1966-03-10 RGMThe Regular Meeting of the Town Board, Town of Wappinger, was held on Thurs- day evening, March 10, 1966, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Joseph H. Fulton - Supervisor Louis C. Clausen - Councilman William J. Bulger - Justice of the Peace Louis D. Diehl - Councilman Vincent S. Francese - Justice of the Peace Elaine H. Snowden - Town Clerk Absent: None Others Present: Harold H. Reilly - Attorney Joseph D. Quinn - Attorney Vincent C. Kelley - Engineer Joseph E. Ludewig - Building Inspector Knud Clausen - Highway Superintendent 60 Meeting was opened at 8;15 P.M. by a Salute to the Flag by Girl Scout Troop 129. Scout Leader - Mrs. Richard Tibbetts, Carol Angel (Bearer), Diana Struble (Caller), Deborah Tibbetts and Linda Calvin (Guards). OPEN DISCUSSION FROM THE FLOOR -- Mr. Cortellino - Reported that his car had been damaged because of road condi- tions in Wildwood Forest. He asked why the bond hadn't been called because the developer was not maintaining the roads. Mr. K. Clausen replied that he had a meeting with the developers and the roads were to be rebuilt. In two months, roads should be fixed. Mr. Fulton replied that the bond runs out in March and Mr. Quinn stated that the bond doesn't cover the conditions stated by Cortellino. After further discussion, Mr. Fulton stated that, if the road is unsafe, the matter will be taken up later and Mr. Clausen advised as to what to do. Mr. Schmalz - Last year the Town passed an ordinance raising the road standards. Because of some debate as to whether new developments go under old or new standards, he suggested that the Town make a resolution that all roads that get Planning Board approval meet the new road standards. Mr. Fulton - The Planning Board has been so informed. Mr. Tullo - Quiet Acres: brought up the subject of airport expansion. He felt the residents were being misled by newspaper articles and suggested that the Town be represented on the Committee. Mr. Migliore expressed concern over the many apartment houses being erected without apparent thought as to where the money for schools to accommodate the increase in school -aged children will come from. Hefelt this would impose an additional burden on the small homeowner and asked if the Board had inten- tions of studying this problem before issuing building permits for these apart- ment houses. Mr. Fulton answered that the Town Board is meeting with the Planning Board and School Board to discuss these problems. el Myers Corners Road was again brought up for discussion. Mr. Clausen pointed out that there are condemnation proceedings in the courts and nothing can be done until this action is completed. Mr. Francese stated that there is a petition by the Board on speed limits on Myers Corners Road. Mr. Quinn stated that the Town Board has no control over speed limits on a road of this type. It is in the jurisdiction of the New York State Traffic Commission and it is the philo- sophy of this Commission not to decrease speed limits on roads of this type. Mr. Fulton then stated that there has been a lot of talk about a First Class Town. He asked Mr. L'Archevesque to outline a few pertinent facts, adding that later he would ask for approval to proceed in this direction. This would be followed by public hearings. Mr. L'Archevesqud then presented an outline of steps involved in becoming a First Class Town, showing the advantages and dis- advantages. Question from floor - To what extent would the disadvantages be? Answer: Mostly salaries - aCtual cost would be a function of optional positions selected by the Board. Question: Is there'any other way to get money? Answer by Mr. Fulton: I would prefer that these questions be answered at the public hearings. Mr. Quinn: You are'rapidly approaching a population state in this Town where the question of contideration by the Board would be academic. Audit and Control will file the order one of these days anyway. Mr. Fulton then introduced Paul Hancock, representing Time -Life, Inc. Mr. Hancock gave a brief resume of a proposal on CATV (Community Antenna TV) presented to the Town Board. (A copy of the proposal is on file in Town Clerk's Office) He also gave a demonstration of closed circuit TV. At the conclusion, Mr. Hancock requested that the Board propose a resolution calling for a public hearing to pass on their application. Mr. Fulton Stated that March 31st had been set aside for a discussion with High Tower, a competitor, and that a date for a public hearing would be set some time after that date. Mr. Bulger asked Mr. Hancock about some variances between what he said and the original letter regarding channels. Mr. Hancock said that it would depend on the public demand as to what channels they pick up. They would comply with any changes that must be made. Mr. Quinn: Would you be content with a non-exclusive franchise? Mr. Hancock: Yes. Mr. Quinn: Does this offer a source