Motion Carried A group of residents from Ardmore Hills,Hopewell Road,with Louis Eck appeared before the Town Board concerning their roads,which at the present time are private roads. The Town Board Members assured the group of co-operation with Mr.Eck and would take over roads when they met Town specifications 1"14 Supervisor Scofield reported that he had filed with the New York State Comptroller,certification of result of Special Census taken in the Town of Wappinger as of April 1,1957 Motion made by Councilman Mewkill seconded by Judge Beatty that the Ardmore Homestead,Hopewell Road be used as registration and voting place for District #6 for 1957 election. Motion Carried Motion made by Councilman Hager seconded by Judge Beatty that the appointment of attendance officer for School District #4 be laid on the table until next meeting Motion carried Motion made by Councilman Mewkill seconded by Councilman Hager that meeting adjourn. Motion carried. In reference to Crest Haven Homes the following resolution was duly adopted by the vote noted therein. Town Clerk No Board of Health meeting was held. At a regular meeting of the Town Board of the Town of Wappinger, held at the Town Offices on Mill Street, Wappingers Falls, New York, in said Township, on the 5th day of September, 1957 at 7:30 o'clock p.m. There were waill . ler . . - . . - . Edward B,.Beatty,Justice of Peace Emory J.Ha e� r,Councilman Harold J,Mewkill,Councilman .Tamps jjymns, Attorney ABSENT: JnseXh F -Ya ly. juQ i _ of Peace The following resolution was offered by F.ard g•Beatty Justice of the Peace , seconded by Councilman Harold J.Mewkill • WHEREAS, Crest Haven Homes, Inc. of 60 East 42nd Street, New York 17, New York, has heretofore dedicated ceLttain roads and streets to the Town of Wappinger as public highways thereof, and WHEREAS, to insure the completion of such roads and streets in accordance with the specifications of the Town Superin- tendent of Highways said Township did require and said Corporation did furnish a performance bond in the penal sum of $23,000.00, the same being issued by the Indemnity Insurance Co. of North America of Philadelphia, Pennsylvania, and being numbered bond #250705, and WHEREAS, said roads and streets have been completed in accordance with the aforesaid specifications of the Town Superin- tendent with the following exceptions: 1. A ditch is required beginning at a point on the east side of Liss Drive 242 feet south of the southerly catch basin thereon, said point of beginning being on the south side of the drive to the house on lot #61, said ditch to be pitched from - L - from nothing to 8" at the catch basin, to be 18" wide at the bottom thereof, to be lined with black top and to be terminated or rear by an adequate drop inlet cut into the side/of the existing manhole. 2. The possibility that the existing pipe discharging water from the aforesaid most southexy manhole into the Wappin- gers Lake may have to be increased in size to carry the volume of water entering the same. FM WHEREAS Crest Haven Homes, Inc. has agreed to perform the work required in the first exception above set forth and to deliver a certified check to the Town of Wappinger in the sum of $1,000., the same to be expended by the Town of Wappinger to correct the second exception should such correction become necessary in the sole discretion of the Town Engineer on or before the 15th day of Ap1riji, 1958, and WHEREAS, the Town of Wappinger desires to effect final acceptance of said roads and to discharge the aforesaid corporation and the surety on its bond upon compliance with the provisions above set forth. NOW THEREFORE be it RESOLVED as follows: SECTION 1. That the roads and streets heretofore dedica- ted by Crest Haven Homes, Inc. to the Town of Wappinger be the I same hereby are finally and fully accepted as public highways of i the Town of Wappinger, such acceptance to become effective upon completion of the work set forth in Exception #1 and the delivery of a certified check in the amount and for the purposes hereinbe- fore expressed. SECTION 2. That the Town Engineer be and he hereby is authorized to execute and deliver to the corporation a letter certifying completion of the work set forth in Exception #1 when the same has been done to his satisfaction, and a copy of such letter may be accepted by any and all persons interested here- in as certification of the corporation's compliance with such provisions of this resolution. SECTION 3. That the Town Supervisor be and he hereby is authorized to execute and deliver to the corporation a letter certifying delivery to him of the certified check of the corpora- tion in the amount of $1,000 for the purposes hereinbefore ex- pressed, and a copy of such letter may be accepted by any and all persons interested herein as certification of the corporation's compliance with such provisions of this resolution. SECTION 4. That upon execution and delivery of both of the letters above described, Crest Haven Homes, Inc. and the Indemnity Insurance Co. of North America, as surety, be and they hereby are forever released and discharged,of and from any ac- countability or liability arising out of the provisions of the performance bond described in this risolution. The foregoing resohtion being put to vote on roll call was unanimously adopted.
