1964-03-12 RGM3 I# The regular monthly meeting of the Town Board, Town of Wappinger was held on Thursday evening, March 12, 1964, in the Town Hall, Mill Street. Present: -Supervisor -Richard H. Linge, Councilman -George Robinson, Justices of the Peace -William Bulger & Vincent Francese, Town Engineer -Charles Maneri, Town Attorney -Judson Williams, Super- intendent of Highways -Robert Lawson, Building Inspector -Joseph Ludewig, Deputy Town Clerk -Agnes Grosenbeck. The meeting was opened at 8 P. M. by Supervisor -Richard H. Linge. Supervisor Linge stated that the Board had received copies of the minutes of the ffebiaary meeting and what was their pleasure on same. Motion was made by Justice of the Peace Bulger and aedonded by Justice of the Peace Francese that the minutes be accepted as amended. Motion carried The bills for the month of February were read. Motion was made by Justice of the Peace Francese and seconded and ;paid by Councilman Robinson that the bills be accepted/ith the exception of #76 which was held over to be checked. Motion ,carried GNERAL FUND WARRANT SHEET #4 $5,547.73 HIGHWAY DEPARTMENT WARRANT SHEET #3 $4,4773,37 Building Inspector -Joseph Ludewig submitted the following report. Building permits issued for the following: 11 Single Family Residences 11 Total permits issued for a value of $185,400.00 Fees collected and turned over to Town Clerk $184.00 Miles traveled on building inspection and zoning business Justice of Peace Francese submitted the following report. Following is a report of actions handled by me during the month of Febrihary, 1964 in my official capacity as Justice of the Peace. 291 Mile 35 (1) Twenty-four motor vehicle cases showing $240.00 collected in fines. (2) Eleven civil cases showing $19.00 colledted in fees and filing costs. (3) There were two criminal actions handled by me diiring hte month of February, 1964, which are still pending final dispostion. I have forwarded a total of $259.00 to the State Department of Audit and Controd). I am holding $40.50 in my official bank account for 17 Civil cases which were not closed during the month. Justice of the Peace Bulger submitted the following report. Duting the month of February, 1964 while presiding in Justice Court, Town of Wappinger, I heard the following cases and collected the fees and fines listed below: TYPE NUMBER FINES & FEES COLLECTED motor vehicle 26 $225.00 civil 3 7.50 29 132.50 I have $4.00 in my official bank account on pending civil cases. During the month of February, I issued one warrant on a criminal case and one on a motor vehicle case. A letter was read from the Citizens Scholarship Foundation of the Wappingers Central District asking the Board to establish and proclaim April 5, 1964 to April 12th, 1964 as Scholarship Week. A resolution was made by Justice of the Peace Francese and seconded by Justice of the Peace Bulger and unamimously carried that the week of April 5, 1964 to April 126h, 1964 be proclaimed Citizens Scholarship week in the Town of Wappinger. A letter was received from the Wappingers Falls Chamber of Commerce, Inc. asking the Town Board if it would be possible for the Town of Wappinger to donate toward the Christmas Lighting Fund. Motion was made by Councilman Robinson and seconded by Justice of Peace Francese that this matter be laid over until and later date and also asked that our Attorney be asked to look into the legality of same. Motion carried nma1111uuu 11111 Letter was read from the Planning Board pertaining to curbs, gutters and sidewalks. Letter was read from the Town Hall Committee recommending,'f1at Town lonsidex' purchasing the Masonic Building. Letter was read from the Town Hall Committee recommending that the Board consider the purchase of the Bisnoff Site, on the New Hackensack Road. Justice of thePeace Bulger suggested that the ground be surveyed and this was discussed in full. Mr. Harry Holt reported that $3,000.00 ber acre Net would be the price and that Town would have to pay for the survey. He pres- ented map of Bisnoff property and suggested that we acquire the property. Mr. Holt stated they had lookdd at 18 or 19 properties since they were appointed, in May 1963. Supervisor Linge spoke on this matter. He then complimented the committee for the work they had done and dismissed them with thanks. Louis Clausen then raised the question of what would happen if the Masonic Temple was sold before the new site was ob- tained. Supervisor Linge asked Attorney Williams to see Mr. Bisnoff and ask if we can obtain a 60 day option in writing on the propertyand then confer with the Planning Board. Knud Clausen spoke on Town Hall Site. A letter of resignation was read from Charles 0. Wood from the Town of Wappinger Recreation Committee. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that this resignation be accepted with re- gret. Motion carried. Mrs. Theresa Arkell recommended that Mrs. Joseph Bosco be app- ointed a member of the Recreation Committee for a term of three years, term to expire May lst, 1967 and Murray Edelstein be appointed for one year, expiring May 1st, 1960. Motion was made by Coucillan Robinson and seconded by Justice of. the Peace Bulger that the above appointments be made to the Secteation Commission. Motion carried Letters were read from ale:Ernest Wharton, U. S. Congressman and Kenneth B. Keating, United States Senate, in reference to reten- ion of manned communications station at Dutdhess County Airport. A letter and pettition from residents of Mac Farland Road was read. This was referred to Highway Superintendent Lawson for investigation with the Planning Board. The following resolution was made by Councilman Robinson and sec- onded by Justice of the geace Francese: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wap- pinger, Dutchess County, New York, in pursuance of the authority conferred by Article 16 of the Town Law of the State of New York, and also in pursuance of Aricle 9 of the Town Law to the extent appli- cable as follows: Section 1. The Town of Wappinger Zoning Ordinance adopted January 29, 1963, as amended, is hereby further amended by re- zoning from R-20, One Family Residential Distrct, to RD -20, Optional Dwelling Residential District, the following tract of land: Lands owned by Lena Rende bounded on the north by Hopewell Junction Road (County Highway 28), on the east by Indian Ridge Development, on the south by lands now ownfdrxierly owned by Card and on the west by lands now or formerly owned by Irving, havir}gaapproximately 373 feet frontage on ,Said Hopewell Junction Road, a depth of approximately 1716 feet and containing approx- imately 6.629 acres of land. Section 2. The zoning map of Town of Wappinger, adopted by the 'Down Board, January 29, 1963, and being a part of the afore- said Town of Wappinger Zoning Ordinance, as amended, is hereby further amended in conformity with the foregoing. Section 3. This amendment shall become effective immediately upon adoption, posting and publication as prescribed by Town Law. The Town of Wappinger Zoning Ordinance adopted January 29, 1963, as amended, is hereby further amended by re- zoning from R-40, One Family Residential District, to GB General Business, the following tract of land: Land fronting on New York Route 9D bounded and described as follows: Beginning at a poSnt approximately 200 feet south of the northerly junction of said Route 9D and Old State Road, said point of beginning being the point of intersection of the present boundary line between R-40 and R-20 zoned lands with the westerly line of said Route 9D1 thence westerly along said boundary line to a point which is 300 feet distant from the said westerly line of said Route 9D measurep at right angles thereto, thence southeky along a1parallel with the said westerly line of said Route 9D and 300 feet distant therefrom to the present boundary line between RD -40 and R-40 zoned lands in the vicinity of the southerly junction of Old State Road and said Route 9D, thence easterly and southerly along the said boundary line between RD -40 and R-40 zoned lands and along the present boundary line between R-20 and R-40 zoned lands' crossing said goute 9D to a point northerly of Stoneykill Road and distant 300 feet from the easterly side. of said Route 9D measured at right angles thereto, thence northerly along a line parallel with the easterly side of said Route 9D and distant 300 feet therefrom to the present boundary line between R-40 and R-20 zoned lands first described above, thence westerly along said mentifted boundary line to the westerly side of said Route 9D and the point of