1965-02-04 RGM191`. The Regular monthly meeting of the Town Board, Town of Wappinger, was held in the Town Hall, Mill St. Wappingers Falls, N.Y., on Thursday, February 4, 1965. Present - Deputy Supervisor and Councilman George Robinson; Councilman Louis Diehl; Justices of the Peace, William Bulger, and Vincent Francese; Attorney for the Town, Harold H. Reilly; Engineer for the Town, Vincent Kelley; Building Inspector, Joseph E. Ludewig; Superintendant of Highways, Robert Lawson; Town Clerk, Helen L. Travis. The meeting was ppened at 8 PM by Deputy Supervisor, George Robinson. Deputy Supervisor Robinson advised the Board that they had received copies of the minutes of the December 28th, 1964 meeting, what was their pleasure on same. Motion made by Justice of the Peace Bulger, and seconded by Councilman Diehl, that the minutes of the December 28th, 1964 meeting be accepted. Motion Carried The bills for the month of January, 1965 were read: General Fund $10,476.88 Highway Fund $ 1,425.89 Motion was made by Justice of the Peace Francese, and seconded by Justice of the Peace Bulger, that the bills be paid, subject to audit. During 1964, in Justice Court, 36 Criminal Cases 39 Civil Cases, and 291 Motor Vehicle Cases were adjudicated for an annual total of 366 cases. During that same period, *3556.50 was submitted to the Comptroller of the State of New York in payment of fines and fees. Total income was $4059.46. The remaining $766.00 consists of adjustments for 1963 transactions disbursed in 1964; bail of $250.00 taken in 1964 for cases not disposed of at the close of the year and fines and fees remitted to the New York State.Comptroller in 1965 for 1964 activity. (2) 7 Civil cases handled, showing $14.50 collected in fees and filing costs. (3) One Criminal case handled. (4) A total of $214.50 has been forwarded to the State Dept. of Audit and Control. (5) At the close of the month, -I was holding $125.00 in my official bank account for bail in two pending Motor Vehicle cases. Vincent S. Francese, Justice of the Peace During the year 1964, the activities listed below were handled in Justice Court: 194 (1) 256 Motor Vehicle cases handled resulting in total of $3030.00 collected in fines. (2) 98 Civil cases were handled resulting in a total of $230.50 collected in fees and filing costs. (3) 19 Criminal cases were handled. (4) (a) During the year, I forwarded $3,260.50 to the New York State Dept. of Audit and Control. (b) I have disbursed $801.61 to individuals during the year for payment of debts, constables fees, return of bail, return of filing costs. (c) At the close of the year, there was $450.00 in my official bsink account for bail in pending cases. A SUMMARY OF THE ABOVE SHOWS A TOTAL OF: (1, 373 cases handled (2) A total of $4,512.11 collected of which (a) $3,260.50 was forwarded to the State Comptroller (b) $801.61 was disbursed (c) $450.00 was held at the close of the year Vincent S. Francese, Justice of the Peace A joint Summary of the Activities of the Justice of the Peace show: 547 Motor Vehicle cases, 137 Civil, and 55 Criminal cases, showing showing a total of 739 cases handled in the Town of Wappinger Court. A total of $9,337.57 collected, of which $6,717.00 was forwarded to the State Dept. of Audit and Control. A total of $700.50 was being held as bail in pending cases at year end. We would like to emphasize that the occupancy of the present Courtroom has permitted holding Special Sessions Court in a suitable environment for the proper administration of Justice, and has Alleviated the necessity of borrowing facilities in which to hold Jury Trials. Travis, Town Clerk Motion was made by Councilman Diehl, and seconded by Councilman Robinson, that these reports be accepted. Motion Carried A letter was read from Joseph E. Ludewig recommending the name of Joseph Gutman as Deputy Building Inspector, stating he would devote a minimum of 18 hours per week on field inspection, at a salary of $2,000.00 per year. Motion was made by Justice of the Peace Francese, and seconded by Justice of the Peace Bulger, that Joseph Gutman be appointed Deputy Building Inspector at a salary of $2,000.00 a year. Motion Carried A letter was read from the Planning Board in reference to the re- zoning bf Martini Property. The Board recommended against this re -zoning. Mr..Pagones asked if he could take'this up again with the Planning Board. - Motion was made by Justice of the Peace Bulger, and seconded by councilman Diehl, -that -this matter be referred back to the Planning Board. Motion Carried A letter was read from the Planning Board in reference to the Mall on Roberts Lane. This was referred to the Attorney for the Town to look into. A letter was received from the Board of Fire Commissioners of the New Hackensack Fire District, asking about changing names of roads and streets that are practically the same. The Board asked Mr. Vandewinkel about this, and he stated that they