The Regular Meeting of the Town Board of the Town of Wappinger was
held November 9, 1970 at Town Hall, Mill Street, Wappingers Falls,
New York.
Supervisor Diehl called the meeting to order at 8:14 P.M.
Present:

MR. HOLT moved that the Minutes of Special Meetings of August 19 and
26, Regular Meeting September 14th, Special Meetings of September 23,
October 1, October 8, and October 20, as submitted by the Town Clerk,
be and they are hereby approved. Seconded by Mr. Mills.
Motion Unanimously Carried
Reports were received for the month of October from the Supervisor,
Town Justices and Building Inspector.
MR. CLAUSEN moved the reports from the Supervisor, Town Justices and
Building Inspector be accepted and placed on file. Seconded by Mr.
Mills.

Dorothy Alsdorf, Town Historian, requested to speak to the Board
regarding two subjects - 1st, the Town of Wappinger Centennial, and
secondly, Bi -Centennial Anniversary of the American Revolution.
Mrs. Alsdorf outlines some preliminary plans being formulated, with
regard to the Bi -Centennial of the American Revolution, by the
Historians in Dutchess, and stated that the Centennial for the
Town of Wappinger could be held simultaneaously, or be synchronized
with, the Bi -Centennial. A period of four years was covered in
founding the Town of Wappinger, from 1874 to 1877, and Mrs. Alsdorf
offered several alternatives ideas for preparation by the Town.
She requested the Board appoint a Committee, (perhaps one person
from each election district) hopefully by the first of the year.
Mr. Mills suggested an executive session, perhaps in December, to
go over some of the details with Mrs. Alsdorf.
A Notice of Order was received from the New York State Department of
Transportation informing the Town of a reduction of speed limit to
40MPH on Myers Corners Road, from the intersection with All Angels
Hill Road east to Route 376.
Mr. Diehl ordered the notice from New York State Department of
Transportation placed on file.

Gentlemen:
In connection with an application which your Supervisor is
currently making to the Federal Water Pollution Control Adminis-
tration, through the New York State Department of Environmental
Conservation (Bureau of Construction Grants), for authorization
to award a contract for the installation and construction of the
facilities involved in the above captioned project, we direct
this letter to you to confirm previous arrangements made with respect
to the cost of legal services which we have performed and will per-
form for the Town of Wappinger with relation to the project.
Legal services for the project shall include preparation and
submission of applications to Federal and State agencies; corres-
pondence and telephone conferences with representatives of Federal
and State agencies; conferences and correspondence with Milton
Chazen, the project engineer, and members of his staff; preparation
of papers in connection with proceedings taken pursuant to Town
Law Sec. 202(b) for authorization to provide district improvement;
attendance at public hearing and examination of engineering witnesses;

preparation of resolution authorizing improvement; preparation of
bond resolution for funding of improvements; preparation of estoppel
notice; supervision of posting and publication of notices of public
hearing and estoppel notice; attendance at bid opening; examination
of bids and bid documents; cooperation with engineering staff in
drafting and approval of contract documents; preparation of engineer-
ing contract; preparation of bond anticipation note certificates,
bond anticipation notes; supervision of sale of bond anticipation
notes and certification of same; preparation of maturity schedules;
preparation, sale and certification ofserial bonds; preparation of
benefit assessment roll; preparation of sewer rent law; conferences
and consultations with Town officers and Town Board; attendance and
counselling at Town Board meetings and preparation of all enabling
resolutions required to effectuate completion of improvement.
The foregoing will require 300 hours of productive work by
the partners of this firm. Accurate records of working time will
be maintained by this office, and work will be billed for at the
rate of $40.00 for each hour of time devoted to the project by
our attorneys. Total billing for these services will not exceed
the sum of $12,000.00.

operator has been reviewed. Based on the information presented
therewith, it is considered that your qualifications meet those
prescribed for Operator in Grade 111-B under Section 11.70, Part
II of the State Sanitary Code.
The enclosed Certificate No. 4722 has been issued to you_
this day as evidence that your qualifications are considered
satisfactory for the above designated grade, and that you are
so listed on our records.

