Adiournment 453 The Regular Meeting of the Town Board of the Town of Wappinger was held on October 13,,1969, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:04 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Councilman Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town William Horton, Superintendent of Highways Kenneth Croshier, Deputy Superintendent of Highways Supervisor Diehl asked for one minute of silent prayer in respect to former Congressman Joseph Y. Resnick. MR. CLAUSEN moved the acceptance of the Minutes of, Aug. 11, 1969, as submitted by the Town Clerk be and they hereby pre approved ;. seconded by Mr. Mills. Motion Unanimously Carried Reports for the month of September were received from the Building Inspector, Town Justices and Supervisor. MR. MILLS moved that the reports be accepted and placed on file, seconded by Mr. Clausen. Motion Unanimously Bills in the following amounts were submitted General Fund $25,849.99 OKSD $ 175.65 Highway Fund 11,386.41 OKWD 126.88 RFSD 220.08 Carried for payment: $ 210.40 1tw.W. 150.35 MR. FINNAN moved the bills be paid, subject to audit, seconded by Mr. Clausen. Motion Unanimously1 Carried A letter was received from Allan Rappleyea, Attorney to the Town, advising that he had examined into the validity of the -$6,780.00 Revenue Anticipation Renewal Note #1, Sept. 11, 1969, and found it has been authorized and issued in accordance with the pertinent provisions of the Constitution and related statutes of the State of New York. MR. CLAUSEN moved that the two letters regarding Revenue Antici- pation Note rdnewals from Mr. Rappleyea, be accepted and placed on file. Seconded by Mr. Mills. Motion Unanimously Carried The Town Clerk had been served with Tax Reviews by Spook Hill Properties Inc. vs. Town of Wappinger and the three Town Assessors;, Jerad Pacilli vs. Assessors; and Louis Eck (3); Louis Eck, Louis Elkies and Bedsie Joffee (2). MR. FINNAN moved that the tax reviews from Spook Hill Properties, Inc. Jerad PaCilli, Louis Eck (3) and Louis Eck, Louis Elkies and Bessie Joffee be referred to Allan Rappleyea to represent the Town. Seconded by Mr. Clausen. Mbtj.on Unanimously Carried Mr. Jack Kolaian was present to .give a brief explanation of the two Seminars on "Refuse Disposal in Dutchess County", Oct. 22nd & 29th in Millbrook. MR. CLAUSEN moved that any Town official or officer w iehing to attend, be -given permission and that their,legitimate expenses be a Town charge. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Bruce Mackachnie, President of the Oakwood Knolls Civic Association had requested to be heard on a rezoning request for multi -dwellings on Section II of Oakwood. As Mr. Mackechnie was not present, his letter was ordered placed on record as follows: October 1, 1969 Wappingers Falls Town Board Mill Street Wappingers Falls, New York Gentlemen: 455 The residents of Oakwood Knolls Sec. I, request to be heard at the October meeting of the Town Board and their business to be put on the agenda at that time. This concerns the proposed multi -dwelling construction in Oakwood Knolls Sec. II, and the proposed rezoning of that area. Included is a letter, copies of which have been sent to the Town Planning Board and the Zoning Board, stating our petitions concerning this proposed development, and we would like to be put on notice when this matter comes up for deliberation, so that we may express our opinions publicly at that time. October 1, 1969 Wappingers Falls Planning Board Mill Street -Wappingers Falls, New York Gentlemen: The residents of Oakwood Knolls wish to present a petition to the Town Planning Board concerning the proposed development and rezoning of Oakwood Knolls Sec. II. First, we request that the existing zoning of R-40 should remain. Second, if indeed any new construction is approved for Oakwood Knolls Sec. II, then the residents of Oakwood Knolls Sec. I would like to see included plans for a recreation area for them which are in accordance with the Planning Boards' regulations. Third, the residents of Oakwood Knolls Sec. I are express- ing their deep concern for the water and sewage systems and of any possible future hookups to our systems. No new construction in Sec. II should be allowed unless provision is made for the rehabilitation of our water and sewage systems in advance. Fourth, no improvements should be made in Sec. II until all improvements