The Regular Meeting of the Town Board of the Town of Wappinger'
was held on Monday, May 12, 1969, at the Town Hall, Mill Street,
Wappingers Falls, New York.
Present:

Supervisor Diehl opened the meeting at 8:05 P.M.
MR. CLAUSEN moved that the Minutes of the Special Meetings of this
Board held on the 3rd and 21st days of April 1969, as submitted by
the Town Clerk, be and they are hereby approved. Seconded by Mr.
Finnan.
Motion Unanimously Carried
Mr. Finnan asked that a correction be made in the Minutes of the
May 12, 1969 meeting, that the words "an alledged" be inserted
before "copy of a lease with Dutchess Aviation Inc."
MR. CLAUSEN moved that the Minutes of the Regular Meeting of this
Board, held on the 12th day of May 1969, as submitted by the Town
Clerk be and they hereby are approved as corrected. Seconded by
Mr. Finnan.

The monthly reports, for the month of April, were received from
the Building Inspector, Town Justices, and the Supervisor.
MR. CLAUSEN moved the reports be accepted and placed on file.

MR. CLAUSEN moved the bills be paid, subject to audit. Seconded
by Mr. Heady.
Motion Unanimously Carried
Mr. Eck had requested to speak to the Board regarding the North
Wappinger Sewer Improvement. He asked if the application had
been submitted yet, commenting that he had called Albany at 3:30
this day and it hadn't been received. Mr. Diehl answered him that
the application had been signed, and mailed. Mr.,Eck asked what
the Board intended to do if the application wasn't received in Albany,
would they call a special meeting. He was again assured the applica-
tion had been mailed.

At the April 21, 1969, meeting of the Town of Wappinger
Planning Board, the following action was taken on the above-
named rezoning petition:
A motion was made by Mr. Chrystie, seconded by Mr. Logan, to
recommend to the Town Board that the rezoning request of Thomas
and Madlyn Marcojohn not be granted, because this zoning change
would not be consistent with the study made by the Planning Board,
with the Planning Consultants, which was completed early in 1968.

Town of Wappinger Planning Board
MR. CLAUSEN moved that the Attorney to the Town be directed to
prepare an ordinance, and prepare a resolution to set a date for
a public hearing. Seconded by Mr. Mills.
Motion Unanimously Carried
A letter was received from the Recreation Commission requesting
the Board appoint two Town Enforcement Officers to be used at
the Family Field Day, June 7, 1969. Mr. Diehl directed that the
Recreation Commission be notified that they should contact the
Sheriffs' Office requesting the use of Deputy Sheriffs for this
type of detail.

MR. DIEHL moved this Board give the CDA, Court Queen of Peace
1534 all the support they can in their efforts to place a memorial
in Mesier Park. Seconded by Mr. Heady.

A letter was received from John W. Haubennestal, Parade Marshal,
extending an invitation to the Board to participate in the Memorial
Day services May 30, 1969, at Martz Field, the Village of Wappingers
Falls and Chelsea.
Mr. Diehl directed Col. Haubennestals' letter be received and
placed on file.
Mr. Rappleyea reported to the Board that the Town commenced an
action against Ritter Construction Corp. Mobile Oil Co. and
Continental Casualty Insurance Co. The purpose being to attempt
to enforce the completion of the roads, the improvements of
Oakwood Knolls, the second phase of it, to either repair or remove
the nuisance of the oil conditions caused in the road. He stated
he had received some calls from Mobile Oil as far as their part
is concerned wherein they said that they had plans submitted to
the County Health Dept. several months ago and they were going
back and forth on it. Approximately two weeks ago they received
approval of the repairs they were to make. He hadn't heard from
Ritter Construction Corp. but had heard from Continental Casualty
Co. requesting they be informed on work that's needed and they
will review the matter. He hopes that the oil matter will be
cleared without actually going to trial.

with Central Hudson, was received:

