Adjournment The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on Monday, January 4, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl opened the meeting at 7:45 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Alre Carried: January 4, 1971 Resolution #3 TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following resolution was offered by MR. HOLT who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates:Heavy Operator, $3.17 to $3.25 per hr. Light Optr. 3.03 to 3.11 per hr. Laborer 2.92 to 3.00 Foreman 3.68 per hr. AND IT IS FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1971, with the first payday to be on Friday, January 8, 1971. FINNAN who moved its adoption. RESOLVED, that Eleanor Croshier be and she hereby is appointed to serve as Secretary to the Town Justices of the Town of Wappinger, Dutchess County, New York, at the pleasure of the Town Board, and it is further RESOLVED, that the annual salary for the Secretary to the Town Justices of the Town of Wappinger be and the same hereby is fixed and established at the rate of $6,000 per year, to be paid every other Friday throughout the year 1971, with 26 pay periods during each year, with the first pay day to be January 8, 1971, and it is further RESOLVED, that the said Secretarlr:T to -the Town Justices of of the Town of Wappinger shall be required to furnish an official undertaking, conditioned for the faithful performance of her duties in the amount of $1,000. CLAUSEN who moved its adoption: RESOLVED, that the W&SD News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered 6 as second class mail matter, be and the same hereby is designated as the official paper of this Town, and it is further RESOLVED, that the Poughkeepsie Journal and the Evening News, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as addi- tional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision II of the Town Law of the State of New York, and it is further RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. HOLT who moved its adoption: WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all minies re- ceived and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, WHEREAS, in lieu of preparing the report required by Sub- division 10 of Section 29 of the Town Law, the Town Board may determine, by resolutionv that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. NOW, THEREFORE, IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller re- quired by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Clausen entertained the name of Michael Turco for the position of Assessor for the Town of Wappinger for the term ending September 30, 1971, and asked that the following letter be read: 1 December 31, 1970 Town Board Members Town of Wappinger Wappingers Falls, New York Gentlemen: In view of the imminent changes due to enactment of the Assessment Improvement Law, I would like- to .submit my name as a candidate for Assessor, Town of Wappinger, and offer the ..following information, pertinent to qualifications, for your consideration: 1. Sixty-one College Credits 2. Completion of the course, "Basic Principles of Assessment Administration", sponsored by the Dutchess County Assessors' Association. 3. Fulfillment of the requirements for the course, "Advanced Appraising for Assessors", given at Cornell University. 4. Near -completion of the courses, "RealEstate Practices and Principles" and "Real Estate Appraisal", which you, members of the Town Board, permitted me to attend and paid for at Dutchess Community College. 5. Enrollment in the correspondence course, "Appraisal Principles and Practices",offered by the N.Y. State Assessors' Association,of which 6'. My term of office as tome the procedures Assessor. 7. Wide experience in dealing with the public, which stood me in good stead during the assessing period and, even more so, on "grievance days". I am a member. appointed Assessor which made familiar and duties of the Office of the In addition, I plan to register for the second semester of courses at Dutchess Community. College and, given the opportunity, to avail myself of any and all opportunities related to furtherance of knowledge in the assessing process. Turco Mr. Diehl said he would like to second the motion for Michael Turco and also offered for the record, a report Mr. Turco turned in of a meeting he attended at the New York State Assembly this past month, in regard to some changes that are anticipated in the assessing for the future. He then asked if there were any other nominations for Assessor. Discussion followed on rules relating to motions. Mr. Rappleyea's interpretation was that a motion to consider names could be made and then names could be entertained before voting, but the motion presenting a name must then be voted on before another name is considered. MR. FINNAN moved the rules be suspended, seconded by Mr. Mills and carried. Arthur Bisom commented that he would like to add to Mr. Turco's qualification, that is, he had switched from an enrolled Republican to an enrolled Democrat after the last election. Mr. Bisom-also criticized Mr. Turco as not having done any appraisals for the Town, no field work, and refusal to correct assessments in the Village. ,Mr. Louis Eck complained that the taxpayers in the Town were sub- sidizing the entire county, he said the Town was the highest taxed Town in the county and it's time to get a new man as Assessor; someone who knows what he's doing. Mr. Eck also asked that a letter from Claude Knapp, complaining about his assessment, be read (letter was addressed to the Wappingers Taxpayers Association.) Mr. Cortellino commented on having all the names of assessors mentioned before voting, he felt it would be best. MR. MILLS moved the rules be resumed, seconded by Mr. Holt and carried. The following resolution was offered by MR. CLAUSEN who moved its adoption: Be