1960-12-08M, The regular monthly meeting of the Town Board, Town of Wappingers was held in the Town Hall, on Thursday evenings December 83 1960. Present: -Supervisor -Richard H. Linges Justice of the Peace -Joseph F. Kelly & Edward B. Beatty, Councilman -Emory J. Hager and Malcolm Haits Superintendent of Highways -Charles Mewkills Sr., -Town Engineer -Charles Maneris Town Attorney - James J. Dons, Town Clerk -Helen L. Travis. The meeting was opened by Richard H. Linges Supervisor at 8 P. M. The minutes of the last meeting were read. A motion was made by Judge Kelly and seconded by Councilman Hait that they be accepted as read. Motion carried. A motion was made by Judge Kelly and seconded by Judge Beatty that they be paid. Motion carried A resolution was made by Councilman Hait and seconded by Councilman Hager and unaniumously carried, as follows; WHEREAS:- The Town Superintendent of Highways, did, on the 8th day'of December 1960, duly recommend purchase of certain Machinery, pursuant to the provisions Of Section 142 of the Highway Law. 0 NOW THEREFORE:- be it Resolved that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways is hereby authorized to purchase, in accordance with the provisions of article 5-A of the Gneral Municipal Law with the approval of the County Superintendent of Highway the following: - 1 -1961 Ford F-100 -One Half Ton Pickup Truck* for a maximun price of One Thousand Seven Hundred Seventy Nine Dollars and Sixteen Cents., $]L, 779.16, delivered at the Town of Wappinger Garage, Wappingers Falls,, N. Y. and to be delivered on or before January 12th, 1960. The term of payment will be as follows: check drawn on MachineriFund for $1,779.16. A contract of purchase for the item purchased shall be duly executed between the Town Superintendent of Highways and such vendor and when duly approved by the County Superintendent of Highways it shall become effective. When such contract has been duly executed and approved, the Supervisor is authorized to complete such purchase upon delivery of the item purchased in accordance with kki terms of such resolution and such contract, and to pay the above amount apecified to be paid by check drawn on the Machinery Fund(Ttem #3) for $$1,779.16 (Gown Superintendent of Highways, Charles E. Mewtill, Sr., recommended the purchase of an Oil Spreader. The following resolution was offered by Councilman Hait and seconded by Judge Beatty. Reolution carried WHEREAS:-, The Town Superintendent of Highways has, at this meeting, recommended the purchase of a new, oil spreader and WHEREAS: -the Town Board, pursuant to #142 of the,Hi.ghway Law, has considered such recoa►mendati.on and the purchase of such highway machinery is deemed: advisable and necessary for the proper maintenance of the Town Highway of the Town of Wappingers, and. ?.WHEREAS. the Town Board-des;i-xR--ti authorize5the Superintendent to enter into a contract for the purchase of such machiner4 pursuant to the statutes in such case -antd and provided now therefore be it RESOLVED:- that the Town Superintendent be and he hereby is authorized and directed 52 to prepare specifications for said oil spreader and that the Town Clerk advertise for bids hereon by cuasing a notice to be phblished in the Pough'�eepsie Journal, auch notice and the publication tereof to be in compliance with #103 of the General Municipal Law. Superentendent 60 Highways, Charles E. Mewkill, Sr., recommended the purchase of a special Plow and stated he had a price on sAame of $935.00. This being below $1,000.00 it does not have to be put out for bids. 11 A motion was made by Councilman Hait and seconded by Councilman Hager that the Superintendent of Highways, Charles Mewkill, Sr., be empowered to purchas a special plow. Motion carried. Ettorhey James J. Lyons, reported that the deed received frog. Russell Fredericks for the Road, Lea Lane was,now in order and ready for acceptance by the Board. 4 motion was made by Councilam Hager and seconded by Councilman Hait that the following resolution be accepted. Motion carried. RESOLVED:- that road known as Lea Lane, described in deed from Russell Fredericks, dated ._' j c., S,.1 j (I L C together with appurtenances,, right of way, easements and draingange easements, be accepted as public Highwayx of the Town of Wappinger Two pieces of properties were brought in bkethe Recreation Committee to the Board, one a gift and another property to be purchased. No names were re- vealed at this time, until option could be taken on the property. A large delegation was on hand in favor of the receration propgram. Dr. Harvey Miller, spoke for the Kiwan�Club and also as a firned of Boy & Girl Scouts. Dr. Daniel J. Hannigan, spoke for the Lions Club. A motion was made by Judge Kelly and seconded by Councilman Hait that our Attorney, James J. Lyons, be empowered to place a four months option on the property to be purchased, and also he is to look into the matter of the gift property. Motion carried. A NOTION was made by Judge Beatty and seconded by Councilman Hager thataasspecial meeting be held with the $ecration committee on Thursday, Nev-e -15th for the purpose of discussi ng this matter, Motion carried. Alexander Goldberg, Attorney for I. C. B. M. Home, Inc., presented the following roads for acceptance by the Town, Lake Oniad Drive, Bungalow Lane and Fox Hill Road.. The follomi ng Resolution was made by Councilman Hager and secondedby Judge Beatty. A vote was taken, all voted in favor with the exception of Judge Kelly who voted Naye. Motion carried. WHEREAS: I. C. B. M. Homes, Inc., have tendered to the Town of Wappinger, by deed, dated; 1 l wcertain roadways and appurtencant drainange easements, known as Lake Oniab Drive, Fox Hill Road and 5ungalow Lane, the same being in the said Township and �JRRAS: these rsadways being unfinished to the Town Speciifi cations. the I. C. B. M. Homs, Inc. have posted a $17A00,00 performance Bond guaranteeing completion of said roadways in accordance with the Town Specifications. Be it also resolved tkKk and agreed that the Town is not to be responsible for the plowing of roads and that a miniumum one foot buffer zone will be amde between the road and the Lake. The following resolution was made by Councilman Hai°t and seconded by Gudge Beatty and unanimously carried. RESOLVED THAT $125.00 be transferred from the budetary appropriation for Police Constables, and Deputy Sheriffs, and be allocated as follows: $50.00 thereof be added to the approrpiation for Justices of the Peace -Office and other expenses, and $75.00 thereof be added to the appropriation for Town Clerk, Office and other expenses. The f ollowing resolution was made by Judge Kelly and seconded by Councilman Hager and unanimously carried. RESOLZTED: that $490.00 be transferred from the Budgetary appropration for Zoning" Inspector and expanese and be allocated as follows: $425.00 thereof be added to the 5 approrpiration for Employees Retirment Syste4Social Security payments) , and $65.00 be added to the appropriation for Traffic signs, signal & Highway Lighting. A motion was made by Judge Beatty and seconded by Judge Kelly that we hold our annual meeting on Thursday evening, December 29th, 1960. Motion carried.
