1964-09-10 RGMThe regular monthly meeting of the Town Board, Town of Wappinger was held on Thursday evening, September 10, '1964 in the Town Hall, Mill Street, Wappingers Falls, N. Y. Present: -Supervisor -Richard H. Linge, Councilmen -Wilmer Ifill & George Robinson, Justice of the Peace -William J. Bulger & Vincent S. Francese, Town Attorney --Judson C. Williams, Town Engineer - Charles Maneri, Building Inspector -Joseph E. Ludewig, Town Sup- erintendent of Highways -Robert Lawson, Town Clerk -Helen L. Travis The meeting was opened by Supervisor Richard H. Linge at 8 P. M. Supervisor Linge advised the Board thajt they had received copies of the Minutes of the August meeting. What was their pleasure on same. Motion was made by Councilman Robinson and seconded by Councilman Ifill that the minutes of the August meeting be accepted. Motion carried Supervisor Linge advised the Board that they had received copies of the Warrant Sheets for Bills for the month of August, totalling as follows: GENERAL FUND WARRANT SHEET $1599.33 HIGHWAY DEPARTMENT $8,880.42 Motion was made by Justice of the Peace Bulger and seconded by Justice of the Peace Francese that the bills be paid. Motion carried The following reports were received: BUILDING INSPECTORS REPORT FOR THE MONTH OF AUGUST 1964 Permits issued for: 25 Single Family Residences 5 Residence Additions 3 Residence Garages 2 Other Structures 35 Total Permits Value of construction $428,840.00 Fees collected and turned over to Town Clerk 447.50 0.3 1p4 Miles traveled on Zoning and Building Inspection 180 Joseph E. Ludewig, Building Inspector During the month of August 1964, while presiding in Justice Court Town of Wappinger, I heard the following cases and collected the fees and fines listed below: TYPE NUMBER FINES & FEES COLL. Motor veh. 27 $380.00 civil 1 .50 criminal 4 10.00 I am holding $100.00 in my official bank account on a pending motor vehicle case which was not closed during the month, and $25.00 in a crimina]jaction. I am also holding $2.50 in a pending civil ;matter. !I William J. Bulger, Justice of Peace Following is a report of actions handled by me during the month of August 1964, in my official capa±&ty as Justice of the Peace. (1) 23 motor vehicle cases showing $205.00 collected in fines (2) 7 civil cases closed showing $30.00 collected in fees and fines. (3) One criminal case closed during the month with no monies collected. (4) (2) criminal warrants were issued. I have forwarded a total of $235.00 to the State Dept. of Audit and Control. I am holding $24.50 in my official bank accoun6 for civil cases which were not closed during the month. Vincent S. Francese, Justice of Peace Town Clerk reported she had received a letter from J. Zola, stating that he was against garbage Dump on Cooper Road, and a copy of same had been sent to Town Board members. Town Clerk reported she had received a letter from Naomi & Barry Girsch, objecting to mod&#1 Home of Cornell Homes still being on Daisy Lane. Building Inspector Ludewig reported that he had written to Cornell Homes about this matter and that he would 105 continue to take care of same. A letter was received from Aldrich & Aldrich enclesing an applic- requesting ation xmcgaix±migxthe Board to require compliance with Section 23,2 of the regulations and to i4plement the appointment of an inspector to assist the Planning Board in performance with its responsibilities to the Town of Wappinter, its taxpayers and residents. Motion was made by Councilman Ifill and seconded by Justice of the Peace Bulger that this be turned over to the Planning Board for study. Motion carried Attorney Russell Aldrich appeared before the Board asking for an adjournment of the Public Hearing on the Oakwood Knolls Sewer District, due to the fact that they had not received the report from the New York State Boat of Health, yet. Motion was made by Councilman Robinson and seconded by Councilman Ifill that the Hearing on Oakwood Sewer District be adjourned, due to the fact that they had not received arepport from the New York State Board of Health. Motion carried Attorney Williams requested authorization from the Board to pay $900.00 to Christopher Simonetty. Upon motion of Justice of the Peace Bulger and seconded by Councilman Robinson the following Resolution was unanimously adopted: RESOLVED, that the Supervisor