Gentlemen:
At the request of Mr. Clausen I have completed a survey of
street lighting along Route 9D within the Hughsonville Lighting'
District from the Village of Wappingers Falls on the north to
the Lighting District line to the South.
At the present time there are twenty two lights consisting
of 17 obsolete incandescent lights and 5 of the more modern
mercury vapor lights installed along Route 9D. These lights are
situated mostly between the Village line and the Baxtertown Road,
with a single mercury light located across from the Montclair
Apartments amass road.
It is recommended that the five mercury lights be retained
at their present locations and the seventeen incandescent lights
be replaced at approximately the same locations with mercury vapor
lights. It is also recommended that new mercury lights be installed
between the Baxtertown Road south to the southerly end of the
Lighting District, which extends approximately to Old Route 9D
south of Montclair Apartments.
The recommended lighting may be installed at an increased
annual charge of $2550 which when reduced by a credit of $604
for lights to be removed will result in a net increase of $1946
per year.
The recommended new lighting will provide about 4 times as
much light as does the present lighting.
If the Town Board approves these recommendations please sign
the attached Street Lighting Authority Orders and return them to
me for processing.

Mr. Clausen added that these additions were all within the
Hughsonville Lighting District and if the Board approved these
recommendations, it would be bringing up obsolete lighting and
increasing the lighting along Route 9D without additional cost
to the residents.
MR. CLAUSEN moved that the Supervisor be empowered to sign the
Street Lighting Authority Orders #7433, 7434, 8260, authorizing
Central Hudson to make changes to the street lighting service
for the Hughsonville Lighting District. Seconded by Mr. Mills.
Motion Unanimously Carried
A Local Law prohibiting the use of any land withing the Town of
Wappinger as a dump or dumping grounds, refuse disposal area, or
as a land -fill site or in a land -fill operation excepting lands
established for such purposed by the Town Board, was introduced
by COUNCILMAN HEADY, seconded by Councilman Clausen.
LOCAL LAW #1 of 1969
Be it enacted by the Town Board of the Town of Wappinger
as follows:
Section 1. Legislative Declaration. A clean, wholesome,
attractive environment is declared to be of importance to the
health and safety of the inhabitants of the Town of Wappinger
and the safeguarding of their material rights against un-
warrantable invasion and for the protection of public health
and, in addition, such an environment is deemed essential to
the maintenance and continued development of theeconomy of the
Town and the general welfare of its citizens. Itis further
declared that the establishment or operation ofprivate dumps,_
dumping grounds, refuse disposal areas, land -fill sites or.
similar land uses, is a hazard to such health, safety, and
welfare of the citizens of the Town; necessitating the elimi-
nation thereof. At the same time, it is recognized that the
maintenance of a public dump, dumping ground, refuse disposal
area or land -fill site owned or operated by the Town is useful
and necessary. It is hereby declared that the prohibition of
private dumps, dumping grounds, refuse disposal areas or land-
fill sites, or other similar use of land for the deposit, burying,
or disposal of, in any matter whatsoever of offal, garbage, trash,
refuse, rubbish and like wastes, and that the maintenance of a
public dump, dumping grounds, refuse disposal area, or land -fill
site is necessary to provide a single confined area for disposal
of waste which will facilitate the inspection of facilities for
disposal of waste and facilitate the enforcement of sanitary
regulations.
Section 2. No lands other than lands of a public dump or
dumping ground heretofore or hereafter established by this town
shall be used as a dump, dumping ground, refuse disposal area
or as a land -fill site in said town.
�y. Section 3. The use of land as a private dump, dumping
`D ground, refuse disposal area or land -fill site is prohibited_
41b. and the use of said land for the deposit, burying, or disposal
in any matter whatsoever of all offal, garbage, trash, refuse,
rubbish, debris and like waste is also hereby prohibited.
Section 4. This local law shall not prohibit the estab-
lishment, by the Town Board, of public dumps, dumping grounds,
refuse disposal areas or land -fill sites owned or operated by
the town, from time to time.
Section 5. Any person violating the provisions of this.
local law shall be guilty of an offense and shall be subject to
a penalty in the sum of not more than one hundred dollars ($100.)
Each such deposit of waste material on lands within the Town of
Wappinger not established as a public dump, dumping grounds,
refuse disposal area, or land -fill site shall constitute a
separate violation of this local law. Each day such lands are
so used as a dump, duijping ground, refuse disposal area or land-
fillsite shall constitute a separate violation. Each separate
violation shall be punishable as herein set forth.
The Town Board in the name of the town, or any person ag-
grieved, may maintain a legal or equitable action or proceeding
in any court of competent jurisdiction to compel compliance with
or to restrain by injunction the violation of any provision of
this local law.
Section 6. Validity. In the event that any portion of this
law shall be declared invalid or held uhconstitutional, said in-
validity or unconstitutionality shall not affect the remaining
provisions which shall remain in full force and effect.
Section 7. This local law shall take effect immediately.
RESOLUTION ESTABLISHING PUBLIC HEARING
ON LOCAL LAW #1 of 1969 PROHIBITING
DUMPING OF REFUSE EXCEPT IN DISPOSAL AREAS.
The following resolution was offered by COUNCILMAN HEADY,
who moved its adoption:
Be it resolved that the Town Board of Wappinger conduct a
Public Hearing On Local Law #1, of 1969 on June 9, 1969 at 7:00
P.M., which said local law prohibits dumping of refuse on lands
other than refuse disposal areas and establishing penalties
thereof ore.

