1963-08-08 RGM32 The regular meeting of the Town Board, Town of Wappinger was held on Thursday evening, August 8, 1963, in the Town Hall, Mill Street, Wappingers Falls, N. Y. Present -Town Board -Supervisor -Richard H. Linge, Councilmen - Malcolm Hait and George Robinson, Justices of the Peace- Vincnet Francese and William Bulger. Building & Zoning Inspector -Joseph E. Ludewig, Town Attorney -Judson Williams, Town Engineer -Charles Maneri, Town Supt. of Highways - Kenneth Croshier, Town Clerk -Helen L. Travis. The meeting was opened at 8 P. M. by Supervisor -Richard H. Linge. The minutes of the July meeting were read. Motion was made by Councilman Hait and seconded by Councilman Robinson that the minutes be accepted as read. Motion carried The bills for the month of 1July were read. Motion was made by Councilman Robinson and seconded by Justice of the Peace Bulger that the bills be paid. Motion carried. Town Clerk presented the name of Paul Yeaple for inspector of election for District #2 replacing Raymond Dolan who has passed away. Motion made by Justice of the Peace Francese and seconded by Justice of the Peace Bulger that Paul Yeaple be appointed in- spector of election in District #2. Motion carried The following report was given by Justice of the Peace, Will- iam Bulger: 1-10 motor vehicle and traffic cases showing fines collected in the amount of $175.00 2 -One civil case closed showing filing cost of $2.50. 3 -No criminal actions handled during the month of July. $7.50 is being held by me in the official bank account on civil cases which were not closed during the month. The following report was given by Justice of the Peace Vincent Francese: 1 --Thirty-five vehicle and traffic cases were closed showing 331 a total of $415.00 collected in fines. 2 --Two criminal cases closed showing no monies collected. 3 --Six civil actions completed showing fees collected in the amount of $12.50. Fines and fees collected were forwarded to State Department of Audit and Control totalling $427.50. $2.00 is being held in my official bank account on a civil matter which was not closed by August 7, 1963. The following report was given by Building InspectorJoseph E. Ludewig. We issued permits for 21 New Residences 1 Residence Addition 1 24 Bed Camp 7 Residences Porches 3 Residence Garages 1 Commercial Addition 1 Fire Restoration 35 Total Permits issued Represention a value of $373,200.00 Fees collected and turned over to Town Clerk $377.50 Traveld 360 miles on building inspection and zoning pro- blems. ro-blems. Motion was made by Justice of Peace William Bulger and sec- onded by Justice of Peace Francese that 6he following Poling Places be designated. Y. #6--Pattys Charcoal Grill --Rt. 9 #7 --Mt. Hope Grange --Myers Corners Road. A letter was received from Mrs. Merle Travis, Robinson Lane asking what could be done about closing Becker Recreation Center at a certain time and also stating her fences had been knocked down allowing the Heifers to get out. The Board turned this matter over to the Town Attorney to look into what could be done. Town Clerk to notify Mrs. Travis of same. A letter was received from Grinnell Library asking Town to make an allotment of $2500. for the Association in the 1964 Budget. The Board tabled this letter to be taken up at Budget time. A letter was read from George Brannan, Chairman of the Town of Wappinger Democratic Committee stating his ideas about changing election districts. Our Attorney Judson Williams stated that he could find no spec- ific authority ;in any New York State Statute to expend money for this purpose but at the same time he is mindful that the work has to be done as soon a possible and that if the Town Board feels there is no other way to have the work done ex- cept to pay for it he could see no other way clear but for the Board to approve doing so. Councilman Hait stated that due to the fact that even though the Womens Republican Club had offered their services, if Mr. 33 Brannan , Ch. of the Democratic Committe thoughThe could get no help and also that the help should be paidwthen the Town Clerk should hire the necessary help at $1.50 per hour. Motion was made by Councilman Hait, seconded by Justice of the Peace, Bulger that the Town Clerk be empowered to obtain help for changing election districts at $1.50 per hour. Motion carried Albert Canale appeared before the Board explaining