A letter was received from Gruenwald Associates, Consulting Engineers,
suggesting that their firm was in a position to offer a complete
engineering and construction project with regard to the Wast -e -Water
Problem (sewage disposal plant) they indicate the Town of Wappinger
is confronted with. They would appreciate the opportunity to discuss
the matter with the members of the Board.
Mr. Diehl recommended a letter be addressed to Gruenwald Associates
indicating that upon the Town's needs the Town would contact them
for an interview. The letter to be placed on file until such time
as would be appropriate. Mr. Diehl directed this letter be referred
to Mr. Lapar, and upon his recommendation, appropriate action taken
at the December meeting.
A request for the Town to accept and approve roads in Section III
Edgehill Manor was received from JamesThomann, President (Hill Top
Drive, Magura Road, Namoth Road, Rock Road, Deer Run and Vorndran
Drive.)
Mr. Horton, Highway Superintendent recommended that Hill Top Drive,
Magura Road, Namoth Road and Rock Road, having met the specifications,
be accepted as and for Town Roads. Deer Run and Vorndran Drive were
not acceptable at this time.
MR. MILLS moved to accept the Highway Superintendent's recommendation
and accept as and for Town Roads, Hill Top Drive, Magura Road, Namoth
Road, and Rock Road and, refer Mr. Horton back to Mr. Thomann on the
remaining two roads that had been included in Mr. Thomann's request.
SEconded by Mr. Holt.
Motion Unanimously Carried
A letter was received from Revere Rdige Inc. requesting Top O'Hill
Road be accepted as a Town Road and also a reduction of a portion
of the Performance Bond covering this road.
Mr. Diehl directed this request be referred to the Town Planning
Board for their recommendation on the reduction of the Bond, indicat-
ing‘to them that Mr. Horton, Highway Superintendent has recommended
this road be accepted for a Town Road.
A letter was received from Walter Cronin, Chairman of the Town of

Wappinger Conservation Advisory Council, pointing out the omission
of monies in the 1971 Budget for their operating expenses and re-
questing a total of $1,000 be transferred to their account from
Contingency, $500 now and remaining $500 later in the year.
Mr. Mills recommended a letter be addressed to Mr. Cronin asking
what their needs would be for these funds. Other areas in the Budget
might already cover these items.

Town of Wappinger
Resolution: To upgrade the streams in the Town of Wappinger by
reclassification.
WHEREAS the Town of Wappinger being a viable community with a.
rapidly expanding population and anticipated growth rate, and
WHEREAS the Town and surrounding area have limited recreation
facilities through which the major streams flow. Examples are
a) Wappingers Creek flows through Airport Park and also
adjacent to the Quiet Acres recreation site
b) Sprout Creek flows adjacent to the Robinson Lane
Recreation area
c) Hunters Creek flows through Reese Park
WHEREAS the pollution of our streams is deemed to be a health
hazard and detrimental to our community, and,
WHEREAS the degree of pollution is a matter of definition when
measured against a standard (stream classification). As a result
the Town has an intolerable situation of polluted streams meeting
state standards.
THEREFORE BE IT RESOLVED the Town of Wappinger Conservation Advisory
Council does hereby recommend and advise that the Supervisor and

Town Board petition Mr. Henry L. Diamond, Commissioner of Environ-
mental Conservation for New York State to reclassify all streams
within the Town of Wappinger to "Class B:'. Also the County Board
of Representatives should be so informed so they may make suitable
recommendations for these streams throughout Dutchess County.
MR. MILLS moved that the recommendation from the Town of Wappinger
Conservation - Advisory Council be accepted and pass the Council's
Resolution (on reclassifying the streams in the Town of Wappinger),
on to Henry Diamond, Commissioner of the New York State Department
of Environmental Conservation, with a copy to the County Board of
Representatives and Town Planning Board. Seconded by Mr. Clausen.
Motion Unanimously Carried
Another letter had been received from the Town of Wappinger Conser-
vation Advisory Council recommending the appointment of Carol Waddle,
Hughsonville, to the Council, the Council being under the impression
there were to be nine members on the Council (Resolution creating
Council only allows for seven members). There had been, however,
a verbal resignation to the Town Clerk from Fred Snowden, one of
the original appointees.
MR. MILLS moved that Mr. Snowden's resignation be accepted and that
(Mrs.)Carol Waddle be appointed to the Town of Wappinger Conservation
Advisory Council, to fill the vacancy created by Mr. Snowden's resig-
nation. Seconded by Mr. Finnan.

