The regular monthly meeting of the Town Board, Town of Wappinger was held on
Thursday evening, March 4th, 1965, in the dawn Hall, Mill Street, Wappingers
Falls, N. Y.
Present: -Councilmen -George Robinson, Louis D. Diehl, Justice of the Peace -
William J. Bulger, Voncent S. Francese, Attorney to Town -Harold H. Reilly,
Engineer to Town -Vincent Kelly, Superintendent of Highways -Robert Lawson,
Byilding Inspector -Joseph E. Ludewig, Town Clerk-Heleh L. Travis.
The meeting was opened by Deputy Supervisor-16eorge Robinson at 8 P. M.
Deputy Supervisor Robinson advised the Board that they had received copies
of the January 7, 1965 and February 4, 1965 meetings, what was their pleasure
on same.
Motion was made by Justice of the Peace Bulger and seconded by Councilman
Diehle that the minutes be accepted as read. Motion carried
The bills for the month of February were read as follows:
General Fund -Warrant Sheet #4-$4,5$8.65
Highway Fund -$3,505.67
Motion was made by Justice of the Peace Francese and seconded by Councilman
Diehl that the bills be paid, subject to audit. Motion carried

Justice Court:
(1) 12 motor vehicle cases handled showing $365.00 collected in
fines.
(2). 8 civil cases handled showing$17.50 collected in fees and
filing costs.

(4) One criminal warrant issued
A total of $382.50 has been forwarded to the State Dept. of Audit and Control
At the close of the month, I was holding $225.00 in pending motor vehicle cases
and $100.00 in a pending criminal cases.

A letter was read from Beactric Irving asking Board to reconsider re -zoning
of property on Hopewell Road. Board requested this be turned over to the
Planning Board.
A letter was read from the residents of Dugans Lane. A discussion was held on
same. iihe Engineer for the Town, Vincent Kelly stated he would like a meeting
with the residents to go over the matter with them. A meeting was scheduled
for Saturday, March 6th, 1965.
A letert was read from Planning Board pertaining to Mall at Oakwood Knomis.
Motion was made by Justice of the Peace Francese and seconded by Councilman
Diehl that the Recommendation of the Planning Board on the Mall foo Roberts
Lane, Oakwood Knolls be accepted with the exception that the following
statement be inserted -"A guarantee of one year be placed upon the tree".

A letter was read from -Attorney -for -the Town, Harold H. Rielly pertaining
to Road Specification.
The new road specifications were read and the following resolution was made.
The following Resolution was proposed by Councilman Diehl
WHEREAS, it has become evident that new roads dedicated to the Town of
Wappinger have not been satisfactorily constructed so as to afford the res-
idents of the Town of Wappinger proper streets and highways, and
WHEREAA it is the desire of the Town Board to do whatever is possible to
correct this situation and to afford the resident& of the Town the proper
streets and highways, and

WHEREAS, the Town Engineer and the Town Superintendent of Highways
has recommended to the Town Board that the existing road spe;cifications be
amended to include certain requirements whcih they feel would be conducive
to the correction of the existing conditions, and
WHEREAS, the Town Board has studied these recommendations and agree

