The Regular Meeting of the Town Board of the Town of Wappinger was
held December 7, 1967, at the Town Hall, Mill St. Wappingers Falls,
New York.
The Supervisor opened the meeting at 7:37 P.M. Public discussion was
held.
The meeting was called to order at 8:52 P.M.
Mr. Bulger moved the minutes of Oct. 26, Nov. 9, Nov. 30 as submitted
by the Town Clerk be and they are hereby approved, seconded by Mr.
Francese. Motion Unanimously Carried.
The Reports from the Building Inspector, Justices and Supervisor were
received and ordered placed on file.
Bills were presented in the following amounts:

Mr. Bulger moved the bills be paid subject to audit, seconded by Mr.
Clausen. Motion Unanimously Carried.
A request was received from John Delano, Superintendent of Transporta-
tion (Wappinger Central School) suggesting the Town request from the
State Transportation Dept. a "No Through Traffic" sign be placed at
the NE corner of the old Route 9 and Myers Corners Rd. as this road
northbound, presents a dangerous traffic condition. Request tabled.
Mr. Clausen reported on the Board's request to discus with Mr. John
Delano, the placement of the trip for the traffic signal at Old Route
9 and Myers Corners, Middlebush Rd. Mr. DeLano had jndicated to him
that if the trip, was installed East-West and operated in the same time
sequence as the traffic light on Myers Corners Rd. and new Route 9
intersection this would be favorable. As there was still some doubt
regarding the order from the N.Y. State Dept. of Transportation, Mr.
Bulger suggested that Mr. Lapar be asked to review the orders, and
that if it does not meet with Mr. Delano's recommendation to ask him,
on the Boards' behalf, to call this request to the attention of the
N.Y. State Department of Transportation.

Mr. James Thomann requested that the Town accept, as Town roads, Shale
Drive, Dillon Court, Plum Court, Short Court and Long Court in Edgehill
Manor Section II.
The Superintendent of Highways recommended that the Town accept these
roads in Section 11 Edgehill Manor as Town Roads. When asked by the
Board for his recommendation, on these roads, Mr. Lapar reported
that he had not been out this week to inspect them, but the Town
still needed to receive the deeds.
Request was referred to the Attorney to the Town and the Engineer to
the Town.
A petition was received from residents of the Orchard Homes Develop-
ment (Spookhill Rd. & Old Hopewell Rd.) requesting to be included in
the Town's plan, for a sewerage system.
Mr. Quinn commented that the area involved inthis petition is present-
ly
included in the perimeter of the proposed North Wappinger Sewer
District (L&A) area.
Rules were suspended to permit Mr. Ralph Relyea a few words with the
Board. He asked that this area be included in the basic extension of
the District. He also asked if the Board could give a time element,
and when he was told that there couldn't be any definite time given,
asked Mr. Fulton if he could have a letter for the Board of Health
stating the Board's intent.
Mr. Fulton asked Mr. Lapar if he would see that Mr. Relyea got a letter
that he could present to the Board of Health. Rules were resumed.
Mr. Maurice Phillips, attorney for Central Park Homes Subdivisions,
requested a meeting with the Town Board to discuss arangements for
sewage disposal service and water service in this subdivision.
Mr. Fulton said that as the engineers had..not submitted their final
plans and detailed maps little could be accomplished. A similar
request was received from James Coombs on behlf of Spook Hill Estates.
Mr. Bulger suggested that a letter be directed to these two attorneys
indicating that a meeting would be arranged as soon as Adler -Brenner

submitted their final reports.

Gentlemen:
The above captioned proceeding was brought to compel the Town
of Wappinger and.its highway superintendent to remove a barrier
situate at the southerly end of Dorothy Heights Road, thereby
converting such road from a dead-end street to a through street.
The matter was argued before Mr. Justice Hoyt in New York
Supreme Court at New City, Rockland County, on June 5, 1967. On
August 7, 1967, Mr. Justice Hoyt handed down a decision which was
favorable to Wappinger and which dismissed the proceeding.
On August 14, 1967 we wrote to you and advised you of that
decision and forwarded a copy of the same to you.
On August 21, 1967, a judgment was made on Mr. Justice Hoyt's
decision. The same was entered in the Rockland County Clerk's office.
On September 8, 1967 petitioner moved for reargument in New
York Supreme Court, Rockland County. The motion for reargument was
referred by the presiding judge to Mr. Justice Hoyt for decision.
At that time,, your body directed this firm tooppose the new applica-
tion.
The application for reargument came on before Mr. Justice Hoyt,
and on November 16, 1967 such application was denied. A copy of the
memorandum ,decision, favorable to Wappinger, is enclosed herewith.

