1971-08-16 SPM245 A Special Meeting of the Town Board of the Town of Wappinger was held on Monday, August 16, 1971, at the Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 7:35 P.M. Present: Louis Diehl, Supervisor G. Donald Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Absent: Louis Clausen, Councilman Others Present: Allan Rappleyea, Attorney to the Town Mr. Diehl explained that the purpose of calling this meeting was to establish further facts in regard to the rates on the sewer district in the L&A Filtration Corp. He then asked Mr. Rappleyea to enlighten the public on what has been going on in this matter. Mr. Rappleyea had been at a hearing in front, f Judge Slitkin in the Supreme Court in the matter between the Town of Wappinger and the L&A Filtration Corp. and their proposed increase in sewer rates. The purpose of the hearing was to determine whether or not a temporary injunction should be granted, pending a further determination by the Town Board. He revealed that Mr. Lafko's attorney, Mr. Rubin had suggested the opportunity of the Town establishing an interim rate for the district, pending a further hearing. A rate of $120.00 as of January 1, 1971, had been suggested by the Attorney, which would be a flat rate without any gallonage or minimum gallons. MR. MILLS moved that the present minimum rate should continue for the Wildwood residents that was set forth in the resolution back in 1965, and the Town should proceed with the hearing in Court.