have been completed in Sec. I namely: the roads to the pumphouse, water, and sewage plants to be completed; the ditch in the area to be removed; the mall and trees to be planted at the entrance to the development. These improvements are on record with the Planning Board and have yet to be done or completed. We wish to be definitely placed on notice when this matter concerning Oakwood Knolls Sec. II comes up for deliberation so that we may have an opportunity to express our opinions. Yours truly, s/ Bruce MacKechnie, Pres. Oakwood Knolls Civic Assoc. Inc. Don Mendorf requested to speak to the Board regarding the roads and drainage in Wildwood Sec.II. Mr. Mendorf said it was his recollection that the Attorney had mentioned getting the Performance Bond ligi- gation on the September calendar, it now being October, has any- thing developed. Mr. Rappleyea commented briefly that there had been meetings with the developer seeking methods to resolve the problem, but these meetings were to no avail. A short discussion ensued reiterating obligations and omissions on the part of the developer. Mr. Mendorf asked if Section 2A could be considered alone, as Section II at least has cover on the roads, and then asked what would happen if Mr. Cornell failed to maintain these roads this winter. Also, in connection with the roads, what could the Town do about road signs? There was no road sign on Split Tree Drive. The Board informed him that signs were part of Cornells' obligations. The question of water pressure was brought up again, and Mr. Mendorf said he had heard it was due to faulty plumbing, had the Town inspected the water lines. Mr. Rappleyea informed him there were no Town laws regulating water at the time these lines were installed, it was under the Dutchess County Dept. of Health. Mr. Lapar stated the residents'only recourse would be the Public Service Commission. Mr. Mendorf further mentioned Mr. Cornell using a model home for our office and maintaining a trailer field office, and storage of construction equipment. The following letter was read: Malcolm Cornell, Inc. Widmer Road Wappingers Falls, New York Attention: Mr. Malcolm Cornell October 10, 1969 457 Dear Mr. Cornell: I believe that you have completed construction of all the homes you intend to build in your Wildwood Forest projects, and that you are continuing to use the Model Houses in the project for the purpose of advertising and selling homes which you are building in locations other than in Wildwood Forest. You seem also to be continuing to use the trailer on Split Tree Drive as a field office and the area around same as parking area for employees' cars and for the storage of construction machinery which is used primarily in other developments. The above facts, coupled with advertisements appearing frequently in local papers which direct the public to your office on Widmer Road, indicates that you are conducting your "off-site" home building business in the Wildwood Forest residential development, which is in violation of the Town Zoning Ordinance. During the period that you were actively developing Wildwood Forest as a subdivisionyou, as well as some developers in other areas of theTown, were permitted to use model houses in order to show prospective buyers what you had to sell them on a lot in your development. You are not entitled to conduct an "oPf-site" home building business because the area in which you are operating is an R-20 residential zone, which does not permit commercial ventures. You are hereby notified that you are to discontinue the operation of your off-site business at once, and to remove the trailer field office, and to cease storing contractor's machinery in the Wildwood Forest subdivision. Ludewig Zoning Administrator Town of Wappinger Mr. Walter Cronin said he felt there should be some emergency measures taken, as in a few weeks it would be too late to do anything - cold weather and snow. Mr. Gerard Lustig asked if the price offered to settle (1/3 of what monies would be needed to complete the roads according to specifications) was for blacktop or just oil and chip, and had the Town written to Mr. Cornell telling him to put in oil and chip. Mr. Fred DiMaria commented that he thought his taxes should be reduced because he was living on a dirt road, not a blacktop one that was supposed to be there. Discussion then continued about Mr. Cornells' obligations