would leek into the matter, andtry to come up with some solution at the next meeting. Superintendant of Highways, Robert Lawson, presented Bids.. The following Bids were reviewed for Fuel Oil; 196 441 Bottini Fuel Oil Corp. -- 0.12 a gallon for No. 2 Fuel Oil to Town of Wappinger, for contract period. Mid -Hudson Oil Co. Inc. -- 0:12.a gallon for Esso # 2 Fuel Oil to Town Hall, and Town Highway Department Building for the firm price of $kgs Sam and Irv's -- $.125 per gallon firm price for #2 Fuel Oil for contract year 1965. Vince's Oil Service -- $.126 per gallon for #2 Fuel Oil. Sinclair Refining Co. -- 13.55 0 per gallon. Motion was made by Councilman Diehl,, and seconded by Justice of the Peace Bulger, that Bottini Fuel Oil Corp. be granted the contract for Fuel Oil. The reason being that Bottini Fuel Oil Corp, and Mid -Hudson Oil Corp. submitted the same bid that they thought the Bottini being a local person he should receive the contract. Motion Carried The rest of the bids were held over until the next meeting in order that they could be looked into further by the Town Board and Attorney for the Town. A letter was read from Attorney Reilly in reference to proposed change of specification to require one and one half inches of Blacktop on roads to be accepted by the Town of Wappinger. Mr. Brannan asked if it wouldn't be wise to hold up Plans so that new builders would have to meet the new road specifications . Mr. Reilly stated he did not think it advisable and that he would give a decision an same. Mr. Hancock, representing Albert J. Ricci, spoke, asking permission to operate a Community Antenae System in the Townof Wappinger. He explained operation of same, and stated he would submit more information to them. Mr. Weinberg asked if this was relative to paid T.V.. Mr. Hancock answered that it could not be used for same. Mr. Brannan asked if they had considered planning regulations with the County Planning Board. Motion was tdade by Justice of the Peace Bulger, and seconded by Justice of the Peace Francese, that this be tabled until they could go further into the matter. Motion Carried Superintendent of Highways, Robert Lawson, asked permission to advertise for bids on a Convedtional Dump Truck. 1974. Motion was made by Justice of the Peace Ptincese,.and seconded, by councilman Diehl, that Superintendent of Highways, Robert Lawson, be given permission to advertise for bids on a conlsntional Dump Truck. Motion Carried Councilman Diehl moved that the compensation of the Election Board members be increased from $1.50 per hour to $2.00 per hour, and that they be allowed $3.00 per day for meals. Justice of the Pegce Bulger said he would second this motion if there was enough money allotted to cover this raise. After discussion, it was decided to withdraw this motion until it was looked into for the next meeting. Justice of the Peace Francese reported progress on the re -districting of the Election Districts, and wished to thank Building Inspector Joseph Ludewig, and Engineer Kelley for their help in this matter. Chairman of the Zoning Board of Appeals reported that Mr. L'Archevegque's term was expiring. Motion was made by Justice of the Peace Bulger, and seconded by Justice of the Peace Francese that Mr. L'Archevesque be re -appointed to the Zoning Board of Appeals. Motion Carried The following Resolution was proposed by Justice 'of the Peace Bulger, and secondedby Justice of the Peace Francese: WHEREAS, an application has been received by this Board from Angelo A. Williams, requesting that the proposed streets and partially constructed proposed streets known as Beechwood Circle and Brook Hollow Court, and located in a residential rea estate subdivishon in the Town of Wappinger, Dutchess County New York, known as "Brook Hollow Estates" be accepted as and for public streets in the Town of Wappinger, and WHEREAS, the plat of the aforesaid subdivision was duly approved, subject to certain conditions, by the Planning Board of the Town of Wappinger on October 5, 1964, and WHEREAS, the said Angelo A. Williams, has tendered to this Board a deed conveying and dhdicating said proposed streets to the Town of Wappinger as and for public streets, it is hereby RESOLVED, that this Board does hereby accept the proposed streets known as Beechwood Circle and Brook Hollow Court and the deed dedicating the same, and it si further RESOLVED, that the said streets shall hereafter be public streets in the 198" Town of Wappinger, known as Beechwood Circle and Brook Hollow Court, subject to the following conditions: FIRST: That Angelo A. Williams furnish to the Town Board of the Town of Wappinger a performance bond in amount of $16,000.00 approved by the said Town Board and by the Town Attorney and by the Superintendent of Highways of the Town of Wappinger as to amount, form, sufficiency of surety and manner of execution, insuring satifactorp completion of the aforesaid streets in said