Adjournment • 418 The Regular Meeting of -the Town Board of the Town of Wappinger was held March 10, 1969, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:12 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr. Councilman Elaine H. Snowden, Town Clerk Others Present: Allan Rappleyea, Attorney to the Town William Horton, Superintendent of Highways Rudolph Lapar, Engineer to the Town Minutes of the Feb. 13, and Adjourned Feb. 20, 1969 Meeting, as submitted by the Town Clerk, be and they are hereby approved, moved by COUNCILMAN CLAUSEN, Seconded by Mr. Heady. Motion Unanimously Carried The monthly reports for the month of February were received from the Building Inspector, Town Justices, and Supervisor. MR. CLAUSEN moved to accept the monthly reports and place them on file. Seconded by Mr. Heady. Motion Unanimously Carried Bills in the following amounts were submitted: General Fund Highway 14,403.12 OKSD 1,241.37 OKWD RFSD 151.38 126.86 261.29 MR. MILLS moved the bills be paid, subject to audit. Seconded by Mr. Finnan., Motion Unanimously Carried Mr. George Still, Director of Dutchess County Civil Defense, was not present, but requested an informal meeting with the Board at a later date. A rezoning petition was received from Mr. & Mrs. Thomas Marcojohn, requesting their parcel of land on Rt. 9 be rezoned from RD -20 to HBI. 81 9 MR. FINNAN moved the petition be referred to the Dutchess County Planning Board and the Town Planning Board for their review and recommendation. Seconded by Mr. Clausen. Motion Unanimously Carried The following letter was read: Feb. 18, 1969 William Horton Town of Wappinger Highway Department Dear Bill, Please accept for your Department, the many thanks of the New Hackensack Fire Department and myself for the excellent assistance given to us at the New Hackensack Shopping Plaza on 10 of Feb. 1969 and at the Hemeston Barnfire on 17 Feb. 1969. I know you had more than you could handle with your own problems but the time devoted to our problem provided service above and beyond the call of duty. Again many thanks, s/ Bud Pottenburgh Chief -New Hackensack Fire Co. The resignation of Charles R. Smith, member of the Planning Board was received. MR. CLAUSEN moved to accept Mr. Smith's resignation, with thanks for past service, and direct a letter so stating to him. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Eck had requested to speak on the North Wappinger Sewer District. Mr. Eck started by questioning the resolution passed at the last meeting, asking if the application went to Audit & Control with it. He also wanted to know why the Board decided to take away the rights of the Rockingham District from voting their own destiny. Mr. Diehl answered that this Board is not attempting in any way to take away the vote of Rockingham or Oakwood, the Board feels that when the resolutions of dissolution are presented to Audit & Control they will be advised by them in what manner to act, in voting in this district. Also to consider are the rights of all the residents of the Town in this matter, but to present time, no rights have been taken away from anyone. The Board received recommendation from Dutchess County Planning Planning Board regarding the two rezoning petitions (R-20 to LB & R-20 to RD -40). The Board received recommendation from the Town Planning Board regarding the rezoning request from Chelsea Ridge on the R-20 to LB. The following letters were received from Joseph D. Quinn, Jr. Attorney on litigation against the Town. March 4, 1969 Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Re: Rawls v. Town of Wappinger Gentlemen: On October 25, 1967 copies of the $50,000.00 claim in the above captioned matter were served upon the Town Clerk of the Town of Wappinger. The asserted basis of the claim was damage to property situate at Montfort Road and Pye Lane. On January 31, 1968, we examined the claimants on behalf of the Town. Upon examination, it appeared that the subject claim was grossly exaggerated. Since the examination was completed, claimants have made no attempt to pursue the matter, with the exception that their attorney has made oral and written demands upon the Town Board for a settlement. We now advise you that the statute of limitations governing the time period within which an action must be commenced upon the subject claim has expired. In the event that any process is served upon the municipality in connection with this matter in the future, it is dismissable as a matter of law. For all practical purposes your files on this matter may be closed. Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Very truly yours, s/ Joseph D. Town of Wappinger Gentlemen: Please be advised that on November 29, 1967 a copy of a $100,000.00 claim was served upon the Wappinger Town Clerk in connection with the above captioned matter. The basis of the claim was property damage allegedly sustained by_claimants as a result of the relocation and reconstruction of Route 9. On December 27, 1967 we served a notice of pre-trial administrative examination upon claimants' counsel. The examination was scheduled for January 17, 1968, At the request of claimants' counsel, we adjourned the examination until April 15, 1968. To date, claimants have refused and neglected to present themselves for examination in spite of several promptings. We are pleased to advise you that the subject claim is now barred by the provisions of section 50 (h) (5) and 50 (i) (1) of the General Municipal Law. Should any process by served in connection with this matter, it is dismissible as a matter of law. For all practical purposes your file on this matter should be closed. Very truly yours, s/ Joseph D. Motion Unanimously Carried The Supervisors' office requested permission to pay the Associated Hospital Service monthly bill when it came in, rather than wait for the Board audit. (The service is on a contract basis). Mr. Rappleyea suggested it was possible for the bill to be paid upon receipt, and put through the normal auditing procedure. Mr. L'Archevesque, County Representive, was present and gave a report of the County Board of Representatives Meeting held today. He mentioned the Board had received the Towns' request to withdraw from the part county sewer district; briefly reviewed some of the resolutions acted on; cancellation of a tax sale, on Eck property (which previously was listed as unknown on the assessment rolls). There were questions from the audience, some from Mr. Lafko in regard to airport resolutions, and Mr. Bisom about completion of Old Hopewell Road and Myers Corners Rd. Mr. Clausen, presented a survey report on lighting at various intersections of Town & County Road intersections. For the consid- eration of the Board, improved lighting is recommended at the s following intersections: Intersection of Meyers Corners Road with: Losee Road Spook Hill Road Ervin Drive Kent Road Fenmore Drive All Angels Road De Garmo Hills Road Brothers Road Hiview Road Montfort Road Intersection at Hopewell Junction with: Sucich Road McFarland Road Eck Road Spook Hill Road Cedar Hill Road Ridge Road All Angels Hill Road Intersection of Route 376 with: New Hackensack Road De Garmo Hills Road Intersection of All Angels Road with: Kent Road Angel Brook near Pye Lane Intersection of Osborne Hill Road with Fleetwood Drive Intersection of Old Route 9D with new 9D near Stoneykill Road The total cost of these lighting improvements will amount to $2,186 on an annual basis. However since these lights may not be installed much earlier than June, 1969, billing will commence during July and six months billing will amount to $1,093 which is about the increase the Town of Wappinger has budgeted for fiscal year 1969. MR. CLAUSEN moved the Supervisor be authorized and empowered to execute the contracts with Central Hudson authorizing the specific changes to the street lighting service in the Town of Wappinger. Seconded by Mr. Heady. Motion Unanimously Carried Mr. Clausen also mentioned an article that appeared in the Poughkeepsie Journal last week, that of a bill being introduced by Senator Speno, whereby the State would install and maintain the lighting on State Roads. Up to the present time the State has installed the lights but the expense has been borne by the munici- palities involved. The following exerpt was read: Highway Lighting Cost May be Borne by State 2323 The cost of safe highway lighting would be borne by the state under a bill submitted by the JLC on Transportation. The major share of these costs are now carried by. communities along state highways. The Department of Transportation would be mandated to establish the criteria for safe highway illumination within one year of the law's enactment. Once the criteria was established, DOT would be mandated to begin installation of the lights with the state paying all costs, maintenance and electric bills. Senator Speno, in introducing the legislation for the Committee, noted: "An unlighted highway can be an inherent dangerous traffic hazard. There is no present state requirement as to which part of a highway should be illuminated. The total responsibility for determining what portions of the highway should be illuminated should be the state's." We welcome your comments, suggestions for legislation, names of officials and others who would be interested in receiving copies of this Bulletin or who wish to be on our mailing list for -public hearings and other activities of this committee. MR. CLAUSEN moved that the