Adjournment 21 The Regular Meeting of the Town Board of the Town of Wappinger was held January 12, 1970 at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:14 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Others Present: Allan E. Rappleyea, Attorney to the Town William Horton, Superintendent of Highways Reports from the Building Inspector, Town Justices and Supervisor for the month of December were received. MR. MILLS moved the monthly reports be accepted and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried Bills presented for payment were as follows: General Fund $ 6,298.23 Highway Fund 599.54 OKSD $ 154.08 FSD $ 114.70 OKWD 119.24 FWD 141.73 RFSD 292.36 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Finnan. Motion Unanimously Carried MR. MILLS moved that the Regular Meeting of the Town Board for the month of February be changed from Feebruary 9, 1970 to February 17, 1970 at 8:00 P.M. Seconded by Mr. Clausen. Motion Unanimously Carried The following letter was received: January 4, 1970 Town Board Town of Wappinger Wappingers Falls, New York Gentlemen: Since Russ Place has had its new drainage program completed, I have suffered on a number of occasions water seepage into the basement of my home. As this phenomena has never occurred before, 7 - 23 el even during the spring floods, I can only attribute it to the improvement of Russ Place. Would you please give me the answer to the following questions? 1. What is the approved plat plan height of the road? 2. Has that height been changed when improving Russ Place? 3. MILLS moved Mr. Cortellino's letter be received and turned over to the Engineer to the Town and Mr. Horton, Highway Superin- tendent for their evaluation. Seconded by. Mr. Clausen. Motion Unanimously Carried A letter was received from the Planning Board indicating that they had interviewed Mr. James Spratt, P.E. for possible planning con- sultant services to the Town (and enclosing a proposal submitted by Mr. Spratt.) The Planning Board recommends that it be accepted. MR. FINNAN moved the proposal from Mr. Spratt be turned over to the Attorney to the Town for his review. Seconded by Mr. Mills, Motion Unanimously Carried A letter was received from Russell Aldrich, representing Herbert Stenger, asking when a Public Hearing would be set on Mr. Stengers' rezoning application. MR. MILLS moved this matter be tabled for further study as there is still some question as to which would be best to rezone this area - piece meal, or hope for an overall development plan. Seconded by Mr. Clausen. The following letter was received: Town Board, Town Hall, Wappingers Motion Unanimously Carried December 22, 1969 Town of Wappinger Mill Street Falls, New York Attention: Elaine Snowden, Gentlemen: Town Clerk Re: Ye Old Apple roads, Town Realty Corp. Orchard, Inc. -sub -division of Wappinger, Appollo and Ye Old Apple Orchard 24 Please be advised that we are attorneys for John Arborio, Inc., thecompany which built the roads in the above referred to sub- division and that there is presently a balance due for said work for $10;848.00 since December of 1968. Please be further advised that we are commencing the necessary legal proceedings to make sure that the monies due the company be paid and that we will take necessary action on the bond if avail- able, relative to this matter. It is our understanding that the bond covering the matter was issued by the Peerless Insurance Company of Keane, New Hampshire, and that we are hereby notifying them that we will proceed against them also unless the matter is amicably resolved. We are hereby notifying you of the present situation, so that the Town will have full knowledge of the circumstances surrounding the construction of the roads' in the above referred to sub -division with the hope that you will take the appropriate action. The following letter was received: Town Board Mill Street Wappingers Falls, New York Gentlemen: Motion Unanimously Carried December 5, 1969 Re: Traffic Light Intersection on Route 9 Several requests have been made for a traffic light on the intersection near the above mentioned apartments on Route 9; but all in vain. The need for a traffic light at this intersection is in the best interest of those living in the apartments (and there are many) and to those going thru on Route 9. There have been many near accidents (and probably some really happening) on this intersection. Not only is it hazardous, but also very inconvenient to the people who have to get to work. Some of our tenants have complained that they had to wait sometimes 10 to 15 minutes ,before they see a clearing to get out on to Route 9. Not only' are they late for work, which is bad enough in itself, but the inconvenience and time wasted. Need I say that what is more important and in the interest of all citizens, that this light is a MUST? For Safety Reasons as well as personal. We