AN ORDINANCE ESTABLISHING PORTIONS
OF WILDWOOD DRIVE AS ONE WAY ROADWAYS
The following Ordinance was introduced by COUNCILMAN MILLS
who moved its adoption:
WHEREAS, Wildwood Drive in the Town of Wappinger is
divided into two roadways, each such roadway being approximately
15 feet in width and each roadway being separated by a 20 foot
grassed area or an open ditch, and
WHEREAS, each such single roadway is not sufficient for
two way traffic,
NOW, THEREFORE,
Be it enacted by the Town Board of the Town of Wappinger
as follows:
Section 1. The southerly lane or roadway of Wildwood Drive
between New Hackensack Road and Widmer Road is hereby designated
as one way east and vehicular traffic is prohibited from traveling
thereon except in an easterly direction from New Hackensack Road
to Widmer Road.
Section 2. The northerly lane or roadway of Wildwood Drive
between New Hackensack Road and Widmer Road is hereby designated
as one way west and vehicular traffic is hereby prohibited from
traveling thereon except in a westerly direction from Widmer
Road to New Hackensack Road.
Section 3. Any violation of this ordinance shall be -a traffic
infraction as defined in Section 155 of the New York State Vehicle
and Traffic Law and the proceeding shall be conducted in accordance
with Section 155 of the New York State Vehicle and Traffic Law and
the penalties upon conviction of a violation of this ordinance
shall be as prescribed in Section 1800 B of the New York State
Vehicle and Traffic Law.
Section 4. This ordinance shall take effect immediately
upon posting and publication as provided by law.

will conduct a public hearing at the Town Hall, Mill Street,
Wappingers Falls, New York, on an Ordinance establishing portions
of Wildwood Drive as One Way Roadways on June 9, 1969 at 7:30 P.M.
at which time all interested persons will be heard.

MR. DIEHL moved that the Highway Superintendent be directed to
take the necessary steps to repair the roads in Oakwood Knolls
so that they are in a passable and safe condition, and further,
that he be directed to bring the roads up to the minimum road
standards as required by the road specifications at the time of
the acceptance of the development and that the Town take steps
through the Town Attorney to recover the costs of such work from
the persons or firms responsible therefore. Seconded by Mr. Heady.