of revenue for the Town? Mr. Quartararo (attorney representing Time -Life): If the Town desires, we would deposit an estimate of 3% of gross, revenue. If they would rather not, we would pass this on to the consumer. Mr. Quinn: Is it contem- plated that you use existing facilities owned by New York Telephone? Is there a 62 problem of additional burden on these easements? Mr. Quartararo: We would attempt to have this system engineered by the Telephone Company. They will build it and we will lease it from them. Mr. Quinn: I was thinking you might contact me of the imposition of a burden on existing easements on private land. Mr. Hancock: Any easements would be owned by the Telephone Company and we would not be involved. Only place we would purchase land would be where we would receive the microwave off Mt. Beacon, Mr, Bulger: Who would purchase the land and receive the signal on Mt. Beacon? Mr.,Hancock: Time -Life. There would be no towers in the Town of Wappinger. Mr, Quartararo: There might be one in Poughkeepsie, near Spackenkill Road. Mr. Fulton:, Do the schools cooperate in educational pro- grams? Mr. Hancock: In Indiana they do and it is excellent. Mr. Clausen: Are you operating in New York State? Mr. Hancock: No. We think there is a good possibility in the Town of Newburgh. They indicated a franchise was not necessary to operate in the Town, as their attorney felt the Telephone Company had the franchise. We would like to have the support of the Town of Wappinger Town Board. Mr. L'Archevesque: Recently the FCC has entered into this. Would you have any comment? Mr. Hancock: FCC, on February 15, assumed jurisdiction over all CATV in the country. They also suggested to Congress that they pass legis- lation on this subject. In this area, nothing applies which would prevent the Town Board from granting a permit or franchise and preventing us from going right ahead to build. This area is not affected by the rules that the FCC adopted. (Time -Life CATV is now operating in Marion and Richmond, Indiana, Station WFBM-TV Indianapolis). Supervisor called for a five-minute recess at 9:10 P.M. Meeting reconvened at 9:22 P.M. Mr. Clausen entertained a motion that the Town Board send a letter to the County Board of Supervisors indicating that the Town Board asks their consider- ation in placing the Supervisor of the Town of Wappinger on the Airport Com- mittee. Discussion followed. Mr. Bulger: I think it might be well to con- sider that this is the prerogative of the Chairman of the Board of Supervisors. Knowing that our Supervisor is a member of this Board, we might well antagonize them and not get our point across. I would suggest that we allow Mr. Fulton to talk with the Chairman unofficially first and, if there is objection on the Chairman's part or if he would like a communication from us, then we can do this. Mr. Clausen: The motion tends to show that the Town of Wappinger is concerned in this airport situation. Whether the Chairman of the Board 63 wants to or not, I think it is almost a duty of the Wappinger Town Board. I think it would be better if this was a communication from the Town Board. Mr, Quinn: Since the Town of Wappinger has a direct interest in the airport, you might be placing your Town and its Supervisor in a less useful position if he is a member of this committee than if he is not. I am sure that there will be plans for expansion -in the future, This may well be a factor which needs weighty consideration and perhaps control by your Town Board and it will be the Airport Committee which will be the steering group and sponsor for any expan- sion plan. Your Supervisor can be put in a difficult position. Mr. Bulger pointed out that the question of taxation can also -be very delicate. A motion was made by Mr. Clausen, seconded by Mr. Diehl, that a letter be dir- ected to the Chairman of the Board of Supervisors stating that the Town Board of the Town of Wappinger-feels our Supervisor should represent the Town on the Airport Committee and that thought be given by said Chairman to the possibility of appointing Mr. Joseph H. Seconded by Mr. Bulger. Motion Carried Unanimously Mr. Diehl made a motion that the bid for Gasoline be awarded to Mid -Hudson Oil Co. at the price of $0.13/gallon. Seconded by Mr. Bulger. Motion Carried Unanimously Mr. Bulger made a motion that the bid for Tires and Tubes be awarded to Good- rich, on the basis of low bid. Seconded by Mr. Diehl. Motion Carried Unanimously Mr. Francese made the motion to award the bid on Bank Run Gravel to Camelot on the basis of a shorter haul distance as it effects the FOB price. Seconded by Mr. Clausen. Motion Carried Unanimously Mr. Bulger made a motion that the bid for Sand be awarded to Camelot on the basis of a shorter haul distance which affects the FOB price. Seconded by Mr. Clausen. Motion Carried Unanimously Mr. Bulger made the motion that the bid on Corrugated Metal Pipe