1969-04-01 SPMA Public Hearing was held by the Town Board of the Town of Wappinger on April 1, 1969 at the Town Hall, Mill Street, Wappingers Falls, New York, on the matter of Amending the Zoning Ordinance of the Town of Wappinger (Chelsea Ridge, Inc. rezoning from R-20 to LB.) Supervisor Diehl opened the Hearing at 7:00 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town Joseph E. Ludewig, Building Inspector and Zoning Administrator The Town Clerk read the following Notice of Publication: PLEASE TAKE NOTICE that the Town Board of the Town of Wappinger will conduct a public hearing at the Town Hall, Mill Street, Wappingers Falls, New York on April 1, 1969, at 7:00 o'clock P.M. to hear all persons concerning an ordinance amending the Zoning Map of the Town of Wappinger. The Town Clerk offered for the record the Affidavits of Posting and Publication, duly signed and notarized. Mr. James Coombs, attorney, representing Chelsea Rige, Inc., made a presentation for the applicant, for a change of zoning from R-20 to LB. This property lies near the intersection of Chelsea Road and Route 9D, and consits of 18.6 acres. Mr. Coombs showed the Board site plan maps, indicating ingress and egress, and answered various other questions from the Board. Supervisor Diehl asked if there were any persons present who wished to speak in favor of the rezoning. There were none. This property is con- tiguous in area that Chelsea Ridge has applied for site plan for an apartment project; a triangular parcel that lies between the property line of various one family residential owners and Chelsea Ridge Properties. When zoning was originally effected, lines were just drawn a certain distance back from the road rather than respect- ing property lines. What Chelsea Ridge would like to do is change this zoning line to respect property lines. It was indicated that the applicant doesn't plan to build on this property. The reason rezoning is requested is so they may increase the density of property presently zoned RD -40 in another area. The parcel before the Board for this rezoning is not to be developed, but kept as a buffer zone, by direction of the Dutchess County Department of Health. Supervisor Diehl asked if there were any persons present who wished to speak either in favor of, or in opposition to the rezoning petition. John Costa, Chelsea Road, asked that consideration be given the pond lying behind his property. His concern is with water from this pont backing up in his back field after heavy rainfall.
