The Re -Organizational.. . _s.�.- meeting of the Town Board, Town of
Wappinger, was held on Thursday evening, January 7, 1965, in the Town
Hall, Mill Street, Wappingers Falls, N.Y.
Present -Richard H. Linge, Supervisor, Councilmen -George Robinson and
Louis Diehl, Justices of the Peace- William J. Bulger and Vincent S.
Francese, Joseph Ludewig, Building Inspector -Robert Lawson, Superintendent
of Highways, Harold H. Reilly -Attorney for the Town, Helen L. Travis,
Town Clerk.
Supervisor Linge opened the meeting at 8 P.M.
Supervisor Linge Advised the Board that they had received copies of the
minutes of the December 3, 1964 meeting, the Public hearing of December
10, 1964 on Amendment of Zoning ordinance and the Public Hearing on
December 10, 1964 on Sewer and Water District in Town and Special
meeting on December 10, 1964. What is their pleasure on same.
The Town Clerk stated the following corrections are to be made to the
minutes of the Regular meeting of the Town Board of the Town of Wappinger
held on December 3, 1964.
Page 157 - under report of William J. Bulger, should read; I am
holding $200.00 in pending vehicle cases, and $25.00 on a pending
Criminal action.
Page 159 - Under Discussion of Jack O'Neill of Marshall & Sterling
Agency;
Mr. O'Neill explained about bonds covering roads in Quiet Acres.
He stated Bonds are in force a year after expiration dates to the effect
that the roads stand up to specifications during that time.

The letter from Merrill Effron on I.C.B.M. Homes, Inc was tabled
and nothing done on same.
In the December 3, 1964 minutes, under those present, the name of
Vincent S. Francese, Justice of the Peace should be omitted.
Motion was made by Councilman Robinson and seconded by Justice of
the Peace Bulger that the above minutes be accepted as read with
correction.

his first meeting and greeted him on behalf of the Town Board.

A letter was read from the Town of Wappinger Assessors, advising the
Board that the Assessors would like to have Verner Christensen remain
as Chairman.
Motion was made by Councilman Louis Diehl, seconded by Justice of

the Peace Bulger that Verner Christensen be appointed Chairman of the
Board of Assessors for the year 1965.

Supervisor, Richard H. Linge appointed George H. Robinson, Councilman,
as Deputy Supervisor for the year 1965.

Helen L. Travis, Town Clerk, recommended Agnes M. Grosenbeck as
Deputy Town Clerk, and Joseph Raffaele, Deputy Town Clerk for issuing of
Conservation Licenses only.

Bulger that the above Appointment be made.

Robert Lawson, Superintendent of Highways, appointed Kenneth Croshier as
Deputy Highway Superintendent. /
Supervisor Linge appointed Louis Diehl to replace Wilmer Ifill on
Southern Dutchess Refuge System. Councilman miehl refused the appointment.
Supervisor Linge asked Councilman Robinson to act, and he said he would if
he could find out if the meetings were held in the evening. Councilman
Diehl moved that the road specifications be changed to include a minimum

of 11 inches of Black Top on roads before they be accepted by the
Town. The Town moard did not pass this, but designated that it be
turned over to the Torn Attorney for study.
A letter was read from the Grinnell Public Library, reporting that for
the year ending December 31, 1964

The Town Clerk stated that the Town Board should Audit the Justice of
the Peace' book at the time. The Board agreed'to do this following the
meeting.

Refuse Disposal System, Inc., asking the Town to send their share of
money, $54$.60, to Mr. Herbert Muller.
Motion was made by Justice of the Peace Bulger, seconded by Councilman
Robinson that the Towns share of $548.60 be sent to Mr. Herbert Muller for
their share in the Southern Dutchess Joint Garbage Metal and Refuse
Disposal System, Inc.. A roll call vote was taken as follows - Supervisor
Linge - Aye. Councilman Robinson -Aye-. Councilman Diehl - Aye. Justice
of the Peace Bulger - Aye. Justice of the Peace Francese - Nay.