Board go on record supporting Senator Speno on the introduction of this highway lighting legislation submitting the names of those groups or parties who would be, of course, members of the Town Board with copies to Senator Rolison, Assemblyman Stevens and members of the Board of Representatives of the Fishkill-Wappinger district (R.H. Linge, C. McMullen , N. Decker, R.L'Archevesque). Seconded by Mr. Mills. Motion Unanimously Carried The following Resolution was offered by COUNCILMAN FINNAN, who moved its adoption: WHEREAS, it has come to the attention of the Town Board of the Town of Wappinger, that the New York State Legislature has passed, or proposes to pass, an amendment to the New York State Motor Vehicle and Traffic Law, raising the state-wide speed limit to 55 miles per hour, and WHEREAS, The Town Board of the Town of Wappinger opposes the establishment of a state-wide speed limit of 55 miles per hour on New York State highways, or highways not specifically having a lower speed limit, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hreeby requests Governor Nelson A. Rockefeller to veto any pending legislation which would increase the state- wide speed limit to 55 miles per hours, and BE IT FURTHER RESOLVED, that the Town Board of the Town of Wappinger requests that the New York State Senate, and the New York State Assembly take steps to withdraw any pending legisla- tion which would increase the state-wide speed limit to 55 miles per hour, and 32 BE IT FURTHER RESOLVED that the Clerk of the Town Board of the Town of Wappinger is directed to forward copies of this Resolution to Governor Nelson A. Rockefeller and the state representatives, to wit, State Senator Rolison and State Assemblyman Stephens. Seconded by: Councilman Heady Roll Call Vote: Supervisor Louis Diehl Ave Councilman Clausen Ave Councilman Finnan Ave Councilman Heady Ave Councilman Mills Ave Resolution duly adopted March 10, 1969 Mr. Finnan added, as a word of explanation, is that many of the roads in the Town of Wappinger are not suited for 50 MPH let alone 55 MPH and as the Town has little or no control in setting and enforcing speed limits in this town, I think this should be the main reason for our objection to it. He asked that these remarks be forwarded also to Governor Rockefeller. The following Resolution was introduced by COUNCILMAN FINNAN who moved its adoption: BE IT RESOLVED and ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, inpursuance of the author- ity conferred by the laws of the State of New York, as follows: Section 1. The Town of Wappinger Zoning Ordinance and Map adopted January 29, 1963, as amended from time to time, is hereby further amended by rezoning the following described parcel of land from R-20 "One Family Residential District" to LB, "Local Business": All that certain lot, piece or parcel of land situate in the Town of Wappinger, County of Dutchess and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the Westerly line of Route No. 9D, said point being the intersection of the Westerly line of Route No. 9D with the Northwesterly line of lands of Central Hudson Gas & Electric Corp. and running thence along the Northwesterly line of lands of said Central Hudson Gas & Electric Corp. Seconded by: Councilman -Heady: Roll Call Vote: Supervisor Diehl Ave Councilman Heady Aye Councilman Clausen Ave Councilman Mills Ave Councilman Finnan Aye Carried: March 10, 1969 7 The following letter was received: March 6, 1969 Town Board Town of Wappinger Dutchess County Gentlemen: This letter has further reference to the joint requests from the Town Board and the Dutchess County Commissioner of Public Works for a lower maximum speed of 35 MPH oh all town.. highways within the Town of Wappinger and a 35 MPH speed limit on Chelsea Road. The field studies have been completed and the reports received and evaluated. Our findings indicate that it is not necessary to restrict the entire town to a 35 MPH speed limit. However, we have determined that a 35 MPH area restriction is warranted in.the southeast portion of the town and for identification purposes we have labeled it the Myers Corners area. Before we can formally establish the 35 MPH restriction, it is required by law, that we have joint approval of the enclosed area description. If the Town Board and the Dutchess County Commissioner of Public Works are satisfied with the described area, please complete the form, obtain the County Commissioner's endorsement, return to this office and we will take the necessary action to establish the area restriction. The investigation of Chelsea Road from Route 9D to Liberty Street disclosed that the marginal developmetn along this section was sufficient to warrant the requested 35 MPH speed limit. The