Adjournment • 2 4 5 The Regular Meting of the Town Board of the Town of Wappinger was held October 13, 1970, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:25 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman Elaine H. Snowden, Town Clerk Others Present: ,Absent: James Mills, Councilman Allan E. Rappleyea, Attorney to the Town Rudolph E. Lapar, Engineer to the Town William Horton, Superintendent of Highways Reports from the Supervisor Town Justice and Building Inspector fortthemonth of September were received. MR. CLAUSEN moved the reports be accepted and placed on file. Seconded by Mr. Holt, Motion Unanimously Carried Bills presented for payment were as follows: General Fund $45,382.14 OKSD $ 630.27 Highway Fund 10,704.12 OKWD 117.66 FLSD $338.14 FLWD 258.37 RFSD 258.37 MR. FINNAN moved the bills be paid, subject to audit. Mr. Clausen. Seconded by Motion Unanimously Carried Two applications were submitted for Hawking & Peddling by Anthony Charles Coratti and John R. Coratti (Culligan Water Softening.) MR. DIEHL moved that the two applications for Peddlers Licenses be accepted and liCenses be issued by the Town Clerk to John and Anthony Coratti. Seconded by Mr. Clausen. Motion Unanimously Carried MR. CLAUSEN moved the following letter be received and placed on record, seconded by Mr. Holt, and unanimously car Town Board Town Hall Wappingers Falls, N.Y. ied. September 23, 1970 Re: Widening of Pye Lane Gentlemen: At the request of Mr. Horton, I secured the enclosed deed for property bordering Pye Lane. The owners of the.property were James Thoman and Eugene G. Schuele. The property included a .721 acre parcel of land. MR. CLAUSEN moved Mr. Goldman's letter be referred to both the Town Planning Board and the Dutchess County Department of Planning, and Mr. Goldman to be advised as to action. Seconded by -Mr. Holt. Motion Unanimously Carried The following letter was received: September 15, 1970 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Re: Rockingham Sewer District Sewer Line Extension Angel Brook Acres Corp. Gentlemen: Please be advised that we have examined the plans and specifica- tions prepared for an extension of sewer lines in the subject district to serve two buildings of a proposed industrial develop- ment. The plans are identified as "Angel Brook Acres Corp., Industrial Park, Section One Proposed 8" A.C. Sanitary Sewer" prepared by Hayward & Pakan Associates and dated August 1970 and approved by the Dutchess County Health Dept. on August 17, 1970. Motion Unanimously Carried The following letter was received: October 5, 1970 Town Board Town of Wappinger Wappingers Falls, New York Re: Water Main Extension, Rockingham Water Company Gentlemen: In accordance with Town of Wappinger regulations I request permission to extend approximately 1400' of water mains along Doyle Drive in Rockingham Farms, Town of Wappinger to serve lots numbers 1 thzugh 31. If it is possible, I would also like to obtain a blanket permission to extend water mains as required to serve all remaining lots in the Rockingham Farms subdivision. All main extensions would be confined to land owned by Schoonmaker Bros., Inc. and as shown on the map filed in the Dutchess County Clerk's office as Rockingham Farms, Section II, Map #3425. Motion Unanimously Carried A letter was received from Robert M. Field, President Schoonmaker Bros., Inc. regarding plans to lay approximately 1400' of sewer mains on Doyle Drive. He contacted Mr. Kelley, who instructed him to have their own engineer certify the installation and testing. MR. CLAUSEN moved Mr. Fields' letter be received and placed on file. Seconded by Mr. Finnan, Motion Unanimously Carried MR. CLAUSEN moved the rules be suspended to permit a question from Mr. Cortellino, seconded by Mr. Diehl and carried. Mr. Cortellino asked what was the number of homes originally allowed for the Rockingham Farms Sewer District and were the homes that would be picked u6n the request for the 1400' included in this allocation. MR. CLAUSEN moved to resume the rules, seconded by Mr. Holt and carried. A request was received from Robert Fields, President of Schoonmaker Bros. Inc. to accept dedication of some of their development streets. MR. DIEHL moved this request be referred to Mr. Horton, Highway Superintendent and Rudolph Lapar. Seconded by Mr. Finnan. Motion Unanimous' Carried Mr. Clausen reported on the Little League Championship Dinner to be held October 16th, at the Woronock House. Gene Michael, from