Brancato Mr. Mills stated that, in view of the, fact that the Park at, Jekoce Acres is 60 acres @ $297,000.00 - that cost is highter than any of the appraised property in the area. In talking to the En gineer to the Town, abutting owners and County H alth"De art- ment, he is of the opinion that -property is just too expensive for the Town, at this time. 40. MR. MILLS moved that the Town does not accept the Bid for Jekoce Acres, and that a letter be addressed to Mr. Brancato notifying him of the Board's decision, Seconded by Mr. Clausen. Inspection of Rockingham Sewer Mains Dear Mr. Ludewig: Enclosed please find executed agreement for T.V. Inspection of Rockingham Farms Sewer Mains between Robinson Pipe Cleaning Company and Schoonmaker Bros., Inc. in accordance with agreements with the Town of Wappinger dated April 18, 1969, and June 9, 1969. We suggest the Town of Wappinger schedule a meeting with all parties that are a part of this agreement the first week of March to work out the details. If you have any questions, please call me. Very truly yours, s/ Victor Caudy. Memo to: Town Board, Town of Wappinger From: Joseph E. Ludewig, Building Inspector Date: February 13, 1970 Subject: T.V. Inspection of Rockingham Sewer Mains Gentlemen: I would like to call to your attention a letter from Schoonmaker Bros., Inc., under date of January 30, in which they enclose an agreement for T.V. inspection of sewer mains in -.the Rockingham District. I think it is important that a meeting be called at which the four developers involved can come to an agreement on a more realistic date for this inspection, because we feel that the suggested final date of June 9 is too late in the season to show up defects in the sewer system which would be easily spotted while the presence of ground water is more likely to be high. Mr. Diehl stated that the Board should authorize Mr. Ludewig to set up a meeting with -all Developers concerned and speed up.the date of these inspection of the mains; so the inspections will be at a time that would be more advantageous to the Town. The Board was in agreement that Mr. Ludewig should follow through with his request. A letter was received from William Scheel, Presidnet of the Board of Directors, Wappinger Conservation Association, regarding the operation of the Town Planning Board. Mrs. Engelman spoke on behalf of the Association, asking if the section, between the northern end of Old State Road up to Ketcham - town Road on the west side of Route 9D could be included in the rezoning'Resolution and Public Hearing (set for March 5). This, she felt, should be included in the rezoning from RD to Residential (this is the area of the Montclair Apartments.) Mr. Diehl stated that nothing could be added to the Resolutions set for Public Hearing. A separate Resolution would have to be introduced and acted on separately. This was confirmed by the Attorney to the Town. Mrs. Engelman then asked that this be done. MR. MILLS moved that the Attorney to the Town and Engineer to'the Town be directed to prepare a proposal of an Ordinance to amend the Town of Wappinger Ordinance for the Board to consider, to rezone this additional section of RD area. Seconded by Mr. Clausen. In providing this service, as Consultant to the Planning Board, I will perform the following upon request by the Chairman of the Planning Board: a) Attend meetings of the Town of Wappinger Planning Board, provided notification is made ten (10) days prior to the specific meeting requiring my attendance. b) Review and make recommendations on planning and zoning matters that are before the Planning Board for consideration, c) Assist the Board in reviewing site plans and other develop- ment plans, based on Town Zoning Ordinance and comprehen- sive plan. Assist the Board in making minor revisions to the Town Subdivision Regulations, Zoning Ordinance and comprehen- sive plan. e) Make field inspections and trips at times mutually convenient. CLASUEN moved that Mr. Hirt be reappointed to the Town Zoning Board of Appeals for a five year term to expire February 1, 1975. Seconded by Mr. Mills. Motion Unanimously Carried The Clerk notified the Board of the receipt of the Report of Examination from the State of New York, Department of Audit and Control for the period covering January 1, 1966 through December 31, 1968. Motion Unanimously Carried 6 4...- 4 3 .