Bulger, that Vincent Kelley be appointed Engineer to the Town of Wappinger
for the year 1965

A letter was read from Harold H. Reilly, stating that this was a notice
of his resignation from the office of Town Attorney, of the Town of
Wappinger.
It also stated that this letter was to serve as an offer of his
services to the Town of Wappinger as legal Council as outlined, for the
amount of $3,500.00 per year;
1. To attend all regular, and special meetings of the Town Board,
and to act as Counsel to the Town Board at such meetings.
2. To furnish legal opinions to the Town Board upon its request.
3. To act as Counsel and render legal opinions to the Town
Superintendent of Highways.
4. To act as Counsel, and render legal opinion to the Torn Building
Inspector.
5. To act as Counsel in all matters in which the Town of Wappinger
i is involved, except those which may be termed extraordinary.
The following resolution was made by Councilman Robinson, seconded
by Justice of the Peace Bulger.
WHEREAS, the Town Board is desirous of abolishing the office of Town
Attorney and,
WHEREAS, The Town Board feels that the interest of the Town of Wappinger
may be better served by the hiring of an Attorney as legal counsel on a
Contract basis, and
WHEREAS, HAROLD H. REILLY, a licensed Attorney in the State of New York
has offered his services as legal Counsel for the Town of Wappinger for
the consideration of $3,500.00 per year.
NOW, THEREFORE, IT IS HEREBY RESOLVED, that this Board does hereby•
disolve and abolish the office of Town Attorney for the Town of Wappinger, and
it is further
RESOLVED, that the Town Board hire as legal Counsel Harold H. Reilly for
a period dating from the 1st day of January, 1965, to the 31st day of
December, 1965, for the sum of $3,500.00 , upon the terms, and conditions

of his offer.

A letter was read from Harry E. Hill, Jr., enclosing an Application
for permission to operate a Community Antenna System.
Attorney for the Town, Harold H. Reilly, suggested that the letter be
held over for the next meeting, so that he could look into same.
A letter was read from the Association of Towns, giving data on
Convention in New York City on Feb. 8, 9, & 10, and enclosing blanks
for Deldgate and Alternate to Convention.
Motion was made by Supervisor Linge, and seconded by Councilman
Robinson, that Justice of the Peace Bulger be appointed Delegate to
the Convention, and Councilman Diehl be appointed alternate.

A letter was read from the Veterans of World War I, of the U.S.A
Barrgcks # 2984, requesting an allotment for 1965 of $200.00 to pay
for a meeting place. The Town Clerk stated she was not sure what we
could pay them, but she thought as long as they were meeting in the
Veterans of Foreign Wars Building in the Town of Poughkeepsie, that
they were not entitled to this ammount. She would check same.
An application for re -zoning was received from A. Thomas Martini asking
for re -zoning.
Motion was made by Justice of the Peace FYancese, and seconded by
Justice of the Peace Bulger, that this application be turned over to the
Planning Board.

Supervisor Linge stated that the Planning Board reported that Eugen
Schueleoi term expired, and the Planning Board recommended his re-
appointment..
Motion was made by Justice of the Peace Bulger,and seconded by Councilman
Diehl, that Eugen Schule be re -appointed to the Planning Board.

SuperYisor Linge appointed Councilman Diehl to the Re -Districting
Committee.
A letter was reviewed from the U. S. Department of Commerce --Bureau of

of Census, stating that the remainder of our payment of $1,188.00 for
special census is due.
Motion was made by Councilman Robinson, and seconded by Justice of the
Peace Bulger, that we pay $1,188.00 to the Board of Census.