are aware that the Town Board had-wiitten to the State Traffic Commission but has had no response to date. Motion Unanimously Carried A letter was received from the Putnam-Dutchess Chapter of the New York State Building Officials Conference inviting any of the Towns' Officials to attend their annual Installation who is desirous of doing so. Installation would be Friday, January 16, 1970. MR. MILLS moved the invitation be received and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from the Rev. Robert A. MacGill regarding replacements for two narcotic councilmembers. MR. CLAUSEN moved that Judson Williams, Attorney, be appointed to the Narcotics Council. Seconded by Mr. Mills. Mr. CLAUSEN moved to appoint Stanley Schab to the Narcotics Council, seconded by Mr. Finnan. Motion Unanimously Carried A problem has been brought to light by the Post Office regarding a short section of Myers Corners Road- cut off by the new Route 9 - has been designated by a sign installed by the County as Middlebush Road. The Post Office would appreciate knowing the official name of this section of road between new Route 9 and old Route 9. MR. CLAUSEN moved that that section of Myers Corners Road lying between new Route 9 and old Route 9 be designated and known as Middlebush Road. Seconded by Mr. Finnan. _ Motion Unanimously Carried Recommendation was received from the Dutchess County Department ofgPlanning regarding the rezoning application of Crimswal Realty. MR. CLAUSEN moved that the rezoning petition of Crimswal Realty be referred to the Attorney to the Town to prepare and submit to the Board an ordinance to amend the Ordinance of the Town of Wappinger regarding the Crimswal rezoning petition. Seconded by 26 Mr. Mills. Motion Unanimously Carried MR. MILLS moved that the following letter be placed on record, seconded by Mr. Clausen: January 7, 1970 Mr. Louis Diehl Wappingers Town Board Wappingers Falls, N.Y. Dear Sir: Please accept our sincere thanks for the fine job done by the Highway Dept. in the Chelsea area during the recent heavy snows. All roads were kept open during and after the storms which was a great help when emergency cases needed_ our attention. Thanks again: Chelsea Fire Co., Inc. s/ John G. Todd, Sec'y Mr. Mills reported on the Dutchess County 1990. He mentioned that he had, from Fred P. Clark Associates, copies of proposed joint planning work program Southern Dutchess area for the Town Board members. Mr. Clausen reported on the Sanitary Landfill. Last week he and Mr. Rappleyea met with County Executive Schoentag_and County Highway Commissioner and Mr. Scoralick Herb Shein and Mr. Welsh, County Attorney. One question brought up was "is there fill available on the present Landfill site, and does the Town have the right to remove additional fill from a piece of land across Rt. 376 directly opposite the Landfill site He was told that the Town originally had submitted, for an operation of a portion of the Landfill site and that the Town has started to exceed this particular area and that it would be necessary for the Town to request a larger area of the site if they are going to work it. More important is that there is a water problem -water coming from Rt. 376. It is recommended that the Town pipe, or make a ditch to take this water away from the present Landfill site. Also there was a recommendation that the Town should drain the site alongside the present site to get more fill. Until the condition of drainage is met, The Town, at this time, could not remove any more fill. 27 The second part of the question was that, as per contract with the County, the Town does not have any matter of rights to draw addition- al fill from the property across from the Landfill site., Mr. Clausen recommended to the Board that the Town does not draw any additional fill from the Landfill site until the proper drainage study has been made and executed and, that the Town go on as it has been direct- ing the Highway Superintendent to get the fill as needed. Mr. Clausen added that he would get together with Mr. Lapar and Mr. Horton and get an additional provision before the county. MR.MILLS,moved the rules be suspended, seconded by Mr. Clausen and carried. Mr. Incoronato suggested the Town negotiate with the County to purchase fill from across Rt. 376 as it would seem more economic- ally feasible. Mr. Eck asked why they couldn't use the fill on the existing site. Mr. Cortellino askedaboutrates of refuse collectors if the Town went into agreement with the Town and City of Poughkeepsie. MR. MILLS moved the rules be resumed, seconded by Mr. Clausen - and carried. Mr. Clausen reported for the Highway Committee that they had a request for a study to be made of speed limits on -Myers Corners Road. A meeting washeld with the New York State Department of Transportation representatives and the County Department of Trans- portation a few weeks ago. There