The following Ordinance was introduced by COUNCILMAN CLAUSEN,
who moved its adoption. ( OR -Office Research Zoning Amendment is
attached hereto and made a part hereof of the minutes.) Seconded

MR. CLAUSEN moved that the proposed Ordinance amending the Ordinance
of the Town of Wappinger, which adds to the district classification
be referred to the Town Planning Board, the Dutchess County Planning
Board, the Towns of East Fishkill, Fishkill, Poughkeepsie, La Grange
and the Village of Wappingers Falls, for their review and recommenda-
tion. Seconded by Mr. Finnan.

who moved its adoption:
WHEREAS, the roads and other improvements in Wildwood Forest
Section 2 and Wildwood Forest Section 2a as set forth in the
following plats filed with the Town of Wappinger have not been
completed in accordance with the requirements of the Town of
Wappinger Sub -division Regulation:
1. Wildwood Forest - Section 2
As shown on Preliminary Map dated April, 1965 and
prepared by Site Planners, Inc. Wappingers Falls,
New York.
2. Wildwood Forest - Section 2a
Located on Westerly side of Widmer Road, Town of
Wappinger, prepared by Richard A. Barger, P.E. &
L.S. dated June 1965.
NOW THEREFORE, BE IT RESOLVED:
That the Attorney to the Town of Wappinger, Allan E. Rappleyea,
is hereby authorized and directed to commence all necessary pro-
ceedings -to compel Malcolm Cornell, Inc. and the Peerless Insur-
ance Company to complete in accordance with Town of Wappinger
specifications, as they existed at the time of the first approval
of said plats, the roads, improvements and drainage system in
Wildwood Forest Section 2 and Wildwood Forest Section 2a or in
lieu thereof to collect money damages for the failure to so
complete such improvements.

The Town Board received application for Federal and State Aid
for development of recreation lands and it was placed on file.
MR. CLAUSEN moved that the Town Board apply for State and Federal
Aid and authorize and empower. the Supervisor to submit an applica-
tion for State -and Federal Aid for development of recreation
facilities -and the purchase of land for such purposes. Seconded
by Mr. Finnan.
Motion Unanimously Carried
Informal bids were solicited for an air conditioning unit to be
installed in the Town Hall (meeting room). Bids were received
from Shaker, Travis & Quinn, Inc. @ $8,581.00, Popper Electric @
$2,915.00; and Franklin H. Slater Inc. @ $1485.00.
MR. MILLS moved that Franklin H. Slater, as low bidder be awarded
the bid to install an air conditioning system in the Town Hall
meeting room, as per specifications, and at the contract price
of $1,485.00. Seconded by Mr. Finnan.

Informal bids were solicited for new 200 amp electric service for
the Town Hall. Bids were received from Popper Electric Co. @ $465.00;
and Franklin H. Slater Inc. @ $435.00.

MR. MILLS moved the bid for new 200 amp service for the Town Hall
be awarded to Franklin H. Slater, Inc. as low bidder, @ $435.00.
Seconded by Mr. Clausen.
Motion Unanimously Carried
MR. HEADY moved the rules be suspended, seconded by Mr. Clausen
and unanimously carried.
Mrs. Florence Graff asked several questions regarding the proposed
recreation land proposal, and also is the Town proposing to build
a new Town Hall.
Mrs. Cottrell asked if there was a time limit on the option for this
land.
Mr. Walter Cronin asked why this proposed recreation project couldn't
be allowed to be considered on a county basis, as a county project.
Mr. Bisom said that several years ago there was supposed to be a
committee to find property for a new Town Hall, he suggested a
committee be formed to find a suitable, and large enough tract
where all the Town offices and buildings could be placed together.

Mr. Eck asked what, if anything, was being done about left turn
arrow lights at various intersections on Route 9.
MR. MILLS -moved the rules be resumed, seconded by Mr. Clausen and
unanimously carried.
Mr. Finnan asked that an executive meeting be set up between the
Board and Sloper-Willen Ambulance Service and their Board of Directors
May 19, 1969 at 7:00 P.M. at the Town Hall.
MR. CLAUSEN moved the meeting be adjourned, seconded by Mr. Finnan
and unanimously carried.