A Public Hearing by the State of New York Public Service Commission
Dec. 4, 1967, on the rates and charges of Fleetwood Water Works Corp.
for water service had been held. Mr. Fulton attended and reported no
decision had been handed down as yet.
A letter was received from Louis Alpert, president Dutchess Heights,
Inc. informing the Board that they were in the process of "under -
grounding" their public utility lines in their subdivision (Angel
Brook Estates) and asked if the Board had any suggestions to offer.

Mr. Francese commented that he thought it was a wonderful step forward
for the community to have underground service.
Approval of the Sewer System for Ye Olde Apple Orchard Section II -
Rockingham Farm Sewer District, by the State of N.Y. Dept. of Health
was received.

Gentlemen:
We have today, accompanied by Mr. Mike Morris, P.E., of the Dutchess
County Health Department, observed infiltration tests on the Edgehill,
Rockingham and Dutchess Estates subdivisions sewer systems.
We find that the sewer systems in the subdivisions noted, above comply
with the -minimum standards established by the issuance of discharge
permits by the New York State Health Department.
We wish, however, to make the following reservations:
(1) That section of sewer in the Edgehill Manor Section 111
subdivision from M.H. 31 to M.H. 21A located along Pye Lane shall be
re-evaluated inethe spring of 1968, under conditions of maximum ground
-water conditions. Until such re-examination the acceptance -of this
section shall be considered tentative.
(2) The sewer system of the Rockingham Section 1 subdivision
shall be re-evaluated in the spring of 1968 under conditions of maxi-
mumground water conditions. Until such re-examination,, the acceptance
of this section shall be considered tentative.

Re: Infiltration -Rockingham Sewer District
Ye Olde Apple Orchard, Inc.
Gentlemen:
We received, today, from Mr. Vincent Dangler, Vice President of Ye
Olde Apple Orchard, Inc., a copy of a contract with Penetryn System,
Inc. for 71.V. inspection and sealing of.necessary sections of the
"Ye Olde Apple Orchard" sewer system.
The estimated time of completion of the work is four (4) weeks.
We recommend, therefore, that this developer be granted the necessary
time extension to complete this repair work.

Mr. L. Clausen stated that the Building Inspector had already resumed
action and no further action by the Town Board is necessary at this
time.
Mrs. Snowden stated that she had received the resignation of James
Mills, Jr. from the Zoning Board of Appeals - effective January 1,
1968.
Mr. Francese moved that the Board accept the letter of resignation
with the utmost thanks to Mr. Mills for serving on the Zoning Board of
Appeals. Seconded by Mr. Bulger. Motion Unanimously Carried.
Mr. Bulger, as ,the Town's representative on the Fishkill, Wappinger
and Casper Creeks Drainage Basins=Comprehensive Sewerage Study Comm-
ittee, reported that this Committee had received the report of the
engineering firm, which has been approved by N. Y. State - they have
accepted the report and forthwith submitted to the Town Clerk one copy
of the Report and 2 copies of the summary.
When Mr. Fulton asked Mr. Bulger what the next step was he replied
that at the last meeting of the Committee, the next step was to send
a recommendation to the Board of Supervisors recommending the estab-
ishment of a County Sewerage Agency, which in turn would, using this
report, establish a part -county District in the Southern Dutchess area.
Mr. Bulger further asked that he be relieved as this Board's represen-
tative, as he felt that a direct member of this Town Board be the repre-
sentative.
Mr. Clausen thanked Mr. Bulger for his diligent time-consuming efforts
on behalf of the Town in aiding in the formation of this Report. He
felt that recognition was certainly due him for his deligence. Mr.
Fulton added that Mr. Clausen's thanks and comments also went for the
whole Board.
Mr. Bulger expressed his admiration for the spectacular achievement
of the Wappinger Central School District Football Team in not only
having been undefeated, but unscored upon. He felt that it would be
nice if this Board gave that organization some recognition for their
outstanding performance.
Mr. FultQn.proposed_the following resolution:
WHEREAS, it appears that the ROY C.. KETCHAM HIGH SCHOOL - -
FOOTBALL SQUAD has completed an undefeated 1967 season, with seven
victories and one tie, under the coaching of Kenneth Lynn and Ralph
Paoness, and
WHEREAS, such an accomplishment is worthy of recognition, the
team also being co -champions of the Dutchess County Scholastic League,
and
WHEREAS, this outstanding team also finished the season unscored
on, a feat unprecedented in Dutchess County sports history, and.
WHEREAS, it is the intent of the Town Board of the Town of
Wappinger to congratulate the team members, Coaches Lynn and Paonessa,
the Cheerleaders, teachers, administrators, students and others lend-
ing moral support which aided in bringing the team to victory,
NOW, THEREFORE, BE IT RESOLVED, that the Supervisor, Joseph H.
Fulton, Town Councilmen Louis Clausen and Louis Diehl, Justices of
the Peace William H. Bulger and Vincent Francese, and other officials
and employees of the Town of Wappinger do hereby extend heartiest
congratulations to the victorious ROY C. KETCHAM HIGH SCHOOL FOOTBALL
TEAM, Coaches Kenneth Lynn and Ralph Paonessa, and further compliment
the Administration, teachers, students and other spectators who
give moral support and demonstrated fine sportsmanship during the
entire 1967 football season.
Seconded by Mr. Bulger. Motion Unanimously Carried.
Mr. Francese had not had an opportunity to discuss with Mr. Fulton or
Mr. Diehl his plans - therefore, withheld reporting on ideas for
expanding office space.
Mr. Diehl submitted a report for Board approval, on behalf of the
Lighting Committee, on Central Hudson's plan to erect a new street