are two alternatives -one study entertained would be a 35MPH speed limit from the intersection of All Angels Hill Road with Myers Corners Road to new Rt. 9, the second would be the possibility of a 35MPH "School Zone" east of the Myers Corners Road Elementary School to west of Ketcham High School. Mr. Finnan noted that a school zone was not applic- able as there were no walking students -the School District provides bussing. -: MR. CLAUSEN moved the rules be suspended, seconded by Mr. Mills and carried to permit questions from the floor regarding speed limits on -Myers Corners Road. 28 MR. CLAUSEN moved the rules be resumed, seconded by Mr. Mills and carried. MR. CLAUSEN moved that the Town Board ask for a study sponsored by the New York State Department of Transportation on Myers Corners Road from the intersection of All Angels Road to new Rt. 9 asking for the reduced speed limits of 35 MPH. Seconded by Mr. Finnan. Motion Unanimously Carried MR. CLAUSEN moved that the Town request the New York State Depart- ment of Transportation to undertake a study for the possibility of reducing speed to 35MPH on Myers Corners Road on either side of the two schools (Myers Corners Elementary and Ketcham High), located on said road. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Clausen commented that theAssociationof Towns was conducting a Seminar on Code of Ethics. He and Mr. Mills agreed that they would take advantage of this before they come up with recommenda- tions to the Town The following resolution was offered by MR. -MILLS who moved its adoption: n . FINNAN moved these above three Ordinances be referred to -the Dutchess County Department of Planning and the Town Planning Board for their review and recommendation. Seconded .by Mr. Clausen. Motion -Unanimously Carried Mr. Clausen commented that there had been a recommendation for a reduction of speed in an area of All Angels Hill Road and Myers Corners Road from the State several months back. It might behoove the Town to look again at this recommendation. Mr. Horton was asked to check into it. Mr. Mills noted that there was an open house shceduled at Mt. Alvernia for the Town of Wappinger Narcotics Council both Tuesday January 13th and Thursday January 15th. MR. MILLS moved the rules be suspended, seconded by Mr. Clausen and carried. Mr. Eck asked about the North Wappinger Sewer Improvement -is it going to take another two years to get it going. Mr. Bisom asked Mr. Diehl why he was interested in the proposed recreation site on All Angels Hill Road. He couldn't understand why the Town wanted to buy swamp and stripped land. Mr. Walter Cronin spoke on the hazardous condition on Route 9 at the intersection of New Hackensack Road - could there be a direction- al arrow installed to alleviate congestion. Charles Cortellino elaborated on the intersection. of Route 9 and New Hackensack Road by noting the exits from Imperial Plaza, Wappingers Plaza and.the sharp uphill curve off Route 9 also create a traffic problem. Dr. Engelman asked if there would be any construction permitted until the outcome of the proposals for rezoning is determined. Mrs. Donald Bradford, Old State Road read a letter, directed to the Wappingers Conservation Association, from Willis Stevens (dopy of letter furnished to Town Clerk to be placed on file) stating that the New York State Department of Health was interested in the proposed project, and that the developers are required to submit geological data to that department to be approved prior to construction. Mr. Luke Little read a letter, addressed to Mrs. Engelman, from Scott Warthin Jr. (copy of letter furnished to the Clerk to place on file.) Dr. Garell's report was read (copy furnished to place on file.) Robert Steinhaus asked if something could be done about the left turn arrow on the traffic light at Route 9 and Myers Corners Road. The Highway Committee agreed to look into the situation. Mr. Mills stated that, with all the talk about the water problem, he sincerely hopes that all of the interested parties, it becomes very evident that the Town is going to need a water system in the Town, and to put in a water system the Board is going to need a lot of help -so it behooves all of the people who are presently interested in the seriousness of the water problem, when and if it comes to a proposal, get solidly behind it because it's going to be needed (like today). Dr. Engelman asked why not combine water and sewer districts. Mr. Mills answered that would be impossible as they fall under different Transportation Acts. The Doctor then commented they would support these Districts 100%. Mr. Milts said "we'll call on you." Dr. Engelman replied "we'll be ready." MR. MILLS moved the rules be resumed, seconded by Mr. Clausen and carried. Mr. Diehl referred the two problems regarding traffic lights on Route 9 to the Highway Committee for their investigation. MR.
