1970-08-19 SPM201 A Special Meeting of the Town Board of the Town of Wappinger was held on August 19, 1970, at the Town Hall, Mill Street, Wappingers Falls, New York. Deputy Supervisor Clausen called the meeting to order at,7:34 P.M. Present: Louis Clausen, Councilman (Deputy Supervisor) G. Donald Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Absent: Louis Diehl, Supervisor Others Present: Rudolph Lapar, Engineer to the Town Allan Rappleyea, Attorney to the Town Joseph D. Quinn, Jr. Vincent Kelley Due to the scheduling of Public Hearings, the first for 7:30 P.M. for Angel Brook Estates Corp. on their application for a well under Local Law #2, 1967, Deputy Supervisor. Clausen called for a recess. MR. MILLS moved the Board recess until after the Public Hearings, seconded by Mr. Finnan and unanimously carried. (7:35 P.M.) Deputy Supervisor Clausen called the meeting back to order at 8:46 P.M. All Board members presen, except Supervisor Diehl (who is on vacation.) RESOLUTION APPROVING OF AMENDED CERTIFICATE OF INCORPORATION OF HILL TOP WATER -WORKS CORP. The following resolution was offered by COUNCILMAN MILLS who moved its adoption. WHEREAS, Hill Top Water -Works Corp., a domestic corporation organized and existing pursuant to the Transportation Corporation Law, previously received the conserft of the Town Board of the Town of Wappinger on or about June 25, 1964, for its formation, and WHEREAS, Hill Top Water -Works Corp. has made an application to the Town Board of the Town of Wappinger for the consent of the Town Board for the amendment of its Certificate of Incorporation, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby grants its consent for the amendment:to.the.Certificate of Incorpor- ation of the Hill Top Water -Works Corp., a copy of which amended certi- ficate is annexed hereto and made part hereof. ._ Seconded by: Councilman Holt 4 Ayes 0 Nays Absent: Supervisor Diehl Resolution Duly Adopted: August 19, 1970 202 RESOLUTION AUTHORIZING SUPERVISOR OR DEPUTY SUPERVISOR TO EXECUTE AGREEMENT BETWEEN HILLTOP WATER -WORKS CORP. AND TOWN OF WAPPINGER AND GRANTING CONSENT TO HILLTOP WATER -WORKS, CORP. FOR EXTENSION OF WATER MAINS PURSUANT TO LOCAL LAW #2 OF 1967. The following resolution was offered by COUNCILMAN MILLS who moved its adoption; WHEREAS, the Hill Top Water -Works Corp. petitioned the Town Board of the Town of Wappinger for its consent to the extension of a water main, all in accordance with a petition filed with the Town Board dated June 23, 1969, and WHEREAS, the Town Board of the Town of Wappinger has received a written option from Hill Top Water -Works Corp. to purchase said water main for $1.00 in the event the rest of the system is purchased by the Town of Wappinger or a public water district, and WHEREAS, the Town Board conducted a public hearing on said application on August 11, 1970, and WHEREAS, it appeared that said line has been installed and is now functioning, NOW, THEREFORE BE IT RESOLVED 1. The Supervisor or Deputy in the absence of the Supervisor is authorized and directed to execute the Agreement between Hill Top Water -Works Corp. and the Town of Wappinger, a copy of which is attached hereto. 2. The consent of the Town of Wappinger is hereby granted to Hill Top Water -Works Corp. to extend its pipes and main in accordance with its petition dated June 23, 1969, and said installation is hereby deemed approved subject to the following conditions: (a) An "as built" survey and engineering map shall be filed with the Town Clerk, which said survey or map shall be certified by an engineer licensed to practice in the State of New York. (b) Approval of said installation by the Dutchess County Health Department or the New York State Department of Health shall be filed with the Town Clerk. (c) Approval of the installation and extensions by the New York State Water Resources Commission or such other New York State Agency as shall be charged with control of ground water supplies. (d) Copies of all rights-of-way or easements shall be filed with the Town Clerk. 