regarding the roads - public safety and hazards. A letter was received from Mr. Leo M. Ritter regarding a problem of the sewer line in the street in front of his clients premises, ;ii Wildwood Sect., I - Mr. Trygve and Mr. Olsen. The letter indicated that the L&A Filtration lines, which are presently receiving sewage from individual houses in that area are on a bad pitch which creates a -backup condition in his clients houses. Mr. Ritters' request is that prior to any purchase by the {-.Town of the L&A Filtration system this condition be corrected by L&A. MR. CLAUSEN moved that this letter be referred to Mr. Lapar to contact Mr.. Leo Ritter informing him that the Town is in receipt of his letter (Oct. 7, 1969) and that the matter is a private one between Mr. Olsen and L&A Filtration Corp. seconded by Mr. Mills. Motion Unanimously Carried Notice of Public Hearing was received from James J. Lyons, Village Attorney, regarding the Village of Wappingers Falls Proposed New Zoning Ordinance. Public Hearing scheduled for 8:00 P.M. Oct. 22, 1969 at the Knights of Columbus Hall. Mr. Diehl directed that this notice of Public Hearing from the Village be placed on file. Mr. Clausen brought up a letter that had been received from Harry Raker regarding water pipes in Tall Trees development. MR. CLAUSEN moved that the communication and problem be turned over to the Attorney to the Town and Engineer to the Town to answer on behalf of the Town. Seconded by Mr. Mills. Motion Unanimously Carried Mr. Mills mentioned having spoken to Dr. Heisler regarding the views of the Planning Board on the "Southern Dutchess 1990" - that Board hadn't been polled as yet but the results wouldbe forwarded to the Town Clerk to send to the Town Board. Mr. Clausen stated that he had discussed a further street lighting change for the Town Garage with Mr. -Barbaro, Central Hudson Represen- tative, after they had evaluated the installations.previously authorized and they concluded that the present lights weren't provid- ing sufficient light in the areas needed. The new lighting would '7 C 4 5-9 would include installation of a 20,000 lumen at entrance, replace a 20,000 on a 14' pole, replace a 20,000 lumen with a 60,000 lumen. MR. CLAUSEN moved that the Supervisor be authorized to sign the street lighting authority order (#8366) authorizing Central Hudson Gas & Electric Corp. to make changes to the street lighting service for the General Town charge. Seconded by Mr. Heady. Motion Unanimously Carried A Public Hearing having been duly conducted by the Town Board on August 25, 1969, on a proposed amendment to the PI Zoning (Affi- davits of Posting and Publication on file with the Town Clerk), the amendment was placed before the Board for their consideration. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF WAPPINGER. The following Ordinance was offered by MR. CLAUSEN who moved its adoption : Be it enacted and ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by the laws of the State of New York, as follows: Section 1. The Town of Wappinger Zoning Ordinance, adopted January 29, 1963, as amended from time to time is hereby further amended to provide that the classification designated PI (PLanned Industry) pursuant to Section 423 of the Zoning Ordinance shall read as follows: PI - Planned Industry (Subject to site plan review by Planning Board. Section 440.) 1. Any industrial or manufacturing use, including fabrication, converting, processing, altering, assembly or other handling of products, the operation of which uses only electric power not generated on the site (except in emergencies), and which use normally will not cause or result in any (1) dissemination of noise, vibration, excessive light, dust, smoke, gas, fumes, odor, or other atmospheric pollutant beyond the boundaries of the site on which the use is located; (2) menace by reason of fire, explosion, atomic or induced radiation or other physical hazard; (3) harmful discharge of waste materials; (4) unusual traffic hazards or congestion due to the type and number of vehicles associated with such use; (5) electrical, visual or physical interference with aircraft landing, take -off and other maneuvers. a. Any accessory building or use customarily incidental to a permitted use. (Signs and lighting regulated as in the LB District.) CLAUSEN, who moved their adoption: WHEREAS, the Acct. #504 (Voting Machines and Purchases) has