about Little League recognition Day to be held on August 18, 1963. Mr. Canale asked that all Town Officials and anyone connected with the Town to enter the parade on that day. Attorney Williams reported he had been working on Dugans Lane and he would suggest that the Town as&the County High- way Department to survey Dugans Lane for them, The Super- visor is to write letter to County Superintendent of High- ways asking them to do this. Anthony Gallo, Fleetwood, appeared before Board asking that Bond on Fleetwood Drive and Ronsue Drive be released. Town Engineer Maneri and Town Highway Superintendent Croshier re- ported that reads were in order. Motion made by Councilman Hait and seconded by Councilman Rob- inson that the Bond on these roads be released. Motion carried Mr. Ryan appeared before the Board requesting that he go on record as stating that the Town Board no'("consider, under any situation, selling the Becker property. Grover Roth appeared byfore the Board asking if there was anything at all that could be done to help the situation 334 on Hopewell Road in the vicinity of where the death occiured. last week, pertaining to have removed and road re - sur ced. Mr. Maneri stated he knew this was under consider- ation at the present time by the County. A letter was read from Mr. Ludewig asking for permission for him to become a member of the New York State Building Officials Conference. Mthtion was made by Justice of Peace Bulgerchnd seconded by Justice of Peace Francese that Mr. Ludwig be granted per- mission to join the New York State Building Official Con- ference. Motion carried Letter was read from Robert F. Winne, Attorney stating that the final order had been signed on July 29 and fileT)in the Clerks office on July 30, 1963 in the matter of the case of Shapiro v.s. Town of Wappinger. The Supervisor reported that the Town Planning Board at its August 5, 1963 meeting had recommended the rezoning from R-15 and R-40 to R-20 of land easterly of Spook Hill Road and ex- tending from Hopewell Junction Road to Kent Road. Upon motion by Justice of Peace Bulger and xseconded by Councilman Hait and by unanimous vote a public hearing was ordered held et the 27th day of August 1963 at 8:00 o'clock on a proposed amendment of the Town of Wappinger Zoning Ordinance reading as follows, "BE IT RESOLVED AND ORDAINED, by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by Article 16 of the 335 Town Law to the extent applicable as follows: "Section 1, The Town of Wappinger Zoning Ordinance, adopted January 29, 1963, as subsequently amended is hereby futher amended to rezone a certain tract of land now zoned in part R-15, one Family Residential, and the remaining part R-40, one Family Residential, to be from henceforth all zoned R-20, one Family Residential, said certain tract of land being situat easterly from Sppok Hill Road and runing generally tetween Hopewell Junction Road and Kent Road and being more particularlly described as follows: " BEGINNING at a point on the existing boundary line between R-20 and R-40 zoned lands, said point being about 200 feet southerly from the intersection of said boundary line and Kent Road, and running thence southerly in a straight line ghrough lands now zoned R-40 to a point on Hopewell Junction Road which is 650 feet easterly from the junction of Hopewell Junction Road and Cedar Hill Road; thence continuing southerly still in a straight line to a point 125 feet southeviy of the southerly line line of Hopewell Junction Road, thence westerly parallel to and distant 125 feet from Hopewell Junctiom Road to the present boundary line between R-20 and R-40 zoned lands; thence northerly along the present boundary line and northerly along the westerly present boundary line between R-20 and R-15 zoned lands and continuing along the p4esent said boundary line between R-20 and R-40 zoned lands to the northerly, easterly, s southerly, easterly, northerly and easterly to the point of 336 beginn j.ng . "Section 2. The zoning map of Town of Wappinger adopted January 29, 1963, and being a part of the aforesaid Town of Wap- pinger Zoning ordinance is hereby amended in conformity with the foregoing "Section 3. This amendment shall become effective upon adoption posting and publication as prescribed by Town Law. Motion was made by Councilman Hait and seconded by Councilman Robinson that the meeting adjourn.