alignment and grades were adverse and these characteristics are not conducive to high speeds. Therefore, we have determined that a lower maximum speed on Chelsea Road is not warranted at this time and the request is denied. Very truly yours, s/ Charles E. Beginning at the intersection of the easterly right-of-way line of All Angels Road, CR 94, with the southerly right-of-way line of Route 376: thence easterly and southeasterly along the southerly and southwesterly right-of-way line of Route 376 to its intersection with the westerly shore line of Strout Creek; thence shoutherly along the westerly share line of Strout Creek to its intersection with the northerly right-of-way line of Brown Road; thence westerly along the northerly right-of-way line of Brown Road to its intersection with the northerly right-of-way line of All Angels Road, CR 94; thence westerly, northwesterly and northerly along the northerly, northeasterly and easterly right-of-way line of All Angels Road, CR 94, to the point of beginning. Mr. Clausen stated that Mr. Horton was not satisfied with the findings. Mr. Horton elaborated that he was very unhappy with the states' 328 opinion had already made arrangements with Mr. Lapar to go over the descriptions of the recommended restricted speed area and would present further recommendation at a later time. Mr. Mills took exception to the paragraph in the letter regarding the Chelsea Road. Because the road isn't condusive to high speeds doesn't mean people won't speed. After Mr. Horton has looked over the other area he thinks another letter should be drafted back to the Department of Transportation, informing them that the Board disagrees with their findings. The Board had nothing to bring up under new business. Supervisor Diehl asked if there were any questions from the audience. Mr. Milts asked when the one way signs would be installed on Wildwood Drive. Mr. Thomas Leach asked when the Town drainage would get started, and what areas were being considered to be done this year. Gerald Steinberg asked when the pot holes would be repaired on Pye Lane. Mr. Clausen thanked Mr. Horton for his assistance during the bad storm in February. Mrs. Donald Mello asked whether or not the minutes were always accepted without being read at the Board meetings and when avail- able for the public to be read. (It was explained the Board members received copies at home before the meetings, dispensing with the reading at the meetings and were available for public inspection anytime after the Board approved them.) She then directed a question to Mr. Finnan regarding the letters he had directed be incorporated in the minutes regarding Cogar rezoning. Mr. Finnan stated he had directed all letters, pro & con, regarding the rezoning be incorporated. Mr. Eck asked whether, when the County comes along and wants to change a Town road somewhat, its' brought before the Town Board; the Board should know about it, if the County is changing a Town road. Mr. L'Archevesque enlarged that the County was considering 9 a change of the intersection of Cedar Hill Road with Old Hopewell Road. The County has been considering several plans, one of which includes some of Mr. Ecks' property at this corner. Whatever the change, it will involve a change of Cedar Hill Road, this is the point being conveyed. Mr. Eck added he thought the County should show the courtesy to the Town by informing them of a change. Maybe the Town wouldn't want it the County's way. Mr. Mills asked Mr. Rappleyea what the normal policy was - does the County have to notify the Town if they want to move a Town road. Mr. Rappleyea replied that if it was a point at the inter- section with a County Road and within a County right-of-way, no; if a Town road, yes. They are essentially improving a County road which may effect a Town road indirectly, its' their perogative. MR. CLAUSEN moved that a letter be sent to Dutchess County, Dept. of Public Works, asking that if they wouldn't, in the future, when they propose intersections that effect Town roads if they wouldn't be courteous enough to inform the Town Highway Superintendent of these changes for his consultations and advice. The letter to be directed to Commissioner Petrovits, with copies to the Committee on Public Works of the County Board of Representatives, R.H. Linge, R. L'Archevesque, N. Decker, C. McMullen. Mr. Finnan said it had just been called to his attention that there had been some letters (regarding Cogar rezoning) that had been sent directly to each Board member and had not been received by the Town Clerk, that were not included in the minutes (of Feb. 20th) He will check his letters with the minutes and ask at the next meeting that the remainder be included in the minutes.
