Supervisor Diehl called the meeting to order at 8:15 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman. Elaine H. Snowden, Town Clerk Absent: James Mills, Councilman Others Present: - William Horton, Highway Superintendent Reports for the month of October were received frOm'the SUpervisor, Buildingl'-inspectOr and Town Justices. MR. FINNAN moved the Supervisor, Building Inspector and Town Justices reports be accepted and placed on tile. Batira had requested to speak before the Board regarding a dog kennel problem on Daisy Lane, in Quiet Acres. 'He first presented a petition, stating as follows: October 21, 1971 PETITION AND GRIEVANCE AGAINST Richard O. and Jewel L. Mendell, 18 Daisy Lane; Wappingers Falls; NY by the undersigned. We the undersigned wish to make known to the Town Board that we are against the establishment of a kennel in our neighborhood. Mr. Mendell has stated to the residents of Daisy Lane that he intends to use his premises for business purposes and has constructed kennel enclosures and facilities on his property. To our knowledge, he is currently housing four (4) dogs (three St. Bernards and one Collie) for breeding purposes on a strictly residential lot of 110' x 125': His property and that of his neighbors is zoned R-20, single family, residential only. We the undersigned feel that the activities of ,the Mendell' -s , ,both current and proposed, will lower property values and are becoming increasingly obnoxious and a nuis- ance to .the, neighborhood. We might note that since their arrival on Daisy Lane approximately two months ago with two dogs, we have found the barking steadily increasing and the, odor offensive, particularly during warm weather. We respectfully request the Wappingers Town Board to take this situation under advisement and initiate appropriate action to protect our neighborhood from deterioration and business usage. This petition contained 38 signatures of residents, of Daisy -Lane. Mr. Batira stated that Mr. Mendell has indicated to the residents in the area and also to the Zoning Administrator, that he intends to conduct a business in this residential area.. Mr. Diehl assured Mr. Batira that the Board was aware of the situation, and would keep it under surveillance,. Mr. :Batira further mentioned a shed at the-r,ear.. of Mr,., Mendell's property which he felt was in violation. The Board said they would look :into this, and asked the Clerk to inform the Zoning Administrator of this matter. Two applications were received from Carmelo and Pasquele Ruggiero for a Hawking and Peddling License. (The applications had been referred to the Dutchess Sheriff's Department, and returned indica- ting no criminal records on file.) Carmelo Ruggiero is also a veteran of the Korean War, and the holder of a Veterans License from Orange County. MR. CLAUSEN moved to approve the applications and grant Carmelo and Pasquele Ruggiero Licenses for Hawking and Peddling in the Town of Wappinger, and further, waive the ,fee for Carmelo Ruggiero. Wappinger- Gentlemen: A representative of this department inspected the constructed sewage pump station for the above referenced project. He also observed representatives of the Camo Corp. operating the raw sewage pumps and conducting pressure tests on the force main and infiltration tests on the manholes and gravity sewers. These inspections and observations indicated the following conclu- sions: 1) 2) 3 The installation of the basically complies with The raw sewage pumps in properly. sewage pump station the approved plans. the station function The results of the pressure tests and infiltration tests were found to be satisfactory. Singer P.E., relative to the effect of the Town of Wappinger Storm Sewer System on residents of Wildwood 2&2A Gentlemen: At your meeting. on October 12, 1971, it was requested that my office investigate, review and make recommendation on the above report in conjunction with William P. Horton, Supt. of Highways. I would be pleased to do the above, only I must insist that all exhibits.be returned to said Fredrick E. FINNAN moved the notification from the Dutchess County Depart- ment of Planning be received and placed on file. Seconded by Mr. Holt., 4 Ayes 0 Nays A request was received from Mr. Bryan Campbell for street lighting on Route 9D between Stoneykill Road and Old State Road intersection. MR. FINNAN moved that this request be referred to the Lighting Committee to investigate. Seconded by Mr. Diehl. 4 Ayes 0 Nays Mr. Clausen so noted that he had been in touch with the Campbell's regarding their request. It seems that this area is between and outside of both the Chelsea and Hughsonville Street Lighting Districts and he would discuss this on Wednesday following, when he meets with Mr. Crans, Central Hudson Representative. Requests were received from Joseph Gutmann and William Mihans to attend training sessions on improved treatment plant operations. Mr. Gutmann requested permission to attend the session in Albany December 1st & 2nd. Mr. Mihans requested permission to attend the session at State University. College at Buffalo, November 15th to the 18th. MR. FINNAN moved that permission be granted to both Mr. Gutmann and Mr. Mihans to attend training sessions and that their legiti- mate expenses be Town charges. Seconded by Mr. Clausen. 