3. The Town Clerk is hereby authorized and directed to file certified copies of this resolution with the Public Service Commission, the Dutchess County Department of Health and the New York State Water Resources Commission. Seconded by: Councilman Finnan Resolution Duly Adopted: August 19, 1970 3 203 A Resolution approving Application for Sewer Service Connection at the Rockingham Farms Sewer District Plant to serve two individual builfdngs to be erected by Angel Brook -Acres within the territorial limits of the Rockingham Farms Sewer District was read. MR. MILLS moved action be tabled on this resolution until the Board received an Engineers' Feasibility Report on the expansion of the plant from Milton Chazen Associates (the engineers to the District.) Seconded by Mr. Finnan. Motion Unanimously Carried MR. MILLS moved the rules -be suspended upon the request of Mr. Worona seconded by Mr. Finnan and carried. Mr. Worona, Attorney for Angel Brook Acres Corp. pled the case for the passage of this resolution, pointing out it was the policy of the Board not to give consent for transportation corporations, they have advocated hook-ups to sewer districts. He stated it was, he felt, the Boards' obligation to allow these connections to the Rockingham Farms Sewer Plant. At the present time the sewer plant can accomodate the present homes that are there, and any others that may be constructed, and can do so for the next year to year and a half, and by that time expansion of the plant is contemplated. Further discussion ensued regarding total number of hook-ups to the plant with Mr. Worona pointing out that there are other developers within the district who have either terminated or, for one reason or another, have not continued building, so they have not begun to approach the number of so-called hook-ups to which they would have been entitled (which had been counted in the total number of hook-ups for the plant.) The total number of hook-ups being contemplated here are only seven. Mr. Mills asked if what Mr. Worona was saying was that Angel Brook would reduce the -.number= -of hook-ups by this amount from their total number. Charles Alpert said this was correct. MR. MILLS moved the rules be resumed, seconded by Mr. Holt &-carried. Mr. Mills withdrew his original motion to table action on the resolu- tion approving application for sewer service connection to Rockingham 2 - v 0- 4 '. Farms Sewer District. RESOLUTION, TOWN BOARD, TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, APPROVING APPLICATION FOR SEWER SERVICE CONNECTION AT THE ROCKINGHAM FARMS SEWER DISTRICT PLANT TO SERVE. TWO INDUSTRIAL BUILDINGS TO BE ERECTED BY ANGEL BROOK ACRE CORP. WITHIN THE TERRITORIAL LIMITS OF THE ROCKINGHAM FARMS SEWER DISTRICT. The following resolution was offered by MR. MILLS who moved its adoption: WHEREAS, Angel Brook Acres Corp. is in the process of erecting two industrial buildings on a site situate westerly of All Angels Hill Road and located in a tract owned by that corporation which is zoned.for plannecindustry and which lies within the territorial limits of Rockingham Farms Sewer District of the Town of Wappinger, and WHEREAS, Angel_Brook Acres Corp. has applied to this board for permission to connect the aforesaid buildings to the Rockingham Farms Sewer District plant and to be furnished with sanitary sewerage service for the aforesaid buildings from that facility, and WHEREAS, the Town Board of the Town of Wappinger has considered the application of Angel.Brook Acres Corp. and deems it to be in the public interest and to the public benefit to grant the same upon the terms and conditions hereinafter provided and to authorize the Supervisor of the Town of Wappinger to execute such application to public agencies, documents and papers as may be required to effectuate the action taken hereunder, NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger as follows: 1. That the application of Angel Brook Acres Corp. for permission to connect the aforesaid industrial buildings to the Rockingham Farms Sewer District and to be furnished sanitary sewerage service for said industrial buildings upon said applicant's performance of and com- pliance with the following terms and conditions: a. The applicant shall retain the services of a professional engineer duly licensed to practise in the: State of New York to prepare plans and specifications for construction of a sanitary sewer line or lines and appurtenances necessary to connect - the aforesaid industrial buildings with the Rockingham Farms Sewer District plant. b. Such plans and specifications shall be approved by Milton Chazen Associates, Engineers for the Rockingham Farms Sewer District as to adequacy. . c. Such plans and specifications shall be approved by the Dutchess County Health Department, and all other govern- mental agencies which may have jurisdiction of the project, d. Theapplicant shall obtain authorization from the Dutchess County Health Department, and all other governmental agencies which may have jurisdiction, to make the connec- tion or connections requested and to receive the sanitary sewer service requested. e. The applicant shall acquire all