that these existing road specifications should be amended so as to include
these recommendations, and
WHEREAS, it is the desire of the Town Board that these requirements
be effective immediately and that all those who have not made formal appli-
cations for approval of subdivision plats become subject to these redluire-
ments, it is hereby
RESOLVED, 1. That new streets and subdivisions be constructed
in stages as follows:
A. -•The subgrade and base(foundation) Course shall
be constructed by the developer. Concurrently the
drainage structures and utilities shall be installed.
This stage to be done immediately and completed be-
fore C. 0."s are issued.
B. At any subsequent stage of the development, but
not later'than approximately half the houses are
occupied, or one year, which ever is the least, the
developer shall repair all defects observed in the
subgrade and base course, and have constructed a
Pavement consisting of a bituminouse surface treat-
ment.(Double).
C. At the completion of the subdivision, and prior
to final acceptance by the Town, but not sooner than
six (6) months from the stage B work, the developer
shall repair any observed defects in the subgrade and
base course and surface treatment, and have constructed
an asphalt concrete surface eousse of 1 1/2" minimum
compacted thickness on all streets except those
streets which are to be permanent dead ends, and
whose length does not exceed six times the minimum
lot width in the zoning district. These Cul-de-sacs
shall have applied the third application of bituminous
surface treatment.
D. The Developer shall, during the year following
acceptance, repair any defects which are observed
in the surface course, the base course, and the
subgrade.
E.- The Town shall closely bbserve the performance of
the constructed pavement and be prepared in three to
five years time or sooner,°if changing traffic patterns
dictate, to resurface the street with at least a 1"
minimum thickness asphalt concrete surface course.
2. That the Town provide snow plowing, and ice cobrol
service to developments under construdtion after stage A. of the
road construction has leen satisfactrily done, but only upon request of
the developer, and accompanied by written waiver of any claim for street
damage which plowing or ice control ;might cause.
3. That, as well as posting the required performance
bonds, the developer shall post $500.00 certified check to be retained until
final acceptance. This money is to be unspect unless the developer shall
fail, at any stage of development as determined by the Superintendent, to
properly maintain the roadway as required, in which event, the Superin-
tendent shall do the required work using the money depostied, and sim-
ultaneously notify the developers Bonding Company that he is in default
of his obligations, and it is further
RESOLVED, that the Planning Board is requested to re -study the
advisability oof continuing the waiver on curb requirements, and it is
further
RESOLVED, that the Town Engineer and the Town Superintendent of
Highways is requested to make a yearly review of the highway specificat-
ions that they be further u -graded and/or revised as needed, and it is
further
RgSOLVED, that these requrements shall become affective immed-
iately and that all new roads, except those in subdivisions whose dev-
elopers have made formal application to 'the Planning Board for prelim-
inary approval, must comply with these specifications.

The Town Clerk reported that the Town had only one outstanding iriddbtedness
at this time, a Highway Bond for $5500.00 and that she suggested that this
be paid from last years balances, which would eliminate interest.
The following resolution was made by Justice of the Peace Francese and
sedonded by Justice of the Peace Bulger:
Be it resolved that the Supervisor of this town be and he hereby is auth-
orized to transfer the .sum of $550G.36 from the Highwy Item #4, 1964 Ac-
count to the Machinery Account. Motion carried.
Motion was made by Councilman Robinson and seconded by Justice of the Peace
Bulger that the Highway Bond for $5500.00 held by the Marine Midland
National Bank of Southeastern New York be paid in full. Motion carried
A letter was read from I. C. B. M. Homes, Inc., in reference to acceptaoce
of Alpine Drive in the Les Chateau Apartments Developement.

The foilow8ng resolution was made by Justice of the Peace Francese and
seconded by Justice of the Peace Bulger and carrieds
WHEREAS, an application has been received by this Board from I.C.B. M.
Homes, Inc., requesting that the proposed street known as Alpine Drive, and
located in a multiple dwelling area in the Town of Wappinger, Dutchess
County, New York, known as "Les Chateaux Apartments" be accepted as and
for a public street in the Town of Wappinger, and
WHEREAS, THE Planning Board of the Town of Wappinger has duly
approved the said apartment project by a resolution adopted January 18,
1965, it is hereby
RESOLVED, that this Board does hereby accept the proposed street
known as Alpine Drive, and it is further
RESOLVED, Thtat the said street shall hereafter be a public street
in the Town of Wappinger, known as Alpine Drvie, subject to the following
conditions:
FIRST: That I.C.B.M. Homes, Inc. furnish to the
Town Board of the Town of Wappinger a performance bond in the amount of
$51,000.00 approved by the said Town Board, and by the Town Attorney
and by the Superintendent of H§ghways of the Town of Wappinger as to
amount, form, sufficiency of surety and manner of execution, insuring
satisfactory completion of the aforesaid streets in said subdivision
in accordance with the current minimum standard requirements for est-
ablishing roads in the said Town of Wappinger and in accordance with
current specification provided by the Superintendent of Highways of the
Town of Wappinger and further insuring installation and completion of
the storm water drainage system for said dubdivision, the plan for which
has been heretofore approved by, the Town Superintendent of Highways and
the Town Engineer, said work and improvements being subject to the final
approval of the Town Superintendent of Highways and the Town Engineer of
the Town of Wappinger, and further insuring compliance with the conditions
set forth in the resolution of the Planning Board of the Town of Wappinger
dated January 18, 1965.
SECOND,