beginning. Section 2. The Town of Wappinger Zoning Ordinance adopted January 29, 1963, as amended, is hereby fl4her amended by re- zoning the following tract of land from R-40, One Family Res- idential District,to R-20, One Family Residential District: All the land now zoned R-40 lying west of New York Route kime 9D and southerly, westerly or northerly of Old State Road ex- cept such portion thereof as may be included in the lands des- cribed in Section 1 hereof. Section 3. The zoning map of Town of Wappinger, adopted by the Town Bpard, January 29, 1963, and being a part of the aforesaid Town of Wappinger Zoning Ordinanca, as amended, is hereby fulther amended in conformity with the foregoing. Section 4. This amendment shall become effective immed- iately upon adoption, posting and publication as prescribed by Town Law. Item 1 of Permitted Principal Uses in Al Airport Industry District, as contained in Section 4.23 of Town of Wappinger Zoning Ordinance, adopted January 29, 1963, is hereby amend ed by inserting in the first sentence of said Item 1 following the word 39 "hotels," the word, "motels". Section 2. Tbis amendment shall become effective immediately upon adoption, ppeting and publication as prescribed by Town Law. Bulger Aye Justice of the Peace --Vincent Francese Aye The following resolution was made by Councilman Robinson and seconded by Justice of the Peace Francese: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by Article 16 of the Town Law of the State of New York, and also in pursuance of Article 9 of the Town Law to the extent applicable as follows: Section 1. The Town of Wappinger Zoning Ordinance, adopted January 29, 1963, is hereby amended by rescinding all of Section 437 of aaid Ordinance and substituting therefor the following: "437. Expiration of Spdccial Permits A special pmagit heretofore or hereafter issued under Section 435.02 hereof shall be deemed to authorize only the pa9icular use or uses specified in the permit and shall have no expiration date, except that sbehl permit shall automatically expire if said use or uses shall cease for more than twelve (12) consecutive months for any reason." Section 2. The Town of Wappinger Zoning Ordinance, adopted January 29, 1963, is hereby amended by inserting in the first sen- tence of Section 531 of said ordinance immediately prior to the phrase "shall be guilty of, a misdeameanort the following: "or who fails to comply with any condition or safeguard at- tached to a special permit issued under Section 435.02 hereof," Section 3. The amendments contained in Section 1 and Section 2 of this ordinance shall become effective immediately upon adoption, posting and publication as prescribed by Town Law. Linge Aye Councilman--Georgeptobinson Aye Justice of the Peace -----------------------Aye Justice of the Peace -9.246 Aye Motion was made by Councilman Robinson and seconded by Justice of Peace Bulger that the following resolution not be approved, due to the fact that it was included in resolutions adopted above: Amend the Zoning Map to rezone from R-40, One Family Residential District to LB, Local Business District, the following tract of land Lands now owned by Rocco Ranieri, Jr. and Vito Vintimiglia bounded on the west by New York Route 9D on the south by lands now or formerly owned by Popular, 4 on the ept by lands now or formerly owned by Central Hudson Gas and Electric Corporation and on the north by lands now or formerly owned by Popular, having app- roximately 400 feet frontage on said Route 9D, a depth of approximately 725 feet and containing approximately 6.68 acres of land. A portion of said lands are in- cluded in the lands described in proposed amendment 6 above. The motion was unanimously carried the Town Board voting as follows: Supervisor --Richard H. Mr. Ludewig explained why he had held up futher permits for the developement. Motion was made by Justice of Peace Bulger and seconded by Justice of Peace Francese 'hat t due to the fact that we have no formal report for sewerage in the letter be tabled for future consideration Ritter Developement. Motion carried Supervisor Linge asked Mr. Ludwig and Attorney Williams to get to- gether to investigate this matter. Mr. Bisom spoke about the lack of ihnforcing the Sakvage Yard Ordinance regarding the property next to him.
