The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held August 9, 1971, at the Town Hall, 'Mill Street,
Wappingers Falls, New York.

The Minutes. of the Regular Meeting of July 12, 1971, and Special
Meeting of.July .21, 1971, having been previously sent to the Town
Board members, were now placed before them for their approval.

Mr. Diehl informecL the residents present that item 5H on the Agenda

would be placed as first orderof business under Petitions and
Communications.due to the number of interested people present,'
regarding the Angelbrook Development. Mr: Diehl stated that the
Board has beQn an -contact with. -Mrs Lapar and Mr. Horton and they've
all been trying to set a deadline to have the roads completed. The
Board has just spoken with Mr. Alpert and given him until September
15, 1971 to complete all work that is not completed, -subject to the
approval of Mr. Horton, Highway Superintendent.
Mr. Cushner asked about the responsibility of snow plowing.
Mr. Horton said the roads would be taken over as soon as they meet
the Town Specifications and all the work done. !They will then be
the responsibility of the Town.

Mr. DiGiacomo said they would like to request the BoardAto set a
special meeting .near the end of August to see if the work is progres-
sing at a satisfactory, pace and discuss what action can be taken if
work IlAs not :been started.:.
Mr. ,Diehl answered that, if, on September 15, 1971, the work is
not completed, the Board will then go into proceedures to pull the
Bond - take legal action.
Mr. Lozito brought up the drainage problems he had.ohserved, catch
basins generally higher than the road and not in the path of the
water flow, and -some are filledwith dirt. He indicated also that
some of the drainage is being caused by erosion from three vacant
lots (34, 36_ & '38 Alpert iDrive.) Mr.::Finnan 'remarked' that Mr. Lapar
is aware of it :and had pictures of this last drainage problem.
Mr. McCarthy asked that if by some Chance the road bond had to be
pulled, would the Town give the residents some assurance that they
would get Town services through the winter. Mr. Diehl stated that
if legal Action was taken, the Alperts would be responsible for
providing. this maintenance. Several other residents of Angelbrook
Development questioned if there was .information awailable•as to what
was left to be done on the roads before the Highway Superintendent
would recommend•they be taken over by the Town; if, in fact, the
Board would institute legal action on the Performance Bond if the

Developer does not have the roads completed by September 15th, 1971;
and several others pointed out drainage and road problems which the
Engineer to the Town agreed to check into.
Mr. DiGiacomo questioned when Mr. Alpert was going to turn over the
water lines to Schoonmaker. Mr. Alpert estimated that all this
would be completed no later than the first of September. This ended
the discussion on the Angelbrook Development.
An Application for a Hawking and Peddling License had been received
from Wallace Van Benschoten. (This application had been referred
to the Dutchess County Sheriff's Office, and an answer received from
them.)
MR. FINNAN moved to approve the application and grant Wallace
Van Benschoten a license for Hawking & Peddling in the Town of
Wappinger.
Seconded by Mr. Mills.

An application was received from John Vorndran for a permit to
excavate fill and gravel from his property on Brown Road.
MR. FINNAN moved that John Vorndran be granted a permit to mine soil
and gravel from his property on Brown Road, subject to the condition
that a suitable map be submitted and approved by the Engineer to the
Town and the Acting Zoning Administrator.
Seconded by Mr. Holt.
Motion Unanimously Carried
Town Justice William Bulger requested permission to attend the State
Magistrates' Association Annual Meeting, September 12th through the
15th, at Ellenville, New York.
MR. MILLS moved that permission be granted William Bulger to attend
the State Magistrates Association Meeting, and his legitimate expenses,
being a legal Town charge, be paid.
Seconded by Mr. Holt.