- 43 February 16, 1970 Mr. Louis Diehl Supervisor, Town of Wappinger Mill Street Wappingers Falls, New York Dear Sir: It has recently been called to my attention that our old family cemeteries in the Town of Wappinger may quite conceivably be lost to new construction projects. In order to preserve these burial spots of the people who laid the foundation stones for this great Town of ours, we have only one recourse as far as I can determine. After considerable' communication with Mr. Edward Winslow of the State Department of History, I,have been informed by him that as a municipality our Town Board may enact legislation requiring that a developer purchasing a property upon which one of these old cemeteries is known to exist, shall suitably fence such cemetery and provide a mea ns of entrance and exits from the nearest highways or street to and from the cemetery. To the best of my knowledge we have two such cemeteries which conceivably will soon need such a protective measure, they are the Montfort Cemetery on the John Vorndran property and the Phillips Cemetery on the former Welter property. There are several other old cemeteries in our township which might well profit from such legistlation. I have a brochure from the State Department of History in Albany dealing with cemetery laws which I shall be happy to loan to our attorney Mr. Rappleyea if he cares to examine it. Trusting you will give this matter your prompt attention, I am Most respectfully yours, s/ Dorothy B. Alsdorf Historian, Town of Wappinger Mr. Diehl recommended that this letter, and whatever other informa- tion Mrs. Alsdorf does have, be turned over to the Attorney to the Town, Mr. Rappleyea for him to investigate and report back his findings to the Board. Mr. Finnan and Mr. Clausen reported the receipt of a letter from the New York State Depargitment of Transportation regarding their request for investigation of traffic conditions at the intersection of Rt. 9 and Myers Corners Road. The Department of Transportation reported that the detection device used for the left arrow signal in this instance can be timed for the 20 second maximum of vehicles are within the "loop" awaiting to make this turn. They also stated that another survey would be made at the 4° New Hacikensack-Rt.9 intersection to determine if an arrow signal would be required at this time. Mr. Mills reported that, at the Association of Towns meeting, Mr. Paul Hughes spoke on the Code of Ethics. The forthcoming proposals, changes, to the present Laws 805A-806-808. .At this time there isn't any official paper to look at to see if it could be amended to fit the Town of Wappinger. It has been mandated that all cities, Towns and Villages in the State of New York shall have a Code of Ethics by. July 1, 1970. Mr. Finnan reported that County Executive David Schoentag answered the question as to whether the Army Corps'of Engineers could remove the old Barge in the cove of the Wappingers Creek. Mx. Schoentag stated that if a disposal area can be found he was certain the Corp of Engineers could handle the disposal of the old Barge. The following Resolution was introduced by COUNCILMAN MILLS who moved its adoption: WHEREAS, the Incorporated Village of Wappingers Falls, the Town of Wappinger, the Town of Poughkeepsie and the City of Poughkeepsie have previously negotiated pursuant to Article 5G of the General Municipal Law for the purposes of jointly operating a landfill at the Dutchess County Airport and WHEREAS, an agreement has been reached as to the terms and conditions pursuant to which land fill will be operated and •- s WHEREAS, said agreement contemplates that the land fill operation will be self-sustaining by reason of the fees to be chargedlfor the use thereof and WHEREAS, the -agreement further provides for the reimburse- ment to the Town of Wappinger of its capital expenditures to date in the sum of $6,200.00 now, thereofore, BE IT RESOLVED, -that the supervisor is hereby authorized and directed to execute the attached agreement between the Inccor- porated Village of Wappingers Falls, the Town of Wappinger, the Town of Poughkeepsie and the City of Poughkeepsie on behalf of the Town of Wappinger, and he is further AUTHORIZED AND DIRECTED to execute on behalf of the Town of Wappinger the attached agreement between the County of Dutchess, the Town of Wappinger, the Village of Wappingers Falls, the Town of Poughkeepsie and the City of Poughkeepsie which agreement provides .for and the leasing of said land site. Seconded by: Councilman -Clausen Roll Call Vote: Supervisor Diehl Aye Councilman Clausen Aye Councilman Finnan Aye Councilman Holt Aye Councilman Mills Aye AGREEMENT This agreement between the Incorporated Village of Wappingers Falls, the Town of Wappinger, the Town of Poughkeepsie and the City•of Poughkeepsie Witnesseth that: WHEREAS, the Town of Wappinger and the Village of Wappingers Falls have entered into a lease with the County of Dutchess pursuant to which they are conducting a sanitary landfill operation on 55.3 acres on the west side of Route 376 and at the northerly boundary.of the Dutchess County Airport and WHEREAS, the City of Poughkeepsie and the Town of Poughkeepsie having abandoned the proposed City= -Town Joint Incinerator Project created by Agreement dated December 16th, 1963, as modified -by Agreement dated September 26, 1966, and intending to terminate their joint sanitary landfill in the Town of Poughkeepsie within the near future desires to participate in the landfill operation at the -County Airport site. NOW THEREFORE IT IS MUTUALLY AGREED AS FOLLOWS: 1. Authority This agreement is made pursuant to Article 5G of the General Municipal Law of the State of New York. 2. Purpose The purpose of this agreement is to outline the method of operation of a joint sanitary landfill operation to allocate responsibility for such operation and to provide a method for joint financing and sharing of the cost of the operation which is reasonable and fair to all parties. 