be awarded to Brighton Steel. Seconded by Mr. Clausen. Motion Carried Unanimously Mr. Diehl made the motion that the bid on Fuel Oil be awarded to Mid -Hudson Oil. Seconded by Mr. Bulger. Motion Carried Unanimously Mr. Bulger commented that it might be well to approach Mid -Hudson about service contracts for the Town Hall furnaces for the start of the next heating season. Bids received for Bituminous Concrete and Concrete Culvert Pipe were rejected as not meeting the specifications and must be re -bid. Mr. Bulger made the motion to accept the only bid of Ralph C. Herman Co., Inc. for a Wood Chipper. Bid price - $3,995.00. Seconded by Mr. Francese. Motion Carried Unanimously A petition for establishment of Rockingham Sewer District was presented. TO THE TOWN BOARD OF THE TOWN OF WAPPINGER: The undersigned, being the owner of all of the taxable real property situate in the proposed Rockingham Farms Sewer District, as is hereinafter more fully described, and, therefore, owning in the aggregate more than one- half of the assessed valuation of all the taxable real property of the pro- posed district as is shown upon the latest complete assessment roll of the Town of Wappinger viz: the assessment roll completed as of August 1, 1965, does hereby petition your Honorable Body to establish a sewer district to be known as Rockingham Farms Sewer District in the area hereinafter described which is located in the Town of Wappinger, County of Duchess, and State of New York, outside of any incorporated village and wholly within the said Town of Wappinger. The undersigned does hereby further petition your Honorable Body to approve the construction by your petitioner within the said proposed district of a sewer system in accordance with the map and plan annexed hereto. 64 65 Your petitioner, as a material representation to this application, hereby agrees that in harmony with its several requests herein that it will at its own cost and expense commence forthwith to complete the construction of the said sewer system in accordance with the map and plan annexed hereto to the approval of the Town Engineer of the Town of Wappinger and to the approval of the New York State Department of Health and any other related State and Muni- cipal agencies, and your petitioner hereby agrees that upon the completion of the construction of the said sewer system and upon the creation of the dis- trict as herein requested that -it will transfer, upon request from the Town Board, the title and ownership to the same to the Town Board on behalf of the said district at no cost or expense to the district. Attached hereto is a map and plan showing the boundaries of the proposed district and a general plan of the proposed sewer system including all outlets and the terminus and course of each proposed main sewer or drain together with the location and -the general description of all sewage disposal plants, pumping stations, and other public works.. That said map and plans have been prepared by Herbert L. Kartiganer, P.E., L.S., a competent engineer duly licensed by the State of New York. Pursuant to the provisions of the Town Law of the State of New York the expense of the said proposed district and the maintenance thereof from and after the date of the acquisition of the sewer system from petitioner shall be assessed and levied and collected from year to year from the several lots or parcels of land within the said district in proportion as nearly as may be to the benefit which each said lot or parcel of land in the said district shall derive therefrom. Motion Carried Unanimously Mr. Clausen proposed the following resolution, seconded by Mr. Francese: WHEREAS, a proposal has been submitted to this Board by Central Hudson Gas & Electric Corporation for a proposed modification of the existing agree- ment made between the Town of Wappinger and the said Central Hudson Gas & Electric Corporation under date of September 1, 1961, for the erection and maintenance of 19 street lights to be located at various intersections in the Town of Wappinger, and WHEREAS, the Town Board has considered this proposal and finds that the lighting of such intersections is necessary for the safety and welfare of the public, NOW, THEREFORE, it is RESOLVED, that the agreement modifying the existing contract between the Town of Wappinger and the Central Hudson Gas & Electric Corporation, as submitted by Central Hudson Gas & Electric Corporation be and the same is hereby approved, and it is further RESOLVED, that Joseph Fulton, Supervisor of the Town of Wappinger, be and he is hereby authorized to execute said agreement on behalf of the Town of Wappinger. Francese Voting: abstain Voting: aye Voting: aye Voting: aye Votitig: aye 71 Mr. Wolinsky addressed the Board in regard to Forrest View Road and the fact that this road has not been accepted by the Town. Mr. Knud Clausen presented the following minimum conditions