FOURTH: That an attorney's certificate of title insuring
title in said road shall be debivered and accepted by the Town Board

accordance with applicable Town spedifications within two years from the
date of the adoption of this resolution, but not sooner than eighteen
months from said date, unless the Town Board shall consent to such sooner
completion based on a finding that the area served by said road or roads has been
substantially developed.

of the Peace Frances that the bid from Southern Dutchess Sand & Gravel

Motion was made by Justice -of the Peace Bulger and seconded by Justice of
the Peace Frances that the bid from Spoor Lasher Co., Inc., for Crushed
Stone be accepted. Motion carried
A report was given by Justice of Peace Francese on the new election
Districts. He reported that there would be 14 Districts instead of
7 and each district would have a proppective total of 900 voters.
He had two maps made up one for the Town Hall and the other for
the Election Board. He then turned the maps over to the Town Board
for action on same.
Motion was made by, Justice of the Peace Bulger and seconded by Councilman
and map b
Diehl that the above districts/be accepted. Motion carried__
Mrs. Oberling asked if map would be posted in the Town Hall.
Deputy Supervisor Robinson thanked the Planning Board for the help they
had given the Town Board.

A delegation from Weidwood Foreest attended !.Thattended (:tho meeting and brought
up the problem of the roads in the developement.! That they were
unpassable.
The Town Clerk is to write a letter to Lafko & Alexander stating that
if some action is not taken to put these roads in passable condition,
within ten days that the Town will notify the bonding company.
Motion was made by Oastice of the Peace Bulger and seconded by Councilman
Diehl that the above letter be written. Motion carried.
Mr. Curran spoke about the ditch hazzard in Wildwood.
Henry Bain asked about the width of the ditch.
Hmtion was made by Councilman Diehl and seconded by Justice of the Peace
Bulger that the Town Engineer check all phases of this and see what can
be done. Motion carried
The Board asked Engineer Vincent Kelly to explain the new road specifications
a little bid more thoroughly for the people.
The Board recommends that the banks be notified not to its close on a
property until a E. 0. is issued.
Mr. Epstein caled upon Mr. Lafko about the roads.
Mr. Tultot spoke on ditch and roads.
Motion was made by Justice of the Peace Bulger and seconded by Councilman
Diehl that the meeting adjourn. Motion carr&ed.

A special meeting of the Town Board, Town of Wappinger was held on Tuesday
evening, March 11, 1965 in the Town Hall, Mill Street, Wappingers Falls,N.Y.
Present: -Councilmen -George Robinson & Louis Diehl, Justices of the Peace-
William J. Bulger & Vincent Francese, Building Inspector -Joseph Ludewig,
Enfineer to the Town-Vincnent Kelly, Attorney for the Town -Harold Reilly,
Town Clerk -Helen L. Travis.
The meeting was opened at 8 P. M. by Deputy Supervisor George Robinson.
Much discussion was held on conditions in Wildwood Forest in reference to
roads and the ditch probtemsthase were recorded on the Tape recorder.
Motion was made by Councilman Diehl and seconded by Justice of thePeace
Bulger that the Building Inspector withhold all Certificates of Occup-
ancy in Wildwood Forests until the Town Board has a report from the
Town Highway Superintendent, the Engineer for the Town, who are to
consult with the Fire Chief of the District. The report to be to the
effect that the roads are passable and safe. This motion to become
effective on Saturday morning. The following vote was taken: -
Councilman Robinsons -Aye, Justice of the Peace Francese--Aye,
Councilman Diehl -Aye, Justice of the Peace William Bulger --Aye
Following this motion a discussion was held with Mr. Lafko, who akked
for a little more time before this motion went into effect.
Motion was made by Councilman Diehl and seconded by Justice of thePeace
Bulger that Skyview Developement Corporation be allowed 4 days to make
a reasonable effort to correct the road conditions in Wildwood Forest.
At the end of this time if they are not passable and in safe condition
the above motion was to go into Effect.
Motion was made by Councilman Diehl and seconded by Justice of the Peace
Bulger that if by Monday, March 15th the roads are not in passable condition
that their motion made above would go into effect immediately. The following
vote was taken. Councilman Diehl --Aye Councilman Robinson --Aye, Justice of
the Peace Bulger --Aye, Justice of the Peace Francese--Aye.
Motion was made by Justice of the Peace Bulger and seconded by Councilman
Diehl that the meeting adjourn.
Motion carried.
