1969-02-13 RGM278 The Regular Meeting of the Town Board of the Town of Wappinger was held Feb. 13, 1969 at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town Joseph Ludewig, Building Inspector William Horton, Superintendent of Highways Supervisor Diehl called the meeting to order at 9:00 P.M. Fire Chief William Brower ordered the Board to disburse the residents present for the preceeding Public Hearing, saying there were too many people for the size of the hall - overcrowding. MR. CLAUSEN moved that the Regular Town Board be adjourned to Thursday Feb. 20, 1969 at 7 P.M. Seconded by Mr. Mills. Introduced: Jan. 27, 1969, Special Meeting Introduced by: Councilman Mills Seconded by: Councilman Clausen The Town of Wappinger Planning Board and Dutchess County Planning Board recommendation had been received. (Recommendations on file in the office of the Town Clerk.) Supervisor Diehl stated this hearing is on the rezoning of property owned by James A. Klein & Dave Alexander, with an option to purchase held by Cogar Corp. the land lying in the area of the Northeast corner of All Angels Hill Road and Myers Corners Road presently zoned R-20 and R-40 and proposed to be changed to PI. Representa- tives of the Cogar Corp. were present to offer their plans for development of this property. Mr. Diehl further stated that Mr. Thomas Logan was also present, representing the Town Planning Board, to briefly state the Planning Boards' position regarding the proposed change of zoning. Mr. Joseph Reis, All Angels Hill Rd. objected to "planned" speakers, he didn't want to hear them or what was intended for the property. Mr. Reis was in opposition to the proposed rezoning. Mr. Diehl then asked all those who were in favor of the proposed rezoning to speak. Mr. Donald Close, All Angels Hill Road, said he could look down on this property, but was in favor of rezoning this parcel, anybody who wanted to come in and put money in the Town he was in favor of. Mr. Pensiero, All Angels Hill Road, (his property boarders on the property proposed for rezoning) has no objection, at this time, to rezoning this tract for Planned Industry. The following letter was requested to be read: February 10, 1969 Town of Wappinger Board Attn: Mr. Louis Diehl Supervisor Mill Street Wappingers Falls, New York Gentlemen: The Chamber of Commerce of Wappingers, urges that the board, at its meeting on the 13th, approve the Cogar Corporation request for a change in zoning at the companies proposed site. The Chamber feels that an industry of this type, is what the Wappinger area wishes to attract in order to bring some relief to the tax burdened homeowner in our area. The average home- owner in Wappinger Falls is bearing an ever increasing tax load, due primarily to the absence of such vital industrial development. _ After studying the Cogar proposal and the background of the principals involved, it is obvious that this firm will be one of the most complex and modern technological facilities in the world and that the community should get behind such a firm that has the potential of becoming a world leader in technological development. Plans developed by the company indicate that it has made very effort to make its site not only an asset to the community 'financially but aesthetically as well. Sincerely, s/ Daniel G. Ryan, President Mr. Louis Eck, Hopewell Junction Road, felt if the Town can get this type of Industry in the Town he would be 100/ for it. Henry Semp, All Angels Hill Road, wasn't against a company like Cogar coming into the Town, but why in the middle of the most populated area of the Town. Mr. Diehl again stated that an Engineer for the Cogar Corp. and the general manager of the Corp. were present to give a brief description of the intended production and layout of the buildings. Mr. Robert Markle, General Manager of the Technology Division of Cogar Corp., started to tell the Corp. wanted to be in the Town of Wappinger and what the business was all about. Mr. Reis interrupted, saying the residents weren't interested in what was being manufactured, they wanted to know how much land they could be using, sewer facilities, water, road problems, etc. Mr. Markle continued explaining that a weeks production could be put in a thimble, there would be no heavy trucking involved. He displayed several sketches of the layouts, and explained them. He was asked about access roads, parking personell capacity, con- struction, and growth. A resident (undentified) said he felt all the residents present were in favor of an industry of this type coming into Wappinger, but not in this location. Mr. John