3. Term This agreement shall remain in effect for five (5) years from the date hereof unless earlier modified or terminated by agreement of all parties. 4. Rent The obligation for the payment of rent to Dutchess County shall be the responsibility of each of the parties. 5. Title The joint project shall be called the Poughkeepsie. Wappingers Joint Landfill Project. 6. Administration Responsibility for the operation of the project shall lie with a board consisting of the Mayor of the Village of Wappingers -Falls, the Supervisors of the Towns of of Wappinger and Poughkeepsie and the City Manager of the City of Poughkeepsie. They shallservewithout payment and shall be re sponsible for the establishment of appropriate rules and regula- tions for the operation of the site; for the hiring and discharge of employees; for the purchase of necessary materials and equip- ment; for the preparation and submission for approval of an annual budget; for the collection of all fees and the payment of all expenses; and for all other matters necessary and proper for the purpose of carrying out this Agreement. The Board shall meet monthly and review all bills for payment. There shall be a yearly audit of the books and accounts of the Joint Landfill Project by an independent auditing firm. 7. Finances The chief fiscal officer for the project shall be the Commissioner of Finance of the City of Poughkeepsie who shall be responsible to the governing board for the submission of budget estimates each year on or before October 1st; for the collection of all accounts receivable and for the payment of all accounts payable. He shall segregate the funds of the project from other funds in his custody and shall keep separate and complete records . 46 with respect to all financial transactions concerning the project. The City shall be reimbursed for the cost of this service at a rate to be determined by the governing board. The Commissioner of Finance of the City of Poughkeepsie is hereby authorized to approve for payment vouchers for purchases and expenditures approved by the governing board. The books and accounts shall be maintained in conformity with the uniform system of accounts for cities as prescribed by the New York State Department of Audit and Control. 8. Services and Rates Because the.City of Poughkeepsie and the Village of Wappingers Falls are the only parties having a munici- pally,operated refuse collection system and because it is determined impractical and expensive to determine the town of origin of material delivered to the project by private garbage and refusecollectors, the parties agree that a charge shall be made for refuse delivered to the project at the following rates which may be increased, de- creased or modified in any way by the governing board. $3.000 per ton for all trucks, including pickup trucks; minimum charge for any truck $2.00. It is agreed that the operation of the joint Landfill Project shall be self sustaining and no municipality shall be required to subsidize the operation thereof. 9. Collections and Security for Payment The fiscal officer shall bill each municipal and private refuse collection agency on the basis of the tons delivered to the project. Any private refuse agency shall be required to execute an agreement with the governing board'and deposit as security in cash an amount equivalent to the estimated average monthly billing for such agency. 