been overexpended and overdrawn by the sum of $2,157.00, BE IT RESOLVED, that the Supervisor be authorized to transfer $2,157.00 from Acct. #1202 (Contingency - Town Wide) to Account #504 in order to eliminate the overdraft and reimburse said account. - WHEREAS, the Acct. #711 (Justice Court -Compensation of Employees) has been overexpended and overdrawn by the sum of $1,200.00, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,200.00 from Account #705 (Town Clerk -Compensation of Employees) to Acct. #711, in order to eliminate the overdraft and reimburse said account. - WHEREAS, the Acct. #1209 (Ambulance Contract) has been overexpended and overdrawn by the sum of $4,000.00, BE IT RESOLVED, that the Supervisor be authorized to transfer $4,000.00 from Acct. #1202 (Contingency -Town Wide) to Acct. #1209 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #901 (Dog Warden) has been overexpended and overdrawn by the sum of $460.30, BE IT RESOLVED, that the Supervisor be authorized to transfer $460.30 from Acct.#1202 (Contingency -Town Wide) to Acct. #901, in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #912 (Traffic Signs, Signals & Lighting) has been overexpended and overdrawn by the sum of $1,987.00, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,987.00 from Acct. #1202 (Contingency -Town Wide) to Acct. #912, in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #704 (Town Clerk -Office Expense & Other) has been overexpended and overdrawn by the sum of $87.87, BE IT RESOLVED, that the Supervisor be authorized to transfer $87.87 from Acct. #705 (Town Clerk -Compensation of Employees) to Acct. #704, in order to eliminate the overdraft and reimburse said account. q 461 WHEREAS, the Acct. #1312 (Refuse & Garbage) has been over - expended and overdrawn by the sum of $4,282.53, BE IT RESOLVED, that the Supervisor be authorized to transfer $4,282.53 from Acct. #1311 (Contingency -Part Town) to Acct. #1312, in order to eliminate the overdraft and reimburse said account. Seconded by: Mr. Finnan Motion Unanimously Carried Mr. Mills asked the Supervisor if these Departments had been notified before they were overexpended that they were going to be overexpended. Mr. Diehl answered to the best of his knowledge, yes. RESOLUTION AUTHORIZING STANDARDIZATION IN PURCHASE BY HIGHWAY DEPARTMENT OF TRUCKS The following regolution was introduced by COUNCILMAN HEADY who moved its adoption. WHEREAS, the Town of Wappinger Highway Department now has several F.W.D. trucks and WHEREAS, such trucks require servicing and repairs and it would be economical if all parts and repairs were performed by the same firm, NOW THEREFORE, BE IT RESOLVED, that the Town Superintendent of Highways and the Engineer to the Town are hereby authorized to prepare -specifications for a new truck and that such specifications shall be limited to F.W.D. trucks and be it further RESOLVED, that the Town Superintendent of Highways is hereby authorized to seek public bids on said truck. Mr. Cronin, in regard to the proposed apartments for Sect. II of Oakwood Knolls, registered opposition to the rezoning request of Mr. Shapiro for this purpose. He also asked the status of the North Wappinger Sewer Improvement. Mr. Mills stated that some residents on Rt. 9D had informed him that the Montclair Apts. sewer system was apparently acting up again, as there had been a very bad odor in that area. MR. MILLS moved that the Town Clerk notify Mr. Ludewig to have him follow it up and see what he could do to get it back to proper performance. Seconded by Mr. Heady. Motion Unanimously Carried MR. MILLS moved that a record of accounts be furnished by the Supervisors' Office for the Boards' information at the Public Hearing on the Budget, Oct. 30th. Seconded by Mr. Heady. Motion Unanimously Carried Mr. Diehl asked if there were any questions from the floor under new business. Mr. Mendorf asked that there be a concerted effort to keep the Town taxes down to offset the school taxes. Charles Cortellino had a question regarding the requirements on laying of the water and sewer lines specifically in'Tall Trees, if shown on plat plan - who was responsible for inspection, or enforcement of regulations. A short discussion ensued between Mr. Lapar & Mr. Cortellino on this subject. MR. MILLS moved the meeting be adjourned, seconded by Mr. Clausen and unanimously carried. Meeting adjourned at 9:21 P.M.