The Town Clerk informed the Board that she had been served on
July 29, 1971, with Tax Reviews from Wappingers Apartments Company;
Wappingers Apartments 2nd Company; and Albert Foreman (Nominee for
Dutchess Associates Company.)
MR. MILLS moved that Joseph D. Quinn, Jr. Attorney, continue as the
appointed attorney for these Tax Reviews to answer and defend on
behalf of the Town of Wappinger.

over to the Attorney to the Town, Engineer -to the Town and Highway
Superintendent, with a copy of letter to the Oakwood Civic Associa-
tion asking them if they have any thoughts on this subject.

Mr. Lucian Kasprzak had requested to speak before the Board in
connection with drainage problems in Wildwood II. He read the
following letter:

We are deeply concerned about the water problem in our back-
yard. The water problem is due to the backing up of storm drains
in the area. This backing up of the storm drains causes flooding
in the area bordered by Split Tree Dr., Widmer Rd., and Malstorme
Rd. This problem has existed for quite some time. The severity
of the problem has increased of late and quite conceivably could
be linked with the installation of storm drains in Wildwood Forest
Sec. I. The connection of Wildwood Forest Sec. I to the existing
storm drain system further taxes those storm drains, which previous-
ly barely drained surface water. It is therefore our feeling that
the existing_'storm drains are inadequate. As evidence for this,
I site the fact that water gushes out of the storm drain at the
back of my lot, when it rains. The drain is located in a low spot
for effectiveness. However when the drain acts as the source of
water to the area, it prevents drainage and causes -a water problem
(flooding.) This flooding depreciates the value of our property
and the value of the entire development. Since the water rises
so high we are concerned that water damage may occur to our home
in the future. We would like the Town Board to look very closely
into this matter and to do whatever they must to remedy the situa-
tion.

Malcolm Cornell, President of Malcolm Cornell, Inc. asked for an
opportunity to answer Mr. Kasprzak. He first asked Mr. Kasprzak
when the picture was taken (taken Saturday, July 31st, 19-71, was
the response.) Mr. Cornell continued, that yes, there was a
drainage problem in Wildwood Forest, after the installation of
s'dtrm drainage in Widmer Road. He contended the fiasco, as he
saw it, on Widmer Road, he has never seen before. He admitted
there were heavy rains, there was a problem, as Mr. Kasprzak pointed
out, and he did have a problem in 1967 with the storm drainage (at
that time it was_due to crushed pipes which he corrected.) He
further_contended that what made the water back up so badly was the
storm drainage Mr. Lapar designed and concluded by elaborating on
what he considered erroneous in the construction.
Mr. Philip Taylor, Malstorm Road stated that, unfortunately, this
water problem has been there for quite a number of years when he
bought from Mr. Cornell in 1968 he noticed that there was quite a lot
of wet ground in back of this property. Mr. Cornell had, at that
time, told him there would be a little storm drain put in and there
would be no problem. A year later, in another discussion (where
Mrs. Cronin was present) Mr. Cornell didn't seem to recall making
such a statement. The fact remains, the problem was there prior
to the installation of the Town drainage.
Mr. Lafko had requested to speak before the Board relative to fire
protection and expanded service ( the expansion of Atlas Water Co.)
He asked the Board where his petition stood in connection with this.
Mr. Diehl said that nothing had been done.
MR. FINNAN moved that Mr. Lafko's petition for an extension of the
Atlas Water Co. area be turned over to the Attorney to the Town, Mr.
Rappleyea, and, to the Engineer to the Town, Mr. Lapar.