subdivision in accordance with current specifications provided by the Superintendent of Highways of the town of Wappinger and further insuring installation and completion of the storm water drainage systed for said subdivision, the plan for which has been heretofore approved by the Town Superintendent of Highways and the Town Engineer, said work and improvements being subject to the final approval of the Town Superintendent of Highways and the Town Engineer of the Town of Wappinger, and further insuring compliance with the conditions set forth in the resolution of the Planning Board of the Town of Wappinger dated October 5, 1964. SECOND: That the Town of Wappinger assumes no responsibility for maintenance and repair, including the removal of snow, of and from said streets until the performance of the conditions mentioned in the aforementioned bond has been completed. THIRD: That the deed of dedication of the aforementioned streets and the grant of storm sewer drainage easements tendered and offered to the Town of Wappinger are accepted jubject to an examination of title to the premises or rights conveyed thereby by the Town Attorney and to the further approval of the Town Attorney as to the adequacy, substance and form of such instruments. FOURTH: That said road or roads shall be completed in accordance f . With applicable Town specifications within two years from the date of the adoption of thus resolution, but not sooner than eighteen months from said date, unless the Town Board shall consent to such sooner completion baled on a finding that the area served by said road or roads has been substantially developed. Resolution unanimously Carrie The following resolution was made by Justice of the Peace William Bulger, and seconded by Councilman George Robinson, and unanimously carried: WHEREAS, the existing facilities at the Castle Point Hospital, Beacon, New York, offers services for veterans in this area and veterans from other parts of the country, and 199. WHEREAS, the existence of the Castle Point NOspital offers employment to a number of residents in this area, and WHEREAS, the existence of the facilities at Castle Point Hospital is conducive in general to the continued growth and prosperity of thisarea, and WHEREAS, the Town Board of the Town of Wappinger is of the opinion that the existing facilities should be maintained and desires to go on record as being in favor of their maintenance, and WHEREAS, the Town Board desires that copies of this resolution be for- warded to the proper authorities having jurisdiction over this mater, it is hereby RESOLVED, that this Board goes on record as being in favor of the continued maintenance of the existing facilities of the Castle Point Hospital Beacon, New York, and it is further RESOLVED, that copies of this resolution shall be forwarded to the proper authorities having jurisdiction over this matter. Louis Clausen asked if we could have a report from the Land Fill Committee and from the Industrial Committee. Councilman Robinson reported that he had jest gotten on the Land Fill Committee, but that they were inspecting sites. Justice of the Peace Francese reported that they had been working on different industries. It was suggested that the Town Clerk write the Department of Health, Poughkeepsie, New YorlF, asking them to give us any reports they may have on the sewage and water systems in the Town of Wappinger. Mr. Tullo brought to the attention the traffic situation at the intersection of Route 9 and New Hackensack Road. Stating people were passing Stop sign by cutting through the vacant gas station lot. Motion was made by Justice of the Peace Bulger, and seconded by Justice of the Peace Francese, that the Town Clerk write a letter to the Village Board explaining the situation, and asking for their help. Town Clerk stated that all things for the Agenda of the Town Board meetings must be in to her at least 7 days ahead of the meeting. Then Agendas would be forwarded to Town Board members at least 4 days ahead of the meeting. The following Resolution was made by Justice of the Peace Francese, and seconded by Justice of the Peace Bulger, and unanimously carried: WHEREAS, Subdivision 10 of Sction 29 of the Town Law requires that the supervisor of each town prepare and file with the Town Clerk within 30 days 2:0 after the expiration of each fiscal year, an annual financial report accounting for all moneys received and disbursed by him, together with the cettificate or certificates of the bank or trust company where Town moneys are deposited, showing the amount of such moneys on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Town Board may determine, by resolution, that the supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. NOW, THEREFORE, IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Sub- division 10 of Section 29 of the Town Law, the supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper.