Mr. Diehl recommended Mr. Kelley's letter be referred to Mr. Quinn,
Attorney for the district for his recommendation.
A letter was received from Mr. Cruickshank regarding speed limits
on Town Roads.
MR. CLAUSEN moved the rules be suspended in order to permit discus-
sion with Mr. Cruickshank, seconded by Mr. Finnan and carried.
Mr. Cruickshank felt that the State speed limit of 55MPH was far
too much on Town Roads, even 40 MPH was in excess in various sections.
He would like the Board to consider 30 or 35 MPH speed limits be
established for all Town Roads, and offered whatever assistance the
Board might find useful, in order to expedite any action the Board
might take. Mr. Finnan reiterated past attempts at speed reductions.
Mr. Cruickshank asked if petitions requesting reduced speed limits
would assist in the cause. It was mutually felt this would probably
carry some weight and lend credance to the Town's request.
MR. CLAUSEN moved the rules be resumed, seconded by Mr. Mills and
carried.
A letter was received from the Hopewell Junction Congregation of
Jehovah's Witnessess requesting the return of whatever remained of
their $150. cash bond, posted for a road opening permit on Ronsue
Drive.
William Horton, Highway Superintendent recommended that $125. of the
Jehovah's Witnessess $150 bond be returned. The Highway Department
had to do some work on the road, after the contractor had finished
which amounted to an estimated $25 worth of materials, etc. used.
MR. CLAUSEN moved that $125. of the $150 cash bond posted by Jehovah
Witnessess be returned to them, and the remaining $25. be transferred
into Highway Item I. Seconded by Mr. Finnan.

Mr_. Diehl reported that he had written to Hamilton Fish with regard
to the Federal Census, since he didn't feel it compared favorably
to the figures of the Special Census the Town had taken last year.
Representative Fish had replied that he had turned Mr. Diehl's
inquiry over to the Bureau of Census and would forward any informa-
tion he received on to Mr. Diehl.
Mr. Diehl reported also that he had sent a letter to David Schoentag,
County Executive, and the four County Representatives from Wappinger-
Fishkill regarding the expansion at the Dutchess County Airport.
The contents, in effect expressed his personal belief that improve-
ments should be done but no expansion should be considered at this
time.
A letter had been received by Mr. Diehl from Mr. Schoentag regarding
the County's contracting for a comprehensive solid wastes disposal
study. Mr. Schoentag indicated that, in order to insure proper
dissemination of information regarding this study, a Public Information
Committee At Large, was being created, and was requesting the Town
Board to appoint a representative from Wappinger to serve on this
Committee.
MR. DIEHL moved that Mr. Clausen and Mr. Finnan as members of the
Town's Sanitary Landfill Committee, either together or singlely, be
appointed to serve on this County Committee. Seconded by Mr. Mills.

Bids had been solicited by advertising for Storm Sewer Contract #5.

I have examined the bids and found that a minor error occured
An the bid of the low bidder. The total error amounted to $20.
It is my professional opinion that the best interest of the Town
will be served in accepting the bid of Lombardi & Son Inc. I,
therefore, recommend that the Town Board award the contract to
Lombardi & Son, Inc., the low bidder.

Mr. Rappleyea recommended these bids be held until the Town Board
reviews the total expenditures to date to ascertain what monies are
left out of the bond issue and what work remains to be done.
Mr. Diehl directed the bids for the Storm Sewer Contract #5 be
tabled until the Board can meet with Mr. Rappleyea to review these
expenditures.

MR. HOLT moved the rules be suspended, seconded by Mr. Clausen and
carried.
Mr. Eck asked Mr. Horton if the Building would be ready for this win-
ter, and what difference did it make if the Building was up or not
if it wouldn't be heated. Mr. Horton replied the difference was
of snow and getting to the equipment, and leaving $100,000 worth
of equipment out to the weather was not the best thing to do with
it.
Mr. Cruickshank asked whit equipment was standing outside and by
spending $45,000 for a building how much more would be gotten out
of the equipment. Mr. Horton said, roughly, life expectancy of the
equipment aould be 10 years longer.
MR. CLAUSEN moved the rules be resumed, seconded by Mr. Finnan and
carried.
MR. MILLS moved that Mr. Rappleyea be directed to prepare a Resolu-
tion for Bonding the entire cost of the Town Highway Building, not
to exceed 5 years. Seconded by Mr. Holt.
Motion Unanimously Carried
The resolution for County road snow removal was placed before the
Board.
Mr. Horton stated that he had met with Mr. Petrovits and Mr. Petrovits
had agreed to assume the responsibility of County Road #28 - Old