of the Town is hereby authorized and directed to apply for the necessary approval of the Dutchess County Treasurer and the Dutchess County Court of a proposal to pay to Christopher J. Simonetty the sum of Nine Hundred Dollars ($900.00) for approximately.059 acre of land required for the reconstruction and improving of Widmer Road. Supervisor Linge reported that the census Bureau had been contacted and that a reply had been received asking for a check for deposit and also for 11 copies of Town Map. The check and maps had been sent by the Town Clerk and he thought we would now receive a date for same. Knud Clausen spoke on Widmer Road. The Amendment to like Zoning Ordinance, whickh was presented at the Hearing on August 13th, 1964 by Mrs. Margaret Card on Parcel #1 was presented and the following vote was taken. Bulger --Nay Justice of the Peace --Vincent Francese--Nay All the Board having voted Nay the amendment was not passed. The Amdndment to the Zoning Ordinance whashwas presented at a /411010 Hearing on August 13, 1264 by Mrs. Margaret Card on Parcel #2 was presented and the following vote was taken: Supervisor --Richard H. Linge--Nay Councilman --Wilmer Ifill--Nay Councilman --George Robinson --Nay Justice of the Peace--Bd14liam-gayBulger—Nay Justice of the Peace --Vincent S. Francese--Nay All the Board having voted Nay the amendment was not passed. The amendment to the Zoning Ordinance which was presented at a Hearing on August 13th, 1964 by Beatric Irving was presented and the vote was a follows: Supervisor --Richard H. Linge--Nay Councilman—Widmer Ifill--Nay Councilman --George Robinson --Aye Justice of Peace -William J. Bulger --Aye Justice of Peace -Vincent Francese--Aye The Town Attorney pointed out that under the Town Zoning Ordinance in as much as the Town Planning Board had reported unfavorably on the proposed re -zoning of the Irving Property, a 2/3 affirmative vote of the Town Board was required to adopt the proposal. The amend- ment required 4 out of 5 votes and the vote was 3 for and 2 against. The amendment was not passed. Motion was made by Councilman Ifill and seconded by Councilman and unanimously carried Robinson/that the Hearing scheduled, on the Wheeler Hill re -zoning for September 17th, 1964 be cancelled and a new date of October 22, 1964 at 8 P. M. be designated for a Public Hearing on the re - above petion and also on the new proposed zoning as follows: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by Article 16 of the Town Law of the State of New York, and also in pursuance of Article 9 of the Town Law to the extenfi applicable as follows: Section 1. The Town of Wappinger Zoning Ordinance adopted January 29, 1963, as amended, is hereby further amended by re- zoning a tract of lance now zoned in part R-20, One Family Resi- dential District, and in part RD -40, Optional Dwelling Residential District, to R-40 One Family Residential District, said trac tof land being in general situate South of the Wappingers Creek and Marlorville Road, West of New York Route 9D, East of part of Wheeler Hill Road and also East of the Hudson River and North of the property of Brothers of the Order Hermits (Good Counsel Novitiate) and being more particularly described as follows: BEGINNING at the most northerly point of the southerly abutment of the New York Central railrod bridge over the Wap- pingers Creek at New Hamburg and running from thence easterly and southerly along the shore line of said abutment and thence northeasterly along the southeasterly shore line of the Wap- pingers creek to the point which is at right angles to Creek Road in range of the junction of thehwesterly side of Marlorville Road and the easterly side of Creek Road, running from thence to the said junction of road lines, thence south easterly along the southwesterly side of Marlorville Road approxi- mately 1302 feet, thence northeasterly still along said Marlor- ville Road approximately 110 feet, thence southeasterly still along said southwesterly side of Marlorville Road 680 feet more or less to the northeasterly corner of lands of the Willis Reese Estate, thence southwesterly along the southeasterly boundary line of the lands of the said Willis Reese Estate approximately 1400 feet to its junction with the northeasterly side of New Hamburg Road, thence in a straight line crossing said