necessary easements and 205 rights-of-way required for construction, installation and maintenance of the connecting sanitary sewer lines involved,in the project. All permanent easements and and rights-of-way shall be twenty (20) feet in width throughout. All permanent easements and rights-of-way shall be transferred to the Town of Wappinger upon satisfactory completion of the project. Instruments of transfer shall meet with the approval of Messrs. Quinn & Reilly, attorneys for the Rockingham Farms Sewer District, as to form, content and manner of execution. f. The applicant shall pay the expense of preparation and filing of all maps required in connection with ease- ments and rights-of-way to be acquired andlitransferred pursuant to subdivision (e), and the applicant shall pay all fees for recording and filing instruments of acquisition and transfer of easements and rights-of-way. g. Prior to commencement of construction of the connecting sanitary sewer line the applicant or its contractor shall deliver to the Town Clerk of the Town of Wappinger certifi- cates showing that the following insurance is in force: (1) Workmen's Compensation, (2) Bodily Injury Liabil- ity with limits of $500,000.00 to $1,000,000.00 (3) Pro- perty Damage Liability with limits of $50,000.00 to $100,000.00. The Town shall be named as an additional insured in the policies of liability insurance. All of such insurance shall be maintained until construction has been completed and the line has been accepted by the Town. . _ h. The professional engineer retained by the applicant shall make inspections at reasonable intervals during the course of construction.. of the_ -connecting line or lines to ascertain compliance with the plans and specifications, and at the completion of construction such engineer shall give written certification to the Town Clerk that construc- tion has been completed in :accordance==with the plans and specifications. The engineer shall also certify that all claims of contractors, sub -contractors and suppliers for labor and materials involved in the construction have been paid in full. i. When construction has been completed and the Town has received the certifications referred to in subdivision (h), the applicant shall transfer title to the connecting sani- tary sewer line or lines and appurtenances and all under- lying easements and rights-of-way to the Town of Wappinger without cost and free and clear of all liens and incum- brances. Instruments of title -shall meet with the approval of counsel for the Rockingham Farms Sewer District. j. The applicant shall indemnify the Town of Wappinger and save it harmless from any and all claims of any nature arising out of the construction of the connecting sanitary sewer line or lines and appurtenances and accruing prior to the vesting of title to such lines and appurtenances in the Town. This obligation shall include the duty to reimburse the Town for counsel fees and court costs incurred in the defense of claims and suits. k. The applicant shall reimburse the Town for all legal and engineering fees which may be incurred in processing its application for sanitary sewer service and in acquir- ing title to the facilities that are to be constructed hereunder. 6. v 206 1. The applicant shall signify'its acceptance of and its agreement to perform all1of the ,obligations imposed upon.it.under.the provisions of_this_resolution:by sending written notice to that effect to the Town Clerk .within (10) days from the date of:adoption of the resolu- -.tion.-• m. The applicant shall not be entitled to have its industrial buildings serviced by the Rockingham Farms Sewer District plant,until it shall have performed all obligations imposed upon it under the provisions of this resolution. 12. That Louis D. Diehl, Supervisor of the Town of Wappinger, be and he is hereby authorized and directed to execute and deliver all applications to public agencies, documents and papers as may be required to effectuate and implement this resolution. 3. That this resolution shall take effect immediately. MILLS moved that Angel Brook Acres Corp. be granted permission to drill wells to serve and supply water for non-residential structures to be erected in Angel Brooks' Industrial Park, Section I Lots #2 and #3 in accordance with Local Law #2, Year 1967. Mr. Clausen asked the public if there were any questions. Mr. Charles Solomon, 10 Franton Drive asked what the annual Unit Benefit charge would be. Jack Johnston, 21 Kretch Circle wondered why the Unit Benefit Charge wasn't included in the service charge. There were no further questions. MR.
