1960-04-14A SPECIAL :.4E1'l'ING of the Town Board of the Town of Wappinger wa held on the 14th day of April, 1960, at the Town Hall, on MLII Street, in Wappingers Falls, N.Y. PRESENT:* Supervisor .Richard H. Linge, Justices of the Peace -Edward Beatty and Joseph I'. Kelly, Councilmen-Egiory J. Hager and Malcolm Hait, Superintendent of Higlways-Charles E. Mevrkill., Sr., and Town Attorney -Janes J. Lyons. The meeting was called to order by Supervisor Li.nge at 7:30 P. M. Hi.chael Piiirras presented to the Board two deed$conveying certain roads in the Cedar Hill area to the Township for highway purposed. Highway Superintendent Mewkill advised the Board that these proposed roads do not meet the present Town specifications for Town roads, but do meet the srecifications in effect at the time such roads were laid out and originally cut by the developer. Attorney Lyons reported that the records in the Dutchess County Clerk's Office dis- close that title to these roadways is vested in the ddjoini.ng property owners, all of whomq own to the center of such roads. After considerable discussion, the following resolution was offered by Judge Beatty and seconded by Judge Kelly. WH'FEAS, certain roadways and drainange easements appurtenant thereto have on this date been dedicated to the Town of Wappinger as public highways thereof, said roads being fu3& and completely described in al deed from Ilichael Mirra.s, Arthur R. Marjorie Lindeborg et, al., the adjoining property owners, to the Torn of Wappinger, dated January 30th, 1959, and in a second deed from Michael Mirras, Rose Mc Grath, John L Velma Kasala wite, etal, adjoining property ovmers, to the Town of Wappinger, dated January 13th, 1958 and WFIREAS, such roads do not meet present Town specifications buf) do meet the spec- ifications existing at the time said roads were laid out and the adjoining land sold off, and WU.IREAS, requring that these roads be re -finished and surfaced to current Town specifications at this time would work a severe hardship on the adjoining property owners, and WFEREAS, the said roads are extensively used, not only by the adjoining land owners but by many others, and acceptance of the same will facilitate the movement of traffic in the Town. NOW, THEREFOHE, BE IT RESOVED THAT the propsed roads and the appurtenance thereto described in the aforesaid deeds be, and they hereby are, accepted as public high— wairs of the Town of Wappinger. The foregoing resolution was carried by unam_inouse vote. On motion of Judge Beatty, seconded by Judge Kelly, and by unaniumous vote, the meeting was addjourned. Town Clerk