New Hamburg Road to the northeasterly corner of other lands of said Reese, 1 thence southwesterly along the southeast Boundary line of lands of said Resse and lands of New York City Congregational Church Associ- ation approximately 2200 feet to lands now or formerly of Lilyan Berger, thence southeasterly along said lands of Berger 50 feet, thence southwesterly along the southeasterly boundary line of the siad lands now or formerly of Berger approximately 1213 feet, thence northwesterly still along the said Berger 400 feet to th southeasterly boundary line of lands of Lwrence Kanter, thence wouthwesterly along the said Kanter lands approximately 675 feet to the lands of Edward Kellenbert, thence southeasterly along the said land of Kellenberg and the Crawford Estate approximately 1700 feet, thence southwesterly through land of said Crawford Estate and along the woutheasterly line of the land of Gerard Schuer to its interesection with the northeasterly line of Wheeler Hill Road which said point is 288.05 feet from the corner junction of Old State Road and Wheeler Hill Road, thence North North west along the said northeasterly line of Wheeler Hill Road to turn in the Road at the foot of hill and then cross- ing said Wheeler Hill Road and proceeding along the southwesterly line of the boundary lines of the Fred Wendell property and the northeasterly boundary line of Brothers of Order Hermits (Good Counsel Novitiate) atotal of 3185 feet to the easterly shore line of Hudson River, thence northerly and northeasterly along the said Easterly shore line of the Hudson River to the point or place of beginning. Section 2. The zoning map of Town of Wappinger adopted by the Town Board, January 29, 1963, as amended, and being a. part of the aforesaid Town of Wa11finger Zoning Ordinance is hhreby amended in conformity with the foregoing. Section 3. This amendment shall become effective im- mediately upon adoption, posting and publication as prescribed by T®wn Law. i The Town Hall Committee reported that the Attorney for the Masonic Lodge states that contracts are ready for signing 109 and that he will send copies to Attorney Williams. Town Clerk reported that the Estimates for Budgets must be in to her by September 20, 1964 and that she would 18ke a date set for a meeting to start the budget. A date of September 24th, 1964 and 7:30 P. M was set. A deed was presented from Rabilt, Inc., for a easement for Surface Drainage. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that this easement beaccepted. Motion carried Councilman Ifill reported on the Sewerage Land Fill Committee: Stating they had held their fiist meeting. Officers had been elected. He stated they had discussed the sites and that the first two sites were not in accordance with their picking and that he thought they would be abolished and that they were look- ing for new sites. Seth Lily asked for detailed information on the sites which had been abandoned. Mr. Bisom spoke saying he had been in touch with some Oakwood Knolls residents and that nobody seems to know who hi in this Association. They want to know who appointed Russell Aldrich to represent them. He would like a copy of the petition to check if people had signed it. He was told he could have a copy of petition, but that he would have to pay for same. Mr. Brannan asked Supervisor Linge how he had voted on the Water District. Supervisor Linge said he had voted to keep Rhinebeck in it, and that he thought they sould have studied it further. A report was given by the Industrial Committee. evsttcenof the Peace Francese reported that they had received no answer from the Ruppert Brewering Company. He reported that there was a pos- sibility of a factory being opened in Town, if the help can be procured. He reported that they had just about completed the brochure of the Town. Mr. Bisom asked why the Town of Wappingerkhdd not received any State Aid for Receration when other Towns & Villages including the Village of Wappingers Falls had. Attorney Williams explained that this help was only given when the Towns or Villages had paid employees working on recreation, and that at vthe present Time the Town had none. Mr. Raffaele asked about a report on the Junk Yards. Mr. Ludewig stated same was going along slowly. Supervisor Richard H. Linge declared the meeting closed at 9:30 P. M.
