1965-10-07 RGM290 The regular monthly meeting of the Town Board, Town of Wappinger was held on Thursday evening October 7, 1965, in the Town Hall, Mill Street, Wappingers Falls, N.Y. Present: Supervisor Richard M. Linge; Councilman George Robinson; Councilman Louis Diehl; Justice of the Peace William J. Bulger; Justice of the Peace Vincent Francese; Attorney for the Town,Harold H. Reilly; Engineer for the Town, Vincent C. Kelley; Superintendent of Highway, Robert Lawson; Building Inspector, Joseph E. Ludewig; Deputy Town Clerk, Agnes M. Grosenbeck. The meeting was opened at 8 P.M. by Supervisor Richard H. Lingm, Supervisor Linge advised the Board that they had received copies of the minutes of the September 9, 1965 meeting, what was their pleasure. Motion was made by Justice of the Peace Bulger to accept the minutes, subject ^ to corrections as pointed out by him, seconded by Councilman Robinson. Motion Carried The following bills were presented: Highway - $22,378.08 General Fund - „7,,�/. Motion was made by Councilman Robinson that the bills be paid, subject to audit, seconded by Justice of the Peace Francese. Inspector - $318x900"00 321.00 166 312 During the month of September, Certificates of Occupancy were issued for 20 Single Family Residences and 1 Private Elementary School. Following is a report of activities handled by me during the month of September, 1965» as Justice of the Peace: (1) 30 motor vehicle cases showing $415~00 collected in fines. (2) 2 motor vehicle case warrants issued. (3) 1 criminal warrant issued. (4) 5 civil cases handled showing $12°00 collected in fees and filing costs. A total of $42/°00 has been forwarded to the State Dept. of Audit and Control. $145,00 is being held in my official bank account on 4 pending motor vehicle and criminal cases. Respectfully submitted, Vincent S. Francese, Justice of the Peace. Adler & Brenner, consulting Engineers presented members of'the Board with copies of a feasabllity report, containing proposal for a larger sewer District in the Town of Wappinger. A letter was read from R. H. Echelmeieron his written proposal for operation of the water treatment plant located at Oakwood Knolls, and requesting permission from the Town to authorize expenditures of up to Two Hundred dollars ($200°08) a month for the purchase of operating supplies. A letter was read from the Board of Fire Commissioners of the New Hackensack Fire District, pertaining to a new Map of the Fire Districts Boundaries. A letter was read from Verner Christensen, Chairman of the Board of Assessors, regarding the purchase of a book entitled "Real Estate Appraisal and Investment" for the Assessors Office. A Petition was read from property owners and residents of Cedar Hill Road, requesting that the Town of Wappinger take over ownership of the Road known as Forest View (or Curnan or Curran Terrace) located on Cedar Hill. A letter was read from Joseph Landolfi, Pres. Wildwood Forest Civic Assoc. asking the Boards current feeling on the "Open Ditch" problem in Wildwood. A letter was read from Miller Clearwater in regard to the controversy over the use of Dorothy Heights by heavy trucks. A letter was read from Estelle Zak also pertaining to the "Illegal opening o of Dorothy Heights. A letter of Resignation was read from Frederick J. Becker, resigning from the Town of Wappinger Planning Board. Supervisor Linge asked that the matter of the New Hackensack Fire District be put on the agenda for the next meeting. Residents living on Dorothy Heights were present, stating their objections to this road being used as a through -way by heavy equipment, and asked the Board that this condition be eliminated. Supervisor Linge replied that as of today, there was a Deputy Sheriff stationed at the entrance of Dorothy Heights to control the speed limit and weight of vehicles using this road. Ed. Vrendenburgh asked the Board who had given per- mission to open this road. Discussion was centered on whether it was the re- sponsibility of the Town or Village. (Later in the meeting Mr. Casay'StStad he had checked unofficially with Mayor Furnari, who felt it was a Town problem.) Attorney Reilly suggested an ordinance be passed, restricting weight limit on Dorothy Heights. Mr. Zak asked what the weight limit would be. The Board stated 4 ton. Motion was made by Justice of the Peace Francese to regulate the flow of Traffic on Dorothy Heights, restricting thru-commercial traffic to 4 ton, seconded by Council- man George Robinson. Motion Carried A Public Hearing was set for October 28, 1965, at the Town Hall, on Dorothy Heights. Justice of the Peace Bulger moved that a letter be addressed to the Village