Mr. Lafko objected to the Board turning this over to Mr. Lapar, stating

that, previous to filing his application he had requested that
another engineer be considered, and has the Board considered that
request?
Mr. Diehl answered that he didn't believe the Board was to the
point of even considering another engineer until the Board finds
out what the report is from the Town's Engineer and Attorney.
Mr. Malcolm Cornell had requested to speak before the Board on his
Sewer Benefit Area #1 proposal. He first mentioned the filing of
a petition for a hearing on the Adler -Brenner Sewer Plan. He then
asked if the Board had considered having a hearing, or if the Board
would entertain a resolution for a Public Hearing. Mr. Diehl said
he wouldn't himself and Mr. Mills added that in order to do so, the
Board would have to rescind the other two. Mr. Rappleyea indicated
the Board "may" hold one, but he would discuss it with Mr. Berns
of Audit and Control and report to the Board. He added that it
would be in direct conflict with action the Board has already taken.
Mr. Cornell then asked if any action had been taken on the petition
that had been submitted at last months meeting regarding the roads
in Section II and IIA Wildwood Forest (for the Town to accept them.)
He asked if the Board, at this time, would entertain a motion to
accept them as petitioned by 91% of the residents of the area.
Mr. Mills requested a 10 minute recess.
Supervisor Diehl called a recess at 9:02 P.M.
Supervisor Diehl called the meeting back to order at 9:15 P.M.
(All Board tembers present except Mr. Clausen)
Mr. Mills stated that, according to information received from the
Attorney, referring to the roads in Wildwood 2 & 2A, the matter is
still in litigation, will be brought up and decided in court. There-
fore, the Board feels, at this time, they want it to go through the
legal action.
Mr. Cornell, referring back to his sewer benefit area ##1, petition,
commented it was his understanding that before Audit & Control can

act on the proposed Wildwood Sewer District, they must have a
rejection, in writing, of his petition. He contended tht the Town
Board must act on the sewer petition and must deny it or have a
Public Hearing on it.
Mr. Rappleyea read the section from Town Law (Section 209q, subd. 10)
relating to Mr. Cornell's contention, pointing out the usage of the
work "may", indicating there was no manditory language in the
section. There is presently before Audit & Control an application
(which includes some of Mr. Cornell's proposed distirct) and it
would be contrary to the prior action of the Board, until the
decision is made on the prior application, to consider another
application which is contrary to the present matter before Audit
and Control.
Mr. Eck, having asked to speak before the Board, in connection with
the Atlas Water and Cornell sewer district petitions, stated first
that Atlas has two partners, F. Lafko and D. Alexander. He hasn't
seen Mr. Alexander's name on the petition Mr. Lafko presented. He
compared Atlas to a cancer and if the said Atlas Area was expanded
it would only make the cancer larger. He believed the only way to
do this is for Lafko to give his plant up for $500 a curb -cock and
then the Town can do what Mr. Lafko now wants to do. Mr. Eck then
expressed his views on the ownership of the sewer and water lines,
by pointing out that when a homeowner bought he paid for the lines
in the purchase price of the house, and concluded by questioning
the validity of Mr. Cornell's intents by obtaining signatures for
his petition from Orchard Home residents and the underlying motives.
A letter was received from General Service Administration in regard
to the Castle Point property that the Town is interested in purchas-
ing. It indicated there should be cooperation with the Town of
Fishkill and the County of Dutchess since they also have shown interest

in the property. Mr. Diehl directed the letter be turned over to
the Attorney to the Town. It is his belief that the property is in
the Town of Wappinger and then the Town might have first preference,

and if so he feels Wappinger should try to_hold on to it.
Mr. Mills agreed, but felt Mr. Heissenbuttel and Mr. Mueller should
be contacted.
The following letter was received, accompanying an application for
Salvage Dealer's License for Sid Shapiro:

Mid -Hudson Auto Wreckers, Inc
Dear Mrs. Snowden:
I am enclosing an application for "Salvage Dealers License"
in behalf of Mid -Hudson Auto Wreckers, Inc., for the premises on
Route 9D, Wappingers Falls, New York. (This is not the site
upon which is situated Mr. Shapiro's home.) Together with the
application, I am enclosing a check:for $25 and a map showing
the area to which this application applies.
You will note that I have placed asterisks after question
number 9 so that I may amplify on this. Technically, I believe
the answer is none, but so that there be no question on any
concealment I bring to your attention the fact that Mr. Shapiro
pled guilty on or about July 12, 1967, of "attempted criminally
concealing and withholding stolen or wrongfully acquired property."
Mr. Shapiro served a_term in the Dutchess County Jail.
I understand that prior to .this date, Mr. Shapiro and/or
the corporation had been issued these licenses.
I also would like to bring to your attention the fact that
the real property owned by Mr. Shapiro personally and which is
designated on your Town Map as Map 82, Block 1, Lot 22, is not
_intended to be'used as a junk yard, and therefore, no application
is made for a license. At the present time, this area has on it
a body shop and this is the only purpose for which Mr. Shapiro
is desirous of using this property.
I do not know whether this type of business requires a
license and I do not see any reference in the zoning ordinance
to a body shop, per se. If I have missed this and it does require
a license, I should like to be given the opportunity -to apply for
a body repair license. If there is such a form available, it
would be greatly appreciated if you would send it to me.
If there are other questions which may arise and which I am
capable of answering, I shall be only too happy to do so upon
request.

A letter was received from:Stanley Steingut, Minority Leader of
the NYS Assembly, with reference to a bill dealing with service
charges on tax-exempt property and further recommending appropriate
enabling legislation to make the Town eligible for these additional
state funds, and large opposition to repeal this section.
MR. MILLS moved this letter be turned over to Mr. Logan, Assessor,
to take whatever action is necessary.

Memo to: Town Board
From: Joseph W. Gutmann
Subject: Work Needed at Rockingham Sewage Treatment Plant
Date: August 9, 1971
The following is a list of small but important work that
should have been completed on original installation. I have
already discussed this with Mr. Vincent Kelley.
1. Two or three110volt weatherproof electric outlets where
convenient at treatment tanks so that tools, pumps and
chlorinating equipment etc. can be used.
2. Exhaust fan for blower and equipment room to get rid of
heat generated. This room gets so hot in summertime,
overload protection throws out because of room temperature.
3. Exhaust fan, for basement for protection against accumulation
of chlorine gas. This fan was shown on original plans
but never installed.
4.. Valve on sludge return line should be moved to allocation
where it does not keep about 20 feet of piping full of
water. This pipe is exposed to the weather and would
freeze and split. This was not necessary while we were
running plant as extended air but now that plant is being
run on contact stabilization, it is urgent that this be
done before freezing weather.
5. Check overflow openings between tanks. These seem -to be
way off and I have had to block them up with wood to keep
the different tanks from just sloshing from one to the other.

6. Install floor drain for basement to prevent basement from
filling with water from flooded lines in spring and drowning
the lift pump motors. We had one sad experience with this
situation already.
7. We have an opportunity right now to install a good working
water system. The contractor installing the new tanks has
had to install what could be a well, to try to pump down
the water level. If a good sized pump and tank could be
installed on this well, I fell we would have all the water
we could use. We could even install a hydrant to which a
fire hose could be connected for blowing out stopped up
lines and washing down tanks. Such a supply is a necessity.
8. One of the skimmers needs to be adjusted to level it.
Welding and burning equipment is needed to do this job.
This skimmer has never been properly lined up and becomes
more important as the flow becomes greater.
9. The grading around the plant has never been completed,
fill should be provided where necessary to come up at least
to the water line. Also, holes and gulleys should be
filled to enable a lawn to be planted and mowed. Also,
a blacktop walk around the tanks would be helpful.
10: A small loading platform to handle chlorine cylinders
should be installed. This would enable the cylinders to
be put in room with a hand truck. Now they have to be
carried in and lifted up through the door -way. They
weigh about 250 pounds with no decent hand holds.

MR. MILLS moved that Mr. Gutmann get together with Mr . Kelley to
give the Board an estimate of cost on repairs before the Board
approve any of the changes.

Mr. Finnan reported on the street lighting request of residents
from the Harbor Hill-Vandewater Drive area. A report and map have
been received from Mr. Crans, Central Hudson Lighting Engineer,
showing the lighting and approximate cost, based on assessed valua-
tion. Mr. Finnan has set up a tentative meeting with these residents,
and if they express an interest in it, a further meeting will be set
up with the Board and Mr. Crans. At that time further action can be
taken. He will have more facts for the September meeting.
Mr. Mills mentioned letting out informal bids for the furnace on the
Town Hall side of the Town Building. Mr. Lapar informed him these
had gone out already.

