1967-02-14 SPM46 6` A Special Meeting of the Town Board of the Town of Wappinger was held at the close of the Public Hearing on Tuesday, February 14, 1967, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Joseph H. Fulton, Supervisor William J. Bulger, Justice of the Peace Vincent S. Francese, Justice of the Peace Absent: None Louis C. Clausen - Councilman Louis D. Diehl - Councilman Elaine H. Snowden.- Town Clerk The meeting was called to order by Supervisor Fulton, The following resolution was offered by Supervisor Fulton, who moved its adoption, seconded by Justice Francese, to -wit: RESOLUTION DATED February 14 ,1967. A RESOLUTION MAKING CERTAIN DETERMINATIONS PURSUANT TO SECTION 209-e OF THE TOWN LAW IN CONNECTION WITH THE PROPOSED ESTABLISHMENT OF THE TOWN OF WAPPINGER GARBAGE DISTRICT IN THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK. WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has duly caused a general map, plan and report to be prepared and filed in the office of the Town Clerk of said Town for the establishment of The Town of Wappinger Garbage District in said Town to be bounded and described as follows: All the land area of the Town of Wappinger, Dutchess County, New York State, outside the corporate limits of the Village of Wappingers Falls; WHEREAS, subsequent to the filing of the aforesaid la and e and q map, plan report, the Town Board duly adopted an order on January 30 ,1967, pursuant to Section 209-d of the Town Law, reciting a description of the boundaries of said proposed District, as hereinabove set forth, the improvements proposed for said District, the maximum amount proposed to be expended for said improvements, the proposed method of financing to be employed, that the cost of said improvements shall be assessed, levied and collected from the several lots and parcels of land in said proposed District at the same time and in the same manner as other town charges, and that said map, plan F and report were available for public Inspection in the Town Clerk's office during regular business hours, and specifying that a meeting of the Town Board would be held at the Town Hall, in said Town, on the 14th day of February ,1967, at 8:00 o'clock P.M.,, Eastern Standard Time, to consider the establishment of said District and said map, plan and report filed in relation thereto, and to hear all persons int- erested in the subject thereof concerning the same; and WHEREAS, notice of said hearing was duly published and posted in the manner pro- vided by Section 209-d of the Town Law, and proof of said publication and posting has been duly presented to the Town Board; and 46' WHEREAS, said hearing was duly held at the time and place set forth in said not- ice, as aforesaid, at which all persons desiring to be heard were duly heard; and WHEREAS, said Town Board has duly considered the evidence given at said hearing; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County,, New York, as follows: Section 1. Based upon the evidence given at the hearing referred to in the preambles hereof, it is hereby, found and determined as follows: a) That the notice of the aforesaid hearing was published and posted as required by law and is otherwise sufficient; b) That all the property and property owners within said proposed Garbage Dis- trict, as described in the preambles hereof, are benefited thereby; c) That all the property and property owners benefited are included within the limits of said proposed Garbage District, as described in the preambles hereof; and d) That the establishment of said proposed Garbage District, as. described in the preambles hereof, is in the public interest. Section 2. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Supervisor Joseph H. The following resolution was offered by Supervisor Fulton , who moved its adoption, seconded by Justice Bulaer , to -wit: RESOLUTION DATED February 14 , 1967. A RESOLUTION APPROVING THE ESTABLISHMENT OF THE TOWN OF WAPPINGER GARBAGE DISTRICT IN THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, AND THE CONSTRUCTION OF THE IMPROVEMENTS PROPOSED THEREFOR. WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has duly caused a general map, plan and report to be prepared and filed in the office of the Town Clerk of said Town for the establishment of the Town of Wappinger Garbage District in said Town; and WHEREAS, subsequent to the filing of the aforesaid map, plan and report, the Town Board duly adopted an order on January 30 , 1967, pursuant to Section 209-d of the Town Law, reciting a description of the boundaries of said proposed District, as hereinafter set forth, the improvements proposed for said District, the maximum amount proposed to be expended for said improvements, the proposed method of fin- ancing to be employed, that the cost of said improvements shall be assessed, levied 468 and collected from the several lots and parcels of land in said proposed District at the same time and in the same manner as other town charges, and that said map, plan and report were available for public inspection in the Town Clerk's office during regular business hours, and specifying that a meeting of the Town Board would be held at the Town Hall, in Wappingers Falls, New York, in said Town, on the 14th day of February , 1967, at 8:00 o'clock P.M., Eastern Standard Time, to con- sider the establishment of said District and said map, plan and report filed in relation thereto, and to hear all persons interested in the subject thereof con- cerning the same; and WHEREAS, notice of said hearing was duly published and posted in the manner provided by Section 209-d of the Town Law, and proof of said publication and post- ing has been duly presented to the Town Board; and WHEREAS, said hearing was duly held at the time and place set forth in said notice, as aforesaid, at which all persons desiring to be heard were duly heard; and WHEREAS, after said hearing, and based upon the evidence given thereat, the. Town Board duly adopted a resolution determining in the affirmative all of the questions set forth in subdivision 1 of Section 209-e of the Town Law; NOW, THERE- FORE, BE- IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York as follows: Section 1. The establishment of the Town of Wappinger Garbage District in the Town of Wappinger, Dutchess County, New York, the entry of said District into an agreement of Municipal cooperation with the Town of Fishkill Garbage District, the Town of East Fishkill Garbage District and the Villages of Wappingers Falls and Fishkill; said agreement to establish a jointly -operated sanitary landfill, with all necessary appurtenances for its proper operation, all as more fully set forth and shown on the map and plan aforesaid, at an estimated maximum cost of $225,000 are hereby approved. The method of financing the cost of said improve- ments shall be by the issuance of serial bonds of said Town maturing in annual installments over a period not exceeding fifteen (15) years. The cost of said improvements shall be assessed, levied and collected from the several lots and parcels of land within said District at the same time and in the same manner as other town charges. Section 2. Said District shall be bounded and described as follows: All the land area of the Town of Wappinger, Dutchess County, New )'ork State, outside the corporate limits of the Village of Wappingers Falls. Section 3. This resolution is adopted subject to a permissive referendum. ' VOTING Ave The resolution was thereupon declared duly adopted. * * * * * * * Mr. Diehl: (to Mr. Fulton) — Could you please explain the resolutions? Mr. Fulton: We've formed the district In the first part and in the second part going to pass a resolution whereby we're -authorizing some negotiations. Mr. Quinn: First resolution establishes fact required by^the statute. Second resolution establishes the district for the garbage and refuse disposal district of the Town of Wappinger only. Mr. Diehl: One more vote before we are completely into it? Mr. Quinn: Yes, sir, if all the other districts are formed. Mr. Diehl: In the meantime, Mr. Clausen is to look into matter on the water table. Mr° Fulton will call Conservation for report to the Town of Wappinger.
