1966-08-16 SPMWAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a Special Meeting of Said Town Board, and do hereby agree and consent that the same be held on the 16th day of August, 1966, at 8:00 o'clock in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the transaction of all business which may properly come before the meeting or any adjournment thereof. With respect to recent action taken by Mr. Mark Ritter in the operation of the Water Service in the Oakwood Knolls Development, that in the judgement of the Board their determinations is as follows: "A situation has arisen which requires action to protect Public Health of the Community, and to the residents of Oakwood Knolls." Prior to this date, Mark Ritter and entities which he represents, has repeatedly threatened to cut off the water in Oakwood Knolls Development. Mark Ritter notified the Sheriff this morning that his employees were taking immediate action to cut off the water supply, and further, that Sgt. John Dakin, on the Staff of the Dutchess County Sheriffs Office, had a conversation with the Supervisor of the Town of Wappinger at 6 o'clock P.M., of August 16, 1966, in which he informed the Supervisor that he (Dakin) had actually observed a Mr. Di Orio shut off the water service for five (5) houses in the Development. Due to the cutting off of the water in the Oakwood Knolls Devel- opment, and due to the resulting action causing a Health and Fire Hazard, a Motion was made by Mr. Bulger, and seconded by Mr. Diehl, that this TowP Board, Resolves that, at the direction of the Town Board, the Supervisor shall direct any Town employee to take what- ever remedial action that must be taken to alleviate the hazardous situation. Motion Unanimously Carried Mr. Bulger made the motion that Counsel to the Town be empowered to investigate and outline for the Board, proceedures for a hearing to be held at a later date, to determine the facts and gravity of the health menace created by the action of turning off water. Also, that the Supervisor, or in the absence of the Supervisor, any other member of the Town Board, shall be author ized to sign the subpoeneas to cause the attendance of any wit nesses that it was felt necessary to have testify, and to produce any papers that may be revelant, in order for the Board to complete its investigation. Seconded by Mr. Clausen. Motion Unanimously Carried Motion was made by Mr. Clausen and seconded by Mr. Diehl, to invite a member of the Oakwood Knolls Civic Association, and Mr. Economou, the Associations Attorney, to any future'negotiations between the Town Board and Mr. Mark Ritter on the purchase of the Water and Sewer facilities. Motion Unanimously Carried Rules were suspended to allow discussion from the floor. Rules were resumed. Motion was made by Mr. Clausen and seconded by Mr. Diehl to adjourn the meeting.