the Yankees will be guest speaker. Mr. Diehl reported that the Annual Town Fall Cleaning Days had ben set by the Highway Department for October 19th, West Side of Route 9; and October 26th for the East Side of Route 9. Mr. Diehl also commended Mr. Horton on the fine job that he has done the last few years. Mr. Diehl, in regard to the L&A Filtration Corp - the Board had requested of Mr. Lafko, the Corporations' President, various infor- mation and projected statements of operating income, and past operat- ing losses or income. (Mr. Lafko is requesting a rate increase on sewerage rates.) The possibility could exist that a municipal district might come out of this. All Board members have* received this evening, a short report showing the financial status of L&A Filtration Corp. from Mr. Lafko. Mr. Clausen, referring to last meeting when the Board had agreed to set up a meeting with some of the Rockingham Farms Sewer District residents and Mr. Quinn, said he had seen Mr. Quinn and he would be glad to meet with these residents. This is still pending and he will confirm a date with Mr. Quinn shortly. Mr. Finnan commented that one speed limit request on Myers Corners Road had been granted by the State and since the State speed limit would be 55 MPH as of the first of October, reduced speeds for the S 249 Town should be considered. MR. FINNAN moved that the Town request the New York State Department of Transportation establish Town wide speed limits for all Town roads not to exceed 45 MPH, exclusive of the Village of Wappingers Falls. Seconded by Mr. Clausen. Motion Unanimously Carried MR. CLAUSEN moved the rules be suspended, seconded by Mr. Diehl and carried. Mr. Landolfi asked, in relation to the L&A rate increase, if there was a projected rate. MR. FINNAN moved the rules be resumed, seconded by Mr. Clausen and carried. A letter was received from the Supervisor's Office regarding a transfer of funds. The following resolution was offered by MR. CLAUSEN, who moved its adoption: WHEREAS, the sum of $200.00 has been appropriated to Account #1004, Celebrations -Town Wide. This account has been overexpended and overdrawn by the sum of $17.28 in order to meet bills presented for payment., The additional monies were obtained from Account *704, Town Clerk -Office & Other. We, therefore, recommend that the Town Board authorize the transfer of the sum of $17.28 from Account #704 to Account #1004 in order to eliminate the overdraft and reimburse said account and in order to ratify and confirm the previously unauthorized appropriation. RESOLVED, that the sum of $17.28 be and the same hereby is appropriated to Account #1004 and that the said sum is hereby transferred thereto from Account #704. Seconded by: Mr. Holt Roll Call Vote: 4 Ayes 0 Nays The following resolution was offered by SUPERVISOR DIEHL, who moved its adoption: BE IT RESOLVED that the Town recreation area called Robinson Lane be hereafter known as the Dan Brouthers Park and, BE IT FURTHER RESOLVED that a suitable sign identifying said park shall be placed at or near the main entrance to said park and be installed by the Town Highway Superintendent. Seconded by: Mr. Finnan Roll Call Vote: 4 Ayes 0 Nays 25 MR. DIEHL moved the rules be suspended, seconded by Mr. Clausen and carried. The question was asked who was Dan Brouthers? Mr. Finnan stated that he was one of the first members of the Baseball Hall of Fame originally from Sylvan Lake, lived in the Village of Wappingers Falls and also Hughsonville. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Finnan and carried. A resolution authorizing the Town Superintendent of Highways to remove snow from county highways was brought before the Board. Mr. Horton, Highway Superintendent, hadn't received a definite answer from Mr. Petrovits as to what county roads the Town would get relief on, and indicated he didn't wish any action taken at this time. Mr. Diehl ordered this resolution tabled until next meeting. MR. CLAUSEN moved the rules be suspended, seconded by Mr. Diehl and carried. Mr. Schouten asked Mr. Horton if Mr. Petrovits had defined relief. He felt the County should assume all of their responsibility on County roads, the Town shouldn't have- to do their work for them. MR. CLAUSEN moved the rules be resumed, seconded by Mr. -Holt and carried. A request was received from Mr. Horton, Highway Superintendent, requesting permission to advertise for Bids for the proposed Highway Garage. Mr. Clausen commented that it was