4 Ayes 0, Nays Mr. Clausen, with regard to committee reports, mentioned that Dr. Felix Scardapane had contacted the Supervisor's office on dangerous traffic conditions at the intersection of All Angels Hill Road and Old Hopewell Road. He spoke with the Doctor indicating he would be most happy to meet with the Doctor at either the County or State highway level. The Doctor understood and was acquiescent. Mr. Finnan commented it would probably have to come to pass that the 812 Town would have to install a traffic light on their own, the same as the Myers Corners, All Angels intersection. Mr. Clausen and Mr. Finnan agreed that after a meeting with Mr. Petm wits, the Board should take action if the County rejects the proposition of in- stalling a signal light at the Old Hopewell, All Angels inter- section. Mr. Clausen asked that Dr. Scardapane be informed that a report was made to the Board, and that he would be hearing from the Board shortly. The County Snow Removal Contract and Agreement was placed before the Board again. The Highway Superintendent recommended the Board accept the contract and agreement. The following Resolution was offered by COUNCILMAN FINNAN who moved its adoption: WHEREAS, the Town Superintendent of Highways has been re- quested to remove snow from County roads, and to sand or otherwise treat them for the purpose of removing the danger of ice and snow, by the Commissioner of Public Works of Dutchess County, in accord- ance with Article 6, Section 135-a of the Highway Law, now there= fore be it RESOLVED, that the Town Superintendent be and is herein authorized to perform such work as is'found necessary, at the hourly rate as fixed by the State Commissioner of Transportation for the renting and hiring of such equipment, for the Winter Season 1971-72. MR. FINNAN moved these appointments be tabled until the December Regular Meeting. Seconded by Mr. Holt. 4 Ayes 0 Nays 7 L L A Public Hearing having been held on October 26th on the Petition for the Extension of the Atlas Water area, the matter was placed before the Board for their consideration. MR. DIEHL moved the matter be tabled until the Board has received a decision from the New York State Department of Environmental Conservation on their hearing. Seconded by Mr. Finnan. 4 Ayes 0 Nays The following Resolution was offered by MR. CLAUSEN who moved its adoption: WHEREAS, all agreements with the Central Hudson Gas & Electric Corporation for lighting the streets and highways in the Cameli Lighting District, Town of Wappinger has been terminated on Nov. 30 '71 and, - WHEREAS, the Central Hudson Gas- & Electric Corporation has submitted a new agreement for lighting said streets and highways subsequent to that date, NOW, THEREFORE, BE IT RESOLVED that the new agreement dated December 1, 1971 as submitted by the Central Hudson Gas & Electric Corporation be and is hereby approved, and it is further RESOLVED that Supervisor Louis D. Diehl be and is hereby authorized to execute said agreement on behalf of the Town of Wappinger. Seconded by Mr. Finnan. 4 Ayes 0 Nays The Chair recognized Arthur Weit, Chairman of the Village of Wappingers Falls Centennial Committee. Mr. Weit presented the Board with a plaque, and also a certificate making the Board honorary citizens for the next 100 years for their cooperation in the Centennial. The following Resolution was offered by MR. HOLT who moved its adoption: WHEREAS, Section 1263-b of the Public Health of New York State and various •Federal laws provide financial aid for the construction of sewage treatment works; and, WHEREAS, the Town of Wappinger, herein called the Applicant, has final engineering plans for sewage treatment works generally described as WPC -NY -340, whichr.plans have been prepared and approved in accordance with Article 12 of the New York State Public Health Law, and intends to proceed with the construction of such works; now THEREFORE BE IT RESOLVED by the Town of Wappinger Town Board, the governing body of said Applicant, as follows: 1. That Louis D. Diehl be authorized to make application for State construction aid and provide the State of New York 313 14 such information, date and documents pertaining to the application for a grant as may be required, and otherwise act as the authorized representative of the Applicant in connection with said application; 2. That the Applicant agrees that if a Federal grant or grants and State assistance for the sewage treatment works are made pur- suant to the Federal Water Pollution Control Act, as amended (33 U.S.C. 446 et seq.), or any other Federal law or program, and Section 1263-b of the New York State Public Health Law, the Town of Wappinger will pay the remaining costs of the approved construction, 3. That all statements, data and supporting documents made or submitted by the Applicant in connection with any application for Federal assistance for the proposed construction are to be deemed a.part .of the application for State assistance, 4. That the Applicant agrees to comply with the assurances specified in Section.44.17 of the Administrative Rules and Regula- tions of the State Department of Health (10 NYCRR 44.17); 5. That five (5) certified copies of this resolution be prepared to accompany an application for State aid for the construc- tion of,sewage treatment works. Seconded by Mr. Clausen. 