Board, and the Village Planning Board, calling their attention to the situation on Dorothy Haighta° seconded by Justice of the Peace Francese. Justice of the Peace Bulger reported on the committee he was empowered to form pursuant to Sewage. He informed the Board that the Dutchess County Board of Health had been invited, and the Towns of LaGrange, Pleasant Valley, Hyde Park, Poughkeepsie, Wappinger, and the Village of Wappingers Falls, attended. Principals and effects of the laws applying to Sewage Districts were explained. The Town of Poughkeepsie passed a resolution to join Wappinger, and hoped the other Municipalities would do likewise. The idea is to take advantage of present State funds to study the entire Wappinger drain basin where the sewage problems exists, and do something about it. The Eng1naersworking on the feasability report on the water system were present at the meeting, and Mr. Aldrich asked Mr. Adler to explain what was proposed. Mr. Aldrich stated that the water system could be purchased from Mark Ritter for $l°OO^ and that he(Mr. Aldrich) would donate his services free of charge to represent the Town in this matter. Mr. Aldrich also stated that the cost 293. to the taxpayers, according to the engineers would be between $42 and $46 per annum. A Resolution was requested for the approval of the creation of a water District in Oakwood Knolls. Mr. Worona spoke in behalf of his client, Mr. Lafko, against the forming of this District. After a lengthy discussion between Mr. Aldrich and Mr. Worona, Mr. Linge called for a recess in the meeting. Upon the continuance of the meeting, the Board moved moved to pass the Resolution to adopt the water system in Oakwood Knolls, including the 2nd and 3rd Section, which is still to be opened. Motion was made by Justice of the Peace Bulger, and seconded by Justice of the Peace Francese, to adopt the following Resolution. The following vote was taken: Justice of the Peace Bulger - - - aye Supervisor Linge aye Justice of the Peace Francese - - aye Councilman Robinson. aye Councilman Diehl abstaining Motion Carried In the matter of the extablishment of the OAKW000 KNOLLS WATER DISTRICT in the Town of Wappinger, County of Dutchess and State of New York, pursuant to Article 12-A of the Town Law. WHEREAS, a map, plan and report relating to the establishment of the proposed Oakwood Knolls Water District, prepared by Barger and Russ, competent engineers, duly licensed by the State of New York, in manner and in such detail as has been determined by the Town Board of the Town of Wappinger, and has been duly filed with the Town Clerk of the Town of Wappinger, in accordance with the requirements of Article 12-A of the Town Law, and WHEREAS, an Order was duly adopted by the Town Board of the Town of Wappinger on the 5th day of August, 1965, reciting the filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district, the estimated expenses thereof, the proposed method of financing, the fact that the map, plan and report describing the same are on file in the Town Clerk's Office for public _inspection, and stating all other matters re- quired by law to be stated, and specifing the 9th day of September 1965, at 7:30 o'clock p.m. on that day, as the time, and the Town Hall, Mill Street in said Town as the place where the said Town Board would meet to consider said map, plan and report, to hear all persons interested in the subject matter there- of concerning the same, and to take such action thereon asis required or authorized by law, and by law, and WHEREAS, such Order was duly published and posted as required WHEREAS, a hearing on said matter was_duly held by said Town Board on the 9th day of September, 1965, beginning at 7:30 o'clock p.m. of that day, at the Town Hall in said Town, and WHEREAS, said public hearing was then adjourned until the 7th day of October, 1965, at 7:30 o'clock p.m. and at that latter date, a full discussion of the matter was had and all persons desiring to be heard having duly been heard, NOW, upon the evidence given upon such hearing, and upon motion of Justice of the Peace Bulger, seconded by Councilman Robinson, it is RESOLVED AND DETERMINED: 294 (a) That the notice of hearing was published and posted as required by law, and is otherwise sufficient. (b) That all property and property owners within the proposed district are benefited thereby. (c) That all the property and property owners benefited are included within the limits of the proposed district. (d) That it is in the public interest to establish said water district. FURTHER RESOLVED that the proposed improvement, including the acquisition of existing improvements, construction