light at Route 9 at Fowlerhouse Road and 2 more lights directly across
the street where old Route 9 exits and enters at 2 different entrances.
Also, a light will be removed at the blocked off section of Old Mac-
farlane Road (and Town given credit). The second report, which
completes all of the intersections onto the new Route 9, consisted
of 4 more lights, one at South Fowlerhouse Road, 2 at Smithtown Road
one on each side of the street - 1 (by N.&S. Supply) where old Route 9
comes back on new Route 9.
Mr. Bulger moved that the Supervisor be empowered to sign these Street
Lighting Authorizations to Central Hudson to install the lights so

specified, and remove the one light so specified.
Seconded by Mr. Francese. Motion Unanimously Carried,
Mr. Clausen pointed out that he felt that new Route 9 presents a
problem in the Myers Corners area specifically with regard to traffic
wishing to make either a North or Southbound lane turn, and wondered if
it couldn't be suggested that indicating arrow lights be installed
(similar to the Hudson Plaza area) and further suggesting this be
communicated to the New York State Department of Transportation.
Mr. Bulger suggested that Mr. Lapar be asked to present the Board with
a concrete recommendation that could be forwarded to the State, Hope-
well Road to be included in the investigation.

Re: Local Law No. 2, 1967
Gentlemen:
As members of the Town Water Committee, and in accordance with your
request, we have examined the proposed Local Law No. 2, 1967, and
the following is our analysis, conclusions, and recommendations.
Throughout the proposed law, there are many implications, ambiguous
terms and overlapping of jurisdiction, which we feel would.create
many undue hardships onproperty owners whose installations have been
in existence for many years and who have been operating within the
scope of the law.
The proposed law is impractical from the viewpoint of maintenance and
operation of existing systems, since it would penalize any individual
or corporation at the rate of $100 per day in the event they desire
to make repairs on their own installations without consulting with the
Town Board. In times of emergency, the delays could cause serious
repercussions and fatalities.
The proposed law is delinquent insofar as not specifying any standards
under which a proposed installation can be guided. In addition to
which, it places too much authority on the Town Engineer, who would
have jurisdiction over applications without standards and in many
instances, without time limitations.
The Town, under this law, could confiscate properties under the heading
of "abandonment" which -would result in litigation and heavy legal costs
to both the town and the property owner.
The Committee also feels that a determination should be made as to
whether -or not any corporation holds an exclusive franchise to operate
and extend water lines within a specified territory.
Instead of the proposed law which could conceivably create many
problems that it could not solve, the Committee recommends the
following:
1. Formation of a Water Committee comprised of knowledgable people,
irregardless of political affiliation, to make an engineering study
of All Angels Hill area, with the thought in mind of installing
storage tanks, and in turn supply the area with water. Additional
conaideration should be given to this area since it holds great
promise as a future location for industry, particularly if the area
is serviced with utilities. Necessary funds should be allocated to
this committee to make the study, engage engineering services in
order to complete the report, the merits of which will be decided
by the Town Board.
2. Upon completion of the study and its acceptance, a Water Board
should be created consisting of knowledgable people with dedication
and experience in this field. The Board would have the authority and
responsibility in conjunction with the Town Engineer to either accept
or deny applications for proposed installations, and also have juris-
diction over existing installations where they do not comply with the
New York State Department of Health and other governmental agencies
under whose jurisdiction they fall.
3. Investigate the possibility of using the New York City water supply
at Chelsea. Available information indicates that the installation
presently is not operating at capacity and is circulating 50 million
gallons of water per day and returning it to the Hudson River,
We thank you for the opportunity to serve on the Water Committee and
hope that we were of service to the Town of Wappinger.