Hopewell Road (from New Hamburg Bridge to Worley Homes, Hopewell
Junction.)
MR. MILLS moved the rules be suspended, seconded by Mr. Holt and
carried.
Mr. Schouten wanted to know why the County couldn't take over all
of their own roads. Mr. Horton answered that next year the County
will assume all snow removal of County roads in Wappinger.
Mr. Eck wanted to know how the Town highway would get to their roads
if the County doesn't plow at the same time?
MR. MILLS moved the rules be resumed, seconded by Mr. Holt and
carried.
The following Resolution was offered by MR. MILLS who moved its
adoption:
WHEREAS, the Town Superintendent of Highways has been requested
to remove snow from County roads, and to sand or otherwise treat
them for the purpose of removing the danger of ice and snow, by
the Commissioner of Public Works of:Dutchess County, in accordance
with Article 6, Section 135-a of the Highway Law, now therefore
be it
RESOLVED, that the Town Superintendent be and is herein author-
ized to perform such work as is found necessary, at the hourly rate
as fixed by the State Commissioner of Transportation for the renting
and hiring of such equipment, for the Winter season 1970-1971.
Seconded by: Mr. Holt

enlargement, acquisition, and operation of the water supply, and
distribution systems as shown on the subdivision plat filed by
Schoonmaker Bros. and Dutchess Heights Inc, in the Dutchess County
Clerk's Office.

TOWN OF WAPPINGER, DUTCHESS
COUNTY AUTHORIZING EXEMPTION
OF SCHOONMAKER BROTHERS, INC.
UNDER SECTION 14 OF LOCAL LAW
NUMBER 2
The following resolution was offered by MR. HOLT who moved
its adoption:
WHEREAS, the Town Board of the Town of Wappinger adopted Local
Law #2, 1967, wherein and whereby conditions and circumstances are
defined for the establishment, construction, installation, extension,
englargement, acquisition, operation and use of water supply and
dkstribution systems in the Town of Wappinger and
WHEREAS, Section 14 of Local Law #2, 1967 permits the Town Board
to exempt any water supply and distribution system designed and
intended to serve any residential complex of structures occupied
or used by humans from operation of this local law upon showing
proof adduced at a public hearing that the use of such a system for
such purpose will not violate the spirit and intent of this local
law and
WHEREAS, Schoonmaker Brothers, Inc. was licensed on January
16, 1967 by the Public Service Commission to own and operate a
water company and
WHEREAS, Schoonmaker Brothers, Inc. has been authorized by
the Public Service Commission to own and operate a water company
serving a territory covering Rockinghams Farms Subdivision and
Dutchess Heights Inc., Town of Wappinger, Dutchess County, New
York and
WHEREAS, both Rockingham Farms Subdivision and Dutchess Heights
Inc. have properly engineered water distribution systems which have
been approved by the Town Planning Board and are a part of the sub-
division plots filed at the Dutchess County Clerk's Office, now
therefore be it
RESOLVED, that as permitted and authorized in Section 14 of
Town Law #2, 1967 a public hearing be scheduled for 7:30 P.M. on
the 23rd day of November, 1970 to consider application by Schoon-
maker Brothers, Inc. for exemption from Town Law #2, 1967, in
respect to establishment, construction, installation, extension,
enlargement, acquisition and operation of the water supply and
and distribution water systems as shown on aforesaid plots filed
by Schoonmaker Brothers, Inc. and Dutchess Heights, Inc. in the
Dutchess County Clerk's Office.