costs, costs of acquisition of lands and easements, legal and engineering fees and all other expenses, be financed by the issuance of serial bonds of said Town to mature in such number of equal Annual installments not exceeding forty (40), as may hereafter be determined by the Town Board of the Town of Wappinger, payable in the first instance from assessments levied on benefited real property in said district; and it is FURTHER RESOLVED that this resolution is subject to a permissive referendum as provided in Section 209e of the Town Law. Attorney Reilly submitted a Resolution for the acceptance of Amherst Lane, in the Subdivision known as Tall Trees. A motion was made by Justice of the Peace Francese to adopt the following Resolution seconded by Councilman Robinson. Motion Carried WHEREAS, an application has been received by this Board from Brook Hollow Builders, Inc., requesting that the proposed street and partially constructed proposed street known as Amherst Lane, located in a residential real estate subdivision, in the Town of Wappinger, Dutchess County, New York, known as "Tall Trees, Section 2" be accepted as and for a public street in the Town of Wappinger, and WHEREAS, Brook Hollow Builders, Inc. has tendered to this Board a deed con- veying and dedicating the said proposed street to the Town of Wappinger as and for a public street, it is hereby RESOLVED, that this Board does hereby accept the proposed street known as Amherst Lane and the deed dedicating the same, and it is further RESOLVED, that the said street shall hereafter be a public street in the Town of Wappinger known as Amherst Lane, subject to the following conditions: FIRST: That Brook Hollow Builders, Inc. furnish to the Town Board of the Town of Wappinger a performance bond in the amount of $36,000.00 approved by the said Town Board, and by the Town Attorney and by the Superintendent of Highways of the Town of Wappinger as to amount, form, sufficiency of surety and manner of execution, insuring satisfactory completion of the aforesaid streets in said sibdivision in accordance with the current minimum standard requirements for establishing roads in the said Town of Wappinger and in accordance with current specifications provided by the Superintendent of Highways of the Town of Wappinger and further insuring installation and completion of the storm water drainage system for said subdivision, the plan for which has been heretofore approved by the Town Superintendent of Highways and the Town Engineer, said work 29�� and improvements being subject to the final approval of the Town Superintendent of Highways and the Town Engineer of the Town of Nappinger, and further insuring compliance with the conditions set forth in the resolution of the Planning Board of the Town of Wappinger giving final approval to the said subdivision plat. SECOND: That the Town of Wappinger assumes no responsibility for main- tenance and repair, including the removal of snow, of and from said streets until the performance of the conditions mentioned in the aforementioned bond hashas been completed. THIRD: That a full covenant and warranty deed of dedication and the grant of storm sewer drainage easements be delivered to the Town of Wappinger and to the approval by the Town Attorney as to the adequacy, substance and form of such instruments and that such instruments are accepted subject to an exam- ination of title to the premises or rights conveyed thereby by the Town Attorney. FOURTH: That an attorney's certificate of title insuring title in said road shall be delivered and accepted by the Town Board. Allan J. lndzuuka* representing Schoonmaker, Inc. came before the Board, and asked their approval to form a sewer corporation, and later to come before said Board with their plans if this approval was granted. At this time, the Board could then either accept or reject their proposal. Mr. Caudy also asked the Board for this approval. Justice of the Peace Bulger moved that this matter be held in abayance until next meet ng so that they may have a chance to confer with their attorney, and engineers, so that they may not become involved in an unpleasant situation. Attorney Reilly explained that this request merely allowed them to fon^the Corp. with no obligation on the part of the Board. Engineer Kelley asked that the motion be tabled and that a special meeting be set for this matter in the near future. Motion was made by Justice of the Peace Francese that Schoonmaker, Inc. request to form a sewer corporation be tabled, and that a special meeting be arranged in the near future, seconded by Councilman Robinson. Motion Carried A motion was made by Justice