Bids had been sought by the Highway Superintendent for snow plow
equipment and material spreaders. Bids for 2 chassis mounted material
spreaders had been received and opened for November 30, 1967 and bids
had been received and opened for snow plow equipment for 2 trucks on
December 6, 1967. The 2 bids received for the material spreaders
were:

The Highway Superintendent recommended Ralph C. Herman Co. Inc. be
awarded the bid for the 2 snow plows and H.O. Penn Co. Inc. be awarded
the bid for 2 material spreaders.

Mx. Quinn brought out the fact that as there were no current funds
available for the purchase of this equipment, the bids would have to
be subject to the new Boards approval and also that written acknow-
ledgement should be obtained from the bidders that the bid will still
be good in January 1968 and they should sbbmit acknowledgement of
approval. Mr. Diehl moved that the Board accept the recommendation of
Knua Clausen, Highway Superintendent and accept the low bid of Ralph
C. Herman for 2 Material Spreaders @ $5,998.00 and Hudson River Sales
Corp. for snow plow equipment. for 2 trucks @ $8,915.00; and that both
of these bidders be notified and also Mr. Petrovits, County Superinten-
dent of Highways be notified that these bids have been accepted, subject
to the formal acceptance of these bids by the new Town Board and new
Highway Superintendent in January 1968 and the terms so stated in the
bids will still hold true; and request a confirmation of these low
bids from the 2 companies concerned for delivery and installation in
January 1968. Seconded by Mr. Clausen.

Mr. Francese moved that the Board hold the annual audit meeting on
Thursday, December 28, 1967 at 7:30 P.M. at the Town Hall. Seconded
by Mr. Clausen. Motion Unanimously Carried.
Mr. K.'Clausen extended an invitation to Mr. William Horton to come
up to the Town Garage at any time to get acquainted with the boys
and operations.
Mr. Bulger reminded the Board that at a joint meeting of the old and
new Boards they had agreed to set a date for a PublicHearing in regard
to a proposed change in the Zoning Ordinance affecting the area
surrounding Route 9. Mr. Bulger moved that the date of January 18,
1968 be established at 8 P.M., for a Public Hearing on the proposed
change in the Zoning Ordinance. Seconded by Mr. Francese.

The following resolution was proposed by Mr. Bulger who offered it

Local Law No. 2, Year 1967, pro-
viding for regulation of water
supply and distribution systems
Gentlemen:

In December of 1966, we prepared and submitted for your considera-
tion a piece of local legislation to control and regulate water supply
and distribution systems in the Town of Wappinger.
During the same month a public hearing was held with respect to
the proposed legislation. Many Comments and objections were raised
with respect to the same. It was decided that the proposed measure
be re -drafted and re -presented.
Early;ir+the year 1967, we wrote to -each of you and asked for
suggestions as to matter which you might want incorporated in or
deleted from the first draft of the proposed legislation. Two or
three of the board members made concrete suggestions.
On April 5, 1967, we prepared and submitted to you a second
draft of the proposed local law. The same was presented and intro-
duced at a meeting of your body held on April 6, 1967. The matter
was tabledLso that a committee might be appointed to make a study
thereof and to present recommendations with respect thereto. The
committee was appointed during the month of May, 1967, but no report
has been presented.
At your last meeting, the supervisor requested that action be
taken on the proposed local law at the meeting to_be_held on November
30, 1967. If such action is to be taken, a public hearing must be
conducted by your body. At least five day's notice of such public
hearing should be given by publication and posting. A resolution
has been submitted to you fixing the time and place for the holding
of such a hearing and prescribing the method of giving notice thereof.
Copies of an appropriate form of notice have been prepared and delivered
to the Town Clerk to be completed and used if you adopt the resolution.
After a public hearing has been conducted action may be taken on
the proposed legislation. An affirmative vote of a simple majority
of the entire voting strength of your body is required for adoption.
If you see fit to act favorably upon the subject measure, your
action will not be subject to either mandatory or permissive referen-
dum procedure.

law, entitled, "A Local Laa regulating the establishment, construction,
installation, extension, enlargement, acquisition, operation and use
of water supply and distribution systems in the Town of Wappinger,"
and
WHEREAS, the provisions of the Municipal Home Rule law require
that no local lasso shall be passed by the legislative body of the town
until a public hearing thereon has been held before such body,
NOW, THEREFORE, be it resolved as follows:
1. That a public hearing shall be held on the said proposed
local law by the Town Board of the Town of Wappinger on the 21st day
of Dec. 1967, at 7:30 P.M. o'clock on such day, at the Town Hall,
Mill Street, in the Village of Wappingers Falls, Town of Wappinger
Dutchess County, New York.
2. That at least five (5) days notice of such hearing shall
be given by the Town Clerk of the Town of Wappinger by the due
posting thereof upon the bulletin board maintained by said Town
Clerk in the -Town Hall and b y publishing such notice at least
once in the official newspaper of the Town of Wappinger.