for acceptance of private roads: (1) 50 foot right of way with title acceptable to Town Attorney, with necessary drainage easements. (2) Monumentation on at least one side of road at points of curv- ature and tangency and at intervals of 500 feet on straight portions. (3) Graded width of 30 feet. (4) 12" gravel base of 22' width, graded and compacted. Town would construct pavement at Town expense, There was discussion on this in which it was brought out by Mr. Wolinsky that the residents have spent approximately $2,000 in having the road surveyed, staked out, filling the holes, etc. Mr. K. Clausen felt it unfair to take over the road when the road standard is three times as strict as what he offered above. He said the road is only 40% of specification. The road is also a dead end, with no room for turn -around. Mr. Fulton asked if it is possible to adopt a resolution for these roads. Quinn: Yes, as long as the necessary width is there to comply with highway laws. Mr. Quinn asked if a cul de sac could be made for turning around and Mr. Wolinsky stated that the land has already been offered. Mr. Kelley stated that he had previously made the suggestion that we take the roads over under the conditions that we might have taken them over under the road specifications prevailing at that time. Mr. Fulton commented on Mr. Kelley's suggestion, stating that a resolution accepting these roads would need other con- ditions with it. I think the Board should face up to this problem and propose a plan to rid the Town of this situation entirely. Another resident of Forrest View Road: 1 would like to remaind the Board that, not only do we pay taxes, but we have also spent $2,000 on this road. Mr. Quinn: Normally, a Town is not permitted to improve personal property but certain roads pre -date specifications. There is a condition which removes it from being an improvement of private property. This would allow the Town to act with authority. Mr. Francese made the motion that this situation be turned over to the Highway Superintendent, Town Engineer and Town Counsel for study and recommendation. Seconded by Mr. Bulger. Motion Carried Unanimously Mr. Cortellino read a letter from the Wildwood Civic Association (letter on file in Town Clerk's Office) regarding the plowing of the development indicating that. the Town provided a waiver which was not signed by Sky View Development Corp. (Lafko) because of a clause which presumably stated that "if the Town could not find the time to plow our streets, the corporation would still be responsible for the plowing." Mr. Quinn explained the situation as follows: I merely provided that the Town would be exempted from liability in the event that they failed to plow and that they would be exempt from damages as a result of the plowing. The, waiver and proposed agreement called for the Town to do plowing at a speci- fied price and rate which was computed by the County Highway standards. The developer felt that this waiver provision was too stringent. I have recommended that provisions, such as mentioned, be made conditions preceding acceptance of bonds on roads and I trust this will be followed in the future. After further discussion in which Mr. Lafko participated, Mr. Quinn stated that the Town is not in the business of plowing snow from private roads except in an emergency. It was my thought to design a waiver agreement which would permit the Town to act legally and give it as much protection as I could. Clerk read a letter from the Planning Board to the Supervisor, informing the Board of their current concerns and activities. Clerk read a letter from the Planning Board to the Town Board regarding Howard Prager's application for rezoning of his property. Planning Board recommended against this rezoning. Town Board could take no action as appli- cation lacked metes and bounds description and specific zoning change wanted. Mr. Fulton said that he had a letter from Mid -Point Park. He said that he would like to go on record stating that they have been given permission to form a corporation. We will meet with them to discuss certain conditions. Clerk read a letter from the New York State Traffic Commission stating that they did not consider it necessary to lower the maximum speed restriction on All Angels Road. Clerk was asked to so inform the petitioners. Mr. Fulton presented a letter in regard to Hankin Development, stating he will withhold consent to form a district. Mr. Fulton referred to a newspaper article regarding Chelsea crossing, which is considered a dangerous intersection. Mr. Bulger made the motion that this Board request our attorney to draw a resolution which supports Mr. Coughlin's ideas, and that this resolution be forwarded to the Public Service Commis- sion and a copy sent to the New York Central Railroad. Apparently repairs made by the developer have not gotten the highway back to its original condition.