Terry, All Angels Hill Road (North of Myers Corners) was in favor of the proposed rezoning, said if the Town was selec- tive in what they get, he thinks this is a fine project, the think- ing in the way they are putting it up. There are many things the Town could get there that would be much worse. He asked also for a definition of PI. Mr. Logan attempted to answer - not the definition per se, without the ordinance but other questions relating to the proposed project and zoning. Mrs. Terry, All Angels Hill Road, asked, if something should happen and the Company didn't build there, then what would happen? Would this leave this property open for another industry, with smoke stalks, etc. to go in there? Mr. Rappleyea answered quoting from the Ordinance. Mr. Joe Reis, All Angels Hill Road, asked that the recommendation from the Dutchess County Planning Board be read. Mr. John Smalley, All Angels Hill Road asked does the Board feel 28 16 that the asthetic values involed here are sufficiently important that this industry be allowed to come into a residential area and in effect, make the zoning laws, that are in effect, meaningless? Mr. John Villani, Sherwood Heights, asked where the 250 people are coming from that the company anticipates hiring? Mr. Markle answered that about 90% of the people they have hired so far are already located within the community. Mr. Reis raised questions about why this company hadn't looked into other properties already zoned commercial. It was explained that Cogar had done so, but that some of these sites were not for sale, some were not suitable for their needs. Village Fire Chief Brower came in at this point, and ordered the Hall cleared, as he indicated it constituted a fire hazard with the large number of people present. Supervisor Diehl stated the hearing would continue at the Wappingers Jr. High School. The hearing recessed to allow for the change of locations (Town Board Meeting regularly scheduled for 9:00 P.M. was called to order at the Town Hall and adjourned until Feb. 20, 1969. The Public Hearing was called back to order in the cafeteria of the Wappingers Jr. High School. Mr. Joseph Merkle, DeGarmo Hills Road, asked how far the Planning Board had gone in investigating all the commercial zones that could possible be available for this company. Vincent Boyle, Edgehill Drive, President of the Edgehill Civic Association, asked that the overall picture of the area be considered, and what about the traffic problem. Virginia Maynard, DeGarmo Hills Road said she understood Cogar had been interested in other properties in the Town, if they were only interested in locating in Wappinger, why not locate on New Hackensack Road. She also asked about the water and sewer prob- lems, wouldn't residents of DeGarmo Hills wells be affected? Chris Simonetty, spoke in favor of the company locating on the Alexander -Klein site, he felt if the Town doesn't get industry, there will be an ever increasing tax burden on the residents. He feels everything has to be done proportionately. Bob Fries, DeGarmo Hills Road, asked why Cogar was interested only in this particular piece of land. Fred Shubert, DeGarmo Hills Road, asked why spot zoning was being considered, when the Town went to all the expense in 1962 to zone the town? Malcolm Cornell, Anvil Court, spoke in favor of Cogar, said he was very much interested in seeing industry coming into Wappinger, especially of Cogars nature, and further stated that it will in- crease the value of the properties in the area of the site. Mr. William Vrooman, All Angels Hill Road, said he would like to see his area kept residential. Also, what recourse the residents had if the Board should rezone this property? The Engineer for the Cogar Corp. was asked about sewer facilities. He attempted to explain the alternate plans, depending on percula- tion tests, and was interrupted with questions about drain -off into the swamp, and mosquito problems, polution of wells on De Garmo Hills , the discussion petered out on this as the questions became too numerous and disconnected. Mr. John Wisner, Dogwood Hill Road and John McDonald, Myers Corners Road, asked what, in dollars, would be realized, if this company located here. Mr. John Russell, DeGarmo Hills Road, Keith Curtis, Edgehill Drive, also spoke in opposition to the proposed rezoning, questions and opposition being similar to those above stated. Predominant were questions about traffic problems, other sites suitable, spot zoning, the legality of changing zoning once it had been established in '62 and use of this and if Cogar didn't locate on this property.