10c. The governing board•shall'make necessary:purchases_of materials_.and.equipment and": shall be authorized..to rent equipment' for_ theaoperation of the project, and for these purposes shall have the rate subject to applicable: laws =and _regulations, to make contracts." Purchases made-bytthegoverning board through such ibidding"-shall be".utilizing the services of -the board .of contract and ,supply -of the .City of ' Poughkeepsie: 12. Capital Expenditures Capital expenditures shall be financed separately by each of the parties hereto.' It is'intended'that the heavy equipment necessary to operate the project shall be rented by the joint project, and the remaining capital expenditures for the project are estimated to be $40,000 allocated as follows: improvements now at site, $6,200.00, pickup truck, $3,500.00, gatehouse, including weighing scale and: counter.calculator, $20,000.00, road work, $10,300.00. Each of the parties shall, upon the signing of this agreement, deposit =with the fiscalofficerits proportional part of the total capital expenditures. The Town of Wappinger shall be reimbursed. =for improvements -now at^theDsite=in the sum of $6,200.00 upon the signing of this agreement. Each of the parties shall, upon' the signing. of this agreement; deposit with the fiscal officer a proportional part of the total expenditures calculated by using the percentages.specified in paragraph ten;above:. The Town of Wappinger shall be reimbursed for improvements now at the site in the sum of $6,200.00 upon the signing of this agreement. v 47 13. 'Employees The governing board shall have the authority to hire and discharge such persons as may be necessary for the proper operation of the project, subject to applicable Civil Service Laws, rules and regulations. Such employees shall be subject to Article 18 of the General Municipal Law with respect to conflicts of interest and employees handling funds shall be bonded in an amount determined by the governing board. The qualifications of the Superintendent of the project shall be subject to review and approval by the Dutchess County Helath Department. The governing board shall have the authority to establish rules regarding terms and conditions -of eitployement, rates of pay,sick leave, vacations, hours of work and employee benefits. Employees of the Joint Land- fill shall, for the purposes of retirement, Social Security,. Workmen's'Compensation, Health and Hospital Insurance Coverage, Civil Service, payroll and other related problems of joint employ- ment, be deemed to be employees of .the City of Poughkeepsie and the city -of Poughkeepsie shall be reimbursed for any additional costs to it by reason of -this .provision. 14. :Liability The -fiscal officer shall procure -and maintain a policy'of liability insurance which shall protect each of the - parties in the -amounts. and to the extent required by the agreement of lease with Dutchess County. To the extent that the parties hereby'agrees to indemnify and hold the: County ,of Dutchess and each .of the other parties, harmless in the proportions fixed at paragraph 10. 1.5. Rights' upon Termination of this Agreement or:Upon Termination of the Agreement of Lease. The parties agree that six months prior to the expiration of this agreement and of any renewal thereof, the governing board will meet to consider renewal of the agreement and the need for the acquisition of a new site. Upon termination of this agreement for any reason or upon termination of the lease agreement, in .the event that an agreement cannot be reached be- tween the parties,, the equipment shall be put up for sale at public auction pursuant toiterms to be established by the govern- ing -board, and the proceeds of such sale shall be refunded to the parties to the agreement in the percentages specified in paragraph 10 above. Title to personal property purchased by the Joint Project shall be taken in the name of the City of Poughkeepsie as custodian for the Poughkeepsie-Wappinger Joint Landfill Project. 16. Arbitration The parties agree that in the event that disputes arise with respect to the operation of this project of the terms and provisions of this Agreement, any:such dispute shall be submitted to arbitration pursuant to Article 75 of the Civil Practice Laws and Rules. In Witness Whereof the parties have executed this agreement on the 19th day of January, 1970. Mr. Clausen requested Mr. Diehl to propose to the governing Board of the.Sanitary Landfill they negotiatea contract with.the County of Dutchess for the removal of excess fill from the site directly adjacent to the Landfill site. It has been indicated it would be a very nominal fee, and the proximity of the fill is so close that the transporting of the fill should be nominal. MR. CLAUSEN moved the rules be suspended, seconded by Mr. Holt and carried. 8 Mr. Incoronato said that Mr. Rappleyea indicated there would be no, financial __disadvantage' entering into_ the Landfill Agreement with the other municipalities.