1971-11-15 SPMA Special Meeting of the Town Board of the Town of Wappinger- was held on November 15, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York. Notice of this meeting was mailed to each Board member on November 12, 1971, meeting called for 5:30 P.M. Supervisor Diehl called the meeting to order at 6:01 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman Elaine H. Snowden, Town Clerk Absent: James Mills, Councilman Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The followingrequest was received: 14 Edgehill Drive Wappingers Falls, New York Town Boarcl Mill Street Wappingers Falls, New York 12590 Attention: Town,Supervisor's Office To Whom It May Concern: Per this letter, I am requesting -permission to be connected to the Rockingham sewer district. At the presenttime, my leach field is completely inoperative and no alternatives are available to me. Your prompt consideration to this problem is appreciated. Sincerely yours-, s/ Jesse R. Penn MR. FINNAN moved that permission be granted t� JesserR.,'Pehn and - _ Doris S. Penn to make -a sewer connectioh to the RthekinghaM Farms Sewer District at 14 Edgehill Drive, due to the extreme and urgent nature of their problem. This permission is granted to connect as a tenant to the Rockingham Farms Sewer District, subject to the following conditions: 1. The connection,is made at the expense of Mr. :Jesse R. Penn, and subject to.inspection by the Town Plumbing Inspector. 2. That the tap fee of $240.00 be paid prior to connection to the .sewer line. 3. That Mr. Penn agree to pay .the same sewer service charge as the district residents. 4. That Mr.& Mrs. Penn agree that they will become part of any sewer district or sewer improvement area formed in the future which would include their property under ordinary circumstances and they hereby waive any objections_to_the formation of such district or improvement area. This permission will be granted upon the Town's receipt of Mr. & Mrs. Penn's agreement to all of the conditions, as set forth above, by their signatures on the agreement,.which will -serve. as an acknow- ledgement of their acceptance. Seconded by Mr. Holt. 4 Ayes 0 Nays Rudolph,Lapar, having placed before the Board supplemental reports #1 & #2 entitled "Proposed Wappinger Sewer Improvement #1, Town of Wappinger, Dutchess County, Feasibility in Relationship to Other Proposed Sewer Districts in the same General Area", dated!October, 1971. The following Resolution was introduced by SUPERVISOR DIEHL who moved its - adoption. adoption. WHEREAS as the Town Board of the Town of Wappinger has approved of the Wappinger Sewer Improvement #1 pursuant to Article 12C of the _Town Law, _and WHEREAS an application has been made to the New.. York State Comptroller for his approval of said improvement area, and WHEREAS Rudolph E. kapar, Engineer to said improvement area has prepared additional material for the submission to the Comp- troller and has already forwarded a copy of said report to said Comptroller, NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Wappinger hereby approves of the supplemental reports, #1 and #2, of the Feasibility in ;Relationship to other Proposed Sewer Districts in the same general area, of Rudolph E. Lapar dated. October; 1971, a copy of which is attached hereto and made part hereof, and be it further L 1 3 819 RESOLVED that the Town Clerk is hereby authorized and directed to forward a certified copy of this resolution and a copy of the reports of Rudolph E. Lapar to the New York State Comptroller. DIEHL moved that Joseph D. Quinn, Attorney to the Oakwood Knolls Water & Sewer District and Rockingham Farms Sewer District, be notified that the Town Board requests an executive meeting with him regarding these districts within the next ten days, and for Mr. Quinn to advise the Board of a date for which this meeting could be accomplished. Seconded by: Mr. Finnan. 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN FINNAN who moved its adoption: BE IT RESOLVED by the Town Board of the Town of Wappinger that Louis D. Diehl, Supervisor, be and he is hereby authorized to execute for and in behalf of the Town of Wappinger, a public entity established under the laws of the State of New York, this application and to file it in the appropriate State Office for the purpose of obtaining certain Federal financial assistance under the Federal Disaster Act (Public Law 606, 91st Congress.) Seconded by: Mr. Clausen 4 Ayes 0 Nays A short discussion was held on the possibility of amending the present Dog Ordinance, and Mr. Rappleyea indicated that he would prepare an amendment for the Board to consider.