Rules were suspended to permit Mr. Cortellino to ask the Board if
there was anything within the document (referring to Local Law #2) which
will be presented at the public hearing which is not within the Boards
right to enact. Mr. Quinn answered that it was within the purview of
Article 9 of the Constitution (of the State) and the Municipal Home
Rule Law. Rules resumed.
Mr. Fulton brought up for discussion again the road program (most
recently discussed at the Nov. 30th meeting). A motion had, at that
time, been defeated, but he would like the Board to reconsider this
motion.
Mr. Francese moved to direct the Attorney to the Town and the Engineer
to the Town and the Highway Superintendent to draft a resolution
according to the recommendations of the Committee, to be presented to
this Town Board-, the -resolution to 'set the mechanics for the road
rebuilding program in motion;- the presentation of this resolution
to be presented to this -Town Board at` a special meeting to be=held
on Dec. 21, 1967 at 7 P.M; and, accept the repor-t of the committee,
seconded by Mr. Fulton.
Roll Call Vote: Mr. Francese, Aye, Mr. Bulger, Aye, Mr. Diehl, Nay
Mr. Fulton, Aye Motion Carried.
Mr. Clausen moved that the Engineer to the Town and the Attorney to
the Town be directed to act on acquiring the most feasable access to
the Oakwood Knolls Sewage Disposal Plant. Seconded by Mr. Bulger.
Motion Unanimously Carried.

Re: Billings for Rockingham
Farms Sewer District
Gentlemen:
On April 6, 1967 the Board adopted a tentative rate of $70.00
per home, per year operational costs for Rockingham Farms Sewer
District.
The Town of Wappinger began operation of the district effective
Nov. 1, 1966.
On June 30th, 1967 billings were sent out to all property owners
receiving service covering the period from Nov. 1, 1966 to May 31,
1967. Billings were mailed with the attached letter, and follow the
same penalty policy as that adopted for the Oakwood Knolls property
owners. Many of these charges have not been paid .
Up to the present time, bills submitted for payment and approved
have been paid out of the Capital Fund for the Rockingham Farms
Sewer District, i.e. the $240.00 hook up fees received upon issuance
of a Certificate of Occupancy. These monies are to be replaced when
the operational fees are received.
In view of past experience with Oakwood Knolls when the billings
first began, I recommend the interest charges for the June 30th billings
be waived and new billings be mailed covering the balance of the year,
i.e., June 1, to Dec. 31, 1967 along with a copy of the adopted policy
herewith submitted. In addition, an explanatory letter will be
enclosed..
POLICY FOR THE BILLING AND COLLECTION
OF MONIES FOR THE ROCKINGHAM FARMS
SEWER DISTRICT SERVICES.
1. All interest charges incurred prior to June 1, 1967 are waived.
2. Rate is tentatively set at $70.00 per year for service.
3. Billings for the period June 1, 1967 to December 31, 1967 are
to be mailed no later than November 27th, 1967,
4. Town Hall personnel will refuse any and all partial payments.
Payments must be made in full, i.e, charges plus penalties, if any.
5. Full payment is due in the hands of Town Hall personnel 15 days
from date of billing, without penalty.
A 5% penalty will be imposed on payments made within 30 days
from due date.
A 10/ penalty of the unpaid balance will be imposed thereafter.
Therefore, bills dated November 27, 1967 are due for payment
December. 12, ,1967, 5% penalty if paid after December 12 but
on or before January 11, 1968 and, 10% penalty if paid after
January 11, 1968.
Mr. Diehl moved to accept the Supervisors recommendation and adopt
the policy for the billing and collection for the Rockingham Farms
Sewer District. Seconded by Mr. Bulger. Motion Unanimously Carried.
Mr. Clausen asked if the letters had been sent to the home owners in
Oakwood Knolls regarding the billings, as had been suggested at the
last meeting. Mr. Fulton said he didn't know if Mrs. Crosby had sent
them or not. Mr. Clausen asked that they would be sent if they hadn't
been.
Motion to adjourn was made by Mr. Francese, seconded by Mr. Bulger
and Unanimously Carried.