understood, several meetings past, that specifications would be drawn up for the Board to discuss and look over before letting it out for Bod. Mr. Holt asked how much urgency there was to this requs t, and Mr. Horton answered that there would be about $100,000.00 worth of machinery left out in the weather if this building were not provided. Mr. Diehl suggested that if the plans could be made available by Thursday (Oct. 15) when the Board would meet to work on the budget, the Board could possibly act that night to grant permission to bid. This was agreeable with all Board members. /l L 251 Mr. Diehl ordered Mr. Horton's request be tabled. Under - new business, the Board opened the meeting to questions from the floor. Mr. Landolfi- went back to his question about projected sewerage rates for the.L&A Filtration Corp. He asked if Mr. Lafko had them. Mr. Lafko indicated that the report in front of the Board, under groes earnings, showed the new adjusted minimal base rate :is $135.30 per year on 345 customers, an increase of $5.50 a month more. The rate of $69.30 has been constant since 1964. Mr. Rappleyea answered the question as to what procedure must be followed by indicating. that the old_agreement with L&A when they incorporated that requires the Town Board's consent to raise_their rates. The rates shall not be raised except for every two years, and there is some procedure set forth in the agreement.. A letter had been received from Mr. Lafko by the Board and Mr. Diehl had discussed,it with Mr. Rappleyea, who in turn wrote Mr. Lafko requesting him to present to the Town, as an initial step, his past operating expenses and figures. What was given to the Board tonight by Mr. Lafko was a response to this request. Mr. Landolfi pursued further his line of thought indicating supposi- tion as to.an increase in rates on water from Atlas Water Works, as by his reasoning sewer rates are based on water consumption. Mr. Lafko asked that this rumor (about an increase in water rates) be dispelled right now. He stated that there is no increase contem- plated in Atlas Water. Charles Simonson, Hackensack Heights Road, brought to the attention of the Board the fact that the trucks hauling fill to the Sanitary Landfill site were damaging Route 376 and dropping dirt causing dust. He asked if there was any possibility of drawing fill from directly across the road from the Landfill site, then gradually build a road back to where the fill is presently being taken from. This would: eliminate_this truck problem on Route 376. Mrs. Snowden was re- quested to direct a letter to Mr. John Nelson asking that he investi- 8 252 gate the complaint -of dirt and road damage. Mr. Eck -first commended the Highway Superintendent on the good job he did on Spook Hill Road. He said that there was still one bad hazard though, that of the bad curve at Hanna's. He continued into the old'problem of the North Wappinger Sewer District. He said the Board'. should sit down, re -instate it omitting the Rockingham Farm Sewer District. It's about time the Board got something done fdr the people. Mr. Bisom asked if there was any information regarding the speed limit signs for Myers Corners Road. There was discussion between Mr. Landolfi, Mr. Cortellino, the Board and Mr. Lapar regarding work being done on Storm Drainage Projects, and what was being done to see that these projects would be completed before winter sets in. Mr. Yigal Bash, principal of BCG Modular Homes, who build and sell modular homes in Dutchess County was the next speaker. He had been denied building permits by the Building Inspector in the Town of Wappinger on the basis of interpretation that these modular homes were defined as mobile homes. It is his understanding that when the Ordinance was written there were no modular homes (this isa new. concept.) He claims that FHA has approved modular homes. He would like torequestthat the Town give a definition of a dwelling as compared to a definition of a mobile home, and would like to ask. for an amendment to the Ordinance to include.modular homes under any category that might be permitted. Mr. Rappleyea asked Mr. Bash if he was a principal of BCG Modular Systems, Inc. Mr. Bash stated he was the Secretary. - Mr. Diehl indicated to Mx. Bash that the correspondence received from Gerald N-. Jacobowitz, Attorney, on this subject was being referred to Mr. Ludewig, Building Inspector, and it will not be acted upon until the Board can confer with Mr. Ludewig.. MR.
