necessary maps have already been delivered to the town. I have this day made application through Emery & Webb, Inc. 2 LaGrange Ave., Poughkeepsie, for a bond as required. If required, necessary or advisable for myself, a represen- tative of the corporation, or Mr. Brooks to attend a Town Board meeting, would you ]cindly notify me. Otherwise, would you kindly process this application and contact me in the event there is any additional informat'ion or forms that are necessary. Seconded by Mr. -Holt. Motion Unanimously Carried 2 -9 The Superintendent of Highways requested permission to bid for Highway Materials,supplies and a Backhoe. MR. CLAUSEN moved that permission be granted permission to bid for Highway supplies and materials, and also -the Backhoe. Seconded -by Mr. Jensen.,. Motion Unanimously Carried A rezoning petition was received from Thomas D. Mahar, Jr. represent- ing Charles D. Fitzgerald Sr. Mr. Fitzgerald requested a rezoning on 40 acres of a parcel of property,_ situated on; Widmer Road, from R-20 to RD -20. MR. HOLT moved the rezoning petition of Mr. Fitzgerald be referred to the Planning Board for their review and recommendatio Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Diehl reported that Mr. Horton's request for a hookup to the Village water supply to the Town Highway garage, and the possibility of installing a fire hydrant, has received favorable action from - the Village of Wappingers Falls Water Board, The Water Board will meet with Mr. Horton and. Mr. Lapar in regard to the hookup and placing of the hydrant. Mr. Diehl further reported on t1e commitment of a new well in the Royal Ridge Development, not having heard from John M. Reed, the Attorney, or the owners -of the development in quite some time Mr. Diehl entertained a motion to contacteither.one or the other. Mr. Saland, noted that he had conferred with Mr. Reed this past week regarding the situation. He had also spoken.to Jack -Hill, who advised him that Tri-Pac, at Poughkeepsie, has to make application to the Department of Environmental Conservation. There are no objections to the application anticipated, only a matter of time, and if Tri-Pac would only expedite this thing, the expanded water facilities can be taken-,care:of in short order. MR. DIHL moved a !letter ,be directed to Mr., John M. Reed _ind .cating the urgency of action there, and requesting a progress report to, date. Seconded by Mr.,Saland.. Motion Unanimously Carried Vacancies still remained on both the Planning Board and Zoning Board: -of Appeals. This matter was placed before the Board for consideration. _ MR._DIEHL moved that Howard Verb be appointed to the seven year: term on the Town of Wappinger Planning Board. Seconded by Mr. Clausen. CLAUSEN moved that Mr. Incoronato be appointed to serve the L five year term created by the expiration and resignation of Mr. Thomas I. Graham. Seconded by,Mr. Diehl. CLAUSEN proposed the following resolution: Resolved that Charles Cortellino be and he hereby is appointed to fill the vacancy on the Zoning Board of Appeals of the Town of Wappinger which has occurred by reason of the resignation of Richard Jacobson, and it is further Resolved, that the said Charles Cortellino be and he hereby is appointed to fill such vacancy for the remainder of the term which shall expire on February 1, 1973. Graham, and it is further Resolved, that the said Allen Cooke is hereby appointed to the said Town Zoning Board of Appeals for a term which shall expire on the 1st day of February 1977.