Discussion was held on the intent of the Local Law on water, who
would fall under it and who would be exempt, and what constituted
an established water works prior to the adoption of Local Law #2,
1967. Mr. Rappleyea said he felt the Board would have to judge each
application on its own merit, and establish the facts of each,
individually.
MR. CLAUSEN moved the rules be suspended, seconded by Mr. Diehl
and carried.
Mr. Logan asked the intent of the Board when they passed Local Law
#2, 1967, was it to effect people who already had approval?
Mr. Clausen & Mr. Diehl, in summary, said it seems the intent was
any future expansion beyond prior subdivision approval, and not
necessarily including franchise areas. Local Law #2, 1967, did
not apply to those subdivisions who had received approval prior to
its adoption, even though all their lines were not installed, these
subdivisions would be able to put their remaining lines in.
MR. CLAUSEN moved the rules be resumed, seconded by Mr. Mills and
carried.
A date for an executive meeting had been set for November 16, 1970,
to meet with Mr. Lafko regarding proposed increase in rates for the
L&A Filtration Corp. The Board decided to reschedule this meeting.
MR. MILLS moved that the Town Clerk be instructed to notify Mr.
L&fko that the executive meeting scheduled for the 16th of November
has been rescheduled for November 23, 1970, after the Public Hearing
(scheduled for 7:30 of that evening.) Seconded by Mr. Clausen.
Motion Unanimously Carried
The request from Schoonmaker Bros. Inc. for the Town to accept roads
in the Rockingham Farms Development was resubmitted to the Board.
Mr. Field, President requested Regency Drive, Lawn Place, and
Cloverdale Place be accepted as and for Town roads. The original
request had been referred to Mr. Horton.
Mr. Horton, Highway Superintendent recommended these roads be accepted
as and for Town roads.
MR. MILLS moved the Highway Superintendent recommendation be accepted
and that Regency Drive, Lawn Place, and Cloverdale Place be accepted
as and for Town roads. Seconded by Mr. Holt.
Motion Unanimously Carried
Mr. Field asked, referring to a request submitted by Schoonmaker
Bros. at the October meeting, if it was possible to get the Board's
permission tonight to extend approximately 1400' of water mains
along Doyle Drive to serve lots 1 thru 31.
MR. HOLT moved tacit agreement to Schoonmaker Bros. request, subject
to final approval on their application for exemption of Local Law #2,
1967. Seconded by Mr. Mills.
Motion Unanimously Carried
Mr. Mills, under new business, mentioned an informal bid from Roy
C. Knapp, on the cost of installing a tax collector's office. There
was thought of putting the office in the northeastern corner of the
Town Hall, an area approximately 13'x 7.6' partitioned. There was
discussion as to whether this was the best place to put this office.
Mr. Mills said he would check further into this matter.
Mr. Mills requested that the Supervisor's office supply the Board
members with a complete report, before the end of the year, on all
the water and sewer districts in the Town, just to find out how much
money we collect on, and what it costs us to operate them, to make
sure there won't be another problem like Oakwood.
MR. CLAUSEN moved that a letter be directed to the Planning Board
asking them to re -survey road bonds that would have to be resubmitted
to the Town as of the first of the year. Seconded by Mr. Finnan.
Motion Unanimously Carried
Mr. Eck, in regard to a letter he had sent to each Board member
offering his services as the Assessor next year, at a salary of
$1,600, said the taxpayers should know before 1971 who the Assessor
will be. He wanted to know the Board's feelings on his offer, and
in all fairness to the people holding these positions they should
know in advance if they are going to be reappointed, the Board
shouldn't wait to next year.

Mr. Clausen commented that Mr. Eck had a point and was the first
one to come forth with an intention for the job - knowing that the
Board will appoint an Assessor in January, anyone who is interested
should make it known to the Board.
Mr. Rappleyea commented to the Board that there was a matter pending
before the court, litigation over his assessment on property he owns
in the Town. He didn't think the Town should be in a position of
litigating the assessment on the Assessor's property. Mr. Mills said
he felt Mr. Eck as Assessor would be a conflict of interest and
morally couldn't vote for a man who presently has a lawsuit against
the Assessor and put him in as an Assessor. Mr. Eck said that was
only Mr. Mills' opinion. Mr. Mills' comeback was that Mr. Eck had
come into the back room and asked the Board to drop the lawsuit and
appoint him Assessor and the difference in money would help the
court costs. Mr. Eck went on about the litigation, that the Judge
had suggested settling and saying Mr. Rappleyea, said he was in favor
of it but Mr. Leskow wasn't; Mr. Leskow wanted to but Mr. Logan told
him not to. Mr. Bisom asked that Mr. Leskow state his qualifications
as Assessor. Mr. Leskow displayed 10 certificates from various schools
for courses taken in assessors. He also called Mr. Eck a public liar
because he never mentioned Mr. Logan's name to him, and, also that
he felt the Town shouldn't lose the case as the assessment placed on
Mr. Eck's property was a very correct assessment and if the case was
dropped it would be an admission of an incorrect assessment. Mr.
Logan stated that, for the purposed of recorded history, he never,
at any time, discussed this lawsuit, which Mr. Eck has against the
Town, with Mr. Leskow or with anyone else in the Assessors Office and
at no time discussed it with Mr. Rappleyea possibility of settlement
or whether it should be settled. He has had nothing to do with it.
Mr. Rappleyea, on this subject, said the litigation involves the
assessment on a number of parcels owned by Mr. Eck and other members
of his family. The case has proceeded over a long period of time
not by any fault of the Town, but by reason of the witnesses pre-

sented by Mr. Eck. Mr. Eck's only expert witness to date has been
himself and Joseph Fulton, former Supervisor. The case is before
the referee, there will be further hearings on it, and there have
never been any discussions by him with Mr. Logan about this case,
whatsoever. The case is to be decided solely on its merits,from
his point of view he thinks the Town has an excellent case and it
will proceed to conclusion. Because of Mr. Eck's offer, he had
made his comments only to call to the attention of the Town to
remind them of this particular matter. Mr. Eck got a bit heated
about one of the cases' postponements, whereby Mr. Diehl suggested
the matter be left in the court, and called for adjournment as there
was no other business to come before the Board.
MR. MILLS moved the meeting be adjourned, seconded by Mr. Holt and
unanimously carried.
