1963-05-16 PH297 A public Hearing was held on May 16, 1963 at the Hughsonville Firehouse at 8 o'clock for the purpose of a proposed amendment to the Town Zoning Ordinance which would rezone the Lilyan Burger(Tall Tree) land so that the portion of it which is now zoned RD40 would be rezoned to R20. This amendment had be recommended by the Planning Board. Present: -Supervisor -Richard H. Linge, Councilmen -George Robinson & Malcolm Hait, Justices of the Peace-Vincnet Frances & William Bulger, Town Attorney -Judson Williams and Town Clerk -Helen L. Travis. Nobody attended the hearing byt Mr. Berger and his attorney William H. Pearse. There was nobody against the change. The meeting was called tonorder by Supervisor Richard H. Linge. Motion was made by Councilman Hait and seconded by Justice of the Peace Francese that the proposed amendment to Zoning Ord- inance as set forth below be adopted. BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, DutchesszCounty, New YO,k, in pursuance of the authority conferred by Article 16 of the Town Law of the State of New York, and also in pursuance of Article 9 of the Town Law to the extent applicabe as follows: Section 1, The Town of Wappinger Zoning Ordin- ance adopted January 29, 1963, ;is hereby amended by re- zoning a certain tract of land from RD -40 optional Dwelling Residential, to R-20, One Family Residential, said tract of land comprising aproximately 24 acres being 299 situate between Wheeler Hill Road and Route 9-D in said Town of Wappinger, and being more particularly descrlibed as follows: BEGINNING at a point on the boundary line between lands of Lilyan Berger on the southwest and lands now or formerly of Platt on the northeast, said point of be- ginning being approximately 1000 feet southeasterly measured along the northeasterly line of said Berger from the southeasterly side of Wheeler Hill Road, said point of beginning being also the boundary line between lands presently zoned R-20. One Family Residential, on the north- west and lands presently zoned RD-40, Optional Dwelling Residential, on the southeast, and running from said point of beginning southeasterly along the said northeasterly line of said Berger about 1040 feet to lands now or formerly of Shook, thence southwesterly along the south- easterly boundary line of said Berger about 1213 feet to a corner, thence northwesterly along the southwesterly line of said Berger about 1154 feet to a point on said southwesterly line of said Berger making the division point between said R=20 zoned lands and said RD40 zoned lands, thence northeasterly through lands of said Berger northeasterly along said Boundary line between said R20 zoned lands and said RD-40 zoned lands to the point or place of beginning. Section 2. It is the intention of this . mendment that all of a tract of land now owned by said Lilyan Berger comprising about 50 acres of land, exclusive of land 300 whithin the bed of Wheeler Hill Road, now zoned in part R-20 and in part RD -40 shall all be zoned R-20. Section 3. The zoning map of Town of Wapgimnger adopted by the Town Board January 29, 1963, and tjeing !a part of the aforesaid Town of Wappinger Zoning ordinance is hereby amended in fonformity with the foregoing. Section 4. This amendment shall become effective immediately upon adoption, posting and publication as prescribed by Tewn Law. A roll call vote was taken with the following results.
