A Special Meeting of the Town Board of the Town of Wappinger was
held on Wednesday, September 15, 1971, at the Town Hall, Mill Street
Wappingers Falls, County of Dutchess, New York.
Supervisor Diehl opened the meeting at 7:15 P.M.
Present:

Others Present:
Allan Rappleyea, Attorney to the Town
Rudolph Lapar, Engineer to the Town
William Horton, Superintendent of,Highways
George DiGiacomo submitted a list'of work to be done' on Angelbrook
roads, and had circled 5 or.6 of the items that the residents felt
to be of an emergency nature.
Mr. Horton reviewed the list and told the residents what could be
done immediately.
Mr. Rappleyea advised the Board that even though there were only
ntWo members of the Board present, Mr. Horton, as Highway Superinten-
dent, did have the authority to act as it constituted an emergency.
Mr. Diehl stated that he and Mr. Finnan were behind Mr. Horton 100%;
the Highway Superintendent would definitely take care of the circled
items on the list-prepented by Mr. DiGiacomo, President of the
Angelbrook Civic Association; and would endeavor to take care of
more items on the list.
Ben Brenneman, 24 Alpert Drive, did not think that filling in holes
in the road would help, because of the improper drainage.
Mr. Rappleyea asked if the pipe that was installed was. in accord-
ance with the subdivision plan. He explained to the residents that
all the drainage systems in the Town were not designed to take a
continual flow of 8" of rain. There could be conditions of rain
that would be considered "acts of God."
Robert Dotterer, Alpert Drive, asked what the amount of the bond
actually was - $105,000 or $44,000. Had it been reduced?
Mr. Rappleyea had had conversations with the bonding company regarding
this, and they took the position that the $44,000 bond was the one
in effect.
Angelo Limardo, Sylvia Drive, questioned how the work done by the
Town Highway Department would affect the bonding company, in terms
of money. Would they reimburse the Town?
Mr. Flood, Alpert Drive wondered if the work done by; the Highway
Department would be billed to Mr. Alpert.
Mr. Stanley, Alpert Drive had a problem because the road needed
filling in -- "if the road was filled in, he wouldn't have a problem."
Charles Dose, 35 Tor Road -- the water is running across the road
into his property, because of the grading of the road.
More discussion followed between the residents of Angelbrook,
the Town Board, the Attorney and the Engineer, on their individual
problems and possible immediate solutions to them, until the Town
could get some satisfaction from either the developer or the bonding
company.
Mr. Diehl explained to the residents that the opinion of the Attorney
to the Tdwn,,and the 'Engineer to the Town, was that even though some
of these problems were of an emergency nature, the Town does not
have the authority to go into the development and make permanent
repairs. The Highway Superintendent will do -the emergency repairs
and the Town would continue with their litigation with the bonding
company.
Mr. Diehl asked if any of the residents had pictures of the condi-
.tions of the roads in the development to turn them over to the Town
Clerk, with the name of the person who took the picture and the
location of the picutre.

Some of the residents desired to discuss further details with Mr.
Horton regarding the more serious problems they felt they had, and
the length of time they were putting up with it, because of promises
from Mr. Alpert. These particular problems were constant, had
nothing to do with flash floods. Mr. Horton arranged to meet with
them after the meeting for discussion.
Mr. Diehl asked Mr. Horton to officially declare an emergency.
Mr. Horton, Highway Superintendent of the Town of Wappinger officially
declared an emergency in the Angelbrook development in regard to
roads and drainage.
MR. FINNAN moved to adjourn the meeting, seconded by Mr. Diehl.
The meeting adjourned at 8:10 P.M.