Mr. Milds asked permission to attend a Planning Meeting in
Monticello'in October in connection with Southern Dutchess 1990.
MR. DIEHL moved Mr. Mills be granted permission to attend the
Southern Dutchess 1990 Planning Meeting in Monticello and that his
legitimate expenses be a Town charge.
Seconded by Mr. Finnan.

Mr. Finnan reported on the Public Hearing on the application of
Consolidated Edison to erect a pumped storage hydro -electric
project at Cornwall, N.Y. He heard testimony given by Dr. James
Alexander, senior scientist of the Monatak Ocean Lab, Mr. Peter
Ferraro and Dr. Alexander Kusco. They all testified in behalf of
the Scenic Hudson Preservation Conference. He highlighted some of
the more pertinent facts touched upon by these gentlemen, with
regard to pollution of the river; and, since there might, in
future times, be the need for the Wappinger and Southern Dutchess
areas to turn to the river as a source of water supply, the concern
is that there is at the present time, inadequate research to
accurately predict the damage of mixing effect of salt and fresh
water. On behalf of the Town, Mr. Finnan made the statement for
the hearing record, that, if there is reasonable doubt that the
Consolidated Edison project will adversely affect the Hudson, the
project should not be approved. The Hearing Examiner informed him
that he bases his decision on the fact that there be reasonable
assurance that such activity will not violate the applicable water
quality.
MR. FINNAN moved that the Town Board forward a letter to Mr. Henry
Diamond, Commissioner of New York State Environmental Conservation
expressing the Board's concern in this matter. That the Board
bases this concern on the reports of interested parties and the
testimony at the Public Hearing held in Cornwall on August 4th, and
the Board believes it is up to him to protect the best interest of
the public.

Mr. Finnan added that perhaps Mr. Rappleyea could assist on more
appropriate wording of the letter.
Mr. Diehl directed that the renewal contracts, submitted by Central
Hudson, for the Hughsonville and Chelsea Districts and the General
Town lighting be tabled until the September meeting.
Mr. Mills brought up the letter he had received from Howard S. Quinn,
District Director Office of ,_Planning Coordination, for the process-
ing of the Comprehensive Planning Assistance Program of the Southern
Dutchess Joint Planning Group, with the accompanying resolution to
approve the Town's share of the Program.
MR. MILLS moved that the same amount that was budgeted last year
be again budgeted this year, and allocate the requested money as
requested by Mr. Quinn.
Seconded by Mr. Holt.

planning study contributing to an overall program'for:its-future
commnnity development, desires to participate, jointly with the
Village of Wappingers Falls, City of Beacon, Town of Fishkill
and the Village of Fishkill in the Federal -State Comprehensive
Planning Assistanc.e'Program:as authorized by Section 701 of the
Housi44 Act �f 1954, as amended, and Article 26 of the New York
State Executive,Law, and
WHEREAS, the New .York ::,State.Office of Planning Services,
under authority of Article 26 of the New York State Executive Law,
is the official State planning -ager y designated:, to administer
Federal and State funds under the provisions of Section 701 of
the Housing Act of 1954,- as amended, now therefore, - be it
RESOLVED, that the Town Board of the Town of Wappinger hereby
requests the New York State Office of Planning Services to provide
planning assistance under authority of Article 26 of the New York
State Executive Law, with such financial assistance as may be
provided by the United States Department of Housing and Urban
Developement, under authority of Section 701 of the Housing Act
of 1954, as amended, Such planning assistance is more particular-
ly described in the project application.
RESOLVED, that if the aforesaid application is approved and
accepted by both. the Director of the New York State Office of
Planning Services and the Department of Housing and Urban