it resolved, that Michael Turco is hereby appointed to the office of Assessor and the term shall commence with the date of this resolution and expire on September 30, 1971. Mr. Eck said he would like Mr. Diehl /4 14 to appoint either Mr. Clausen or Mr. Finnan to make a spot check, (or Mr. Diehl himself). Mr. Finnan suggested every 7th name be checked. Mr. Eck suggested the Town Clerk make the calls. Mr. Finnan and Mr. Mills both said that was an imposition. MR. MILLS moved the rules be suspended, seconded by Mr. Finnan and carried. Mr. Clausen asked that the following letter be read into the minutes: December 18, 1970 Wappinger Town Board Town Hall Mill Street Wappingers Falls, New York Gentlemen: This letter is to express the views of my wife and me in regard to the possible reappointment of the present chairman of the board of assessors. We own the former Oscar Goebel property at 103:'East Main Street, Wappingers Falls, where the Post Office department maintains a parcel post annex consisting of a frame building of 800 square feel. We receive $250.00 per month rental from which we must pay for maintenance, insurance, and taxes. There is also an old uninhabited and gutted house on the property. We are assessed $9,290.00. We have petitioned for the reduction of this amount to a more realistic figure and have had no success. 15 The following comparable properties are offered to illustrate what we consider to be inequalities: Hedges Lumber --approximately 61 times more working floor space, approximately 2 times more monthly income from 2 stores: assessed for $5,400.00. Rowe -Rutledge Lawn Mower and Power Equipment Sales --approxi- mately 91/2 -times more working floor space in two buildings, one masonry and one sheet metal; an income that supports 2 families, 2 full time mechanics plus part time help: assessed for $8,700.00 It is not our intent to have our neighbor's taxes raised, but to have ours lowered to a more realistic figure in comparison to his. We don't like to feel that we are being taken. I have lived in Wappingers Falls all my life and I have seen many changes in fifty-four years. All of these changes have not benefited Wappingers. In each of the three years that we have been in contact with the present assessor chairman, we have found him to be without integrity, untruthful, impolite, unfair, and with a seemingly disregard for equality in assessing. My wife and hope that the Town Board members will, in this case, move in the right direction to appoint a replacement for the presetit chairman of the Board of Assessors. Mr. Leskow, in answer to the Erickson letter, mentioning Rowe - Rutledge & Hedges, what incomes they make, but whatever the assess- ment;is, the Ericksons are still grossly under assessed for the rent they collect. Rowe -Rutledge doesn't collect rent, they have their own business and must be assessed on a cost approach less depreciation, so does Hedges Lumber. As for a statement by Mr. Eck regarding one assessment he claimed was taken to a county official and was changed, he declared that the man was S. J. Reynolds, who presented his farm credentials, showed his income tax 1040F form, this man was a bona fide farmer and has been for many years. He also having been to Mr. Knud Clausens residence in the Village, inquiring as to rental income, all apartments and businesses that rent, have to submit their income. Income has to be figured on a gross rent multiplier. Mr. Cortellino questioned the statement about assessing on income. Knud Clausen elaborated on what he considered inequities in the 16 4" assessing of his properties and stated that politics have no place in the assessors office - take politics out of the Highway and Assessors Office. Mr. Probst brought out the fact that there were three assessors, any two could veto the third on any change of assessment and all three had to sign the role. MR. HOLT moved the rules be resumed, seconded by Mr. Clausen and carried. MR. FINNAN moved the Resolutions appointing a.. Deputy Assessor and a member to the Board of Assessment Review be tabled. Motion Unanimously Carried MR. MILLS moved that Robert Y. Heisler be reappointed as Chairman of the Town of Wappinger Planning Board. Seconded by Mr. Clausen. Motion Unanimously Carried MR. MILLS moved that Einar Chrystie be reappointed to a seven year term as a member of the Town of Wappinger Planning Board, term to expire January 4, 1978. MR. MILLS moved that Louis Clausen be appointed as the Town of Wappinger representative to the Association of Towns Annual Meeting, and Harry Holt be appointed as an Alternate. Seconded by Mr. Finnan. Motion Unanimously Carried MR. MILLS moved that Ralph Zimmerman, Skytop Drive, Chelsea, be appointed as one of the three new members to the Southern Dutohess 1990 Planning Council. Seconded by Mr. Holt. Motion Unanimously Carried A resolution appointing Barger & Russ as Engineers to inspect and certify to installation and costs of additions to system of L&A Filtration Corporation facilities was introduced by Supervisor Diehl. There was no second to the resolution. MR. MILLS moved to table this resolution until the January 11, 1971 Regular monthly Town Board meeting. Seconded by Mr. Holt. The Village has an opportunity to purchase the Sweet -Orr Building for $40,000.00 and the Village Committee would like a letter of intent from the Town Board that the Town may possible share this with them. The Village would like an answer by the 13th of January. This was referred back to Mr. Holt. Mr. Finnan, stating that he had pushed for a full-time Comptroller, and having been defeated in this, thought in lieu of this, would like to instruct the Attorney to the Town to prepare the paper work to enact a local law, which he would move at the next meeting, to establish the office of Supervisor as a full time position to become effective January 1st, 1972.