Mr. Ritter asked why the roads in Oakwood Knolls had not been accepted
and taken over. The Board stated the Planning Board sys the roads are
not completed to the Planning Board specifications. Town Board can do
nothing without)i the consent of the Planning Board. The Planning
Board stated there should be a Mall in the middle of the road. Mr.
Ritter stated that same of the residents did not want the Mall. Mr.
Joseph Sipowski spoke against the Mall
Mr. John Kehoe spoke against the Mall.
Mr. Cain spoke against the Mall.
Motion was made by Justice of the Peace Bulger, and seconded by Councilman
Diehl that this matter should be referred back to the Planning Board.

Attorney Russell E. Aldrich appeardd before the Board, asking the Board
to set a date for a Public Hearing for the Approval of Oakwood Knolls
Sewerage District, and Water District. He Stated the people thought they
should dpnsider the two together for $120,000.00.
He asked the Board to appoint Engineer and Attorney andset adjournment
date for Public hearing on Sewer District, and combine same with Public
Hearing on Water District.
NOW, on motion of Councilman Robinson, and seconded by Justice of the
Peace Bulger, it is hereby
ORDERED that the Town Board of the Town of Wappinger shall meet and
hold a public hearing at the Town Hall, Mill Street in the Village of
Wappingers Falls, Butchess County, New York in said township, on the
11th day of February, 1965, at 7:30 o'clock, p.m., on that date, to
consider map, plan and report, and to hear all persons interested in
the following subject, concerning the same, and to take such action
thereon as is required or authorized by law.
WHEREAS, a map, plan ;and report have been prpared, in such manner and in

such detail as has heretofore been determined by the Town Board of
the Town of Wappinger, relating to the establishment of a proposed
Water District to be known as the Oakwood Knolls Water District, in
the area of said township hereinafter described; and
WHEREAS, such map, plan and report have been duly filed In the
Town Clerk's Office in the Town of Wappinger situate on Mill Street in
the 'pillage of Wappingers Falls, New York; and
WHEREAS, said map, plan and report were prepared by Barger and Russ, a
competent engineering firm, of which Richard G. Bargdr is a duly
licensed engineer, licensed by the State of New York, showing the
boundaries of the proposed district, a general plan of the propesed
water system and a report of the proposed method of operation, together
with the source of water or water rights to be acquired therefor, the
method of conducting the proposed water works and the location thereof,
including reservoirs, water purification or treatment works, water mains,
distributing pipes and hydrants, as well as a description of the
facilities presently installed, and in operation, and proposed to be
acquired by said proposed district, including the well, pump house,
storage tanks and water mains; and
WHEREAS, the boundaries of the proposed district are as follows:

improvements andwfai the acquisition of necessary lands and easements
as well as the existing welll, pumps, well house, storage tanks, mains
and other facilities presently in operation in parts of the premises to
be included in said proposed district is Eighty-three Thousand Six
Hundred and Six Hundred and Sixty-seven($83,667.00) Dollars; and
WHEREAS, said map, plan and the report describing said improvements
including the exidting facilities to be acquired and the extension and
expense thereof within said proposed district, are on file in the
Town Clerk's Office at Mill Stree in the Village of Wdppingers Falls,
Dutchess County, New York, available for a public inspection.
The adoption of the foregoing Order was duly put to a vote, and
upon roll call, the vote was as follows:

and Water Disqrict.

could they be accepted separately
In order that proper statuatory controls may be maintained on the
expenditure of town funds, the Town Board of the Town of Wappinger has
established the following policy effective January 1, 1965.
1. Town Officials, Chairman of Boards, Committees, Commissions
or department heads are the only persons empowered to make any contract,
committment or promis to pay any Town Funds, for any town purpose in

accordance with the current budgetary appropriations,:'up to a maximum
amount ,of five hundred dollars ($500.00) Any such chairman, department
head or Town Official who comtemplates an expenditure in excess of
Five Hundred Dollars is requested to submit the details of such planned
expenditures to the Town Board prior to makeng any contract, commitment
or expenditure.

of the Peace Francese, that the above recommendation be accepted.
