Yeeting called to order by Supr.Scofield at 8 P.M. Health officer reported one case of diarrhea,no infectious or contagious diseases otherwise Town health in good condition. Meeting adjourned. CAPITAL NOTE RESOLUTION OF OCTOBER 9TH, 1952 AUTHORIZING THE ISSUANCE AND SALE OF A CAPITAL NOTE OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, IN THE AMOUNT OF FIVE THOUSAND DOLLARS ($5,000.00) FOR THE CONSTRUCTION AND ERECTION OF A BUILD- ING FOR THE HOUSING AND STORING ON HIGHWAY MACHINERY, TOOLS, IMPLEMEENTS AND EQUIPMENT. WHEREAS, at a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held in the office of the Town Clerk of Wappingers Falls, New York on the 13th day of March, 1952, a resolution was duly adopted pursuant to Section 142, subdivision 4 of the Highway Law authorizing the erection of a town garage building by the town Superintendent of Highways, at a total cost not in excess of Fifteen thousand dol- lars ($15,000.00), and WHEREAS, such resolution provided that the plan of financing the cost of the construction should be as follows: $5,000.00 of such cost to be paid outjof surplus funds of the town, and the balance from proceeds of obligations to be issued pursuant to the local finance law to finance such purpose, said obligations to be authorized by later resolution of the Board, and WHEREAS, the Town Board of the Town of Wappinger now desires to authorize such obligations to provide for a part of the remaining cost of construction, Now Therefore, BE IT RESOLVED this 9th day of October, 1952 by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: SECTION 1. For the purpose of providing funds to pay a part of the balance of the cost of constructing a town ga:�- age building, the erection of which has heretofore been authorized; a capital note of the Town of Wappinger in the amount of $5,000.00 to be of the terms, form and content hereinafter specified, shall be issued by the said Town pursuant to the provisions of the Local Finance Law of the State of New York. - 1 - SECTION 2. The maximum cost for the construction of such garage building is estimated to be the sum of $15,000.00 and the plan for financing such cost is as follows: 05,000.00 of such cost already paid out of surplus funds of the Town, '5,000.00 thereof by the proceeds of the capital note herein authorized, and the balance of such cost by obligations of the Town to be authorized by later resolution of the Board. SECTION 3. It is hereby determined that the pur- pose for which said note is to be issued to wit, the construction and erection of a town garage building, falls within subdivision 11-B of Section 11 of the Local Finance Law, and that the period of probable usefulness thereof is twenty (20) years. SECTION 4. The proposed maturity of the capital note hereby authorized will not be in excess of five (5) years. SECTION 5. The said note shall be dated not earlier than October 15, 1952 and shall be designated and known as "Capital Note of 1952 of the Town of Wappinger, Dutchess County, New York", the said note shall bear interest at a rate not ex- ceeding five per centum (51) per annum, and the principal and interest thereof shall be payable in lawful money of the United States of America at the National Bank of Wappingers Falls, Wappingers Falls, New York. Said note shall mature and be payable with interest thereon from the date of issuance, in one full, single installment on March 15, 1953• SECTION 6. The said note shall provide that it may be called in and redeemed prior to maturity by the giving of at least ten (10) days notice of the date of redemption by registered letter directed to the holder of such note, and in- terest shall cease to be paid thereon after such date of redemp- tion. - 2 - SECTION 7. Except as herein expressly provided, the said note shall be of such terms, form and content as the Town Supervisor shall determine and execute, consistent however with the provisions of the Local Finance Law. SECTION 8. Said note shall be executed in the name of the Town by the Town Supervisor and sealed with the corporate seal of the Town and attested by the Town Clerk. SECTION 9. The said note shall be sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and the proceeds of the sale shall be applied solely for the purpose aforesaid. SECTION 10. Upon due execution and sale of said note, the same shall be delivered to the purchaser upon payment of the purchase price in full, and the receipt of the Town Supervisor shall be a full acquittance to the purchaser who shall not be obliged to see to the application of the purchase money. SECTION 11. The full faith and credit of the Town of Wappinger, Dutchess County, New York, are hereby pledged to the punctual payment of the principal of and interest on said note. An amount sufficient to pay such principal and interest shall be included in the annual budget and levied as a part of the taxes for the fiscal year in which the same matures. mediately.
