A Special. Meeting was held on May 18,. 1970, by the Town,Board of
the Town of Wappinger at the Town Hall, Mill Street, Wappingers
Falls, New York. Each member having had due and timely notice of
said meeting - notices mailed to each member May 15, 1970, (also
see minutes of May 11, 1970 meeting.)
Supervisor Diehl called the meeting to order at 7:45 P.M.

A Resolution entitled "Town Board, Town of Wappinger,
New York, Approving Time Schedule for Construction of
ment Facilities at the Rockingham Farms Sewer District

read.
Mr. Finnan asked if the title to the plant was necessary before this
can go through.
Mr. Quinn answered it would be required before completion of the
project.
MR. FINNAN moved the rules be suspended to permit questions from the
floor, seconded by Mr. Mills and carried.
Mr. Lafko askedquestions relative to the deed from Schoonmaker for
the sewer plant. A discussion followed on this, at what point the
deed was necessary, the requirements for the grant, and what happens
if the deed is not forthcoming. The deed must be in the Town's name
before any_towns' money is spent-,
Mr. Steinhaus asked if it wasn't unethical to advertise and receive
bids without owning the plant.
Mr. Cornell couldn't see how the Board.could act without owning

the District.
Mr. Diehl assured him that the action of the Board tonight was a
resolution of intent. If the Town does not get deeded ownership,
the bids would not be accepted, but if the resolution was not
passed and the deed was received. the Town would have lost the
opportunity of receiving the grant.
Mr. Lafko asked about the legality of advertizing for bids under
these circumstances unless it was stipulated somehow, that they
may not be accepted.
MR. MILLS moved the rules be resumed, seconded by Mr. Finnan and
carried.
Supervisor Diehl called for a recess at 8:10 P.M.
Supervisor. Diehl called the meeting back to order at 8:40 P.M.
Mr. Diehl announced that, regarding the resolution before the Baird,
it comes before the Board, after previous discussion tonight, with
the full knowledge of this Board that the Town must have the deed
before the contract is awarded on June 22, 1970.
The following resolution was offered by MR. MILLS who moved its
adoption:
WHEREAS, the Town of Wappinger has heretofore taken formal
action to accept an offer of a grant from the Federal Water Pollu-
tion Control Administration to aid in defraying the cost of
construction of tertiary treatment facilities at the Rockingham
Farms Sewer ' District Plant, and
WHEREAS, the proposed construction has been designated as
pra_Oct No. WPC -NY -340 by the Federal Water Pollution Control
Administration, and
WHEREAS, the subject project involves the installation of
sand filters in accordance with plans and specifications prepared
by Milton Chazen Associates, Consulting Engineers of Poughkeepsie,
New York, previously retained by this board, and
WHEREAS, the Federal Water Pollution Control Administration
and the New York State Health Department have requested that this
Town Board and the Town Supertisor furnish assurance of their
intention to proceed with the project, and, in that connection,
that a time schedule be submitted to those agencies, and
WHEREAS, the Town's Consulting Engineers have prepared the
following time schedule for the project:'
Advertisement of bids- May 21, 1970
Receiving of bids- June 16, 1970
Award of Contract subject
to Federal Water Pollution
Control Administration- June 22, 1970

Completion of Work -
July 15, 1970
August 1, 1970
December 1, 1970
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the
Town of Wappinger as follows:
1. That the foregoing time schedule for commencement
and completion of work involved in project No. WPC -NY -340
be and the same hereby is ratified, confirmed and adopted.
2. That Louis D=. Diehl, Supervisor of the Town of
Wappinger, Milton Chazen Associates, Consulting Engineers
for the subject project, and Messrs. Quinn & Reilly,
Attorneys for the subject project be and they hereby
are authorized and directed to take all steps necessary
to implement the foregoing time schedule.
3. That certified copies of this resolution be furnished
to the Commissioner of the Federal Water Pollution Control
Administration and to the New York State Department of
Health.
4. That this resolution shall take effect immediately.

Mr. MacDonald was present as attorney representing the Fleetwood
Water and Sewer Districts. He read Local Law #2 and Local Law #3,
which would set the rates for use of water and sewer in the Fleetwood
District. Mr. Lapar noted a few discrepancies in the Local Laws
that deviated from engineering reports submitted.
Mr. Mills called for a recess.
Supervisor Diehl called a recess at 8:56 P.M.
Supervisor Diehl called the meeting back to order at 9:12 P.M.
Mr. MacDonald asked that the matter of the two Local Laws before
the Board be adjourned to the earliest possible time.
MR. MILLS moved that the matter of Local Law #2 and Local Law #3
be adjourned until May 25, 1970 for a Special Meeting after the
Public Hearing, at the Wappinger Junior High School, Remsen Avenue,
Wappingers Falls, New York at or about the hour of 9:00 P.M.
Seconded by Mr. Holt.

MR. FINNAN moved the rules be suspended for questions from the
floor, seconded by Mr. Mills and carried.
Mr. Fulton spoke again on the Rockingham Resolution. He said that
any resolution brought before the Board tonight could be rescinded,
advising that the structure of Schoonmaker Corp. had been reformed.
Mr. Cornell spoke briefly on consideration of appointment of
another attorney for the district.
MR. FINNAN moved the rules be resumed, seconded by Mr. Holt and
carried.
MR. HOLT moved the meeting be adjourned, seconded by Mr. Mills
and unanimously carried.
Meeting adjourned at 9:20 P.M.