Development, the Town of Wappinger shall enter into a formal
agreement with the New York State Office of Planning Services
to undertake the project described in the approved application
and to pay to the State of New York its share of the estimated
total cost of the said project, together with such other terms
and conditions as may be deemed necessary and appropriate to
carry out the said project.
RESOLVED, that the Town of Wappinger hereby agrees to have
available, in the year the project is to be completed, thesum
of One Thousand Eighty -Eight dollars ($1,088.00), as its pro-
portionate share of the local share of the total cost of the
said project, to be paid to the State of New York, on condition
that the above-mentioned application is approved by both the
Department of Housing and Urban Development and the Director
of the New York State Office of Planning Services.
RESOLVED, that the Town of Wappinger shall assume the costs
of operating and maintaining its own planning board or commission
including such services as clerical personnel, office space,
equipment, materials, cdmmunication and travel, as such costs
cannot be charged to the Comprehensive Planning Assistance Program.
RESOLVED, that it is understood that current planning services
may not be charged to the Comprehensive Planning Assistance Program.
RESOLVED, that the Supervisor of the Town of Wappinger be and
hereby is authorized and empowered to executive in the name of
the Town of Wappinger all necessary applications, contracts and
agreements to implement and carry out the purposes specified in
this resolution.

A Resolution was proposed by SUPERVISOR DIEHL in regard to
opposition of Stewart Air Field as a major Jet Port. It was noted
by other members of the Board that a similar resolution, indicating
this position, had been passed two months ago. Mr. Holt, therefore,
recommended a copy of that resolution be forwarded to the Wappin-
ger Conservation Association and the Hudson River Valley Commission.
A resignation was received from Richard Hodge, as Water Plant
Operator for the Oakwood Knolls District.
MR. DIEHL moved that William Mihans be appointed as Water Plant
Operator for the Oakwood Knolls Water District, at the same rate
of pay that Mr. Hodge was receiving.
Seconded by Mr. Mills
Motion Unanimously Carried
Mr. Diehl recommended that Mr. Hodge receive his salary up to the
date of his resignation (through the last pay period of July) and
the effective date to be July 24th, as having started on an emer-
gency basis.
A letter was received from Mr. Ian MacDonald in regard to the
Board's query about tenants to the Fleetwood Water District. Mr.
MacDonald indicated the Board could charge premium rates for tenants
outside the District. It was also his opinion that a uniform rate
should be established.
MR. MILLS moved that a letter be sent back to Mr. MacDonald request-
ing he and Mr. Lapar confer on the establishment of some formula
to provide a standard water rate for all tenants to all districts.

Mr. Finnan asked if there had been any new developments regarding
underground cable. Mr. Rappleyea said there has been no change
since he last reported to the Board.
Charles Cortellino, being recognized by the Chair, asked for
verification as to whether taxes on the sewer lines in Wildwood

Forest were being paid by L&A Filtration. If Mr. Cornell is indeed
the owner of the lines in Wildwood 2, he doesn't think L&A Filtra-
tion should pay the taxes, if they are. His second question was, if
Mr. Cornell indeed owns the lines in Wildwood 2, shouldn't he have
formed a Transportation Act on lines considered as a sewer plant
and he should have come to the Town and asked for permission to
form a corporation and operate a sewer. Mr. Rappleyea answered
that he had spoken to Jack Hill of the Dutchess County Department
of Health regarding the sewer lines who informed him that any
application for any extensions have always been in the name of L&A
Filtration Corp. It's a requirement of the County Health Department
that before they give approval for a facility it form a Transporta-
tion Corp. Mr. Hill had at the time, however, asked that more time
be given to him to check into it further.
MR. HOLT moved that the Engineer to the Rockingham Farms Sewer
District (Mr. Vincent Kelley of Milton Chazen Associates) be in-
formed that the Board is very anxious to hear of their expansion
plans for this District.
Seconded by Mr. Mills.

MR. MILLS moved the meeting be adjourned, seconded by Mr. Finnan
and unanimously carried.