(. Is there any financial advantage in entering in withthe other municipalities? Mr. Clausen noted_that the Town was running at a deficit at present. Mr. Diehl added that under the present contract with the County, the Town cannot keep them out. Mr. Incoronato said he feels the Town hag abbreviated the potential life of the Landfill site by bringing in the other municipalities, unless the Town absolutely had to, and he isn't sure the Town absolutely had to. MR. MILLS -moved the rules be resumed, seconded by Mr. Clausen and carried. MR. CLAUSEN moved to introduce Local Law #1 of 1970 - "A Local Law Regulating the Use of Public Sewers in the Town of Wappinger". Seconded by Mr. Holt. Motion'.Unanimously Carried 1: The. following resolution was proposed by MR. MILLS who.moved its adoption: . WHEREAS, there has been duly presented and introduced at a meeting of this Town Board held on February 17, 1970,_ a proposed Local Law entitled "A Local Law.Regulating the Use of Public Sewers in the Town of Wappinger." and WHEREAS, the provisions of the Municipal Home Rule Law require that no local law shall be passed by the Legislative body of the Town until -a Public Hearing _thereon. -has been _held before -:such body, NOW, THEREFORE, BE IT RESOLVED as follows: 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 9th day of March 1970, at 7:30 o'clock P.M. on such day, at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger_by due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Mr. Mills stated that before voting on the transfers from the Supervisors' -office, he would:like to,see the Supervisors' report on the Balances of Accounts, as he knows the Contingency Account is minimal this year. (The following transfer was a late Central Hudson bill for 1969 budget item.) The following Resolutionwasoffered by MR. CLAUSEN: —WHEREAS, the .sum of $4,400.00 has been appropriated to Acct. #910 (Highway Lighting), this account has been overexpended and overdrawn by the sum of $13.10. Said Committee shall select its own chairman and shall perform the following functions: 1. To meet with the officials of the Town of Wappinger, County of Dutchess and State of New York and to acquaint itself with programs involving environmental and pollution problems. 2. Mr. Finnan made the statement regarding his proposal for an emergency fund to be set up for the Building Inspector. He had discussed with the Building Inspector and Town Board, a fund of $3,000 to be made available to the Building Inspector to. use in emergency situations. As the Board and Building Inspector have asked for more time to consider it, he will postpone his proposal to a later date. MR. CLAUSEN moved therulesbe suspended, seconded by Mr._Mills and carried. Mr. Incoronato, with regard to Mr. Finnan's proposal, suggested a fund be established at $1,000 per 100 units as an escrow account, from the apartments, then the monies would be available as required. Charles Cortllino suggested there should be a code for prevention before things occur. If the codes could be brought upto date some incidents could be. avoided. MR. MILLS moved the rules be resumed, seconded by Mr. Clausen and carried. John, Schouten, Ketchamtown Road had asked to speak before the Board 52 regarding the proposed growth of the Town. On water, he mentioned the pumping station at Chelsea. It is his understanding that seven years ago New York City decided they didn't need .this station, scrapped all the quipment, and sold the property to a Mr. Levine, would there be a chance of the New York Board of Water Supply allowing Wappinger to use the water. Mr. Diehl interrupted saying that a letter had been.received from.Maurice M. Feldman, P.E. Commissioner of the City of New York Environmental Protection Administration, stating that -the Chelsea pumping station could not be considered as a source of,water supply for a water district, first, because this station .pumps_water from the Hudson only in times of emergency, when regular water supplies are dangerously low,and second, a proposed district would be ineligible. under. Section K51-420 of the Administration Code of the City of New York. No municipality or water district in Dutchess County may obtain water from the New York City system. Mr. Schouten concluded that despite the letter, if the facilities ever are put up for sale, the Town should be ready to invest in its purchase. Mr. Luke Little, River Road North,, asked that the next time the Town Board meet with the Planning,Board,in executive session, they should discuss their responsibilities -he feels there's.a lot of confusion, even on the Planning Board itself, of their responsibil- ity. He pointed out section 434.014 of the Town Zoning Ordinance, and stated that a member of the Planning ,Board was uncertain as to the extent of responsibility and authority it implied. John Schouten, referring to Southern Dutchess 1990, asked if the Board would reconsider it, and consider resigning from it. He feels it would be better to go it _alone and plan our own community. Mrs. Engelman suggested that the Town considerbuying the property that Riverdale Apartments owns,_if._the Zoning is changed. She feels it would ,make a beautiful recreation spot. Mr. Diehl referred this suggestion to the Recreation Committee - Messrs. Clausen and Finnan to look into. Supervisor Diehl called -for a five minute recess at 9:30 P.M.