of the Peace Bulger that the Board set a special meeting regarding Schoonmakers request, and at which other business can be con- ducted, seconded by Councilman Diehl. Motion Carried Justice of the Peace Bulger suggested that Attorney Reilly and Engineer Kelley be consulted before this special meeting. Mr° Cortell1no presented a map and spoke on speed limits in the Town of Wappinger. A motion was made by Councilman Diehl for the Board to accept this map, and submit it to the Dutchess County Highway Department for approval, seconded by Justice of the Peace Francese. Motion Carried Supervisor Linge asked that a letter be written to the Superintendent of High- ways of Dutchess County asking that the painting of the centerline be finished on All Angels Road at the bad curve, also that hazzardous conditions be eliminated at the intersection of All Angels Road and Kent Road. This condition is being caused by mud piling up. Supervisor Linge also recommended that Mr. Ludewig also look into this matter. Justice of the Peace Francese gave a report on the Budget; the taking Highway IJI, and IV out of Whole Town funds, and putting these items into Part -Town. Councilman Diehl moved that the Board discontinue Highway Item III, and IV, with the exception of the Superintendent of Highways Salary which should be trans- ferred to General Fund. These items pertain to upkeep and/or purchase of machinery for road work, and being the Town at no time spends one dollar on these roads in that part of the Town which lies within the Village, I believe this represents "Double Taxation'/ by the Town. Therefore, I would recommend we pass a Resolution at this meeting, effective with the 1966 Budget to correct this, seconded by Justice of the Peace Francese. Justice of the Peace Bulger called for a ruling. Supervisor Linge made a motion to exclude the motion made by Councilman Diehl. Councilman Diehl wanted the motion to stand. A Vote was taken. Councilman Diehl Ave Justice of the Peace Francese - - - - Aye The motion was defeated for lack of information. Justice of the Peace Francese asked if the motion could be taken up at a later meeting. Board agreed. Mr. Rifkin addressed the chair, and stated that Engineer Kelley said the roads in Wildwood would be completed by October 15. Engineer Kelley replied, stating the proper date which should have been quoted was October 31, 1065. The Letter from Cedar Hill Residents is to be referred to Engineer Kelley and Attorney Reilly. A motion was made by Justice of the Peace Bulger to ask Engineer Kelley to talk to the signers of the petition,requesting that the Town take over Forest View Rd., on Cedar Hill, and any others affected, to determine whether or not they are willing to meet with the proposed pol{O, seconded by councilman Diehl. Motion Carried Motion was made by Justice of the Peace Bulger to appoint Michael Cunningham to fill the vacancy on the Town of Wappinger Planning Board left by the resignation 297 of Thomas Logan, seconded by Justice of the Peace Francese. Motion Carried A motion was made by Councilman Robinson to appoint Einer Chrystie to fill the vacancy on the Town of Wappinger Planning Board created by the resignation of Fred Becker, seconded by Councilman Diehl. Motion Carried Councilman Robinson moved that the meeting be adjourned, seconded by Justice of the Peace Bulger. Motion Carried Signed -7;7 2r* Deputy Town Clerk ; A Spacial Meeting was called on Thursday, Oct. 7, 1965, after the Regular Board Meeting adjourned, for the purpose of closing Dorothy Heights. Present: Supervisor Linge; Justice of the Peace Bulger; Justice of the Peace Francese; Councilman Robinson; Councilman Diehl; -and Deputy Town Clerk, Agnes M. Grosenbeck. Motion was made by Justice of the Peace Francese to close Dorothy Heights temp- orarily for inspection by Town Engineer Kelley, and Superintendent of Highways Lawson, seconded by Councilman Robinson. Motion Carried Justice of the Peace Bulger stated; We have had reports on very heavy construction equipment being moved over this old highway, that was built in accordance with old specifications. We are concerned for the residents and users of this highway° We request the Town Superintendent of Highways and Town Engineer to take all necessary steps to insure the safety of the Highway. In accordance with Article 41, Paragraph 1660, Subdivision 11 of the Vehicle and Traffic Law, the Town Board of Wappinger does temporarily exclude from Dorothy Heights Road, any vehicle with gross weight of over 4 or more tons, since in the opinion of the Board, the Dorothy Heights Road Highway will be materially injured by the operation of such vehicle thereon.