4 Ayes 0 Nays The following Resolution was offered by MR.. CLAUSEN who. moved its adoption: WHEREAS, Section 1263-b of the Public Health Law of the State of New York and various Federal laws provide financial aid for the construction of sewage treatment works; and WHEREAS, the Town of Wappinger, hereinafter called the Applicant, has made application for State Aid for Construction of Sewage Treatment Works, State Water Pollution Control Project Number WPC -NY -340, and WHEREAS, it is necessary that a Contract by and between. the People of the State of New York, hereinafter referred to as the State, for. such State Aid be executed on behalf of the Town of Wappinger, now THEREFORE BE IT RESOLVED BY the Town Board, the governing body of said Applicant, as follows: 1. That Louis D. Diehl, Supervisor, be hereby authorized to sign, on behalf of the Applicant, State Contract WPC -EPC -340, providing for payment by the State of a portion of the cost of construction of Sewage Treatment Works; and 2. That Louis D. Diehl, Supervisor be designated as the Fiscal Officer of said Applicant to receive and distribute funds as the authorized Fiscal Officer of the Applicant in connection with said Project; and 3. That Five (5) Certified Copies of this Resolution be prepared and sent to the New York State Department of Environ- mental Conservation, Albany, New York, together with the signed State Contract ;and 4. That this Resolution shall take effect immediately. Seconded by Mr. Holt. 4 Ayes 0 Nays 815 Supervisor Diehl directed that the appointment to. the Planning Board be tabled until the December Regular Meeting, similarly the other vacancies on other committees. The matter of appointing Betty -Ann Geoghegan as Secretary to the Planning Board and Zoning Board of Appeals on a permanent basis, and establishing her salary on the amount allowed in the budget for this position, was placed before the Board. MR. FINNAN moved that Betty -Ann Geoghegan be appointed as a full- time Secretary to the Planning Board and Zoning Board of Appeals, her salary to be established based on her current monetary compen- sation. Seconded by Mr. Clausen. 4 Ayes 0 Nays Under Unfinished Business, the Chair recognized Malcolm Cornell. Mr. Cornell first commented that he believed Mr. F. Singer's seal and signature appeared on his xeport. He felt that with a few days notice Mr. Singer could come down to the Town, or he could personally have Mr. Singer sign it. The Chair recognized Mr. Eck, who asked about the road problem in Angelbrook Development, what has happened, it is his understanding that the principles have sold the Development. Charles Cortellino asked if the Board would support a citizens committee to review sewer problems in their own districts, in order to keep abreast of what the situations are. Mr. Clausen indicated that any group can choose their own representatives to meet at any time with the Board to discuss problems or receive information. Mr. Cortellino felt a Board appointed committee would be more effective. Mr. Cornell suggested two residents from each sewer and water district to serve as a committee, in this way they could pool their resources, and serve the people more efficiently. MR. CLAUSEN moved that two residnets from each water and or sewer district be empowered by the Town Board to act as liaison between the Town and the residents to receive any information that the Town Board may have or any actions pending, and further recommended that 16 a letter be sent out to the Presidents of the. Associations asking them to , o rwa rd two names to the Town Board. Seconded by Mr. Finnan. 4 Ayes 0 Nays Mr. Eck spoke again about the Town getting into the water business, forming a district encompassing the Hilltop, Rochingham and Orchard Homes. He would like to get the Board to get the people who own these water plants together to see if something can't be worked out, and get going on it. Mr. Diehl informed Mr. Eck that Mr. Lapar has already distributed to the Board members a preliminary report of a Town wide water district. Mr. Lapar hopes to have it final- ized before the next meeting. Under New Business the Chair recognized Mr. Bisom, who wished to discuss the County Representatives. He feels they owe the Town Board an obligation, indicating that there hasn't been any communication for several years between the Town and County, at this level. A comprehensive report should be given every month, they owe it to the residents to let them know what is going on in the County Board. There are four County Representatives, they should alternate each month. He suggested the Town Board make a resolution requesting monthly reports. MR. DIEHL moved that a letter be sent to the four Wappinger County Representatives recommending that one or more appear at the monthly Town Board meetings, giving the Town an idea of what is going on at County level that involves the Town of Wappinger. Seconded by Mr. Clausen. 4 Ayes 0 Nays Mr. Holt also suggested that any communications received by the Town from any County office or Department should be forwarded to the County Representatives also, to keep them informed of what is transpiring on the Town level.
